सा०का० नि० 312.- भारतीय बायलर विनियम, 1950 में और संशोधन करने के लिए, जिसका प्रस्ताव केन्द्रीय बायलर बोर्ड भारतीय बायलर अधिनियम , 1923 ( 1923 का 5 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए करता है कतिपय विनियमों का निम्नलिखित मसौदा उक्त अधिनियम की धारा 31 की उपधारा ( 1 ) की अपेक्षानुसार उन सभी व्यक्तियों की सूचना के लिए एतद्वारा प्रकाशित किया जाता है जिनके इससे प्रभावित होने की संभावना है और एतद्वारा यह सूचना दी जाती है कि उक्त मसौदे पर राजपत्र, जिसमें इस अधिसूचना का प्रकाशन सम्मिलित है, को जनता के लिए उपलब्ध कराये जाने की तारीख से पैंतालीस दिन की अवधि' समाप्त होने के बाद विचार किया जायेगा ।
2. उक्त मसौदे के संबंध में इस प्रकार विनिर्दिष्ट की गयी अवधि के भीतर किसी भी व्यक्ति से प्राप्त होने वाली किसी भी आपत्ति अथवा सुझाव पर केन्द्रीय बायलर बोर्ड द्वारा विचार किया जायेगा ।
3. आपत्तियां अथवा सुझाव , यदि कोई हों, सचिव, केन्द्रीय बायलर बोर्ड, वाणिज्य और उद्योग मंत्रालय , औद्योगिक नीति और संवर्धन विभाग , उद्योग भवन, नई दिल्ली 110011 को भेजे जा सकते हैं ।
मसौदा विनियम
1. (1 ) इन विनियमों को भारतीय बायलर ( चौथा संशोधन ) विनियम, 2004 कहा जायेगा ।
(2 ) ये विनियम सरकारी राजपत्र में उनके प्रकाशन की तारीख से प्रभावी होंगे ।
2. भारतीय बायलर विनियम, 1950 ( जिसे इसके पश्चात् उक्त विनिमय कहा जायेगा ) , में विनियम 57 के खण्ड ( ख ) के लिए निम्नलिखित खंड प्रतिस्थापित किया जायेगा, नामतः :-
" (ख ) अन्य राष्ट्रीय अथवा अन्तर्राष्ट्रीय मानकों के अनुरूप वैल्डड ट्यूबें जो बायलर सुपर हीटर और हीट एक्सचेंजर ट्यूबों के रूप में प्रयोगके लिए उपयुक्त होने के कारण प्रायः प्रयोग में लाए जाने के लिए जानी जाती हैं, और जिन्हें विशिष्ट रूप से इन विनियमों द्वारा निषेध नहीं किया गया है, को भी उपयोग किया जा सकता है बशर्ते कि ऐसी ट्यूबें इन विनियमों की अपेक्षाओं को पूरी करती हों और इन विनियमों के अनुसार प्रमाणित हों।
बशर्ते यदि ट्यूबों का इन विनियमों के अन्तर्गत अपेक्षित दबाव पर हाइड्रोलिक परीक्षण नहीं किया गया है, जो निरीक्षण प्राधिकारी निर्माता/फेब्रीकेटरों की वर्कशापों अथवा प्रयोगकर्ता के परिसरों में अपेक्षित दबाव पर हाइड्रोलिक परीक्षण देखने के पश्चात् ऐसी ट्यूबों को स्वीकार कर सकता है । " 1833 [ भाग II- खण्ड 3 (i ) ]

