सा.का.नि. 257.- राष्ट्रपति , संविधान के अनुच्छेद 299 के खण्ड ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए यह निदेश देते हैं कि भारत सरकार के तत्कालीन विधि मंत्रालय ( विधि कार्य विभाग ) की अधिसूचना सं. सा.का. नि. 585 , तारीख 1 फरवरी , 1966 में निम्नलिखित और संशोधन किए जाएंगे , अर्थात्:-

उक्त अधिसूचना में: -

( 1) भाग 9 में , " गृह मंत्रालय के मामले में " शीर्षक के अधीन मद क के पैरा 19 के खंड ( घ) के उपखंड ( i ) में, " महानिरीक्षक (मुख्यालय और रसद) , केन्द्रीय औद्योगिक सुरक्षा बल, उप महानिरीक्षक (रसद) , केन्द्रीय औद्योगिक सुरक्षा बल, " प्रविष्टियों के स्थान पर निम्नलिखित प्रविष्टियां रखी जाएंगी अर्थात्: -

सा. का. नि. 258.- भारतीय प्रशासनिक सेवा (वेतन ) नियमावली, 1954 के नियम 11 के साथ पठित , अखिल भारतीय सेवा अधिनियम, 1951 ( 1951 का 61 ) की धारा 3 की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, केन्द्रीय सरकार पश्चिम बंगाल सरकार के परामर्श से भारतीय प्रशासनिक सेवा ( वेतन ) नियमावली, 1954में आगे और संशोधन करने के लिए एतद्वारा निम्नलिखित नियम बनाती है , अर्थात्: -

सा.का.नि. 259.- भारतीय प्रशासनिक सेवा ( संवर्ग ) नियमावली, 1954 के नियम 4 के उप नियम ( 2 ) के साथ पठित, अखिल भारतीय सेवा अधिनियम, 1951 ( 1951 का 61 ) की धारा 3 की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, केन्द्रीय सरकार पश्चिम बंगाल सरकार के परामर्श से भारतीय प्रशासनिक सेवा ( संवर्ग पद संख्या का नियतन ) विनियमावली , 1955 में आगे और संशोधन करने के लिए एतद्वारा निम्नलिखित विनियम बनाती है , अर्थात्: - 1. ( i ) इन विनियमों का नाम भारतीय प्रशासनिक सेवा ( संवर्ग पद संख्या का नियतन ) -चतुर्थ संशोधन विनियमावली, 2004 है । ( ii ) ये विनियम भारत के राजपत्र में इनके प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. भारतीय प्रशासनिक सेवा ( संवर्ग पद संख्या का नियतन ) विनियमावली, 1955 की अनुसूची में " पश्चिम बंगाल " शीर्षक और उसके नीचे आने वाली प्रविष्टियों के स्थान पर निम्नलिखित प्रतिस्थापित किया जाएगा , अर्थात्: -

सा.का.नि. 261. भारतीय वन सेवा ( वेतन ) नियमावली, 1968के नियम 11 के साथ पठित , अखिल भारतीय सेवा अधिनियम,

1643 1951 ( 1951 का 61 ) की धारा 3 की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, केन्द्रीय सरकार उत्तरांचल सरकार के परामर्श से, भारतीय वन सेवा ( वेतन ) नियमावली, 1968 में आगे और संशोधन करने के लिए निम्नलिखित विनियम बनाती है , अर्थात्:-

1. (i) इन नियमों का नाम भारतीय वन सेवा ( वेतन ) संशोधन नियमावली, 2004 है ।

सा. का. नि. 262.- राष्ट्रपति , संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, विनिवेश विभाग , वित्त मंत्रालय में , प्रशासनिक अधिकारी की भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्: -

1. संक्षिप्त नाम और प्रारम्भ. ( 1 ) इन नियमों का संक्षिप्त नाम, विनिवेश विभाग प्रशासनिक अधिकारी भर्ती नियम, 2004 है । (2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद संख्या, वर्गीकरण और वेतनमान, उपाबद्ध अनुसूची के स्तंभ 2 से स्तंभ 4 में विनिर्दिष्ट हैं । उक्त पद की संख्या , उसका वर्गीकरण और उसका वेतनमान वह होगा, जो इन नियमों से 3. भर्ती की पद्धति, आयु सीमा, अर्हताएं आदि. उक्त पद पर भर्ती की पद्धति, आयु सीमा, अन्य अहर्ताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ 5 से स्तंभ 14 में विनिर्दिष्ट हैं ।

