सं0 3942- बैंककारी कम्पनी ( उपक्रमों का अर्जन तथा अंतरण) अधिनियम , 1980 ( 1980 का 40 ) की धारा 12 की उपधारा ( 2 ) के साथ पठित धारा ( 19 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए ओरियन्टल बैंक ऑफ कॉमर्स का निदेशक मंडल , भारतीय रिजर्व बैंक के परामर्श से तथा केन्द्रीय सरकार की पूर्व स्वीकृति से, एतद्वारा ओरियन्टल बैंक ऑफ कॉमर्स अधिकारी कर्मचारी ( अनुशासन एवं अपील ) विनियम , 1982 में आगे संशोधन करने हेतु निम्नलिखित विनियम बनाता है, अर्थात्: -
1. संक्षिप्त नाम तथा प्रारम्भ : ( 1 ) ये विनियम ओरियन्टल बैंक ऑफ कॉमर्स, अधिकारी कर्मचारी ( अनुशासन एवं अपील ) ( संशोधन ) विनियम, 2004 कहलाएंगे ।
(2 ) ये विनियम "सरकारी राजपत्र" में अपने प्रकाशन की तारीख से लागू होंगे ।
2. ओस्टिल बैंक ऑफ कॉमर्स अधिकारी कर्मचारी (अनुशासन एवं अपीलू) विनियम, 1982 में , विनियम 17 के लिए, निम्नलिखित विनियम प्रतिस्थापित किया जाएगा , अर्थात्: -
'17 अपील: ( 1 ) अधिकारी कर्मचारी विनियम 4 में निर्धारित अपने ऊपर लगाए गए किसी भी दण्ड या विनियम 12 में उल्लिखित निलंबन आदेश के खिलाफ, आदेश मिलने की तारीख से पैतालीस दिनों के भीतर अपीलीय प्राधिकारी को अपील कर सकता है ।
परन्तु, यदि अपीलीय प्राधिकारी संतुष्ट हो कि अपीलकर्ता के पास समय पर अपील न कर पाने का पर्याप्त कारण है तो वह उक्त अवधि के समाप्त हो जाने के बाद भी अपील पर विचार कर सकता है ।
(2) अपीलकर्ता द्वारा अपीलीय प्राधिकारी को अपील प्रस्तुत की जाएगी जिसकी एक प्रति उस अधिकारी कीअग्रेषित की जाएगी जिसके आदेश के विरूद्ध अपील की गई है । इस अपील में महत्वपूर्ण कथन, सामग्री एवं बहस के वे मुद्दे होंगे जिन पर अपीलकर्ता निर्भर करता है परन्तु उसमें कोई भी अपमानजनक अथवा अनुचित भाषा नहीं होगी और यह अपने आप में पूर्ण होगी । भाग III-खण्ड ]

