( 8 ) 70 /बी 52 और भारत सरकार के दिनांक 21 फरवरी , 1990 के असाधारण राजपत्र सं. 67 के अंतर्गत यथा संशोधित लोक ऋण अधिनियम 1944 की धारा 28 के अंतर्गत भारत सरकार द्वारा बनाए गए लोक ऋण नियमावली 1946 के नियम 18 के अनुसरण जून 2004 को समाप्त माह के लिए निम्नलिखित सूची खो गई आदि ऐसी प्रतिभूतियों के बारे में एतद्वारा विज्ञापित की जाती है, जिसके संबंध में इस बात का विश्वास करने के लिए प्रथम दृष्टया आधार माजूद है कि प्रतिभूतियां खो गयी हैं और आवेदकों का दावा न्यायोचित है । नीचे लिखे गये संबंधित दावेदारों से इतर सभी व्यक्ति जिनका प्रतिभूतियों पर किसी प्रकार का दावा हो , तत्काल महाप्रबंधक , भारतीय रिज़र्व बैंक केन्द्रीय कार्यालय , सरकारी और बैंक लेखा विभाग , केन्द्रीय ऋण प्रभाग, मुंबई -400 008 को संसूचित करें ।

सं. 666/20/ आई.आर./ 182-- बैंककारी कंपनी ( उपक्रमों का अर्जन और अन्तरण ) अधिनियम, 1980 ( 1980 का 40 ) * की धारा 12 की उप- धारा (2 ) के साथ पठित धारा 19 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, आन्ध्रा बैंक का निदेशक मंडल, भारतीय रिज़र्व बैंक से परामर्श करके और केन्द्र सरकार की पूर्व मंजूरी से, आन्ध्रा बैंक अधिकारी कर्मचारी ( अनुशासन एवं अपील ) विनियम, 1981 में संशोधन करने हेतु एतदद्वारा निम्नलिखित विनियम, बनाता है, अर्थात्:--
( 1 ) ये विनियम आन्ध्रा बैंक अधिकारी कर्मचारी ( अनुशासन एवं अपील) ( संशोधन ) विनियम, 2004 कहलाएंगे। 1. संक्षिप्त शीर्षक एवं प्रारंभ
(2 ) ये विनियम ' सरकारी राजपत्र ' में अपने प्रकाशन की तारीख से लागू होंगे ।
2. आन्ध्रा बैंक अधिकारी कर्मचारी ( अनुशासन एवं अपील ) विनियम, 1981 में विनियम 17 के लिए, निम्नलिखित विनियम प्रतिस्थापित किया जाएगा, अर्थात्: --
" 17 अपील ( 1 ) अधिकारी कर्मचारी विनियम 4 में निर्धारित अपने ऊपर लगाए गए किसी भी दण्ड या विनियम 12 में उल्लिखित निलंबन आदेश के खिलाफ, आदेश मिलने की तारीख से पैंतालीस दिनों के भीतर, अपील प्राधिकारी को अपील कर सकता है । परंतु, यदि अपील प्राधिकारी संतुष्ट हो कि अपीलकर्ता के पास समय पर अपील न कर पाने का पर्याप्त कारण है तो वह उक्त अवधि के समाप्त हो जाने के बाद भी अपील पर विचार कर सकता है ।
(2) अपीलकर्ता द्वारा अपील प्राधिकरी को अपील प्रस्तुत की जाएगी जिसकी एक प्रति उस अधिकारी को अग्रेषित की जाएगी जिसने निर्णय के विरुद्ध अपील करने का आदेश दिया था, इस अपील में पूरी विवरण सामग्री एवं बहस के वे मुद्दे होंगे जिन पर अपीलकर्ता निर्भर करता है परंतु उसमें कोई भी अपमानजनक अथवा अनुचित भाषा नहीं होगी और यह अपने आप में पूर्ण होगी ।
(3) निर्णय के विरुद्ध अपील करने का आदेश देने वाला प्राधिकारी , अपीलकर्ता से अपील की प्रति प्राप्त होने पर उसे , अपनी टिप्पणियों और संबंधित रिकॉर्ड के साथ , अपील प्राप्त होने की तारीख से पैंतालीस दिनों के भीतर अपील प्राधिकारी को अग्रेषित करेगा।