4. निरर्हता. वह व्यक्ति,-

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है , विवाह किया है , या

(ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्र नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह , ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

6. व्यावृत्ति.--इन नियमों की कोई बात , ऐसे आरक्षणों, आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों , अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

प्रोन्नति द्वारा या प्रतिनियुक्ति/आमेलन द्वारा तथा विभिन्न पद्धतियों द्वारा भरे जाने वाले पदों की प्रतिशतता

(i ) केन्द्रीय सचिवालय सेवा के अनुभाग अधिकारी; या

( ii ) 5500-9000 रुपए के वेतनमान में केन्द्रीय सचिवालय सेवा के ऐसे सहायक, जिन्होंने उस श्रेणी मेंतीन वर्ष सेवा की हो ।

(प्रतिनियुक्तिकी अवधि, जिसके अन्तर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवधि है साधारणतया तीन वर्ष से अधिक नहीं होगी । प्रतिनियुक्ति द्वारा नियुक्ति के लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अन्तिम तारीख को 56 वर्ष से अधिक नहीं होगी ) ।

भर्ती करने में किन परिस्थितियों में संघ लोक सेवा आयोग से परामर्श किया जाएगा यदि विभागीय प्रोन्नति समिति है तो उसकी संरचना

G.S.R. 262. In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules regulating the method of recruitment to the post of Administrative Officer in the Department ofDisinvestment, Ministry of Finance , namely :-

1. Short Title and Commencement .-( 1 ) These rules may be called the Department of Disinvestment Administrative Officer Recruitment Rules , 2004.

(2) They shall come into force on the date of their publication in the Official Gazette .

2. Number of posts , classification and scale of Pay. The number of the said post , its classification and the scale ofpay attached thereto shall be as specified in columns 2 to 4 of the Schedule annexed hereto.

3. Method of Recruitment , age limit and other qualificationsetc. The method of recruitment age limit, qualifications and other matters relating to the said posts, shall be as specified in columns 5 to 14 of the said Schedule.

1651 4. Disqualification. No person,-

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who , having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to any of the said post :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operation of this rule.

5. Power to relax .-Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, and for reasons to be recorded in writing , relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving. Nothing in these rules shall affect reservations , relaxation of age- limit and other concessions required to be provided forthe Scheduled Castes, the Scheduled Tribes, Ex- Servicemen and other special categories of persons, in accordance with the orders issued by the Central Government from time to time in this regard.

" 5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके तथा संघ लोक सेवा आयोग से परामर्श करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी । "

सा..का. नि. 264.- राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और वायदा बाजार आयोग (सहायक) भर्ती नियम , 1996 , वायदा बाजार आयोग, वर्ग 3 भर्ती नियम, 1958 को, जहां तक उनका संबंध उच्च श्रेणी लिपिक पदों से है और वायदा बाजार आयोग (अवर श्रेणी लिपिक ) भर्ती नियम , 1987 को उन बातों के सिवाय अधिक्रान्त करते हुए जिन्हें ऐसे अधिक्रमण से पहले किया गया है या करने का लोप किया गया है , उपभोक्ता मामले, खाद्य और सार्वजनिक वितरण मंत्रालय ( उपभोक्ता मामले विभाग ) के अधीन वायदा बाजार आयोग , मुंबई में सहायक, उच्च श्रेणी लिपिक और अवर श्रेणी लिपिक के पदों पर भर्ती की पद्धति को विनियमित करने के लिए निम्नलिखित नियम बनाते हैं , अर्थात्: - 1. संक्षिप्त नाम और प्रारम्भ. ( 1 ) इन नियमों का संक्षिप्त नाम, वायदा बाजार आयोग , मुंबई ( सहायक, उच्च श्रेणी लिपिक और अवर श्रेणी लिपिक ) भर्ती नियम, 2004 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद संख्या, वर्गीकरण और वेतनमान. उक्त पदों की संख्या, उनका वर्गीकरण और उनके वेतनमान वे होंगे , जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ 2 से स्तंभ 4 में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति, आयु-सीमा , अर्हताएं आदि.-उक्त पदों पर भर्ती की पद्धति, आयु सीमा, अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ 5 से स्तंभ 14 में विनिर्दिष्ट हैं ।