3. उक्तविनियमों में , 151 विनियम में, खंड ( i ) में, शुरू के पैराग्राफ में, " सभी बट्ट वेल्डिड जोड़ों " शब्दों के लिए " बट्ट वेल्डिड जोड़ों जैसा कि खंड ( ज ) में निर्दिष्ट किया गया है " शब्दों को प्रतिस्थापित किया जायेगा ।
4. उक्त विनियम में, विनियम 266 में, खंड ( ख ) के लिए, निम्नलिखित खंड प्रतिस्थापित किया जाएगा, नामतः-
" (छ ) मरम्मत के पश्चात्रेडियोग्राफिकल जांच- मरम्मत किए गए सभी क्षेत्र अनुमोदित तकनीकों द्वारा रेडियोग्राफिक या रेडियोस्कोपिक जांच के अध्याधीन होंगे" ;
5. उक्त विनियमों में, 365 विनियम में " खण्ड ( ख ) में, उप खंड ( ii ) में, मद ( 2 ) के पश्चात् निम्नलिखित को शामिल किया जाएगा,नामतः - " ( iii ) अनफायरड बॉयलरों के निर्माण में जब डिसड एन्ड गर्म सतह का रूप नहीं लेते हैं तो आई एस : 2825 के अनुरूप कोल्ड स्पन डिसड्एन्डस प्रयोग किया जा सकेगा " ।
6. उक्त विनियमों में, 382 विनियम में, खंड ( क ) में, " त्रिपुरा टी आर. " शब्दों के पश्चात् " उत्तरांचल यू आर " शब्दों को शामिल किया जाएगा । 7. उक्तविनियमों में, 391 (क) विनियम में, खंड ( ख ) में, उप खंड ( ii ) में" तकनीकी सलाहकार ( बॉयलर ) " शब्दोंके लिए " मुख्य बॉयलर निरीक्षक" शब्दों को प्रतिस्थापित किया जाएगा ।
नामतः- 8. उक्तविनियमों में, 561 विनियम में, खंड ( ख ) में, उप खंड (vii ) में, टिप्पण ( 2 ) के पश्चात्निम्नलिखित को शामिल किया जाएगा, ( 3 ) सभी बट्ट वेल्डिड जोड़ों की रेडियोग्राफिक रेडियोस्कोपी अथवा अल्ट्रासोनिक परीक्षण मैगनेटिक पार्टिकल निरीक्षण अथवा लिक्विड डाई पेनिट्रेंट निरीक्षण जैसी अन्य अनुमैंदित विधियों द्वारा अविनाशक जांच की जायेगी । जब वेल्डिड संघटकों पर रेडियोग्राफी के बदले रेडियोग्राफिक परीक्षण किया जाना होगा तो निम्नलिखित अपेक्षाओं को पूरा करना होगा , अर्थात्:-
:
( 1 ) निरीक्षण प्राधिकारी के अनुमोदनार्थ एक लिखित प्रक्रिया प्रस्तुत की जायेगी और उसमें निम्नलिखित शामिल किये जायेंगे :-
(i ) पदार्थ तथा मोटाई रेंज
(ii ) उपकरण योग्यताएं
(iii ) परीक्षण वस्तु विश्लेषण योजना
(iv ) रेडियोस्कोपिक पैरामीटर
(v ) छाया प्रसंस्करण पैरामीटर
(vi ) छाया प्रदर्शन पैरामीटर
(vii ) छाया प्राप्ति अपेक्षिताएं
(viii) स्वीकृति-अस्वीकृति मानदंड कोड संदर्भ
(ix) कार्य निष्पादन मूल्यांकन
(x) आपरेटर की पहचान
(2 ) रेडियोस्कोपिक छाया की गुणवत्ता बढ़ाने हेतु एक इमेज प्रोसेसर की सहायता से प्रणाली को समर्थन दिया जायेगा और प्रणाली कार्य- निष्पादन गुणवत्ता इन्हें दर्शायेगा: -
(i) 3 की पतला खंड वैषम्य संवेदनशीलता
(ii) 2 की मोटा खंड वैषम्य संवेदनशीलता
(iii) प्रति एम एम 3 लाइन जोड़ा का स्थानक विभेदन

