2. उपरोक्त चयन सूचियों से उपरोक्त अधिकारियों को अवर सचिव के पद पर नियुक्ति श्री आर ० के० ओझा व सुश्री प्रीति श्रीवास्तव द्वारा बनाम यूनियन ऑफ इंडिया दिल्लो हाईकोर्ट में दाखिल किरें गरे सिविल रिट याचिका के मामलों में अंतिम निर्णय के अध्यधीन होगी ।

3. उपरोक्त अधिकारियों की अवर अचिव के ही में नियुक्ति उनके अनुमोदित सेत्रः एवं अवर सवित्र के रूप में कल्पित वेतन निर्धारण के लिए क्रमशः 1-7-1995 एवं1-7-1996 से मान्य होतो । परंतु, कल्पित वेतन के पुननिर्धारण रूत्रहन बढ़े हुए वेतन का वास्तविक लाभ उनके अवर सचिव के रूप में कार्मिक एवं प्रशिक्षण विभाग व मुख्य आदेश के आधार पर प्रारंभिक तदयं निक्ति की तारीख से प्रोद्‌भूत होगा । उन अधिकारियों को एफ ० आर ० 22 के अनुसार वेतन निर्धारण के लिए विकल का लाभ प्राप्त करने क। भी हक प्राप्त होग । परन्तु ऐसे अधिकारी जो अपने चयन सूचो वर्ग के प्रथम जुलाई से पहले ही तदर्थ अ.धार पर अवर सचिव नियुक्त हो गए थे एवं स्पिलिट विकल्प (Spilit option ) का लाभ ले चुके थे , पुर्नानर्धारण के विकल्प का लाभ प्राप्त करने के हकदार नहीं होंगे ।

3. The appointment of the above mentioned may be deemed to have been made effective with effect from 1.7.1995 and 1.7.1996 respectively for the purpose of approved service and for fixation of their pay in the grade of Under Secretary on notional basis .
