सं . प्रका/औसं/फा-49/1981 बैंककारी कंपनी ( उपक्रमों का अर्जन और अंतरण ) अधिनियम , 1980 (1980 का 40 ) की धारा 12 की उप- धारा ( 2 ) 19 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , इलाहाबाद बैंक का निदेशक मंडल , भारतीय रिजर्ब बैंक से परामर्श करके और केन्द्र सरकार की पूर्व मंजूरी से , इलाहाबाद बैंक अधिकारी कर्मचारी ( अनुशासन एवं अपील ) विनियम , 1976 में संशोधन करने हेतु एतद्वारा निम्नलिखित विनियम बनाता है , अर्थातः-

1. संक्षिप्त शीर्षक एवं प्रारम्भः ( 1 ) ये विनियम इलाहाबाद बैंक अधिकारी कर्मचारी (अनुशासन एवं अपील ) , ( संशोधन ) विनियम , 2004 कहलाएंगे ।

( 2 ) ये विनियम सरकारी राजपत्र में अपने प्रकाशन की तारीख से लागू होंगे ।

2. इलाहाबाद बैंक अधिकारी कर्मचारी ( अनुशासन एवं अपील) विनियम , 1976 में , विनियम 17 के लिए , निम्नलिखित विनियम प्रतिस्थापित किया जाएगा , अर्थात्ः-

"17 अपीलः (1 ) अधिकारी कर्मचारी विनियम 4 में निर्धारित अपने ऊपर लगाए गए किसी भी दंड या विनियम 12 में उल्लिखित निलंबन आदेश के खिलाफ , आदेश मिलने की तारीख से पैंतालीस दिनों के भीतर अपील कर सकता है ।

परंतु , यदि अपील प्राधिकारी संतुष्ट हो कि अपीलकर्ता के पास समय पर अपील न कर पाने का पर्याप्त कारण है तो वह उक्त अवधि के समाप्त हो जाने के बाद भी अपील पर विचार कर सकता है ।

(2 ) अपीलकर्ता द्वारा अपील प्राधिकारी को अपील प्रस्तुत की जाएगी जिसकी एक प्रति उस अधिकारी को अग्रेषित की जाएगी जिसने निर्णय के विरुद्ध अपील करने का आदेश दिया था । इस अपील में पूरी विवरण सामग्री एवं बहस के मुद्दे होंगे जिन पर अपीलकर्ता निर्भर करता है परंतु उसमें कोई भी अपमानजनक अथवा अनुचित भाषा नहीं होगी और यह अपने आप में पूर्ण होगी ।

(3 ) निर्णय के विरुद्ध अपील करने का आदेश देने वाला प्राधिकारी , अपीलकर्ता से अपील की प्रति प्राप्त होने पर उसे , अपनी टिप्पणियों और संबंधित रिकार्ड के साथ , अपील प्राप्त होने की तारीख से पैंतालीस दिनों के भीतर अपील प्राधिकारी को अग्रेषित करेगा । 6445 भाग III-खण्ड 4]

(4 ) निर्णय के विरुद्ध अपील करने का आदेश देने वाले प्राधिकारी से मामले पर टिप्पणियां एवं रिकार्ड प्राप्त होने पर , अपील प्राधिकारी विचार करेगा कि क्या निलंबन आदेश/निष्कर्ष न्यायसंगत हैं या क्या दण्ड बहुत अधिक या अपर्याप्त है और उचित आदेश पारित करेगा । अपील प्राधिकारी दण्ड/ निलंबन की पुष्टि करने , उसमें वृद्धि करने , कमी करने या उसे अलग रखने का आदेश पारित कर सकता है या मामले को , मामले की परिस्थितियों में उचित समझे गए निदेशों सहित , जिस अधिकारी ने दण्ड लगाया था उसके पास या किसी अन्य अधिकारी के पास भेज सकता है ।

परंतु:

