2. एन० एस०ई ० ( फ्यूचर एण्ड ऑपशन ) कारोबार विनियमनों के विनियम 3.6 क में विहित उपबंधों को निम्नानुसार के माध्यम से संशोधित किया जाता है ।
( i ) " कारोबारी सदस्य द्वारा इलैक्ट्रानिक रूप में भी जारी किया जाए" शब्दों और " सूचना प्रौद्योगिकी अधिनियम, 2000 और उसके तहत बनाए गए नियमों में यथा निर्दिष्ट डिजिटल हस्ताक्षर द्वारा यथोचित रूप से अधिप्रमाणित" के बीच " ऐसे फार्मेंट में जैसा कि समय- समय पर एक्सचेंज द्वारा विनिर्धारित किया जाता है" शब्दों को जोड़ कर ; और

विहित उपबंधों को उक्त विनियमन की धारा ( V) के रूप में निम्नलिखित धाररा को जोड़कर संशोधित किए जाने का प्रस्ताव है : --

6.1.6.2 (V) ( क ) कारोबारी सदस्य अपने स्त्रयं की डिमटीर- लाइज्ड प्रतिभूतियों को रखने के लिए रखे गए लाभभोगी खाते से पृथक लाभभोगी खाते में संघटकों की डिमटीरलाइज्ड प्रतिभूतियों को रखेगा । कारोबारी सदस्यों के स्वयं के लेन-देनों के लिए संघटकों के खाते से डिलीवरी किए जाने की अनुमति नहीं होगी । इस प्रयोजन के लिए, प्रत्येक कारोबारी सदस्य को सिर्फ संघटकों की प्रतिभूतियों के लिए कारोबारी सदस्य के नाम में लाभभोगी खाता खोलना अपेक्षित है ( इसमें इसे इसके पश्वात् " संघटकों का लाभभोगी खाता" कहा जाएगा) । एक कारोबारी सदस्य अपने सभी संघटकों के लिए एक समेकित संघटकों का लाभभोगी खाता अथवा अपने प्रत्येक संघटक के लिए भिन्न खाते, जैसा वह उचित समझता है , खोल सकता है । ( ख ) प्रतिभूतियां संघटकों के लाभभोगी खाते में डिलीवर की जाएंगी निम्नलिखित को छोड़कर कोई भी प्रतिभूति संघटकों के लाभभोगी खाते में डिलीवर नहीं की जाएगी:--
क. मार्जिन के लिए अथवा प्रतिभूति जमा के रूप में संघटकों के खाते में प्राप्त अथवा धारित प्रतिभूतियाँ;
ख. उन प्रतिभूतियों के प्रतिस्थापना के लिए जो गलती से अथवा संयोग से निकाल ली गई हैं ।
( ग) संघटकों के लाभभोगी खाते से हटायी जाने वाली प्रतिभूतियां : निम्नलिखित को छोड़कर कोई भी प्रतिभूति संघटकों के खाते से नहीं निकाली जाएगी
क. जब वे संघटकों को अथवा संघटकों की ओर से , संघटकों के माजिन अथवा अदायगी बाध्यताओं के लिए अथवा उनको पूरा करने के लिए उचित रूप से अपेक्षित हैं ;
ख . संघटकों के प्राधिकार के तहत निकासी अथवा जिनके संबंध में कारोबारी सदस्य को संघटकों को देनदारी है;

इसके अलावा यह के इस प्रकार निकाली गई प्रतिभूतियां किसी भी दशा में संबंधित संघटक के लिए फिलहाल इस प्रकार रखी गई प्रतिभूतियों से अधिक नहीं होगी ।

The provisions contained in Chapter 3 of NSE (Futures & Options ) Trading Regulations are amended as below :
General Clauses Act , 1897 in the Gazette of India . Any person having any observations on the propos- ed amendments to the Regulations can send the same in writing to the undersigned at Exchange Plaza , C - 1 , Block -G, Bandra - Kurla Complex, Bandra (East) , Mumbai - 400051 within fifteen days from the date of this publication in the Gazette . The obser- vations received after the aforementioned date will not be considered when the draft amendments will be taken for consideration .
The provisions contained in Regulation 6.1.6.2 in Chapter 6 of the NSE (Futures & Options ) Trading Regulations of the Exchange are proposed to be amended by the insertion of the following clause as clause (v) to the said Regulation : -
QUOTE
1. The provisions contained in Regulation 3.6.1 is amended by substituting the words " specified in ANNEXURE : 2 " with the words " may be prescribed by the Exchange from time to time " in between the words " Every Trading Member shall issue a contract note to his constituents for trades executed in such format as " and "with all relevant details as required therein to be filled in, " .
2. The provisions contained in Regulation 3.6A of the NSE (Futures & Options ) Trading Regulations are amended through
(i) insertion of the following words " in such format as may be prescribed by the Ex- change from time to time " in between the words " may also be issued by a Trading Member in electronic form " and " duly authenticated by means of a digital signa- ture as specified in the Information Technology Act , 2000 and the Rules made thereunder " ; and
(ii) deletion of the words " in the format as prescribed under Regulation 3.6 " .
3. As a consequence of the above amendments , the formats of contract notes specified in Annexure 2 to the NSE ( Future & Options) Trading Regulations stand deleted .

6.1.6.2 (v) ( a ) The Trading Members shall keep the dematerialised securities of Constituents in a separate beneficiary account distinct from the benefi- ciary account maintained for hold- ing their own dematerialised securi- ties . No delivery towards the own transactions of the Trading Mem- bers shall be allowed to be made from the account meant for Consti- tuents . For this purpose , every Trading Member is required to open a beneficiary account in the name of the Trading Member exclusively for the securities of the Constituents ( hereinafter , to be referred to as " Constituents benefi- ciary account " ) . A Trading Member may keep one consolidated Consti- tuents' beneficiary account for all its Constituents or different accounts for each of its Constituents as it may deem fit .

" 316 (10) A person who shallbe admitted as a member after Ist January 2004 of the exchange has to deposit Rs . 45,000/- (Forty five thousand) as a Trade Guarantee Fund fee . There shall be no change in Trade Guarantee Fund fee for old members who has been enrolled as a member before 31st Dece- mber 2003. "