[PART II-SEC. 3 (i ) ] ( iv ) आई क्यूआई संवेदनशीलता- जब तार के आई क्यूआई का प्रयोग किया जाए तब जोड़ की मोटाई का 2 तार के व्यास धुरी प्रणाली की न्यूनतम संवेदनशीलता की धुरी की ओर उन्मुख होगी ।
( 3 ) प्रतिनिधित्व वाले जोड़ के भाग विशेष के साथ सह - संबद्धिकरण हेतु रेडियोस्कोपों को उचित रूप से चिन्हित किया जायेगा । (4) निरीक्षणकारी प्राधिकारी द्वारा यथा विनिर्दिष्ट रेडियोस्कोपिक जांच की तारीख के बाद पर्याप्त अवधि के लिए रेडियोस्कोपिक जांच आंकड़ों का निर्माता के संयंत्र में वीडियोटेप, मैग्नेटिक डिस्क अथवा आप्टिकल डिस्क में रिकार्ड और भंडारण किया जायेगा । रिकार्ड रिटेंशन अवधि में किसी भी समय दक्ष रेडियोस्कोपिक जांच रिकार्ड प्रत्यावर्तन उपलब्ध कराया जाएगा और यह परीक्षण वस्तु के लिए अनुरेखनीय होगा ।
(5 ) जब रेडियोस्कोपिक जांच के फलस्वरूप मरम्मत कर दी जाती है तो मरम्मत की कामयाबी का मूल्यांकन करने के लिए उसी रेडियोस्कोपिक तकनीक का प्रयोग करके मरम्मत किये गये भागों की पुनः जांच की जायेगी ।
( 6 ) रेडियोस्कोप जांच संबंधी आंकड़ों की उचित व्याख्या करने में सहायता पहुंचाने के लिए प्रयोग में लायी गयी तकनीक के ब्यौरे आंकड़ों के साथ दिए जायेंगे । कम से कम उक्त सूचना में अनुमोदित प्रक्रिया संबंधी अपेक्षाएं और प्रणाली निष्पादन के परीक्षण संबंधी आंकड़े सम्मिलित होंगे ।
9. उक्तविनियम में, प्रपत्र 4 में, निम्नलिखित टिप्पण को अंत में शामिल किया जाएगा, नामतः
" टिप्पण : जहां स्टील का विनिर्माण एक निर्माता द्वारा होता है, जो एक सुप्रसिद्ध स्टील निर्माता के रूप में नहीं जाना जाता, उसका परीक्षण प्रमाण-पत्र निरीक्षक अधिकारी द्वारा हस्ताक्षरित होगा " ।

G.S.R. 312. The followingdraft of certain regulations further to amend the Indian Boiler Regulations , 1950 , which the Central Boilers Board proposes to make in exercise of the powers conferredby Section 28 of the Indian Boilers Act, 1923 (5 of 1923 ) , is hereby published, as required by Sub - section ( 1 ) of Section 31 of the said Act, for the information ofall persons likely to be affected thereby and notice is hereby given that the said draft will be taken into consideration after the expiry of a period of forty - five days from the date the Gazette containing the publication of this notification is made available to the public .

2. Any objections or suggestions which may be received from any person with respect to the said draft within the period so specified will be considered by the Central Boilers Board.
3. Objections or suggessions , if any, may be addressed to the Secretary , Central Boilers Board, Ministry of Commerce and Industry ( Department of Industrial Policy and Promotion), Udyog Bhavan , New Delhi- 110011 .
DRAFT REGULATIONS
1. (1) These regulations may be called the Indian Boiler (Fourth Amendment) Regulations , 2004 .
(2) They shall come into force after final publication in the Official Gazette .
2. In the Indian Boiler Regulations , 1950 ( hereinafter referred to as the said regulations ) , in regulation 57, for clause (b), the following clause shall be substituted, namely :-
"(b) The welded tubes conforming to other national or international standard which are known to be commonly used as being suitable for use as boiler , superheater or heat exchanger tubes and not specifically prohibited by these regulations can also be used provided such tubes satisfy the requirements of these regulations and are certified as per these regulations :
Provided that if the tubes are not hydraulically testedat the pressure required under this regulations , the Inspecting Autlıority may accept such tubes after witnessing hydraulic test at the required pressure at the maker's / fabricator's works or user's promises " ;
3. In the said regulations , in regulation 151 , in clause ( i), in the opening paragraph, for the words " All butt welded joints" , the words " Butt welded joints as indicated in clause (h ) " shall be substituted.
4. In the said regulations , in regulation 266, for clause (b) , the following clause shall be substituted, namely :

