की तिथि निश्चय नहीं है, उनमें इसे निम्नानुसार उठा हुआ माना जायेगा:
:
(क) ऐसे मामलों जिनमें जारीकर्त्ता घटक को शेयरों केअंसरण को सम्प्रेषित नहीं करता , उनमें विवाद की तिथि को जारीकर्ता के पास अंतरण के लिए घटक द्वारा शेयरों को प्रस्तुत करने की तिथि से 30 दिन की समाप्ति की तारीख से छह महीने की समाप्ति की तारीख को उठा माना जायेगा, अथवा
(ख ) ऐसे मामलों जिनमें जारीकर्ता शेयरों के अंतरण को मना करता है , उनमें विवाद की तिथि को घटक के पक्ष में शेयरों के अंतरण को मना करते हुए जारी- कर्त्ता के सम्प्रेषण की प्राप्ति की तारीख से छह महीनों की समाप्ति की तारीख को उठा माना जायेगा ।
(ग) ऐसे मामलों जिनमें जारीकर्ता घटक के शेयरों के अंतरण में निर्धारित अवधि से परे देरी करता है, उनमें विवाद की तिथि को जारीकर्ता के पास अंतरण के लिए घटक द्वारा शेयरों को प्रस्तुत करने की तारीब से अथवा घटक के पक्ष में शेयरों के अंतरण की सूचना देते हुए घटक को जारीकत्ती के सम्प्रेषण * की प्राप्ति की तारीख से 30 दिन की समाप्ति की तिथि से छह महीने की समाप्ति की तारीख , इनमें से 'जो भी ब.द में हो , को उठा माना जायेगा । उद्धरण चिन्ह बन्द
2. अध्याय X के मौजूदा उन- नियम 5 ( ख ) को निम्नानुसार संशोधित किया जाता है:
" में बन्द कर सकता है " शब्दों और " और किया गया कोई व्यय अथवा कोई हानि" शब्दों के बीच आने वाले "खुले बाजार" शब्दों को " संबंधित प्राधिकारी द्वारा निर्दिष्ट ढंग से" शब्दों द्वारा प्रतिस्थापित किया जाता है ।

The provisions contained in the Byelaws of the Exchange are inleds ander :
1. The following explanations is inserted in Bye- law 3 of Chapter XI :
DUOTE
Explanation :--
(1) in cases where the date of claim , difference or dispute is not ascertainable , it shall be deemed to have arisen on the date of expiry of six months from the date of the transaction in respect of which the claim, difference or dispute has arisen .
(2) In cases where the date of claim , difference or dispute arising out of Bye - law ID of Chapter XI of the Bye - laws is not ascertainable , it shall be deemed to have arisen as follows :
(a) In cases where the Issuer fails to communi- cate to the Constituent the transfer of shares , the date of dispute shall be deemed to have arisen on the date of expiry of six months from the date of expiry of 30 days from the date of lodgment of shares by the Constituent for transfer with the Issuer; or
:
(b) In cases where the Issuer refuses to transfer the shares, the date of dispute shall be deemed to have arisen on the date of expiry of six months from the date of receipt of communication of Issuer. refusing to transfer the shares in favour of the Constituent .
(c) In cases where the Issuer delays the transfer of shares of the Constituent beyond the stipulated period, the date of dispute shall be deemed to have arisen on the date of expiry of six mouths from the date of expiry of 30 days from the date of lodg- ment of shares by the Constituent for transfer with the Issuer ; or the date of receipt of communication of the Issuer to the Constituent intimating the transfer of shares in favour of the Constituent , whichever is later .

2. The existing Bye - law 5 (b) of Chapter X is amended as under :
The words " open market ' appearing in between the words " he may close - out in the " and the words "and any expense incurred or any loss " are sub- stituted with the words " manner specified by the relevant authority ".