(4) निर्णय के विरुद्ध अपील करने का आदेश देने वाले प्राधिकारी से मामले पर टिप्पणियां एवं रिकार्ड प्राप्त होने पर, अपील प्राधिकारी विचार करेगा किक्यास्थगन आदेश/निष्कर्ष न्यायसंगत है या क्या दंड बहुत अधिक या अपर्याप्त है और उचित आदेश पारित करेगा, अपील प्राधिकारी दण्ड/निलंबन की पुष्टि करने, उसमें वृद्धि करने, कमी करने या उसे अलग रखने का आदेश पारित कर सकता है या मामले को, मामले की परिस्थितियों में उचित समझे गए निदेशों सहित, जिस अधिकारी ने दण्ड लगाया था उसके पास या किसी अन्य अधिकारी के पास भेज सकता है ।
परंतु
(i ) यदि बढ़ाया हुआ दण्ड, जो अपील प्राधिकारी लगाने हेतु प्रस्तावित करता है , विनियम. 4 के खंड ( च) ( छ) ( ज ) ( झ ) और ( ञ ) में उल्लिखित अनुसार, कोई बड़ा दण्ड है और विनियम 6 में दिए गए अनुसार मामले में पहले कोई जांच नहीं की गई है तो अपील प्राधिकारी निर्देश देगा कि विनियम के प्रावधानों के अनुसार मामले की ऐसी जांच की जानी चाहिए और उसके पश्चात् जांच के रिकॉर्ड पर विचार - विमर्श करेगा तथा जैसा वह उचित समझे , आदेश पारित करेगा ;
( ii ) यदि अपील प्राधिकारी दण्ड बढ़ाने का निर्णय लेता है परंतु विनियम 6 में दिए गए अनुसार जांच पहले ही की जा चुकी है, तो अपील प्राधिकारी अधिकारी कर्मचारी को कारण बताओ नोटिस जारी करेगा कि बढ़ाया हुआ दण्ड उस पर क्यों न लगाया जाए और अधिकारी कर्मचारी द्वारा प्रस्तुत अभ्यावेदन, यदिकोई हो, को ध्यान में रखते हुए अंतिम आदेश पारित करेगा ।
(5) अपील प्राधिकारी अपीलकर्ता से अपील प्राप्त होने की तारीख से 90 दिनों के भीतर उसका निपटान करेगा:
परंतु इस विनयम में उल्लिखित समय - सीमा उन मामलों में लागू नहीं होगी जो सतर्कता से सम्बंधित हों और जहां अधिकारी कर्मचारी के विरुद्ध छोटी बड़ी दण्ड कार्रवाई , मामले की जांच कर रही पुलिस या केन्द्रीय जांच ब्यूरो या केन्द्रीय सतर्कता आयोग, जैसा भी मामला हो, द्वारा की गई सिफारिशों पर आरंभकी गई हो ।
(6) 90दिनों से अधिक समय तक लंबित मामलों की अपील प्राधिकारी द्वारा आवधिक रूप से समीक्षा की जाएगी और मामलों को निपटाए न जाने के कारणों को लिखित रूप में दर्ज किया जाएगा ।

2(ख) (6) को
" (6 ) कोई आवेदक, जो अधिवर्षिता पेंशन या सवैच्छिक सेवानिवृति पेंशन या अनिवार्य सेवानिवृति पेंशन या अशक्त पेंशन या अनुकंपा भत्ता के लिए प्राधिकृत है वह इन विनिमनों के अधीन अपनी पेंशन का एक अंश संराशीकृत करने के लिए पात्र होगा । "
2 ( ख ) ( 6 ) इस प्रकार पढ़ें
" (6 ) कोई आवेदक , जो अधिवर्षिता पेंशन या स्वैच्छिक सेवानिवृति पेंशन या समयपूर्व सेवानिवृति पेंशन या अनिवार्य सेवा निवृत्ति पेंशन या अशक्त पेंशनःया अनुकंपा भत्ता के लिए प्राधिकृत है वह इन विनियमनों के अधीन अपनी पेंशन का एक अंश संराशीकृत करने के लिए पात्र होगा । "

