का.नि.आ. 133.-केन्द्रीय सरकार, तटरक्षक अधिनियम , 1978 ( 1978 का 30 ) की धारा 123 की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, तटरक्षक ( ज्येष्ठता और प्रोन्नति ) नियम , 1987 में संशोधन करने के लिए निम्नलिखित नियम बनाती है, अर्थात्: - 1. ( 1 ) इन नियमों का संक्षिप्त नाम तटरक्षक ( ज्येष्ठता और प्रोन्नति ) ( संशोधन ) नियम, 2004 है ।
( 2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. तटरक्षक ( ज्येष्ठता और प्रोन्नति ) नियम , 1987 ( जिसे इसमें इसके पश्चात् उक्त नियम कहा गया है ) के नियम 5 में,- (i) उपनियम ( 1 ) में खंड ( ख ) से खंड ( घ ) के स्थान पर निम्नलिखित रखा जाएगा, अर्थात्: -
" ( ख) कमांडेंट के रैंक में स्थायी रूप से आमेलित अधिकारियों की ज्येष्ठता, उस तारीख से, जो भारतीय नौसेना में अधिष्ठायी कमांडर के रैंक में की गई पूरी सेवा को ध्यान में रखते हुए नियत की हो , अवधारित की जाएगी ।
(ग ) कमांडेंट ( कनिष्ठ श्रेणी ) के रैंक में स्थायी रूप से आमेलित अधिकारियों की ज्येष्ठता भारतीय नौसेना में दस वर्ष कीकमीशन्ड सेवा पूरी होने की तारीख से अवधारित की जाएगी ।
(घ) उप कमांडेंट के रैंक में स्थायी रूप से आमेलित अधिकारियों की ज्येष्ठता भारतीय नौसेना में पांच वर्ष की कमीशन्ड सेवा पूरी होने की तारीख से अवधारित की जाएगी ।
(ङ) सहायक कमांडेंट के रैंक में स्थायी रूप से आमेलित अधिकारियों की ज्येष्ठता भारतीय नौसेना में कमीशन प्राप्त करने की तारीख से अवधारित की जाएगी । "
( ii ) उपनियम (2 ) में खंड ( ग ) और खंड ( घ ) के स्थान पर निम्नलिखित खंड रखे जाएंगे , अर्थात्: -
" ( ग ) कमांडेंट ( कनिष्ठ श्रेणी ):- भारतीय नौसेना में दस वर्ष की कमीशन्ड सेवा के पूरा होने की तारीख । (घ) उप कमांडेंट: भारतीय नौसेना में पांच वर्ष की कमीशन्ड सेवा के पूरा होने की तारीख ।
(ङ) सहायक कमांडेंट: भारतीय नौसेना में. कमीशन प्राप्त करने की तारीख । "
3. उक्त नियमों के नियम 6 के स्थान पर निम्नलिखित नियम रखा जाएगा , अर्थात्:-
" 6. प्रोन्नति के लिए प्राधिकारी अधिकारियों की प्रोन्नति के लिए प्राधिकारी केन्द्रीय सरकार या जहां केन्द्रीय सरकार द्वारा महानिदेशक को इस प्रकार सशक्त किया गया है, वहां महानिदेशक होगा । "
4. उक्त नियमों के नियम 7 में, उपनियम ( 1 ) से उपनियम ( 3 ) के स्थान पर निम्नलिखित उपनियम रखे जाएंगे , अर्थात्:-
" ( 1 ) अधिकारी अपनी उन शाखाओं और काडर में जिनके वे हैं, वित्तीय वर्ष के दौरान होने वाली रिक्तियों के विरुद्ध प्रोन्नति के लिए पात्र होंगे ।
( 2 ) उप कमांडेंट और कमांडेंट ( कनिष्ठ श्रेणी ) के रैंक में अधिकारियों की प्रोन्नति, उपयुक्तता और इन नियमों के सुसंगत उपाबंध में अंतर्विष्ट अपेक्षित अर्हताओं के अधीन रहते हुए, उनकी ज्येष्ठता के आधार पर की जाएगी ।
( 3 ) कमांडेंट और उससे ऊपर के रैंक में अधिकारियों की प्रोन्नत्ति, अपने उस काडर और शाखा में जिनके वे हैं के पात्र अधिकारियों के समूह के भीतर गुणागुण आधारित चयन और इन नियमों के सुसंगत उपाबंध में अंतर्विष्ट अपेक्षित अर्हताओं के अधीन रहते हुए की जाएगी। " [ भाग II-खण्ड 4]

5. उक्त नियमों के नियम 10 के उपनियम ( 2 ) के खंड (क) में उप खंड ( ii ) से उप खंड ( iv ) के स्थान पर निम्नलिखित उप खंड रखे जाएंगे , अर्थात्: -
" ( ii ) उन उप कमांडेंटों की दशा में जो भूतपूर्व नौसेना अधिकारी है , उनकी सम्पूर्ण कमीशन्ड सेवा की कमांडेंट ( कनिष्ठ श्रेणी ) के रैंक में प्रोन्नति के लिए गणना की जाएगी । (iii ) उन कमांडेंटों ( कनिष्ठ श्रेणी ) की दशा में, जो भूतपूर्व नौसेना अधिकारी हैं, उनकी सम्पूर्ण कमीशन्ड सेवा की कमांडेंट के रैंक में प्रोन्नति के लिए गणना की जाएगी ।
(iv ) उन कमांडेंटों की दशा में, जो भूतपूर्व नौसेना अधिकारी हैं, कमांडर के रैंक में उनकी सम्पूर्ण पूर्ववर्ती सेवा, यदि कोई हो , की उप महानिरीक्षक के रैंक में प्रान्नति के लिए गणना की जाएगी ।
(v ) उन उप महानिरीक्षकों की दशा में, जो भूतपूर्व नौसेना अधिकारी हैं, भारतीय नौसेना में कैप्टन के रैंक में पूर्ववर्ती सेवा, महानिरीक्षक केरैंक में प्रान्नति के लिए पूर्णतः गणना में ली जाएगी ।"
6. उक्त नियमों के उपाबंध 1 से 3 , के स्थान पर निम्नलिखित उपाबंध रखे जाएंगे , अर्थात्: -