(i) यदि बढ़ाया हुआ दण्ड, जो अपील प्राधिकारी लगाने हेतु प्रस्तावित करता है , विनियम 4 के खण्ड (च ) , (छ), (ज) , (झ) और (ञ) में उल्लिखित अनुसार , कोई बड़ा दंड है और विलियम 6 में दिए गए अनुसार मामले में पहले कोई जाँच नहीं की गई है तो अपील प्राधिकारी निदेश देगा कि विनियम 6 के प्रावधानों के अनुसार मामले की जाँच की जानी चाहिए और उसके पश्चात जाँच के रिकार्ड पर विचार- विमर्श करेगा तथा जैसा वह उचित समझे , आदेश पारित करेगा;

: (ii ) यदि अपील प्राधिकारी दण्ड बढ़ाने का निर्णय लेता है परंतु विनियम 6 में दिए गए अनुसार जाँच पहले ही की जा चुकी है , तो अपील प्राधिकारी अधिकारी कर्मचारी को कारण बताओ नोटिस जारी करेगा कि बढ़ाया हुआ दण्ड उस पर क्यों न लगाया जाए और अधिकारी कर्मचारी द्वारा प्रस्तुत अभ्यावेदन , यदि कोई हो , को ध्यान में रखते हुए अंतिम आदेश पारित करेगा ।

(5 ) अपील प्राधिकारी अपीलकर्ता से अपील प्राप्त होने की तारीख से 90 दिनों के भीतर असका निपटान करेगाः

परंतु , इस विनियम में उल्लिखित समय- सीमा उन मामलों में लागू नहीं होगी जो सतर्कता से संबंधित हों और जहाँ अधिकारी कर्मचारी के विरुद्ध छोटी/ बड़ी दण्ड कार्रवाई , मामले की जाँच कर रही पुलिस या केन्द्रीय जाँच ब्यूरो या सतर्कता आयोग , जैसा भी मामला हो , द्वारा की गई सिफारिशों पर आरंभ की गई हो ।

(6) नब्बे दिनों से अधिक समय तक लंबित मामलों की अपील प्राधिकारी द्वारा आवधिक रूप से समीक्षा की जाएगी और मामलों को निपटाए न जाने के कारणों को लिखित रूप में दर्ज किया जाएगा ।

सं. ओडीएआर/ 1/2004। बैंककारी कंपनी (उपक्रमों का अर्जन और अंतरण) अधिनियम, 1970 ( 1970 का 5) की धारा 12 की उपधारा (2) के साथ पठित धारा 19 के द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए यूको बैंक का निदेशक मंडल, भारतीय रिजर्व बैंक से परामर्श करके और केंद्र सरकार की पूर्व मंजूरी से यूको बैंक अधिकारी कर्मचारी (अनुशासन और अपील) विनियम, 1976 में पुनः संशोधन करने हेतु एतद्वारा निम्नलिखित विनियम बनाता है , अर्थात:-

1. संक्षिप्त शीर्षक एवं प्रारंभ: ( 1 ) ये विनियम यूको बैंक अधिकारी कर्मचारी (अनुशासन और अपील ) (संशोधन). विनियम, 2004 कहे जाएंगे ।

(2) ये सरकारी राजपत्र में अपने प्रकाशन की तारीख से लागू होंगे ।

2. यूको बैंक अधिकारी कर्मचारी (अनुशासन और अपील) विनियम, 1976 में विनियम 17 के लिए निम्नलिखित विनियम प्रतिस्थापित किया जाएगा, अर्थात:-

" 17. अपील: ( 1) अधिकारी कर्मचारी विनियम 4 में निर्धारित अपने ऊपर लगाए गए किसी भी दंड या विनियम 12 में उल्लिखित निलंबन आदेश के खिलाफ , आदेश मिलने की तारीख से पैंतालीस दिनों के भीतर अपील प्राधिकारी को अपील कर सकता है ।

परंतु, अपील प्राधिकारी उक्त अवधि के समाप्त हो जाने के बाद भी अपील पर विचार कर सकता है यदि वह इस बात से संतुष्ट हो कि अपीलकर्ता के पास समय पर अपील न कर पाने का पर्याप्त कारण है ।

