2. उपर्युक्त तदर्थ पदोन्नतिर्या 11.05.2004 (पूर्वाह्न ) से लागू होंगी तथा एक वर्ष तक लागू रहेंगी ।
3. यदि न्यायालय/ट्रिब्यूनल द्वारा कोई निर्णय या आदेश पारित होता है तो ऐसी बदली हुई स्थिति के कारण उपर्युक्त तदर्थ पदोन्नतियों में संशोधन किया जा सकता है ।
4. डब्लू. पी. ( सिविल ) सं. 323 ऑफ 2002 तथा उसी प्रकार एकत्रित मामलों पर माननीय सुप्रीम कोर्ट ( संविधान बेंच ) के निर्णय के बाद उच्च ग्रेडों में वरिष्ठता तथा पदोन्नति जारी होने पर यदि आवश्यकता हुई तो इस विषय पर डी.ओ.पी. एण्ड टी. के अनुदेशों के प्राप्त होने पर ऐसी तदर्थ पदोन्नतियों की समीक्षा की जा सकती है ।
5. उक्त तदर्थ पदोन्नति वरिष्ठता को प्रभावित किए बिना एवं विद्यमान रिक्तियों पद दी जाती है ।

( सिविल ) संख्या 323 ऑफ 2002 पर शीर्ष न्यायालय के निर्णय के परिणामस्वरूप सरकारी आदेश प्राप्त होने पर डी.ओ.पी. एण्ड टी . के कार्यालय ज्ञापन सं. 20011 / 1 /2001-स्थापना ( डी ) दिनांक 21.01.2002 के शर्तों के अधीन अनुसूचित जाति/अनुसूचित जनजाति सरकारी कर्मचारियों के संबंध में पदोन्नति पर नोशनल इफेक्ट आवश्यकतानुसार प्रभावी होगा ।