(3) प्राधिकारी जिसके आदेश के विरूद्ध अपील की गई है, अपीलकर्ता से अपील की प्रति प्राप्त होने पर उसे , अपनी टिप्पणियों और संबंधित रिकार्ड के साथ , अपील प्राप्त होने की तारीख से अधिकतम पैंतालीस दिनों के भीतर अपीलीय प्राधिकारी को अग्रेषित करेगा ।
(4) प्राधिकारी जिसके आदेश के विरूद्ध अपील की गई है, से मामले पर टिप्पणियां एवं रिकार्ड प्राप्त होने पर , अपीलीय प्राधिकारी विचार करेगा कि क्या निलम्बन आदेश/ निष्कर्ष न्यायसंगत हैं या क्या दण्ड बहुत अधिक या अपर्याप्त है और उचित आदेश पारित करेगा । अपीलीय प्राधिकारी दण्ड/निलम्बन की पुष्टि करने , उसमें वृद्धि करने, कमी करने या उसे अपास्त करने का आदेश पारित कर सकता है या मामले को, मामले की परिस्थितियों में उचित समझे गए निदेशों सहित, जिस अधिकारी ने दण्ड लगाया था उसके पास या किसी अन्य अधिकारी के पास भेज सकता है ।
परन्तु,
(i) यदि बढ़ाया हुआ दण्ड, जो अपीलीय प्राधिकारी लगाने हेतु प्रस्तावित करता है, विनियम 4 के खंड ( च) , ( छ ) , ( ज ) , ( झ ) और ( ज ) में उल्लिखित अनुसार , कोई बड़ा दण्ड है और विनियम 6 में दिए गए अनुसार मामले में पहले कोई जांच नहीं की गई है तो अपीलीय प्राधिकारी निदेश देगा कि विनियम 6 के प्रावधानों के अनुसार मामले की ऐसी जांच की जानी चाहिए और उसके पश्चात् जांच के रिकार्ड पर विचार - विमर्श करेगा तथा जैसा वह उचित समझे , आदेश पारित करेगा ;
( ii ) यदि अपीलीय प्राधिकारी दण्ड बढ़ाने का निर्णय लेता है परन्तु विनियम 6 में दिए गए अनुसार जांच पहले ही की जा चुकी है, तो अपीलीय प्राधिकारी अधिकारी कर्मचारी को कारण बताओ नोटिस जारी करेगा कि बढ़ाया हुआ दण्ड उस पर क्यों न लगाया जाए और अधिकारी कर्मचारी द्वारा प्रस्तुत अभ्यावेदन, यदि कोई हो, को ध्यान में रखते हुए अंतिम आदेश पारित करेगा ।
(5 ) अपीलीय प्राधिकारी अपीलकर्ता से अपील प्राप्त होने की तारीख से 90 दिनों के भीतर उसका निपटान करेगा: -
परन्तु, इस विनियम में उल्लिखित समय - सीमा उन मामलों में लागू नहीं होगी जो सतर्कता से संबंधित हों और जहां अधिकारी कर्मचारी के विरूद्ध छोटी बड़ी दण्ड कार्रवाई, मामले की जांच कर रही पुलिस या केन्द्रीय जांच ब्यूरो या केन्द्रीय सतर्कता आयोग , जैसा भी मामला हो, द्वारा की गई सिफारिशों पर आरंभ की गई हो ।
(6) 90 दिनों से अधिक समय तक लंबित मामलों की अपीलीय प्राधिकारी द्वारा आवधिक रूप से समीक्षा की जाएगी और मामलों को निपटाए न जाने के कारणों को लिखित रूप में दर्ज किया जाएगा ।