[PART II-SEC. 3(i)] "(g) Radiographical Examination after Repairs-All repaired areas shall be subjected to Radiographic or Radio- scopic Examination by the approved techniques ." ;
5. In the said regulations , in regulation 365 " in clause (b ) , in sub- clause (2) , after item ( ii) , the following shall be inserted, namely:
"(iii) In the construction of unfired boilers when the dished ends do not form of the heating surface , cold spun dished ends conforming to IS: 2825 may be used . "
6. In the said regulations , in regulation 382, in clause (a) , after the words " Tripura UR" shall be inserted. words " Uttaranchal TR" , the 7. In the said regulations , in regulation 391A, in clause (b ) , in sub - clause ( ii ) , for the words , " Technical Adviser (Boilers)" , the words , " Chief Inspector of Boilers " shall be substituted.
8. Inthe said regulations , in regulation 561 , in clause (b), in sub- clause (viii ) , after Note (2) , the following shall be inserted, namely:
"(3) All butt welded joints shall be subjected to non - destructive examination by radiographic , radioscopy or other approved methods such as ultrasonic testing , magnetic particle inspection or liquid dye penetrant inspection . When radioscopic examination is to be performed in lieu of radiography on welded components , the following requirements shall bemet, namely
(1) A written procedure shall be submitted for approval to the Inspecting Authority which shall contain the following:---
(1) material and the thickness range;
(ii) equipment qualifications ;
(iii) test object scan plan;
(iv) radioscopic parameters ;
(v) image processing parameters ;
(vi) image display parameters ;
(vii) image archiving requirements ;
(viii) accept -reject criteria (Code reference) ;
(ix) performance evaluation ;
(x) operator identification .
(2) The system shall be aided with an image processor to enhance the quality of the radioscopic images and system performance quality shall exhibit-
a thin section contrast sensitivity of 3 %;
(ii) athick section contrast sensitivity of 2%;
(iii) a spatial resolution of 3 line pairs per mm;
(iv) IQI sensitivity-2% of the joint thickness when wire IQI's are to be used, the wire diameter axis shall be oriented along the axis of the least sensitivity of the system.
(3) Radioscopes are to be properly marked to co - relate with particular part ofjoint represented.
(4) The radioscopic examination data shall be recorded and stored on videotape , magnetic disk or optical disk at the maker's plant for a sufficient period after the date of radioscopic examination as specified by the Inspecting Authority, efficient radioscopic examination record recall shall be made available at any time over the record retention period and shall be traceable to the test objects .
(5) When.repair has been performed as a result of radioscopic examination , the repaired areas shall be re-examined using the same radioscopic technique to evaluate the effectiveness of the repair.