(2) अपीलकर्ता द्वारा अपील प्राधिकारी को जो अपील प्रस्तुत की जाएगी , उसकी एक प्रति उस अधिकारी को अग्रेषित की जाएगी , जिसने निर्णय के विरुद्ध अपील करने का आदेश दिया था । इस अपील में सभी महत्वपूर्ण विवरण एवं दलीलें होंगी , जिनपर अपीलकर्ता निर्भर करता है परंतु उसमें कोई भी अपमानजनक अथवा अनुचित भाषा नहीं होगी और यह अपने आप में पूर्ण होगी ।

(3) निर्णय के विरुद्ध अपील करने का आदेश देने वाला प्राधिकारी , अपीलकर्ता से अपील की प्रति प्राप्त होने पर अपनी टिप्पणियों और संबंधित रिकार्ड के साथ उसे अपील प्राप्त होने की तारीख से अधिकतम पैंतालीस दिनों के भीतर अपील प्राधिकारी को अग्रेषित करेगा ।

(4) जिस प्राधिकारी के आदेश के विरुद्ध अपील किया गया है उससे मामले पर टिप्पणियां एवं रिकार्ड के प्राप्त होने पर , अपील प्राधिकारी विचार करेगा कि क्या निलंबन आदेश/निष्कर्ष न्यायसंगत हैं या क्या दंड बहुत अधिक या अपर्याप्त है और उचित आदेश पारित करेगा । अपील प्राधिकारी दंड/निलंबन की पुष्टि करने , उसमें वृद्धि 6448

करने, कमी करने या उसे अलग रखने का आदेश पारित कर सकता है या मामले को, मामले की परिस्थितियों में उचितसमझे गए निदेशों सहित , जिस अधिकारी ने दंड लगाया था उसके पास या किसी अन्य अधिकारी के पास भेज सकता है ।

परंतु यह कि

(i ) यदि बढ़ाया हुआ दंड, जो अपील प्राधिकारी लगाने हेतु प्रस्तावित करता है, विनियम 4 के खंड (च ) , (छ), (ज), (झ) और (ञ) में निर्दिष्ट कोई बड़ा दंड है और विनियम 6 में दिए गए अनुसार इस मामले में पहले कोई जांच नहीं की गई है तो अपील प्राधिकारी निर्देश देगा कि विनियम 6 के प्रावधानों के अनुसार मामले की ऐसी जांच की जाए और उसके बाद जांच के अभिलेख पर विचार करेगा और उचित समझा गया आदेश पारित करेगा ।

(ii) यदि अपील प्राधिकारी दंड बढ़ाने का निर्णय लेता है परंतु विनियम 6 में दिए गए अनुसार जांच पहले ही की जा चुकी है तो अपील प्राधिकारी अधिकारी कर्मचारी को कारण बताओ नोटिस जारी करेगा कि बढ़ाया हुआ दंड उसपर क्यों न लगाया जाए और अधिकारी कर्मचारी द्वारा प्रस्तुत अभ्यावेदन, यदि कोई हो, को ध्यान में रखते हुए अंतिम आदेश पारित करेगा ।

(5) अपील प्राधिकारी अपीलकर्ता से अपील प्राप्त होने की तारीख से 90 दिनों के भीतर उसका निपटान करेगा; परंतु इस विनियम में निर्दिष्ट समय- सीमा उन मामलों में लागू नहीं होगी जो सतर्कता से संबंधित होंगे और जहां अधिकारी कर्मचारी के विरुद्ध छोटी बड़ी दंडात्मक कार्रवाई मामले की जांच कर रही पुलिस य केंद्रीय जांच ब्यूरो या केंद्रीय सतर्कता आयोग , जैसी भी स्थिति हो, द्वारा की गई सिफारिशों पर आरंभ कीगई हो।

(6) नब्बे दिनों सेअधिक समय तक लंबित रहने वाले मामलों की समीक्षा अपील प्राधिकारी द्वारा आवधिक रूप से की जाएगी और मामलों को निपटाए जाने के कारणों को लिखित रूप में दर्ज किया जाएगा ।

