सेबी के दिनांक 3 अगस्त 2004 के पत्त्र सं ० एमआरडी/ डीएसए/ बीएसई/ 17019/2004 द्वारा यथा अनुमोदित किसो सदस्य को चूककर्ता घोषित करने के लिए मुख्य कार्यपालक अधिकारी और उसकी अनुपस्थिति में मुख्य परिचालन अधिकारी को शक्तियाँ प्रदान करने के संबंध में एक्सचेंज के निक्रमों, उप नियमों तथा विनियमों में उप नियम 316 में आशोधन ।
सिक्यूरिटीज पॉण्ट्रवट्स ( रेग्मेशन) एक्ट , 1956 की धारा 10(4) के प्रावधानों के अनुसार किलो उप नियम का बनाया नाना, उसमें अ.शोधन करवा अथवा उसमें संशोधन करना उसके अर्थ प्रकाशन की शर्त के अधीन होता है ।चीएसई के किसी सदस्य को बुककर्ता घोषित करने के लिए कार्यपालक निदेशक एवं मुख्य कार्यपालक अधिकारी और उसकी अनुपस्थिति में मुख्न परिचालन अधिकारी को शक्तियों प्रदान करने के लिए, एक्सचेंज के नियनों, उप नियनों तया विनियमों में किये गये आशोधन संशोधन को अभिमत अ.मंत्रित करने के लिए 11 सितम्बर 2004 के भारत के आधिया रिक गजट में प्रकाशित किया गया था ।
चूंकि उपर्युक्त मामले पर कोई भी अभिमत प्राप्त नहीं हुआ है , अतएव, अब बीएसई, अपने नियमों, उपनियमों तथा विनियमों के अशोधित उप नियम 316 को निम्नलिखित रूप में शकशित करता है :
"चूक की घोषणा"
316. किसी सदस्य को गनिंग बोर्ड अयत्रा मुडा कार्यकालक अधिकारी अथवा उरुको अनुपस्थिति में मुख्य परिवः- लन अधिकारी के निर्देश के द्वारा चूतकर्ता. घोषित किया जा सकता है
( i ) यदि बह अपने दिने गरेका (इंनेशमेंट्स) पूरे करने में असमर्थ रहता है; अथवा (ii) यदि वह अपने दिये गये कार्य, दायित्व और देवत.ए पूरी करने अथवा निमाने में असनो असमर्थता स्वीकार करता है या प्रकट करता है; अथवा
( iii) यदि वह इन उप नियमों और नियमों के अंतर्गत निर्धारित समय के भीतर अपने खिलाफ क्लोजिंग आउट को वजह से हुई हानियाँ अथवा धन के अंतर की राशि अदा नहीं कर सकता अथवा ऐसा करने में असमर्थ रहता है; अथवा ( iv ) यदि वह दावे के नोट सदस्यों ( वशतें कि इस तथ्य की रिपोर्ट एक्सचेंज को उस समाशोधन के लिए निर्धारित पे इन तारीख से पहले दावा नोट प्राप्त न करने वाले सदस्य द्वारा को जाती है ) तक पहुंचाने अथत्रा समाशोधन गृह को देस कोई राशि अदा करने अयवा निघतं तारीख को 40 2004 (फातिक 8, 1926)
691 समाशोधन गृह की सुगुर्दगो , अंतर की राशि के :: विवरण अथवा प्रविभूति , तुलन पंत्र तथा ऐसे अन्य समाशोधन फार्म जो गवनिंग बोर्ड समत्र- समन पर निर्धारित करे , देने और आदेश प्राप्त करने में अजनर्थ रहता है, बरारों किसी भी स्थिति में चूत को घोषणा करने में , यदि उचित सनमा जाने, उस सो के लिए निर्धारित सेटिंग तारीज से पहले तक के लिए बिलम्ब किया जा सकता है; अथवा
(V) यदि वह चुकतों को सनिधि को ऐसो सभी धनराशियों, प्रतिमूतियाँ दथा अन्य आस्तियाँ अदा करने तथा सुगुर्द करने में असमर्थ रहता है जो किसी ऐसे सदस्य को देय है जो गर्ननिग बोर्ड अयत्रा मुझ कात्रपालक अधिकारी और उसकी अनुपस्थिति में मुखा परिवलन अधि- कारी द्वारा यथानिर्देशित, ऐसे सदस्य को चूक को घोषणा के ऐसे समय के भीतर चूककर्ता घोषित किया गया हो , अथवा
(vi ) यदि वह उसके द्वारा देय कोई र . सि ट्रेड गारंटी निधि में अश करने में असमर्थ रहता है . अथत्रा (vii) यदि वह किती अनुमोदित योजना ( जा नियम 418 द्वारा यथा परिभाषित) के अंतर्गत अथवा किसो अन्य उधार, कर्ज, करार, लेन देन, कारो- बार अथवा लेनदेनों के अंत अथवा किसी अनुमोदित योजना के अनुसरण में कोई दात्रित्व पूरा करने अथवा उसका निर्वाह करने में असनयं रहता है । (6) बगर्ने कि गर्भानग बोर्ड अथवा मुख्य कार्यपालक अधिकारी और उनको अनुपस्थिति में नु परिवजा अधिक.रो किसो सदस्य को चूत के रूप में वोषित न करे यदि खसेको चूक एक्सचेंज के प.स सदस्य की मूल पूंजी तथा अतिरिक्त पूंजी, ट्रेड गारंटी निधि को सदस्य द्वारा वारिस दिए जाने योग्ग सभी अंशद.न और कोई अन्य विपणन योग्य प्रतिमूतियां, धनराशियां तथा सम्स्य द्वारा एक्सवेंज को निश्यदित को गई तथा बैंक द्वारा स्वीकार की गई बैंक गारंटी के मूल्य से कन है, तथा ऐसे मामले में, एक्सचेंज अधार पूंजी , अतिरिक्त पूंजी, वापिस दी जाने योग्य अंशदान, इस तरह की प्रतिभूतियां , धनराशि तथा गारंटो को सदस्य के दायित्य और देवताओं को पूरी करने के लिए डिस्वार्ज कर सकता है तथा सदश्य के सदस्यता अधिकार सस्पेंड कर सकता है ।"