4. निरर्हता. वह व्यक्ति,-

( क ) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या

(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है ,

उक्त पद पर नियुक्ति का पौत्र नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह, ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी । 6. व्यावृत्ति. इन नियमों की कोई बात, ऐसे आरक्षणों, आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों , अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है:-

टिप्पण 1 : प्रतिनियुक्ति की अवधि, जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवधि है . साधारणतया तीन वर्ष से अधिक नहीं होगी ।

टिप्पण ( क ) किसी विशिष्ट वर्ष से संबंधित न भरी गई रिक्तियां अगले वर्ष के लिए अग्रनीत नहीं की जाएंगी। ( ख) यदि खंड ( ii ) के अधीन उपलब्ध रिक्तियों की संख्या से अधिक कर्मचारी उक्त परीक्षा को उत्तीर्ण कर लेते हैं तो ऐसे कर्मचारियों के संबंध में पश्चात्वर्ती वर्षों में उद्भूत होने वाली रिक्तियों को भरने के लिए विचार किया जाएगा जिससे पूर्ववर्ती परीक्षा को उत्तीर्ण करने वाले कर्म- चारियों के संबंध में उन कर्मचारियों से पहले किया जा सके जो बाद वाली परीक्षा में उत्तीर्ण होते हैं ।

In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Forward Markets Commission , (Assistant ) Recruitment Rules , 1996, the Forward Markets Commission. Class III Recruitment Rules , 1958 , in so far as they relate to the posts of Upper Division Clerk and the Forward Markets Commission (Lower Division Clerk) Recruitment Rules , 1987 , except as respect things done or omitted to have been done before such supersession , the President hereby makes the following rules regulating the method of recruitment to the posts of Assistant , Upper Division Clerk and Lower Division Clerk in the Forward Markets Commission, Mumbai under the Ministry of Consumer Affairs , Food and Public Distribution ( Department of Consumer Affairs ) , namely :-

1. Short Title and Commencement. ( 1 ) These rules may be called the Forward Markets Commission , Mumbai (Assistant , Upper Division Clerk and Lower Division Clerk ) Recruitment Rules, 2004.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number , classification and scale of Pay. The number of the said posts , their classification and the scale of pay attached thereto shall be as specified in columns 2 to 4 of the Schedule annexed to these rules.

5. Power to relax.-Where the Central Government is of the opinion that it is necessary or expedient so to do , it may, by order, for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

6. Savings . Nothing in these rules shall affect reservation, relaxation of age - limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , Other Backward Classes , Ex - Servicemen and other special categories of persons, in accordance with the orders issued by the Central Government from time to time in this regard.

और जबकि विनिर्दिष्ट अवधि के भीतर इस अधिसूचना में निहित संशोधनों के बारे में कोई भी आपत्तियां अथवा सुझाव प्राप्त नहीं हुए; अतः अब भारतीय बायलर अधिनियम , 1923 ( 1923 का 5 ) की धारा 28 में प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्रीय बायलर बोर्ड, एत‌द्वारा भारतीय बायलर विनियम , 1950 में और संशोधन करने हेतु निम्नलिखित विनियम बनाता है, नामतः

1. ( 1 ) इन विनियमों को भारतीय बायलर ( तृतीय संशोधन ) विनियम, 2004 कहा जायेगा ।

(2) ये विनियम सरकारी राजपत्र में इनके प्रकाशन की तारीख से प्रभावी होंगे ।

2. भारतीय बायलर विनियम, 1950 ( जिन्हें इसके पश्चात् उक्त विनियम कहा जाएगा ) में, विनियम 36 में-

(i ) उप विनियम ( ख ) में, धारा ( ii ) में रसायनिक संरचना के मानक चार्ट में, ग्रेड टी सी के लिए, स्तम्भ एस में, प्रविष्टि " 0.35 [ भाग II- खण्ड 3 (i ) ]

1661 अधिकतम " के स्थान पर प्रविष्टि" 0.035 अधिकतम " प्रतिस्थापित की जाएगी;

(ii) उप विनियम (घ ) में, मानक टार्च ( ii ) में, " 2.4 तथा कम " स्तम्भ में, " 101.6 से अधिक " पंक्ति में, प्रविष्टियों " ० " तथा " ०" के स्थान पर, प्रविष्टियां " लागू नहीं" तथा " लागू नहीं " क्रमशः प्रतिस्थापित की जाएंगी ।