(6) To aid in proper interpretation of the radioscopic examination data, the details of the technique used shall accompany the data . As a minimum , the information shall include the approved procedure requirements and system performance test data . ";
9. In the said regulation , in Form IV, the following Note shall be inserted at the end, namely:
"Note : Where the steel is manufactured by a maker, who is not recognised as a well known Steel Maker , the certificate of test shall be signed by the Inspecting Authority. "

सा.का.नि. 313.- केन्द्रीय सरकार, रेल संरक्षण बल अधिनियम , 1957 ( 1957 का 23 ) की धारा 21 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, रेल संरक्षण बल नियम, 1987 का और संशोधन करने के लिए निम्नलिखित नियम बनाती है, अर्थात्:-
1. ( 1 ) इन नियमों का संक्षिप्त नाम रेल संरक्षण बल ( संशोधन ) नियम, 2004 है ।
(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. रेल संरक्षण बल नियम, 1987 के अध्याय 2 में, " रेल संरक्षण विशेष बल " शीर्ष के अधीन पैरा 7 के सामने प्रविष्टियों के नीचे निम्नलिखित अंत में अंतःस्थापित किया जाएगा, अर्थात्: -
" 7.6 बटालियनों में आर्मररों जैसे प्रशिक्षित वायरलेस कार्मिक होंगे । ये पद काडर बाह्य पद होंगे । पदों की संख्या वह होगी जो समय-समय पर विनिश्चित की जाए । ये पद इस संबंध में समय- समय पर महानिदेशक/रेल सुरक्षा बल द्वारा जारी किए गए निदेशों द्वारा शासित होंगे । " 3. रेल संरक्षण बल नियम, 1987 की अनुसूची 1 में मद II के अधीन निम्नलिखित अंत में अंतःस्थापित किया जाएगा , अर्थात्: - " 39. निरीक्षक/वायरलेस
40. उपनिरीक्षक/वायरलेस
41. सहायक उपनिरीक्षक/वायरलेस
42. हेड कांस्टेबल/वायरलेस
43. कांस्टेबल/वायरलेस" ।

G.S.R. 313. In exercise of the powers conferred by Section 21 of the Railway Protection Force Act , 1957 (23 of 1957) , the Central Government hereby makes the following rules further to amend the Railway Protection Force Rules, 1987, namely :-
1. ( 1) These rules may be called the Railway Protection Force ( Amendment) Rules , 2004 .
(2) They shall come into force on the date of their publication in the Official Gazette .
2. In the Railway Protection Force Rules , 1987 , in Chapter 11, under heading "Railway Protection Special Force" , below the entries against para 7, the following shall be inserted at the end , namely :-
" 7.6 Battalions will have trained wireless personnel like Armourers . These posts will be ex- cadre . The number of posts will be as decided from time to time . These posts will be governed by the Directives issued in this regard by DG/RPF from time to time ."
3. In the Railway Protection Force Rules , 1987 in Schedule I , under item II , the following shall be inserted at the end , namely:-
"39. Inspector/ Wireless
40. Sub - Inspector/Wireless
41. Asstt . Sub - Inspector/Wireless
42.Head Constable/ Wireless

[PART II-SEC . 3 ( i)] अधिक्रमण से पूर्व किया गया है या करने से लोप किया गया है , कृषि मंत्रालय, ( कृषि और सहकारिता विभाग ) के अधीन अखिल भारतीय मृदा तथा भूमि उपयोग सर्वेक्षण संगठन में ज्येष्ठ मृदा सर्वेक्षण अधिकारी के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:-
1. संक्षिप्त नाम और प्रारम्भ. ( 1 ) इन नियमों का संक्षिप्त नाम अखिल भारतीय मृदा तथा भूमि उपयोग सर्वेक्षण संगठन ( ज्येष्ठ मृदा सर्वेक्षण अधिकारी ) भर्ती नियम, 2004 है ।
(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे । 2. पद संख्या, वर्गीकरण और वेतनमानः उक्त पद की संख्या, उसका वर्गीकरण और उसका वेतनमान वह होगा, जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ ( 2 ) से स्तंभ ( 4 ) में विनिर्दिष्ट हैं । 3. भर्ती की पद्धति, आयु सीमा , अर्हताएं आदि.- उक्त पद पर भर्ती की पद्धति, आयु- सीमा और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ( 5 ) से स्तंभ ( 14 ) में विनिर्दिष्ट हैं । 4. निरर्हता.- वह व्यक्ति,-
(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या
(ख) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है ,
उक्त पद पर नियुक्ति का पात्र नहीं होगा :
परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।
5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके, इन नियमों के किसी उपबन्ध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी । 6. व्यावृत्ति.- इन नियमों की कोई बात, ऐसे आरक्षणों, आयु सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्गों के व्यक्तियों के लिए उपबन्ध करना अपेक्षित है ।