THE STOCK EXCHANGE , MUMBAI Amendments to bye-law 316 of the Rules , Bye- laws and Regulations of the Exchange , to Em- power the Chief Executive Officer and in his Absence the Chief Operating Officer to Declare a Member as Defaulter on the Exchange , as Appro- ved by SEBI vide it's Letter No. MRD/DSA/ BSE / 17019 /2004 Dated August 3 , 2004 .
Whereas rursuant to the provisions of Section 10 (4) of the Securities Contract (Regulation) Act, 1956, the making or the amendment or revision of any bye - law is subject to the condition of previous publication , the amended Bye - law 316 of the Rules , Bye- laws and Regulations of BSE was published in the Official Gazette of India dated the 11th September , 2004 inviting comments thereon .
Since no comments on the above mentioned matter had been received , BSE , now therefore here- to publishes the amended Bye -law 316 of its Rules , Bye- laws and Regulations as follows .
"Declaration of Default "
316. A member may be declared a defaulter by direction of the Governing Board or the Chief Executive Officer and in his absence the Chief Operating Officer :-
(i) if he is unable to fulfil his engagements ;
or
(ii) if he admits of discloses his inability to fulfil or discharge his engagements , obli- gations and liabilities ; or
(iii) if he fails or is unable to pay within the specified time the damages and the money difference due on a closing- out effected against him under these Bye - laws and Regulations ; or
(iv) if he fails to pass Claim Notes to mem- bers (provided that fact is reported to the Exchange by the member not recei- ving the Claim Note before the Pay- in Day fixed for that Clearing) or to pay any sum due to the Clearing House or to sumbit or deliver to the Clearing House on the due date the Delivery and receive

Orders , Statement Sheets of Differences and Securities , Balance Sheet and such other Clearing Forms as the Governing Board may from time to time determine provided that in any such case the dec- laration of default may be delayed if deemed proper upto but not beyond the Settling Day fixed for that Clearing; or (v) if he fails to pay or deliver to the De- faulters ' Committee all monies , securities and other assets due to a member who has been declared a defaulter within such time of the declaration of default of such member as the Governing Board or the Chief Executive Officer and in his absence the Chief Operating Oficer may direct; or
(vi) if he fails to pay any sum payable by him to the Trade Guarantee Fund or (vii) he fails to fulfil or discharge any obligation or liability under an Approved Scheme (as defined by Bye- law 418) or under any borrowing, lending , contracts , dealings or transactions under or or pursuant to or anApproved Scheme .
Provided that the Governing Board or the Chief Executive Officer and in his absence the Chief Operating Officer may not declare a member as a defaulter if his default is of a sum less than the value of the base Capital and Additional Capital of the member with the Exchange , all refundabls contributions by the member to the Trade Guaran- tee Fund , and any other marketable securities, money and bank guarantee furnished by the mem- ber to the Exchange and accepted by the Exchange , and , in such case , the Exchange may realise and utilise the base Capital, Additional Capital , refund able contributions , such securities , moncy and guarantee to discharge the members ' obligations and liabilities and suspend the member's mem- bership rights..
