बैंककारी कंपनी ( उपक्रमों का अर्जन और अंतरण) अधिनियम, 1970 ( 1970 का 5) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , यूमियम बैंक ऑफ इंडिया का निदेशक मंडल , भारतीय रिज़र्व बैंक से परामर्श करके तथा केन्द्रीय सरकार की पूर्व मंजूरी से यूनियन बैंक ऑफ इंडिया ( कर्मचारी ) पेंशन विनियम, 1995 में पुनः संशोधम हेतु एतद्वारा , निम्नलिखित विनियम बनाता है , अर्थात्:
1. (1) येविनियम यूनियन बैंक ऑफ इंडिया (कर्मचारी) पेंशन ( संशोधन) विनियम , 2004 कहलायेंगे .
(2) ये सरकारी राजपत्र में अपने प्रकाशन की तारीख से लागू होंगे .
2. यूनियन बैंक ऑफ इंडिया ( कर्मधारी ) पेंशन विनियम , 1995 में ,
(क) विनियम 2 के उप- विनियम ( घ) के खंड (ख) में, उप खंड (iii) के बाद निम्नलिखित उप-खंड शामिल किया जाएगाः अर्थात्
"(iv) 1960 = 100 श्रृंखला में औद्योगिक कामगारों के लिए अखिल भारतीय औसत उपभोक्ता मूल्य सूचकांक में सूचकांक के 1148 अंकों तक परिकलित महंगाई भत्ताः"
(ख) विनियम 41 में , उप- विनियम (6) के लिए , निम्नलिखित उप- विनियमं प्रतिस्थापित किया जाएगा , अर्थात्ः
"(6) जो आवेदक अधिवर्षिता पेंशन या स्वैच्छिक सेवानिवृत्ति पेंशन या समयपूर्व सेवानिवृत्ति पेंशन या अनिवार्य सेवानिवृत्ति पेंशन या अशक्त पेंशन या अनुकंपा भत्ताके लिए प्राधिकृत है , वह इन विनियमों के अंतर्गत अपनी पेंशन के एक हिस्से को सरांशीकृत करने का पात्र होगा;

परंतु , 1.7.2003 को या से , जिस आवेदक के मामले में पेंशन का संराशीकृत मूल्य उसकी सेवानिवृत्ति की तारीख के अगले दिन या संराशीकरण पूर्ण होने की तारीख से देय होता है , संराशीकरण के कारण पेंशन की रकम में कमी उसके प्रारंभ की तारीख से ही लागू होगी . तथापि, जहाँ संराशीकृत पेंशन की रकम का भुगतान , यथास्थिति, सेवानिवृत्ति की तारीख से पहले माह या संराशीकरण पूर्ण होने की तारीख से पहले माह के भीतर नहीं होता है वहां मासिक पेंशन और संराशीकृत पेंशन के अंतर का भुगतान , यथास्थिति , सेवानिवृत्ति की तारीख के अगले दिन से या संराशीकरण पूर्ण होने की तारीख से , जिस तारीख को संराशीकृत पेंशन को प्रदत्त माना गया है , उससे पिछली तारीख तक किया जाएगा . "

52. यमुना नगर परिषद अपने विशेषाधिकार के अर्न्तगत किसी भी परीक्षा केन्द्र को किसी भी समय बिना कोई कारण दिए रद्द कर सकती है । यह परीक्षा इंस्टीट्यूट के केवल पात्र सदस्य जो कि पहले से ही पंजीकृत है, के लिए है ।
इस परीक्षा के लिए परीक्षा शुल्क 1,000/- रूपये (एक हजार रूपये मात्र) है ।
परीक्षा शुल्क की राशि का भुगतान बैंक के डिमांड ड्रॉफ्ट द्वारा होना चाहिए । आवेदन पत्र उपयुक्त शुल्क के डिमांड ड्रॉफ्ट के साथ इस प्रकार भेजा जाना चाहिए कि वह संयुक्त सचिव (परीक्षा) के कार्यालय में दिनांक 01.09.2004 तक पहुँच जाए । दिनांक 01.09.2004 के बाद प्राप्त आवेदन पत्रों को स्वीकार नहीं किया जायेगा । इस परीक्षा के लिए आवेदन निर्धारित आवेदन पत्र पर ही किया जाना चाहिए जो कि इंस्टीट्यूट ऑफ चार्टर्ड एकाउन्टेन्टस ऑफ इंडिया के संयुक्त सचिव (परीक्षा) के नई दिल्ली स्थित कार्यालय से 25/- रूपये प्रति आवेदन पत्र भुगतान करने पर मिल सकता है । आवेदन पत्र इंस्टीट्यूट के रीजनल और ब्रांचो के कार्यालयों में भी उपलब्ध है और नकद भुगतान करने पर 13 अगस्त 2004 से प्राप्त किये जा सकते हैं।