सं. रा. आ. बैंकविनियम/2004.--राष्ट्रीय आवास बैंक अधिनियम , 1987 ( 1987 का 53 ) की धारा 55 में प्रदत्त शक्तियों का प्रयोग करते हुए भारतीय रिजर्व बैंक के पूर्व अनुमोदन से और केन्द्र सरकार के परामर्श से, निदेशक मंडल, राष्ट्रीय आवास बैंक सामान्य विनियमन , 1988 में संशोधनार्थ एतद्वारा निम्नलिखित विनियम बनाता है , अर्थात्: -- [भाग III-खण्ड 4 भारत का राजपत्र, सितम्बर 11, 2004 ( भाद्रपद 20, 1926)

1. (1) इन विनियमों को राष्ट्रीय आवास बैंक सामान्य ( संशोधन ) विनयमावली , 2004 कहा जाएगा ।
(2) वे 15 जनवरी , 2004 से लागू माने जाएंगे ।
3. राष्ट्रीय आवास बैंक सामान्य विनियमन, 1988 के विनियम 7 में,--
क. उप.विनियम ( 1 ) में " 1,000 रुपए" शब्दों और अंकों के संस्थान पर " 5,000 रुपए " शब्द एवं अंक प्रतिस्थापित किए जाएंगे । ख. उप . विनियम ( 2 ) में 500 रुपए " शब्दों और अंकों के संस्थान पर " 2,500 रुपए " शब्द एवं अंक प्रतिस्थापित किए जाएंगे ।

भारत सरकार के वित्त मंत्रालय के आर्थिक कार्य विभाग ( बैंकिंग प्रभाग ) ने अपने परिपत्र एफ. सं. 26/2/2000- बीओआई दिनांक 15 जनवरी, 2004 में बैंकों और वित्तीय संस्थानों के निदेशक मंडल में निदेशकों को निदेशक मंडल और समितियों की बैठकों में भाग लेने के लिए संदेय वर्तमान फीस की दरों को संशोधित करके क्रमशः 5,000/ - रुपए एवं 2,500/- रुपए कर दिया है । कथित पुनरीक्षण को राष्ट्रीय आवास बैंक सामान्य विनियमन, 1988 का संशोधन 15 जनवरी, 2004 से प्रभावी बनाता है ।
टिप्पणी: मुख्य विनियमावली भारत के असाधारण राजपत्र, भाग- II खंड 3 , उपखंड (ii) में का.आ. 935 ( अ ) दिनांक 8 अक्तूबर, 1988 में प्रकाशित हुई थी और का.आ. 1041 ( अ ) दिनांक 29 अगस्त, 2003 में और सा.का.नि. (अ. ), दिनांक 1 जुलाई, 2004 में संशोधित की गई थी ।