संख्या एसआरसी / 47 बैंककारी कंपनी (उपक्रमों का अर्जन और अंतरण अधिनियम, 1970 (1970 का 5) की धारा 12 की उप-धारा (2) के साथ पठित धारा 19 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , इंडियन बैंक का निदेशक मंडल, भारतीय रिज़र्व बैंक से परामर्श करके और केन्द्र सरकार की पूर्व मंजूरी से, इंडियन बैंक अधिकारी कर्मचारी (अनुशासन एवं अपील) विनियम, 1976 में संशोधन करने हेतु एतद्वारा निम्नलिखित विनियम बनाता है, अर्थात्:

1. संक्षिप्त शीर्षक एवं प्रारंभ :

(1) ये विनियम इंडियन बैंक अधिकारी कर्मचारी (अनुशासन एवं अपील) (संशोधन) विनियम, 2004 कहलाएंगे ।

(2) ये विनियम ' सरकारी राजपत्र' में अपने प्रकाशन की तारीख से लागू होंगे ।

2. इंडियन बैंक अधिकारी कर्मचारी (अनुशासन एवं अपील) विनियम 1978 में, विनियम 17 के लिए, निम्नलिखित विनियम प्रतिस्थापित किया जाएगा, अर्थात्:-

17 अपील (1) अधिकारी कर्मचारी विनियम 4 में निर्धारित अपने ऊपर लगाए गए किसी भी दण्ड या विनियम 12 में उल्लिखित निलंबन आदेश के खिलाफ, आदेश मिलने की तारीख से पैंतालीस दिनों के भीतर अपील प्राधिकारी को अपील कर सकता है ।

परंतु, यदि अपील प्राधिकारी संतुष्ट हो कि अपीलकर्ता के पास समय पर अपील न कर पाने का पर्याप्त कारण है तो वह उक्त अवधि के समाप्त हो जाने के बाद भी अपील पर विचार कर सकता है । (.

(2) अपीलकर्ता द्वारा अपील प्राधिकारी को अपील प्रस्तुत की जाएगी जिसकी एक प्रति उस अधिकारी को अग्रेषित की जाएगी जिसने निर्णय के विरुद्ध अपील करने का आदेश दिया था । इस अपील में पूरी विवरण सामग्री एवं बहस के वे मुद्दे होंगे जिन पर अपीलकर्ता निर्भर करता है परंतु उसमें कोई भी अपमानजनक अथवा अनुचित भाषा नहीं होगी और यह अपने आप में पूर्ण होगी।

1 (3 ) निर्णय के विरुद्ध अपील करने का आदेश देने वाला प्राधिकारी अपीलकर्ता से अपील की प्रति प्राप्त होने पर उसे, अपनी टिप्पणियों और संबंधित रिकॉर्ड के साथ, अपील प्राप्त होने की तारीख से पैंतालीस दिनों के भीतर अपील प्राधिकारी को अग्रेषित करेगा ।

(4) निर्णय के विरुद्ध अपील करने का आदेश देने वाले प्राधिकारी से मामले पर टिप्पणियां एवं रिकॉर्ड प्राप्त होने पर, अपील प्राधिकारी विचार करेगा कि क्या स्थगन आदेश / निष्कर्ष न्यायसंगत हैं या क्या दण्ड बहुत अधिक या अपर्याप्त है और उचित आदेश पारित करेगा। 6450

अपील प्राधिकारी दण्ड / निलंबन की पुष्टि करने, उसमें वृद्धि करने, कमी करने या उसे अलग रखने का आदेश पारित कर सकता है, या मामले का, मामले की परिस्थितियों में उचित समझे गए निदेशों सहित, जिस अधिकारी ने दण्ड लगाया था उसके पास या किसी अन्य अधिकारी के पास भेज सकता है ।