( ii ) मृदा सर्वेक्षण कार्य में कम से कम दस वर्ष का अनुभव ।
टिप्पण: आयु-सीमाअवधारित करने लिए निर्णायक तारीख भारत में अभ्यर्थियों से आवेदन प्राप्त करने के लिए नियत की गई अंतिम तारीख होगी । ( न कि वह अंतिम तारीख जो असम , मेघालय, अरुणाचल प्रदेश , मिजोरम, मणिपुर , नागालैंड, त्रिपुरा, सिक्किम, जम्मू- कश्मीर राज्य के लद्दाख खंड, हिमाचल प्रदेश के लाहौल और स्पीति जिले तथा चम्बा जिले के पांगी उपखंड, अंदमान और निकोबार द्वीप या लक्षद्वीप के अभ्यर्थियों के लिए विहित की गई है । )
टिप्पण 1 : अर्हताएं, अन्यथा सुअर्हित अभ्यर्थियों की दशा में संघ लोक सेवा आयोग के विवेकानुसार शिथिल कीजा सकती है । टिप्पण 2: अनुभव संबंधी अर्हता (अर्हताएं ) संघ लोक सेवा आयोग केविवेकानुसार अनुसूचित जातियों और अनुसूचित जनजातियों के अभ्यर्थियों की दशा में तब शिथिल की जा सकती हैं जब चयन के किसी प्रक्रम पर संघ लोक सेवा आयोग की यह राय है कि उनके लिए आरक्षित रिक्तियों को भरने के लिए अपेक्षित अनुभव रखने वाले उन समुदायों के अभ्यर्थियों के पर्याप्त संख्या में उपलब्ध होने कीसम्भवना नहींहै ।
वांछनीय : हवाई फोटो का निर्वचन करने या सर्वेक्षण सहित मृदा संरक्षण कीकिसी अन्य शाखा में योजना और अनुरक्षण में अनुभव या उच्च प्रशिक्षण ।
भर्ती की पद्धति: भर्ती सीधे होगी , या प्रोन्नति
प्रोन्नति/प्रतिनियुक्ति/आमेलन द्वारा भर्ती की दशा में वे श्रेणियां जिनसे प्रोन्नति/ प्रतिनियुक्ति/आमेलन किया जाएगा
द्वारा या प्रतिनियुक्ति/आमेलन द्वारा तथा विभिन्न पद्धतियों द्वारा भरे जाने वाले पदों की प्रतिशतता

प्रोन्नतिः
ऐसे मृदा सर्वेक्षण अधिकारी जिन्होंने 10000-15200 रुपए के वेतनमान में इस श्रेणी में पांच वर्ष की नियमित सेवा की है ।
प्रोन्नति जिसके न हो सकने पर प्रतिनियुक्ति द्वारा ( जिसके अंतर्गत अल्पकालिक संविदा भी शामिल है ) , दोनों के न हो सकने पर सीधी भर्ती द्वारा ।
टिप्पण: जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में जिन्होंने अपनी अर्हक ( पात्रता ) सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो जहां उनके ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा परंतु यह तब जब कि उसके द्वारा की गई ऐसी अर्हक/पात्रता सेवा, अपेक्षित अर्हक (पात्रता) सेवा के आधे से अधिक से या दो वर्ष से, इनमें से जो भी कम हो , कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित उनकी उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली है , जिन्होंने ऐसी अर्हक ( पात्रता ) सेवा पहले ही पूरी कर ली है ।
प्रतिनियुक्ति ( जिसके अंतर्गत अल्पकालिक संविदा भी है ) :-
केन्द्रीय सरकार या राज्य सरकार या संघ राज्यक्षेत्र या कृषि विश्वविद्यालय , भारतीय कृषि अनुसंधान परिषद् और अन्य स्वशासी संस्थाओं के अधीन ऐसे अधिकारी: -
(क) ( i ) जो मूल काडर या विभाग में नियमित आधार पर सदृश पद धारण किए हुए हैं ; या 1