S.R.O. 133. In exercise of the powers conferred by sub - section ( 1 ) of Section 123 of the Coast Guard Act, 1978 (30 of 1978 ) , the Central Government hereby makes the following rules further to amend the Coast Guard (Seniority and Promotion) Rules, 1987, namely :-
1. (1) These rules may be called the Coast Guard (Seniority and Promotion) (Amendment) Rules, 2004.
(2).They shall come into force on the date of their publication in the Official Gazette .
2. In rule 5 of the Coast Guard (Seniority and Promotion ) Rules, 1987 (hereinafter referred to as said rules) ,- (1) in sub rule ( 1 ) for clauses (b ) to (d), the following shall be substituted, namely: ---
"(b) Seniority of permanently absorbed officers in the rank of Commandant shall be determined from the date arrived at after taking into consideration full service in the rank of substantive Commander in the Indian Navy .
(c) Seniority ofpermanently absorbed officers in the rank of Commandant (Junior Grade) shall be determined from the date of completion of ten years ' commissioned service in the Indian Navy .
(d) Seniority ofpermanently absorbed officers in the rank ofDeputy Commandant shall be determined from the date of completion offive years ' commissioned service in the Indian Navy .
(e) Seniority of permanently absorbed officers in the rank of Assistant Commandant shali be determinedfrom the date of commissioned in the Indian Navy.";
(ii) in sub rule (2) , for clauses (c) and ( d) the following clauses shall be substituted, namely :-
"(c) Commandant ( Junior Grade).-Date of completion of ten years commissioned service in the IndianNavy.
(d) Deputy Commandant . Date of completion of five years commissioned service in the Indian Navy.
(e) Assistant Commandant. Date of commissioned in the Indian Navy . "
3. For rule 6 of the said rules, the following rule shall be substituted namely: ----
"6. Authority for promotion. The authority for promotion of officers shall be the Central Government or the Director General where so empowered by the Central government. "
4. In rule 7 of the said rules , for sub rules ( 1 ) to (3 ) , the following sub - rules shall be substituted, namely :----
"( 1) Officers shall be eligible for promotion against vacancies occurring during a financial year in the respective branches and cadres to which they belong.
(2) The promotion of officers to the ranks of Deputy Commandant and Commandant ( Junior Grade ) shall be made on the basis of their seniority subject to fitness and possession of requisite qualifications contained in the relevant Annexure to these rules.
(3) The promotion of an officer to the rank of Commandant and above shall be made on relative merit based selection within the eligible batch of officers of his cadre and branch to which he belongs and subject to possession of requisite qualifications contained in the relevant Annexure to these rules ."
5. Inrule 10 of the said rules , in sub rules (2) , in clause (a) , for sub -clauses (ii ) to (iv) , the following sub -clauses shall be substituted, namely : -
"( ii) In the case of Deputy Commandants who are ex - Naval officers , their entire commissioned service shall be counted for promotion to the rank of Commandant ( Junior Grade) .
(iii) In the case of Commandants (Junior Grade ) who are ex - Naval officers , their entire commissioned service shall be counted for promotion to the rank of Commandant .
(iv) In the case of Commandants who are ex- Naval officers , their entire previous service , if any , in the rank of Commander shall be counted for promotion to the rank of Deputy Inspector General .
(v) In the case of Deputy Inspector Generals , who are ex - Naval officers , previous service in the rank of Captain, Indian Navy , shall be counted in full for promotion to the rank of Inspector General . "