परंतु

(i ) यदि बढ़ाया हुआ दण्ड, जो अपील प्राधिकारी लगाने हेतु प्रस्तावित करता है, विनियम 4 के खंड (च), (छ), (ज), (झ) और (ञ) में उल्लिखित अनुसार, कोई बड़ा दण्ड है और विनियम 6 में दिए गए अनुसार मामले में पहले कोई जाँच नहीं की गई तो अपील प्राधिकारी निदेश देगा कि विनियम 6 के प्रावधानों के अनुसार मामले की ऐसी जाँच की जानी चाहिए और उसके पश्चात् जाँच की रिकॉर्ड पर विचार- विमर्श करेगा तथा जैसा वह उचित समझे, आदेश पारित करेगा (ii ) यदि अपील प्राधिकारी दण्ड बढ़ाने का निर्णय लेता है परंतु विनियम 6 में दिए गए अनुसार जाँच पहले ही की जा चुकी है, तो अपील प्राधिकारी अधिकारी कर्मचारी को कारण बताओ नोटिस जारी करेगा कि बढ़ाया हुआ दण्ड उसपर क्यों न लगाया जाए और अधिकारी कर्मचारी द्वारा प्रस्तुत अभ्यावेदन, यदि कोई हो, को ध्यान में रखते हुए अंतिम आदेश पारित करेगा । (5) अपील प्राधिकारी अपीलकर्ता से अपील प्राप्त होने की तारीख से 90 दिनों के भीतर उसका निपटान करेगा:

(6) 90 दिनों से अधिक समय तक लंबित मामलों की अपील प्राधिकारी द्वारा आवधिक रूप से समीक्षा की जाएगी और मामलों को निपटाए न जाने के कारणों को लिखित रूप में दर्ज किया जाएगा ।

परिषद अपने विशेषाधिकार के अन्तर्गत किसी भी परीक्षा केन्द्र को किसी भी समय बिना कोई कारण दिए रद्द कर सकती है ।

यह परीक्षा इंस्टीट्यूट के केवल पात्र सदस्य जो कि पहले से ही पंजीकृत है , के लिये है ।

इस परीक्षा के लिए परीक्षा शुल्क 1,000/- (एक हजार रूपये) मात्र है ।

परीक्षा शुल्क की राशि का भुगतान बैंक के डिमांड ड्राफ्ट द्वारा होना चाहिए । आवेदन पत्र उपयुक्त शुल्क के डिमांड ड्राफ्ट के साथ इस प्रकार केजा जाना चाहिए कि वह संयुक्त सचिव (परीक्षा) के कार्यालय में दिनांक 01/12/2004 तक पहुंच जाये । दिनांक 01/12/2004 के बाद प्राप्त आवेदन पत्रों को स्वीकार नहीं किया जायेगा ।

इस परीक्षा के लिए आवेदन निर्धारित आवेदन पत्र पर ही किया जाना चाहिए जो कि इंस्टीट्यूट ऑफ चार्टर्ड एकाउन्टेन्टस आफ इंडिया के संयुक्त राचिव (परीक्षा ) के नई दिल्ली स्थित कार्यालय से 25/- रूपये प्रति आवेदन पत्र भुगतान करने पर मिल सकता है । आवेदन पत्र इंस्टीट्यूट के रीजनल और ब्रांचो के कार्यालयों में भी उपलब्ध है और नकद भुगतान करने पर 11 नवम्बर 2004 से प्राप्त किये जा सकते हैं ।

एस आर ओ सं. 646/ ए डी एम / इ. 1 / - 2004 जबकि देवलाली छावनी सीमा में प्रवेश करने वाले वाहनों पर वाहन प्रवेश कर लागू करने के लिए छावनी अधिनियम 1924 ( 1924 का 2) की धारा 255 के साथ पठनीय धारा 61 के तहत यथापेक्षित प्रस्ताव के प्रारूप के नोटिस की प्रति उसके प्रकाशन की तिथि से 30 दिनों की अवधि की समाप्ति तक उक्त कर से प्रभावित होने वाले सभी व्यक्तियों से आपत्तियाँ और सुझाव आमंत्रित करते हुए देवलाली छावनी परिषद के सहज रुप से दिखाई देने वाले भाग में चिपका कर दिनांक 18 अगस्त 2004 को प्रकाशित किया गया था एवं इसको स्थानीय दैनिक समाचार पत्रों में प्रकाशित किया गया था ।

तथा, जबकी उक्त प्रारुप पर जनता से प्राप्त आपत्तियों और सुझावों पर छावनी परिषद् द्वारा विधिवत् विचार किया गया ।