(ii ) जिन्होंने मूल काडर या विभाग में 10000-15200 रुपए या समतुल्य के वेतनमान में नियमित आधार पर नियुक्ति के पश्चात् पांच वर्ष तक सेवा की है ; और
(ख ) जिनके पास सीधी भर्ती किए जाने वाले व्यक्तियों के लिए स्तंभ 8 में विहित शैक्षिक अर्हताएं और अनुभव हैं ।
(पोषक प्रवर्ग के ऐसे विभागीय अधिकारी , जो प्रोन्नति की सीधी पंक्ति में हैं, प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे । इसी प्रकार प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिएविचार किए जाने के पात्र नहीं होंगे । प्रतिनियुक्ति/संविदा की अवधि, ( जिसके अंतर्गत अल्पकालिक संविदा भी है ) केन्द्रीय सरकार के उसी या किसी अन्य संगठन/ विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवधि है, साधारणतया चार वर्ष से अधिक
नहीं होगी । प्रतिनियुक्ति पर नियक्ति ( जिसके अन्तर्गत अल्पकालिक संविदा भी है ) के लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी । यदिविभागीय प्रोन्नति समिति है , तो उसकी संरचना
भर्ती करने में किन परिस्थितियों में संघ लोक सेवा आयोग से परामर्श किया जाएगा

In exercise of the powers conferred by the proviso to article 309 of the Constitution , and in supersession ofthe All India Soil and Land Use Survey Organization (Senior Soil Survey Officer) Recruitment Rules , 1977, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Senior Soil Survey Officer in the All India Soil and Land Use Survey Organization under the Ministry of Agriculture (Department of Agriculture and Cooperation ) , namely :
1. Short title and commencement. ( 1 ) These rules may be called the All India Soil and Land Use Survey Organization ( Senior Soil Survey Officer) Recruitment Rules, 2004.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Number of posts , classification and scale of pay. The number of the said posts , its classification and the scale of pay attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules .
3. Method of recruitment , age limit and other qualifications etc. The method of recruitment to the said post, age limit, qualifications and other matters relating thereto shall be as specified in columns (5) to ( 14) of the said Schedule .
4. Disqualification . No person ,
(a) who has entered into or contracted a marriage with a person having a spouse living ; or
(b) who , having a spouse living, has entered into or contracted a marriage with any person, 1843

shall be eligible for appointmentto the said posts :
Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operation of this rule.
5. Power to relax .-Where the Central Government is of opinion that it is necessary and expedient so to do, it may, by order, for reasons to be recorded in writing and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.
6. Saving. Nothing in these rules shall affect reservations, relaxation of age - limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , Other Backward Classes , Ex - Servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

Note 1. Qualifications are relaxable at the discretion of the Union Public Service Commission in case of candidates otherwise well qualified .
Note 2. The qualification (s ) regarding experience is ( are ) relaxable at the discretion of the Union Public Service Commission in case of candidates belonging to the Scheduled Castes and the Scheduled Tribes . If at any stage of selection the Union Public Service Commission is of the opinion that sufficient number of candidates from these communities possessing the requisite experience are not likely to be available to fill up the posts reserved for them.