सं . 1/2004 युनाइटेड बैंक ऑफ इंडिया का निदेशक मंडल , बैंककारी कंपनी ( उपक्रम का अर्जन और अंतरण) अधिनियम , 1970 ( 1970 का 5) की धारा 12 की उपधारा (2) के साथ पठित धारा 19 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , भारतीय रिज़र्व बैंक से परामर्श करके और केंद्र सरकार की पूर्व संस्वीकृति से , निम्नलिखित विनियम बनाता है , जो इस प्रकार है: -
1. संक्षिप्त नाम और प्रारंभ
(1) इन विनियमों का नाम युनाइटेड बैंक ऑफ इंडिया अधिकारी- कर्मचारी (अनुशासन और अपील) ( संशोधन) विनियम , 2004 है ।
(2) ये विनियम सरकारी राजपत्र में उनके प्रकाशन की तिथि को प्रभावी होंगे ।
2. युनाइटेड बैंक ऑफ इंडिया अधिकारी- कर्मचारी (अनुशासन औरअपील) विनियम , 1976 में , विनियम 17 के लिए निम्नोक्त विनियम उस स्थान पर विकल्प होगा , जो इस प्रकार है: -
" 17 अपील: ( i ) एक अधिकारी-कर्मचारी , उस पर विनियम 4 में विनिर्दिष्ट किसी प्रकार दंड लगाए जाने पर अथवा विनिमय 12 में उल्लिखित निलंबन आदेश के विरुद्ध, चाहे तो अपील प्राधिकारी से अपील कर सकते हैं । बशर्ते कि अपील प्राधिकारी उक्त अपील को निर्धारित अवधि की समाप्ति के बाद स्वीकार करें, यदि यह पूर्णरूप से पाया जाता है कि अपीलार्थी के पास अपील को समय पर वरीयता न देने के लिए पर्याप्त कारण था ।
(2) अपीलार्थी द्वारा , उस प्राधिकारी , जिन्होंने अपील के विरूद्ध आदेश दिया है , को एक प्रति अग्रेषित करते हुए अपील को अपील प्राधिकारी के समक्ष प्रस्तुत किया जाएगा । उसमें सभी महत्वपूर्ण विवरण और दलील दी जाएगी , जिसपर अपीलार्थी भरोसा करता है, लेकिन उरामें कोई निरादरपूर्ण , असंगत भाषा नहीं होनी चाहिए तथा अपने आप में परिपूर्ण होने चाहिए ।
(3) वह प्राधिकारी , जिन्होंने की गई अपील के विरूद्ध आदेश किया है , अपीलार्थी से अपील की एक प्रतिलिपि प्राप्त करने के पश्चात्, उस पर अपनी टिप्पणी सहित एवं संबद्ध अभिलेखों के साथ उक्त अपील प्राप्त होने की तारीख से पैंतालीस दिन के भीतर अपील प्राधिकारी को अग्रेषित करेंगे ।
(4) अपील प्राधिकारी , उस प्राधिकारी जिनके आदेश के विरूद्ध अपील की गई है , से मामले के संबंध में टिप्पणी और अभिलेख प्राप्त करने के बाद यह विचार करेंगे कि क्या निलंबन आदेश/निष्कर्ष न्यायोचित है , अथवा दिए गये दंड अत्यधिक या अपर्याप्त है एवं तदनुसार यथोवित आदेश पारित करेंगे । अपील प्राधिकारी उसे पुष्टि करते हुए , ह्रास करते हुए अथवा दंड/निलंबन को अलग करके या मामले को उस प्राधिकारी के पास अग्रेषित करके जिसने दंड लगाया है अथवा ऐसे निदेश देते हुए किसी अन्य अधिकारी को भेजेंगे जो कि उक्त मामले को नजर में रखकर जैसा उचित समझें आदेश पारित करेंगे । [भाग III-खण्ड 4 3802

बशर्ते कि:
(i ) यदि बढ़ाए गए दंड , जिसे अपील प्राधिकारी ने लागू कराने के लिए प्रस्ताव किया , वह विनिमय 4 के खंड (च ) , ( छ)( , ( ज) , ( इ) और (ञ) में विनिर्दिष्ट प्रमुख दंड है और विनियम 6 में जैसा उल्लिखित उक्त मामले में पूछताछ शुरू नहीं हुई , अपील प्राधिकारी यह निदेश देंगे कि विनियम 6 के प्रावधानानुसार ऐसी पूछताछ प्रारंभ की जाए और इसके पश्चात् पूछताछ को रिकॉर्ड करने पर विचार करेंगे तथा जैसा उचित समझे आदेश पारित करेंगे ।
(ii) यदि अपील प्राधिकारी दंड बढ़ाने का निर्णय लेते हैं , लेकिन विनियम 6 के अनुसार पूछताछ हो चुकी है , तो अपील प्राधिकारी उक्त अधिकारी कर्मचारी को एक कारण बताओ नोटिस देंगे जैसा कि उस पर वर्धित दंड क्यों नहीं लागू किया जाएगा तथा इस संबंध में अधिकारी कर्मचारी द्वारा भेजे गए , यदि कोई , अभ्यावेदन प्राप्त होता है , उस पर विचार करते हुए अंतिम आदेश पारित करेंगे ।
(5) अपीलार्थी से अपील प्राप्त करने की तारीख से 90 दिन के भीतर अपील प्राधिकारी उसे निपटाएंगे । बशर्ते कि इस विनियम में विनिर्दिष्ट समय सीमा उन मामलों में लागू नहीं होगी जिनको सतर्कता की दृष्टि से देखा जाता है तथा पुलीस अथवा केन्द्रीय जांच ब्यूरो अथवा केन्द्रीय सतर्कता आयोग की सिफारिश के अनुसार, जैसा मामला है, विषयवस्तु की जांच करते हुए उस अधिकारी- कर्मचारी के विरूद्ध भारी/ सामान्य दंड देने के लिए कार्यवाही शुरू की गई हो ।
(6) अपील प्राधिकारी द्वारा 90 दिन से अधिक लंबित मामलों की समय- समय पर समीक्षा की जाए और मामलों के निपटान न हो पाने के कारणों को लिखित रूप से रिकॉर्ड किया जाए ।