तथा, जबकी उक्त अधिनियम की धारा 63 के तहत यथा अपेक्षित केन्द्र सरकार ने छावनी परिषद, देवलाली को उपर्युक्त कर को इसके मूल रूप में लगाने के लिए विधिवत् प्राधिकृत कर दिया है ।

अतः अभी उक्त अधिनियम की धारा 60 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए छावनी परिषद् देवलाली केन्द्र सरकार की पूर्व स्वीकृति से एतद्वारा देवलाली छावनी सीमा में प्रवेश करने वाले और सीमा से गुजरने वाले वाणिज्यिक तौर पर भारित वाहनों पर वाहन प्रवेश कर नामक कर लागू करती है जो वाहन के मालिक या वाहन के प्रभारी व्यक्ति द्वारा , संलग्न अनुसूची में उल्लिखित दर से देय होगा: -

10 भारतीय पथकर (सेना और वायुसेना अधिनियम 1901 (1901 का 2) की धारा 3 के तहत छूट प्राप्त व्यक्त्तियों के वाहन और संपत्ति । )

एस०आर०ओ सं०- 289 ए जबकि छावनी अधिनियम की धारा 61 के साथ धारा 255 के द्वारा अपेक्षित , जनता के रते हुए प्रारूप प्रस्ताव , दिल्ली छावनी परिषद के द्वारा सभी विज्ञापनों पर कर लगाने से सम्बन्धित प्रारूप सार्वजनिक नोटिस सं०- डी. सी. बी/26/टी/रेवन्यू/विज्ञा०कर , दिनांक 4 अप्रैल , 2003 को प्रकाशित हुआ इसके आगे उक्त अधिनियम के नाम से निदिष्ट उक्त सूचना के प्रकाशित होने के 30 दिन के अन्तर्गत प्रभावित होने की संभावना के , सभी व्यक्तियों से आपत्ति एवं सुझाव आमन्त्रित किये गये ।

और जबकि उक्त नोटिस छावनी परिषद के सूचना पट्ट में दिनांक 4 अप्रैल , 2003 को लगाया गया था ।

और जबकि उपयुक्त समय से पहले उक्त प्रास्य प्रस्ताव पर जनता के अनापत्ति एवं सुझाव प्राप्त हो चुके हैं ।

और जबकि केन्द्र सरकार ने दिल्ली छावनी परिषद के उक्त अधिनियम की धारा 63 के अन्तर्गत अपेक्षित मूल रूप से उक्त कर लगाने हेतू अधिकृत किया है । अब , इसलिए उक्त अधिनियम की धारा 60 के द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए एवं भारत सरकार रक्षा मंत्रालय व एस०आरओ सं०-289 दिनांक 16.8.1965 की अधिसूचना का अतिक्रमण करते हुए भारत के गजट , भाग 2 धारा 4 में प्रकाशित किया । ऐसे अतिक्रमण से पहले जो हो गया है या हटा दिया गया है के अनुसार , दिल्ली छावनी परिषद समाचार पत्रों में प्रकाशित विज्ञापनों के अतिरिक्त सभी विज्ञापनों पर केन्द्र सरकार के पूर्व स्वीकृत के अनुसार कर अधिरोपित करती है । किसी भी जमीन पर विज्ञापन लगा कर प्रदर्शित करना , भवन , वाल होल्डिंग , संरचना या वाहनों या दिल्ली छावनी की सीमा के अन्दर जब भी किसी स्थान के चाहे वह सार्वजनिक या गैर सरकारी हो , किसी भी तरह का विज्ञापन जनता को दिखाने के लिये करता हो , तो उस व्यक्ति को निम्न सूची में यथा निर्दिष्ट दर के अनुसार प्रत्येक विज्ञापन पर कर देगा:

1. Short title and commencement : ( 1 ) These Regulations may be called Allahabad Bank Officer Employees ' (Discipline and Appeal ) (Amendment ) Regulations, 2004:

(2) They shall come into force on the date of their publication in the Official . Gazette .

