आ. अ. 57.-लोक प्रतिनिधित्व अधिनियम, 1950 ( 1950 का 43 ) की धारा 13 क की उपधारा ( 1 ) और ( 2 ) के अनुसरण में, निर्वाचन आयोग असम राज्य में जिला निर्वाचन अधिकारियों की नियुक्ति के सम्बन्ध में अपनी अधिसूचना सं. 508/असम/92 तारीख 30 जुलाई , 1992 में एतद्वारा निम्नलिखित और संशोधन करता है , अर्थात्:-
उक्त अधिसूचना से संलग्न सारणी के स्तम्भ ( 1 ) , ( 2 ) और ( 3 ) में, मद सं. 13 दारंग के सामने विद्यमान प्रविष्टियों के स्थान पर निम्नलिखित प्रविष्टियां रखी जाएंगी:-

O.N. 57. In pursuance of Sub- sections ( 1) and (2) of Section 13 A of the Representation of the People Act, 1950, (43 of 1950) , the Election Commission, hereby, makes the following further amendments to its Notification No. 508/AS/92, dated 30th July , 1992, relating to the appointment of District Election Officers in the State of Assam, namely:-
In columns ( 1 ) , (2) and (3) of the Table appended to the said Notification, the existing entries against item No. 13.. Darrang shall be substituted by the following entries :---

आ. अ. 58.- यतः श्री जागीर सिंह निवासी गांव बडाला खुर्द, पो . ओ. वडाला कलां, तहसील और जिला कपूरथला, पंजाब जो 2002 में हुए पंजाब विधान सभा के लिए साधारण निर्वाचन में अभ्यर्थी थे, को , लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10 क के अधीन निर्वाचन आयोग के 7 अक्तूबर, 2002 के आदेश सं. 76/पंजाब-वि.स. /2002 ( 1 ) द्वारा भारत निर्वाचन आयोग द्वारा निरर्हित कर दिया गया था क्योंकि वे उक्त अधिनियम और उसके अधीन बनाए गए नियमों और आदेशों द्वारा अपेक्षित अपने निर्वाचन व्ययों का लेखा दाखिल करने में असफल रहे थे; और यतः , उक्त श्री जागीर सिंह ने बाद में अपना लेखा प्रस्तुत कर दिया था और विधि द्वारा यथा अपेक्षित निर्वाचन व्ययों का लेखा पहले दाखिल करने में असफल रहने के कारण बताते हुए अपने ऊपर अध्यारोपित निरर्हता हट्टाने के लिए भारत निर्वाचन आयोग के समक्ष एक याचिका प्रस्तुत की थी; और यतः , उक्त याचिका पर विचार करने के बाद तथा मामले के सभी सारवान तथ्यों को ध्यान में रखते हुए, निर्वाचन आयोग ने , लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 11 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए उक्त अधिनियम की धारा 10 क के अधीन उक्त श्री जागीर सिंह पर अध्यारोपित निरर्हता की अवधि इस आदेश की तारीख तक घटा दी है ;
अतः अब, आयोग के 7 अक्तूबर, 2002 के आयोग के आदेश सं. 76/पंजाब- वि.स./ 2002 ( 1 ) क्रम् सं. 17 पर उल्लिखित उक्त श्री जागीर सिंह का नाम 20 सितम्बर, 2004 से उक्त आदेश से हटा लिया समझा जाएगा ।

ORDER
New Delhi , the 21st September, 2004
O.N. 58. Whereas, Shri Jagir Singh , R/o , V. Wadala Khurd, P. O. Wadala Kalan, Tehsil & District Kapurthala, Punjab a contesting candidate for the General Electionto the Legislative Assembly ofPunjab held in 2002 was disqualified by the Election Commission of India, vide its order No. 76/PB - LA/2002 ( 1 ) , dated 7th October, 2002, under Section 10A of the Representation of the People Act, 1951 , for failure to lodge his account of election expenses as required by the said Act and the Rules and Orders made thereunder, and
Whereas, the said Shri Jagir Singh had subsequently submitted his account and submitted a petition before the Election Commission of India for removal of disqualification imposed on him , giving reasons for his failure to lodge the account earlier as required by law; and
Whereas, after considering the said petition and taking into account all material facts of the case , the Election Commission, in exercise of the powers conferred by Section 11 of the Representation of the People Act, 1951 , has reduced the period of disqualification imposed under Section 10A of the said Act on the said Shri Jagir Singh up to the date of this order, Now, therefore, the name of the said Shri Jagir Singh appearing at Sl. No. 17 in Commission's Order No. 76 /PB - LA/ 2002( 1 ) , dated 7th October , 2002, shall deemed to have been omitted from the said order with effect from 20th September, 2004.