3. उक्त विनियमों में, विनियम 38 में, मानक चार्ट में , अंतिम स्तम्भ के शीर्षक के स्थान पर निम्नलिखित प्रतिस्थापित किया जाएगा, अर्थात्:-

4. उक्तविनियमों में, विनियम 43 में उप - विनियम (ग ) में, " बाहरी व्यास में अनुमत अंतर " के मानक चार्ट में, " 10.3 से 48.3 सहित तक " पंक्तिमें, " निम्नलिखित से कम " स्तम्भ में, प्रविष्टि " 0.79 " के स्थान पर, प्रविष्टि " 0.40 " प्रतिस्थापित की जाएगी ।

5. उक्त विनियमों में, विनियम 44 में, उप- विनियम (क) में:-

( i) मानक चार्ट में , अंतिम स्तंभ के शीर्षक के स्थान पर निम्नलिखित प्रतिस्थापित किया जाएगा, अर्थात्: -

" पूर्ण ट्यूब जांच के लिए जी एल = 50 मि.मी. न्यूनतम पर % दीर्घाकरण "

(ii ) समीकरण " ई = 1942.57 (ए००2/यू०.१ ) " के स्थान पर, निम्नलिखित समीकरण प्रतिस्थापित किया जाएगा , अर्थात्: - " ई = 1944 ( ए²/ यू०" ) " ।

6. उक्तविनियमों में, विनियम 47 में, उप-विनियम ( iv ) में " 12 एक्स 1 एम ओ " के स्थान पर निम्नलिखित प्रतिस्थापित किया जाएगा, अर्थात्:-

" 12 एक्स 1 एम फाई" ।

7. उक्तविनियमों में, विनियम 48 और विनियम 51 के पश्चात् आने वाली तालिका 1 और 2 के स्थान पर निम्नलिखित विनियम और तालिका प्रतिस्थापित किये जाएंगे , अर्थात्: -

" 48 ( क) सामग्री:- ( i ) ट्यूबें सीवनहीन होंगी तथा उनका विनिर्माण, खुली भट्टी अथवा विद्युतीय प्रक्रिया अथवा किसी भी आक्सीजन वाली प्रक्रिया से तैयार किये गये इस्पात से किया जायेगा । इस्पात को पूरी तरह निष्प्रभावी किया जायेगा ।

( ii ) इस्पात तालिका-1 और 2 में दी गयी रासायनिक बनावट की सीमाओं के अनुरूप होगा ।

( iii ) कोल्ड वर्ल्ड ग्रेड टी पी 321 एच के दानों का आकार नं . 7 अथवा और खुरदरा होगा ।

(ख ) उष्मोपचार: ( i ) टी 91 , 12 एक्स 1 एम फ़ाई और एक्स 20 सी आर एम ओ वी 121 को छोड़कर, तालिका-1 की सभी श्रेणी की ट्यूबों को दोबारा गर्म किया जाएगा और उन्हें पूर्ण अनुशीतित, समतापी अनुशीतित अथवा सामान्यीकृत और मृदुकृत और मृदुकृत दशाओं में फर्निश किया जायेगा । यदि सामान्यीकृत और मृदुकृत दशाओं में फर्निश किया जाता है तो श्रेणी टी 1 और टी 11 के लिए न्यूनतम मृदुकरण तापमान 650 डिग्री सेल्सियस तथा श्रेणी टी 5, टी 9 और टी 22 के लिए 675 डिग्री सेल्सियस होगा ।

( ii ) गर्म तैयार अथवा कोल्ड ड्रान टी 1 , टी 2 और टी 12 श्रेणी की ट्यूबिंग को खण्ड 3.1 में विनिर्दिष्ट उष्मोपचार के बजाय 650 डिग्री से. से 730 डिग्री से. तक का अंतिम उष्मोपचार दिया जायेगा और यह विनिर्माता के विकल्पाधीन होगा ।

(iii ) टी 91 श्रेणी को अंतिम उष्मोपचार के तौर पर न्यूनतम 1040 डिग्री से. पर सामान्यीकृत किया जायेगा और न्यूनतम 730 डिग्री से . पर मृदुकृत किया जायेगा ।