2. नियोजक ऐसे निरीक्षण प्रभारी का प्रत्येक मास की समाप्ति के 15 दिन के भीतर संदाय करेगा जो केन्द्रीय सरकार, उक्त अधिनियम की धारा 17 की उपधारा ( 3 - क ) के खण्ड क के अधीन समय - समय पर निर्देश करें ।
3. लाईफ कवर के स्कीम के प्रशासन में, जिसके अन्तर्गत लेखाओं का रखा जाना, विवरणियों का प्रस्तुत किया जाना, प्रभार संदाय आदि भी है, होने वाले सभी व्ययों का वहन नियोजक द्वारा किया जाएगा । संख्याः एन-15/13/1/4/2001-यो. एंव वि.--कर्मचारी राज्य बीमा (सामान्य) विनियम 1950 के विनियम 95 - क के साथ पठित कर्मचारी राज्य बीमा अधिनियम, 1948 ( 1948 का 34 ) की धारा -46 ( 2 ) द्वारा प्रदत्त शक्तियों के अनुसरण में महानिदेशक महोदय ने 01 मार्च, 2004 ऐसी तारीख के रूप में निश्चित की है जिससे उक्त विनियम 95 - क तथा आन्ध प्रदेश कर्मचारी राज्य बीमा नियम 1955 में निर्दिष्ट चिकित्सा हितलाभ आन्ध्र प्रदेश राज्य में निम्नलिखित क्षेत्रों में बीमांकित व्यक्तियों के परिवारों परलागू किए जाएंगे, अर्थात :--
4. नियोजक , केन्द्रीय सरकारा द्वारा अनुमोदन लाईफ कवर स्कीम के नियमों की एक प्रति और जब उसमें संशोधन किया जाये, तब उस संशोधन की प्रति तथा कर्मचारियों की बहु संख्या की भाषा में उसकी मुख्य बातों का अनुवाद स्थापना के सूचना पट्ट पर प्रदर्शित करेगा ।

6. यदि उक्त स्कीम के अधीन कर्मचारियों का उपलब्ध लाभ बढ़ायें जाते है, तो नियोजक लाईफ कवर स्कीम के अधीन कर्मचारियों को उपलब्ध लाभों में समुचित रूप से वृद्धि किये जाने की व्यवस्था करेगा, जो कि कर्मचारियों के लिए लाईफ कवर स्कीम के अधीन उपलब्ध लाभों से अधिक अनुकूल हो जो उक्त स्कीम के अधीन अनुज्ञेय है ।

( टयय मोटर्स लि. ) जमशेदपुर, खाता संख्या, बी. आर. / 05 ने कर्मचारी भविष्य निधि और प्रकीण उपबन्ध अधिनियम , 1952 ( 1952 का 19 ) की धारा 17 की उपधारा 2 ( क ) के अंतर्गत छूट विस्तार के लिए आवेदन किया है जिसे इसमें इसके पश्चात अधिनियम कहा गया है ।
7.लाईफ कवरस्कीम में किसी बात के होते हुए भी यदि किसी कर्मचारी की मृत्यु पर इस स्कीम के अधीन संदेय राशि से कम है जो कर्मचारी को उस दशा में संदेय होती तब तक उक्त स्कीम के अधीन होता तो, नियोजक कर्मचारी के विधिक वारिश नाम निर्देशितों को प्रतिकार के रूप में दोनो राशियों के अन्तर के बराबर राशि का संदेय करेगा ।
चूकि में,केन्द्रीय भविष्य निधि आयुक्त इस बात से संतुष्ट हूं कि उक्त स्थापना के कर्मचारी कोई अलग अंशदान या प्रीमियम की अदायगी किये बिनाजीवन बीमा के रूप में उक्त स्थापना की लाईफ कवर स्कीम का लाभ उठा रहे है, जोकि ऐसे कर्मचारियों के कर्मचारी निक्षेप सहबद्ध बीमा स्कीम 1976के अन्तर्गत स्कीकार्य लाभों में अधिक अनुकूल है जिसे इसमें इसके पश्चात्स्कीम कहा गया है ।
8. लाईफ कवर स्कीम के उपबन्धों में कोई भी संशोधन सम्बन्धित क्षेत्रीय भविष्य निधि आयुक्त के पूर्व अनुमोदन के बिना नहीं किया जायेगा और जहां किसी संशोधन के कर्मचारी के हित पर प्रतिकूल प्रभाव पड़ने की संभावना हो , वहां क्षेत्रीय भविष्य निधि आयुक्त अपना अनुमोदन देने से पूर्वकर्मचारियों को अपना दृष्टिकोण स्पष्ट करने का युक्तियुक्त अवसर देगा ।
9. यदि किसी कारणवश स्थापना के कर्मचारी की उस लाईफ कवर स्कीम के, जिसे स्थापना अपना चुकी हैअधीन रह जाता है या इस स्कीम के आधीन कर्मचारियों को प्राप्त होने वाले लाभ किसी राशि से कम हो जाते हैं तो यह रद्द की जा सकती है ।
अतः उक्त अधिनियम की धारा 17 की उपधारा ( 2 क ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए तथा श्रम मंत्रालय भारत सरकार/केन्द्रीय भविष्य निधि आयुक्त की अधिसूचना सं .2/1959/ डी. एलआई/एक्जाम/ 89- भाग-1/ 4467 दिनांक 11.10.99 के अनुसरण में तथा संलग्न अनुसूची में निर्धारित शर्तों के रहते हुए, मैं. एच. डब्ल्यू. टी . स्येम उक्त स्कीम के सभी उपबंधों के संचालन के उक्त स्थापना को और 3 वर्षों की अवधि के लिए छूट प्रदान करता हूं, दिनांक 01.03.2002 से 28.02.2005 तक लागू होगा जिसमें यह तिथि 28.02.2005 भी शामिल है ।
10. किसी व्यक्ति क्रम की दशा में उन मृत सदस्यों के नाम निर्देशें या विधिक वारिसों को जो यदि यह छूट दी गई होती तो उक्त स्कीम के अन्तर्गत होते, बीमा लाभों के संदाय का उत्तर दायित्व नियोजक पर होगा । अनुसूची