2. In the Allahabad Bank Officer. Employees ' (Discipline and Appeal ) Regulations , 1976, for regulation 17, the following regulation shåll be substituted, namely : -

" 17 Appeal : ( 1 ) An officer employee may prefer an appeal to the: Appellate authority within forty five days from the date of receipt of the order imposing upon him any of the penalties specified in regulation 4' or against the order of suspension referred to in regulation 12:

Provided that the Appellate authority may entertain the appeal after the expiry . of the said period , if it is satisfied that the appellant had sufficient cause for not preferring the appeal in time.

(2 ) : The appear shall be presented to the Appellate authority with a copy being forwarded by the appellant to the authority which made the order appe aled against. It shall 6472

[PART III--SEC. 4 contain all material statements and arguments on which the appellant relies but shall not contain any disrespectful or improper language , and shall be complete in itself.

(3) The authority which made the order appealed against shall , on receipt of a copy of the appeal from the appellant , forward the same with its comments thereon together with the relevant records to the Appellate authority within a period not exceeding forty five days froin the date of the receipt of the appeal .

(4) The Appellate authority shall on receipt of the comments and records of the case from the authority, whose order is appealed, against , consider, whether the order of suspension/ findings are justified or whether the penalty.is excessive or inadequate and pass appropriate orders . The Appellate authority may pass an order confirming . enhancing , reducing or setting aside the penalty /suspension or remitting the case to the authority which imposed the penalty or to any other authority with such directions as it may deem fit in the circumstances of the case .

Provided that:

(i) If the enhanced penalty , which the Appellate authority proposed to impose is a major penalty specified in clauses ( f) , ( g ) , ( h ) , (i ) and (j ) of regulation 4 and an inquiry as provided in regulation 6 has not already been held in the case , the Appellate authority shall direct that such an enquiry be held in accordance with the provisions of regulation 6 and thereafter consider the record of the inquiry and pass such orders as it may deem proper ;

(ii) If the Appellate authority decides to enhance the punishment but an enquiry has already been held as provided in regulation 6 , the Appellate authority shall give a show cause notice to the officer employee as to why the enhanced penalty should not be imposed upon him and shall pass final order after taking into account the representation , if any , submitted by the officer employee .

(5) The Appellate authority shall dispose of the appeal within a period of ninety days from the date of its receipt from the appellant :

6473 Provided that the time limit specified in this regulation shall not apply to cases having a vigilance angle and where major/ minor penalty proceedings against the officer employee have commenced on recommendations of the Police or Central Bureau of Investigation or Central Vigilance Commission, as the case may be , investigating the matter.

(6) The cases lying pending over ninety days shall be reviewed periodically by the Appellate authority and reasons for non - disposal of the cases shall be recorded in writing.

The candidates who opt for a centre mentioned under category II would be required to give one or two alternate centres in order of preference from centres mentioned under Category I. In the event of a minimum of 25 candidates not opting for a centre mentioned under Category II , candidates who had opted for the said centre would be allotted to the centre of their choice in order of preference in Category I as mentioned in their application forrn . Category II has not given his option for any alternate centre in Category I , he will be allotted to any of the nearest centre in Category I as per the discretion of the Institute .

The Council reserves the right to withdraw any centre at any stage without assigning any reason . The above test is open only to eligible Members of the Institute who are already registered with the Institute for the said course . The fees payable for the above Assessment Test is Rs . 1000/- .

Payment of fees for the Assessment Test should be made only by Demand Draft . The Demand Draft may be of any Scheduled Bank and should be drawn in favour of the Secretary , The Institute of Chartered Accountants of India , payable at New Delhi only . Application together with the prescribed fee be sent so as to reach the Joint Secretary (Exams) - CC at New Delhi on or before 1st December 2004 .