(iv) 12 एक्स 1 एम फ़ाई श्रेणी को 950-980 डिग्री से. पर सामान्यीकृत किया जायेगा तथा 1 से तीन घंटों की अवधि के लिए 720-750 डिग्री से. पर मृदुकृत किया जायेगा ।

(v ) एक्स 20 सी आर एम ओंवी 121 श्रेणी को 1020-1070 डिग्री से. पर सामान्यीकृत किया जायेगा तथा न्यूनतम 1 घंटे की अवधि तक 730-780 डिग्री से. पर मृदुकृत किया जायेगा ।

[PART II-SEC . 3 (i ) ] (vi ) सभी आस्टेनिटिक ट्यूबों को ( तालिका -2 ) उष्मोपचारित दशा में फर्निश किया जायेगा । एच श्रेणी को छोड़कर अन्य श्रेणियों के लिए उष्मोपचार प्रक्रिया के अंतर्गत गर्म किये जाने वाले पदार्थ को न्यूनतम 1040 डिग्री से . तापमान तक गर्म किया जायेगा और फिर पानी में ठंडा किया जाएगा अथवा अन्य साधनों से तीव्रता से ठंडा किया जायेगा । (vii ) सभी एच श्रेणियों को विलयन उपचारित दशा में फर्निश किया जायेगा । यदि प्रक्रिया में ठंडा करने की शामिल हो तो न्यूनतम विलयन उपचार तापमान श्रेणी टी पी 321 एच तथा टी पी 347 एच के लिए 1100 डिग्री से. तथा श्रेणी टी पी 304 एच और टी पी 316 एच के लिए 1040 डिग्री से. होगा । यदि पी श्रेणी हॉट राल्ड हो तो न्यूनतम विलयन उपचार, श्रेणी टी पी 321 एच और टी पी 347 एच के लिए 1050 डिग्री से. तथा श्रेणी टी पी 304 एच और टी पी 316 एच के लिए 1040 डिग्री से. होगा । (ग ) शिल्प और सहनशक्ति ट्यूबें भली- भांति अंतिम रूप से तैयार, स्वच्छ और हानिकारक कमियों से मुक्त होंगी । वे पर्याप्त रूप से सीधी, चिकनी और बेलनाकार होंगी तथा निम्नलिखित सहनशक्ति परीक्षा से उन्हें गुजारा जायेगा । अंतिम रूप से तैयार ट्यूबें पर्याप्त रूप से सीधी होंगी और उनके किनारे किसी खुरदरेपन से मुक्त और चिकने होंगे । उनकी फिनिशिंग ऐसी होगी जैसे कुशल श्रमिकों द्वारा की जाती है । ट्यूब की निरंतरता में बवरोध या अनियमितता जैसी कमियों को ग्राइंडिंग से दूर किया जा सकता है, बशर्ते सतह चिकनी गोलाईयुक्त हो और दीवार की मोटाई को अनुमत सीमा से कम न किया जाए । ग्राइंडिंग के दौरान हटाये गये बाहरी व्यास की मात्रा को उतना कम किया जा सकता है ।

घ) परीक्षण नमूने: ( i ) विनियम 49 ( क) , ( ख ) और 49 ( ग ) में विर्निदष्ट चपटा करने और फैलाने /प्रदीप्त करने हेतु आवश्यक परीक्षण नमूने अंतिम रूप से तैयार ट्यूबों के अंतिम सिरों से , ट्यूबों को अस्तव्यस्त करने , उन पर ठप्पा लगाने , उन्हें फैलाने अथवा अन्य किसी भी तैयार करने वाली प्रक्रिया या काटे जाने से पूर्व लिये जायेंगे । वे सिरों पर चिकने तथा किसी भी खुरदरेपन और कमियों से मुक्त होंगे । ( ii ) यदि वांछित और व्यवहार्य हो, तो तनन परीक्षण ट्यूबों की पूरी लंबाई पर परीक्षण मशीन की क्षमता तक किये जा सकते हैं । बड़े आकार की ट्यूबों के लिए तनन परीक्षण नमूना ट्यूब से अनुदैर्ध्य काट द्वारा ली गयी पट्टी को लिया जाएगा और इसे और उष्मोपचारित गेज लंबाई के भीतर सीधा किया हुआ नहीं होना चाहिए ।