(b) In regulation 41 , for sub - regulation (6) , the following sub- regulation shall be substituted namely -
"(6) An applicant who is authorised a superannuation pension or voluntary retirement pension or premature retirement pension or compulsory retirement pension or invalid pension or compassionate allowance shall be eligible to commute a fraction of his pension under these regulations .
Provided that on and from 01.07.2003 in case of an applicant in whose case the commuted value of pension becomes payable on the day following the date of his retirement or from the date from which the commutation becomes absolute , the reduction in the amount of pension on account of commutation shall become operative from its inception . Where , however , payment of commuted value of pension could not be made within the first month after the date of retirement or within the first month after the date when the commutation becomes absolute as the case may be, the difference between the monthly pension and the commuted pension shall be paid for the period between the date following the date of retirement or the date when the commutation becomes absolute , as the case may be , and the date preceding the date on which commuted value of pension is deemed to have been paid"

AND WHEREAS , I , Central Provident Fund Commissioner is satisfied that the employees of the said establishment is , withoutmaking any separate contribution or payment ofpre- mium, in enjoyment of benefits under the Group Insurance scheme of the establishment in the nature of Life Insurance which are more favourable to such employees than the ben- efits admissible under the Employees' Deposit Linked Insur- ance Scheme . 1976 (hereinafter referred to as the said Scheme) .
9. Where for any reason, the employees of the said estab- lishment do not remain covered under the Life Cover Scheme ofthe said establishment as already adopted by the said es- tablishment or the benefits to the employees under this Scheme are reduced in any manner, the exemption shall be liable to be cancelled.
10. The responsibility for payment of assurance benefits to the nominee (s ) legal heir (s ) ofdeceased member who would have been covered under said Scheme but for grant of this exemption shall be that of the employer.
NOW, THEREFORE , in exercise of the powers conferred by Sub- Section ( 2A) of Section 17 of the said Act and subject to the conditions specified in Schedule annexed hereto , I , Central Provident Fund Commissioner hereby exempt the above said establishment with retrospective effect from which date relaxation order under Para 28 ( 7 ) of the said Scheme has beengranted by the Regional Provident Fund Commissioner, Patna from the operation of the said Scheme for and upto a period of 3 years from 01-03-2002 to 28-02-2005 .
SCHEDULE- II
11. Upon the death of the member covered under the Life Cover Scheme the employer in relation to said establishment shall ensure prompt payment of the sum assured to the nomi- nee (s) Legal heir ( s) of the deceased member entitled for it and in any case within one month from the receipt of claims complete in all respect .

The employer in relation to each of the said establishment (hereinafter referred to as the employer ) shall submit such returns to the Regional Provident Fund Commissioner con- cerned and maintain such accounts and provide such facili- ties for inspection, as the Central Provident Fund Commis- sionermaydirect from time to time.