No. 666/ 20/IR/ 182- In exercise of the powers conferred by section 19 read with sub- section(2) of section 12 of the Banking Companies (Acquisition and Transfer ofUndertakings ) Act, 1980 (40 of 1980), the Board of Directors ofAndhra Bank in consultation with the Reserve Bank ofIndia and with the previous sanction of the Central Government, hereby makes the following Regulations to amend further the Andhra Bank Officer Employees' (Discipline and Appeal) Regulations , 1981, namely:-
1. Short title and commencement: ( 1 ) These Regulations may be called Andhra Bank Officer Employees' (Discipline and Appeal) (Amendment) Regulations , 2004.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Andhra Bank Officer Employees' (Discipline and Appeal) Regulations , 1981 , for Regulation 17 , the following Regulation shall be substituted, namely:-
"17Appeal: (1 ) An Officer Employee may prefer an appeal to the Appellate Authority within forty five days from the date of receipt ofthe order imposing upon him any of the penalties specified in Regulation 4. or against the order of suspension referred to in Regulation 12:
Provided that the Appellate Authority may entertain the appeal after the expiry of the said period, if it is satisfied that the appellant had sufficient cause for not preferring the appeal in time .
(2) The appeal shall be presented to the Appellate Authority with a copy being forwarded by the appellant to the authority which made the order appealed against . It shall contain all material statements and arguments on which the appellant relies but shall not contain any disrespectful or improper language , and shall be complete in itself.
(3) The authoritywhich made the order appealed against shall , on receipt of a copy of the appeal from the appellant, forward the same with its comments thereon together with the relevant records to the Appellate Authority within a period not exceeding fortyfive days from the date of the receipt of the appeal .
(4) The Appellate Authority shall on receipt of the comments and records of the case from the authority whose order is appealed against, consider whether the order of suspension/findings are justified or whether the penalty is excessive or inadequate and pass appropriate orders . The Appellate Authority may pass an order confirming , enhancing , reducing or setting aside the penalty/ suspension or remitting the case to the authority which imposed the penalty or to any other authority with such directions as it may deem fit in the circumstances of the case.
Provided that :
(i) If the enhanced penalty, which the Appellate authority proposed to impose is a major penalty specified in clauses (f) , (g) , (h) , ( i ) and (j ) ofRegulation 4 and an inquiry as provided in Regulation 6 has not already been held in the case, the Appellate Authority shall direct that such an enquiry be held in accordance with the provisions of Regulation 6 and thereafter consider the record of the inquiry and pass such orders as it may deem proper;
(i) If the Appellate Authority decides to enhance the punishment but an enquiry has already been held as provided in Regulation 6, the Appellate Authority shall give a show cause notice to the officer employee as to why the enhanced penalty should not be imposed upon him and shall pass final order after taking into account the representation, if any, submitted by the officer employee .
(5) The Appellate authority shall dispose of the appeal within a period of ninety days from the date of its receipt from the appellant:
Provided that the time limit specified in this Regulation shall not apply to cases having a vigilance angle and where major/ minor penalty proceedings against the officer employee have commenced on recommendations ofthe Police or Central Bureau of Investigation or Central Vigilance Commission, as the case may be , investigating the matter.
(6) The cases lying pending over ninety days shall be reviewed periodically by the Appellate Authority and reasons for non-disposal of the cases shall be recorded in writing .

EXPLANATORY MEMORANDUM
Government of India , Ministry of Finance , Department of Economic Affairs (Banking Division) vide its circular F. No. 26/2/ 2000-B.O.I . dated 13th January, 2004 had revised the rates of sitting fee payable to the directors on the board of banks and financial institutions for attending the Board and Committee meetings to Rs . 5000/- and Rs. 2,500/- respectively. The amendment to the National Housing Bank General Regulations , 1998 is to give effect to the said revision with effect from 15th January, 2004 .
Note. The principal regulations were published in the Gazette of India Extraordinary, Part II section 3 , sub -section ( ii ) vide S.O. 935 (E) dated 8th October, 1998 and amended vide S.O. 1041 (E) dated the 29th August, 2003 , and GSR (E), dated the Ist July, 2004.

(P&D) No. N- 15/ 13 /14/2 /2003 -P &D-In pursuance ofpowers conferred by Section 46( 2 ) of the Employees ' State InsuranceAct, 1948 (34 of 1948 ) , read with Regulation 95-A of the Employees' State Insurance ( General) Regulations , 1950 , the DirectoJeneral has fixed the 1st July, 2004 as the date from which the medical benefits as laid down in the said Regulation 95 -A م the Tamil Nadu Employees ' State Insurance ( Medical Benefit ) Rules , 1954 shall be extended to the families of insurerversons in the following area in the State of Tamil Na namely.