( iii ) यदि किसी परीक्षण नमूने में कोई त्रुटि या कमी पायी जाती है तो उसे अस्वीकृत करके दूसरे नमूने से बदला जाए ।

(iv ) सभी नमूनों के परीक्षण कमरे के तापमान पर किये जायेंगे ।

( घ) परीक्षण की संख्या: विनियम 49 ( क ) , 49 ( ख ) , और ( ग ) में विनिर्दिष्ट परीक्षण , प्रथम 100 के लिए न्यूनतम 2 ट्यूबों पर तथा 100 से अधिक संख्या के लिए प्रति 100 पर एक अथवा उसके भाग पर किये जायेंगे ।

9. उक्त विनियमों में, विनियम 51 में, " एस खिंचाव ( स्ट्रेस ) , जिसे कमरे के तापमान पर न्यूनतम तनाव शक्ति 40 % के रूप में माना जाएगा " के स्थान पर निम्नलिखित प्रतिस्थापित किया जाएगा, अर्थात्: -

" एस = खिंचाव ( स्ट्रेस ) , जिसे कमरे के तापमान पर कार्बन तथा फैराईटिक स्टील के लिए न्यूनतम तनाव शक्ति के 40 % के रूप में माना जाएगा तथा ऑसटैनाईटिक स्टेनलैस स्टील के लिए न्यूनतम पराभव शक्ति के 80 % के रूप में माना जाएगा " ।

10. उक्त विनियमों में , विनियम 53 में,

G.S.R. 265. Whereas certain draft regulations further to amend the Indian Boiler Regulations , 1950 were published, as required by sub -section ( 1 ) of Section 31 of the Indian Boilers Act, 1923 (5 of 1923 ) , vide notification ofthe Government of India in the Ministry of Commerce and Industry (Department of Industrial Policy and Promotion) (Central Boilers Board) number G.S.R. 379 , dated the 21st October , 2003 , in Part II, Section 3 , Sub-section (i ) of the Gazette of India, dated the 25th October , 2003 , for inviting objections and suggestions from all persons likely to be affected thereby till the expiry ofthe period of forty- five days from the date on which the copies of the Gazette containing the said notification are made available to the public;

Andwhereas the copies of the said Gazette containing the notification were made available to the public on the 7th November, 2003;

And whereas no objections or suggestions have been received within the period so specified in respect of the amendments contained in the said notification;

Now, therefore , in exercise of the powers conferred by Section 28 of the Indian Boilers Act, 1923 (5 of 1923) , the Central Boilers Board hereby makes the following regulations further to amend the Indian Boiler Regulations , 1950 , namely :-

1. (1 ) These regulations may be called the Indian Boiler (Third Amendment) Regulations , 2004.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Indian Boiler Regulations , 1950, (hereinafter referred to as the said regulations) , in regulation 36,- (i) in sub-regulation (b ), in clause ( ii ) , in the specification chart for chemical composition, for Grade TC , under the column S, for the entry " 0.35max " , the entry " 0.035max " shall be substituted;

(ii ) in sub - regulation ( d) , in the specification chart ( ii ) in the column " 2.4 and under" , in the row "Over 101.6 " , for the entries " o " and " 0 " , the entries , " NA" and " NA", shall respectively be substituted.

3. In regulation 38 of the said regulations , in the specification chart , for the heading appearing in the last column, thefollowing heading shall be substituted, namely :--

4. In regulation 43 of the said regulations , in sub -regulation (c) , in the specification chart for " Permissible variation in outside diameter " , in the row " 10.3 to 48.3 incl . " , in the column " Under" , for the entry " 0.79 " , the entry " 0.40 " shall be substituted .

5. In regulation 44 of the said regulations, in sub - regulation ( a) ,

(i ) in the specification chart, for the heading appearing in the last column, the following shall be substituted, namely:-

(ii ) for the equation " e = 1942.57 (A002 / 09 ) " , the following equation shall be substituted, namely:-

6. In regulation 47 of the said regulations , in sub - regulation ( iv ) , for Grade " 12X1Mo " , the following shall be substituted , namely:-

7. For regulation 48 of the said regulations and Tables 1 and 2 occurring after regulation 51 , the following regulation and Tables shall be substituted, namely :-

1671 "48. (a) Material .-( i ) The tubes shall be seamless and manufactured from steel produced by an open hearth or electric process or any of the oxygen processes . The steel shall be fully killed.