Applications for admission to the Assessment Test is required to be made in the prescribed form which may be obtained from the Joint Secretary (Exams ) CC, The Institute of Chartered Accountants of India , Indraprastha Marg , New Delhi 110 002 on payment of Rs.25/ - per application form , The forms are also available in the Regional and Branch Offices of the Institute and can be obtained there from on cash payment on or from 11th November 2004. Alternatively, the format of application form can be downloaded from the website of the Institute viz . www.icai.org and the cost of the application form of Rs. 25/ - can be added to the Assessment Test fee of Rs . 1000/- and the Demand Draft for Rs . 1025/- has to be sent . The last date for receipt of duly filled in application forms is 1st December 2004. The application together with the prescribed fee should be sent by Speed Post/ Registered Post to the Joint Secretary ( Exams . ) -CC, New Delhi . The applications received after 1st December 2004 will not be entertained under any circumstances .

2004 WHEREAS a notice of certain draft proposal for imposing a Vehicle Entry Tax on entry of vehicles within the limits of Deolali Cantonment was published on the 18th August , 2004 by affixing a copy thereof in a conspicuous part of the Cantonment Board, Deolali and published in daily local newspapers as required under section 61 read with section 255 of the Cantonment Act, 1924 (2 of 1924) inviting objections and suggestions from all persons likely to be affected thereby till the expiry of a period of thirty days from the date of publication of the said notice;

AND WHEREAS , the objections and suggestions received from public on the said draft proposal were duly considered by the Cantonment Board;

AND WHEREAS , the Central Government have duly authorized the Cantonment Board, Deolali to impose the aforesaid tax in its original form as required under section 63 ofthe said Act;

NOW THEREFORE, in exercise of the powers conferred by section 60 of the said Act, the Cantonment Board , Deolali hereby imposes with the previous sanction of the Central Government a tax to be known as the Vehicle Entry Tax on commercial loaded vehicles entering and passing through the limits of Deolali Cantonment, payable by the owner of the vehicle or the person in - charge of the vehicle at the rates specified in the Schedule annexed hereto .

Provided that for the second and the subsequent entries of the vehicles in the Cantonment limits of the Deolali Cantonment on a single day, tax shall be payable at half ofthe rate on production of the entry pass issued at the time of first entry.

Provided further that no tax shall be levied on the following vehicles , namely: - 1. Vehicles belonging to Central or State Government .

2. Vehicles belonging to Cantonment Board, Deolali .

3. Vehicles belonging to Nashik Municipal Corporation and Bhagur Municipality 4. Ambulances for carrying patients .

5. Vehicles for carrying solely funeral parties .

6. State Transport Buses of Maharashtra Government .

7. Vehicles deployed for election duty.

8. Tractors of agriculturists used solely for agricultural purposes .

9. Buses carrying school students .

10. Vehicles belonging to persons and property exempted under section 3 of the Indian Tolls (Army and Airport Act, 1901 (2 of 1901 ).

SRO NO. 289 A Whereas a draft of public containing certain draft proposals relating to the imposition of tax on all advertisements in the Delhi Cantonment Board was published vide public notice No. DCB /26 /T / REV/ADV TAX dated 4th April , 2003 as required by section 61 read with section 255 of the Cantonments Act , 1924, (2 of 1924 ) (hereinafter referred to as the said Act ) inviting objections and suggestions from all persons likely to be affected thereby within thirty days from the date of publication of the said notice.

And whereas the said notice was affixed on the Notice Board of the Delhi Cantonment Board on the 4th April ,2003;

And, whereas no objections or suggestion has been received from the public on the said draft proposal before the period aforesaid ;

And, whereas the Central Government has authorised the Delhi Cantonment Board to impose the tax aforesaid in the original form as required under section 63 of the said Act ;

Now, therefore, in the exercise of the powers conferred by section 60 of the said Act and in supersession of the notification of the Government of India in the Ministry of Defence vide SRO No. 289 dated 16.8.1965, published in the Gazette of India , Part II section 4, except as respects things done or omitted to be done before such supersession , the Delhi Cantonment Board, with the previous sanction of the Central Government hereby imposes tax on all advertisements other than those published in newspapers , payable on every advertisement by the person who erects , exhibits of fixes an advertisement upon any land, building, wall hoardings, structures or vehicles or who displays any advertisement to the public view in any manner whatsoever in any place whether public or private within the limits of Delhi Cantonment at the rates specified in the Schedule below , namely : -