जैसा कि खडकी छावनी में सफाई कर पर संशोधित दरों से कर लगाने के प्रस्ताव का मसौदा छावनी अधिनियम १९२४ (१९२४ का २ ) की धारा ६१ के अन्तर्गत, छावनी परिषद खडकी की सूचना संख्या. ७/ १/ कर/ सीटी./ पृ.सं. २३ दिनांक ८ मार्च २००४ द्वारा प्रकाशन की तिथी से ३० दिन के अन्दर आपत्तियाँ और सुझाव मांगने के लिए प्रकाशित किया गया ;
जैसा कि उपरोक्त सूचमा १० मार्च २००४ को अखबारों में प्रकाशित की गयी ;
जैसा कि परिषद मे २१ अप्रैल, २००४ को हुई अपनी बैठक में जनता से प्राप्त की गई आपत्तियों और सुझावों पर विचार किया ;
जैसाकि परिषद ने सफाई कर की दरों को संशोधित करने का निर्णय लिया ;
जैसा कि केन्द्रीय सरकार ने उपरोक्त कर के प्रारुप को अनुमोदित किया और उपरोक्त अधिनियम की धारा ६३ के तहत, छावनी परिषद खडकी को संशोधित कर लगाने की अनुमतिदी;
अतःछावनी अधिनियम १९२४ (१९२४ का २) की धारा ६० द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और भारत सरकार, रक्षा मंत्रालय के का.मि.आ. २४९४ दिनांक ११ अक्तूबर १९४७ की अधिसूचना का अधिक्रमण करते हुए, इस अधिक्रमण से पूर्व किए गए यान किए गाए कार्यकलापों को छोड़कर, छावनी परिषद खडकी , केन्द्र सरकार की पूर्व स्वीकृति से, निम्मलिखित सूची में विनिर्दिष्ट दरों से सफाई कर लागू करता है:.

New Delhi , dated the 19th July , 2004 No. 3942 - In exercise of the powers conferred by section 19, read with sub - section (2) of section 12 of the Banking Companies (Acquisition and Transfer of Undertakings ) Act , 1980 (40 of 1980), the Board of Directors of Oriental Bank of Commerce in consultation with the Reserve Bank of India and with the previous sanction of the Central Government , hereby makes the following Regulations to amend further the Oriental Bank of Commerce Officer Employees' (Discipline & Appeal) Regulations, 1982 namely: -
1. Short title and commencement : ( 1 ) These Regulations may be called Oriental Bank of Commerce Officer Employees ' (Discipline & Appeal ) (Amendment) Regulations, 2004.
(2) They shall come into force on the date of their publication in the Official Gazette .
2. In the Oriental Bank of Commerce Officer Employees ' (Discipline & Appeal) Regulations, 1982, for Regulation 17, the following regulation shall be substituted, namely:-
17. Appeal ( 1) An officer employee may prefer an appeal to the Appellate Authority within forty five days from the date of receipt of the order imposing upon him any of the penalties specified in regulation 4 or against the order of suspension referredto in Regulation 12:
Provided that the Appellate Authority may entertain the appeal after the expiry of the said period, ifit is satisfied that the appellant had sufficient cause for not preferring the appeal intime.