सा.का.नि. 315.- राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, कृषि मंत्रालय ( पशुपालन और डेयरी विभाग ) में केयरटेकर के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्: -
1. संक्षिप्त नाम और प्रारम्भ. ( i ) इन नियमों का संक्षिप्त नाम पशुपालन और डेयरी विभाग ( केयरटेकर ) भर्ती नियम, 2004 है । ( ii ) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. पद संख्या, वर्गीकरण और वेतनमान. उक्त पद की संख्या, उसका वर्गीकरण और उसका वेतनमान वह होगा , जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ ( 2 ) से स्तंभ ( 4 ) में विनिर्दिष्ट हैं ।
3. भर्ती की पद्धति , आयु- सीमा तथा अन्यअर्हताएं आदि . उक्त पद पर भर्ती की पद्धति, आयु सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ( 5 ) से स्तंभ ( 14 ) में विनिर्दिष्ट हैं ।

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।
5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके, इन नियमों के किसी उपबन्ध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी । 6. व्यावृत्ति.- इन नियमों की कोई भी बात, ऐसे आरक्षणों, आयु सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों, और अन्य विशेष प्रवर्गों के व्यक्तियों के लिए उपबन्ध करना अपेक्षित है ।

G.S.R..-In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules regulating the method of recruitment to the post of Caretaker in the Ministry of Agriculture (Department of Animal Husbandry and Dairing) namely :-
1. Short title and commencement. ( 1 ) These rules may be called the Department of Animal Husbandry and Dairying (Caretaker) Recruitment Rules, 2004.
(2) They shall come into force on the date of their publication in the Official Gazette .
2. Number of posts , its classification and scale of pay. The number of the said post, its classification and the scale ofpay attached thereto shall be as specified in columns (2 ) to (4 ) ofthe Schedule annexed to these rules .
3. Method of recruitment, age limit, qualifications , etc. The method of recruitment, age limit , qualifications and other matters relating to the said post shall be as specified in columns (5) to ( 14) of the Schedule aforesaid .
4. Disqualification . No person ,
(a) who has entered into or contracted a marriage with a person having a spouse living ; or
(b) who , having a spouse living , has entered into or contracted a marriage with any person,
shall be eligible for appointment to the said post :
Provided that the Central Government may , if satisfied that such marriage is permissible under the personal law applicable to, such person and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operation of this rule .

6. Saving. Whereas certain draft rules further to amend the Employees ' State Insurance (Central ) Rules , 1950 were published , as required under Sub - section (i) of Section 95 of the Employees ' State Insurance Act, 1948 (34 of 1948) in the notification of the Government of India in the Ministry of Labour No. GSR 212 dated the 11th June , 2004 in the Gazette of India, Part II , Section 3 Sub - section (i) dated the 19th June , 2004 for inviting objections or suggestions from any persons likely to be affected thereby till the expiry of the period of fortyfive days from the date on which the copies of the Gazette of India, in which the said notification was published , were made available to the public;
And whereas , the copies of the said Gazette were made available to the public on 20th June , 2004 .
Andwhereas , objections and suggestions received from persons likely to be affected thereby have been considered by the Government .
Now therefore , in exercise of the powers conferred by Section 95 of the said Act, the Central Government, after consultation with the Employees ' State Insurance Corporation , hereby makes the following rules further to amend the Employees' State Insurance (Central ) Rules, 1950 , namely:---
1. (a) These rules may be called the Employees ' State Insurance (Central ) ( 1st Amendment) Rules , 2004.
(b) They shall come into force with effect of from 1st October , 2004 .
2. In the Employees ' State Insurance (Central ) Rules , the present text of Rule 51 shall be substituted by the following:--
"51. Rate of Contribution -The amount of contribution for a wage period shall be in respect of ---
(a) employer's contribution , a sum (rounded to the next higher rupee ) equal to four and three fourth per cent of the wages payable to an employee ; and
(b) employer's contribution , a sum (rounded to the next higher rupee ) equal to one and three fourth per cent of the wages payable to an employee" .