(ii ) The steel shall conform to the limits of chemical compositions given in Tables 1 and 2 .

( iii ) The grain size of cold worked grade TP 321H shall be No. 7 or coarser.

(b) Heat treatment.( i) All tubes of grades in Table - 1 , except T91 , 12X1Mo and X20CrMoV121 shall be reheated and furnished in full annealed, isothermal annealed or normalised and tempered condition. If furnished in the normalised and tempered condition, the minimum tempering temperature for Grades T1 and T11 shall be 650 degree Cand the minimum tempering temperature for Grades T5, T9 and T22 shall be 675 Degree C.

( ii ) Tubing ofGrades T1 , T2 and T12 either hot finished or cold drawn , may be given a final heat treatment at 650 degree C to 730 degree C , instead of heat treatments specified in sub - clause ( i) above , at the option of the manufacture .

( iii) Grade T91 shall be normalised at 1040 degree C minimum and tempered at 730 degree C minirnum as a final heat treatament.

(iv) Grade 12 × 1Mo shall be normalised at 950-980 degree C and tempered at 720-750 degree C for a period of 1 to 3 hours.

(v) Grade X20CrMoV121 shall be normalised at 1020 to 1070 degree C and tempered at 730 to 780 degree C for a period of 1 hour minimum .

(vi) All austenitic tubes (Table 2 ) shall be furnished in the heat treated condition . The heat treatment procedure, except for the H grades shall consist of heating the material to a minimum temperature of 1041) ° C and quenching in water or rapidly cooling by other means .

(vii) All H grades shall be furnished in the solution treated condition. If cold working is involved in processing, the minimum solution treating temperatures for grades TP321 H and TP347H shall be 11000 degree C and for grades TP304H and TP316H shall be 1041) degree C. If the P grade is hot rolled, the minimum solution treatment for grades TP 321 H and TP 347 H shall be 1050 degree C and for grades TP 31)4H and TP 316H shall be 1040 degree C.

(c)Workmanship and tolerance. The tubes shall be well finished, cleaned free from harmful defects. They shall be reasonably straight , smooth , cylindrical and subject to the following tolerances. Finished tubes shall be reasonably straight and have smooth ends free of burns. They shall have a workmanlike finish. Surface imperfections like any discontinuity or irregularity found in the tube may be removed by grinding, provided that a smooth curved surface is maintained, and the wall thickness is not decreased to less than that perinitted. The outside diameter at the point of grinding may be reducedby the amount so removed.

(d ) Test specimens .-( i ) Test specimens required for the flattening and expanding/ flaring test specified in regulations 49 ( a ) , 49 (b ) and 49 ( c ) shall be taken from the ends of finished tubes priorto upsetting , swaging . expanding or any other forming operations or being cut to length . They shall be smooth on the ends and free from burts flaws .

(ii ) If desirable and practicable, tensile test may be carried out on full section of the tubes up to the capacity ofthe ( esting machine. For large size tubes , the tensile test specimen shall consist of strip cut longitudinally from the tube and which is not straightened within the gauge length further heat -treated.

( iii) If any test specimen shows flaws or defective machining it may be discarded and another specimen substituted.

( iv) All specimens shall be tested at room temperature .

(e) Number of tests .- The tests specified in regulations 49( a) , 49 (b ) and 49 ( c ) shall be made on minimum 2 tubes for first 100 and I per 100 or part thereof for tubes over 100 numbers .

[PART II-SEC. 3 (i ) ] 9. In regulation 51 of the said regulations , for " S = stress which shall be taken as 40 % of the minimum tensile strength at room temperature " , the following shall be substituted, namely :-

"S = stress which shall be taken as 40% of the minimum tensile strength at room temperature for carbon and ferritic steel and 80 % of the minimum yield strength at room temperature for austenitic stainless steel ."

10. In regulation 53 of the said regulations ,- (i ) for sub - regulation ( a ) , and Table 4 occurring after regulation 56 , the following sub - regulation and Table shall be substituted , namely :-

"( a) Material .-( i ) The pipes shall be seamless and manufactured from steel produced by an open hearth or electric process or any of the Oxygen processes . The steel shall be fully killed .

(ii ) The steel shall conform to the limits of chemical composition as given in Table 4.