(2) The appeal shall be presented to the Appellate Authority with a copy being forwarded by the appellant to the authority which made the order appealed against . It shall contain all material statements and arguments on which the appellant relies but shall not contain any disrespectful or improper language, and shallbe complete in itself.
(3 ) The authority which made the order appealed against shall, on receipt of a copy of the appeal from the appellant, forward the same with its comments thereon together with the relevant records to the Appellate Authority within a period not exceeding forty five days from the date of the receipt of the appeal.
(4) The Appellate Authority shall on receipt of the comments and records of the case from the authority whose order is appealed against , consider whether the order of suspension/ findings are justified or whether the penalty is excessive or inadequate and pass appropriate orders . The Appellate Authority may pass an order confirming , enhancing, reducing or setting aside the penalty/ suspension or remitting the case to the authority which imposed the penalty or to any other authority with such directions as it may deem fit in the circumstances of the case .
Provided that :
(i) Ifthe enhanced penalty, which the Appellate Authority proposed to impose is a major penalty specified in clauses (f) , (g) , (h) . (i ) and (j ) of regulation 4 and an inquiry as provided in regulation 6 has not already been held in the case, the Appellate Authority shall direct that such an enquiry be held in accordance with the provisions of regulation 6 and thereafter consider the record of the inquiry and pass such orders as it may deem proper ;
(ii) If the Appellate Authority decides to enhance the punishment but an enquiry has already been held as provided in regulation 6, the Appellate Authority shall give a show cause notice to the officer employee as to why the enhanced penalty should not be imposed upon him and shall pass final order after taking into account the representation, if any, submitted by the officer employee.

(5) The Appellate Authority shall dispose of the appeal within a period of ninety days from the date of its receipt from the appellant:
Provided that the time limit specified in this regulation shall not apply to cases having a vigilance angle and where major/minor penalty proceedings against the officer employee have commenced on recommendations of the Police or Central Bureau of Investigation or Central Vigilance Commission, as the case may be, investigating the matter .
(6) The cases lying pending over ninety days shall be reviewed periodically by the Appellate Authorityand reasons for non-disposal of the cases shall be recorded in writing.

Resolution passed by ESI Corporation at its meeting held on 25.4.1951 conferring upon the Director General the powers of the Corporation under Regulation 105 of the ESI ( General ) Regulation , 1950 and such powers further delegated to me vide Director General's Order No.1024(6) dated 23.5.1983 , I hereby authorise Dr. (Mrs. ) L.Hazarika , PTMR to function as Medical Authority for Assan Centre Ahmedabad for the period of one year from 17.8.2003 16.8.2004 for arens to be allocated by State Medical Commissioner , Kolkata for the purpose of medical examination of the insured persons and grant of further certificates to them when the correctness of the original certificate is in doubt .

:inpursuance of powers conferred by Section 46 (2 ) of the Employees' State Insurance Act, 1948 (34 of 1948 ) , read with Regulation 95-A of the Employees ' State Insurance ( General ) Regulations , 1950 , the Director General has fixed the 1st August 2004 as the date from which the medical benefits as laid down in the said Regulation 95-A and the Uttar Pradesh Employees' State Insurance ( Medical Benefit) Rules, 1954 shall be extended to the families of insured persons in the following area in the State of Uttar Pradesh namely

S.R.O. 7/ 1 /Taxes/CT WHEREAS a draft of proposal to impose revised rates of Conservancy Tax based on Annual Rateable Value within Kirkee Cantonment was published with Kirkee Cantonment Board's Notice number 7 / 1 /Taxes/CT/P - 23 dated the 8th March, 2004 as required by Section 61 of the Cantonments Act , 1924 (2 of 1924) for inviting objections and suggestions till the expiry of a period of thirty days from the date ofpublication ofthe said Notice.
WHEREAS the said notice was published in local newspapers on 10th March 2004;
WHEREAS all the objections received from public have been duly considered by the Cantonment Board in its meeting held on 21 April, 2004;
WHEREAS the Board have decided to revise the rates of Conservancy Tax;
AND WHEREAS the Central Government has approved and confirmed the said draft of revised tax and authorised the Board to impose revised tax as required by Section-63 of the said Act;
NOW, THEREFORE, in exercise of the powers conferred by section 60 of the Cantonments Act , 1924 ( 2 of 1924 ) and in supersession of the notification of the Government of India, in the Ministry of Defence number SRO 2494 dated the 11th October 1947 in so far as it relates to the Conservancy Tax on buildings situated within Kirkee Cantonment , except as respects things done or omitted to be done before such supersession, the Cantonment Board, Kirkee with the previous sanction of the Central Government hereby imposes the Conservancy Tax at the rates specified in the table below:
