सेबी के दिनांक 17 फरवरी 2004 के पत्त्र सं ० एमआरडी/ डीएसए/एमेंड/ 3382/ 04 द्वार। यथाअनुमोदित गैर सदस्य बनाम सदस्य मध्यस्थता में किसी मध्यस्थता संदर्भ में पार्टियों द्वास देय शुल्क और प्रभारों के संबंध में एक्सचेंज के नियमों, उप नियमों तथा विनियमों में उप नियम 264 में आशोधन । सिक्यूरिटीज कॉन्ट्रॅक्ट्स ( रेगुलेशन) एक्ट, 1956 की धारा 10( 4) के प्रावधानों के अनुसार किसी उप नियम का बनाया जाना, उसमें आशोधन करना अथवा उसमें संशोधन करना उसके पूर्व प्रकाशन की शर्त के अधीन होता है । बीएसई के नियमों, उपनियमों तथा विनियमों के आशोधित उप नियम 264को अभिमत आमंत्रित करने के लिए 3 जुलाई 2004 के भारत के आधिकारिक गजट में प्रकाशित किया गया था । चूंकि उपर्युक्त मामले पर कोई भी अभिमत प्राप्त नहीं हुआ है , अतएव , अब बीएसई के नियमों, उप नियमों तथा विनियमों के उप नियम 264 को निम्नलिखित रूप में प्रकाशित करता है:-
"शुल्क तथा प्रभार
264. संबंधित विनियम में निर्धारित संदर्भ में मध्यस्थता में शुल्क तथा कार्य बाहियों को प्रस्तुत करने तथा विनियमित करणे के लिए प्रभार अग्रिम रूप से देय होंगे तथा यदि अवा करने में 608

पार्टी अथवा पाटियों की ओर से कोई चूक , लापरवाही अथवा इनक, र होता है तो तदनुसार दूसरी पार्टी अपने इस अधिकार , यदि कोई हो, पर बिना कोई प्रतिकूल प्रभाव डाले कि वह उसे चूक , लापरवाही अथवा इनकार करने वाली पार्टी अथवा पार्टियों से इस शल्क को वसूल कर सके , अग्रिम रूप से इस तरह के भुगतान करने के लिए उत्तरदायी होगा । किसी भी संदर्भ की सुनवायी होने से पहले यह शर्त रहेगी कि संदर्भ की पार्टी अथवा पटियों द्वारा एक्सचेंज को अग्रिम रूप से निर्धारित शुल्क तथा प्रभार चुका दिये गये हैं । एक्सचेंज इस तरह के सभी शुल्क तथा प्रभार जमा करेगा और आवश्यक भुगतान करेगा बशर्ते हमेशा वास्तव में जमा की गयी राशियों से अधिक राशियां अदा नहीं की जायेंगी ।
बशर्ते कि ऐसा सदस्य, जिसके खिलाफ मध्यस्थता का मामला दर्ज किया गया है , चूककर्ता घोषित किया गया है, मध्यस्थता शुल्क अदा करने में चूक , लापरव. ही अथवा इनकार करने की स्थिति में एक्सचेंज इस तरह के भुगतान करेगा और ऐसे सदस्य जिसे चूककर्ता घोषित किया गया है, को आस्तियों में से इनकी वसूली करेगा ।
बशर्ते यह भी कि ऐसे सदस्य द्वार। , जिसके खिलाफ मध्य- स्थर्ता का मामला दर्ज किया गया है , मध्यस्थता शुल्क अदा करने में चूक , लापरवाही अथवा इनकार करने की स्थिति में एक्सचेंज इस तरह के शुल्क एक्स बेंज अथवा समःशोधन गृह में रखी सदस्य की जमानत राशि/आस्तियों में से नामे डाल देगा । " कृते बीएसई वी जी भगत सचिव

THE STOCK EXCHANGE , MUMBAI Amendment to bye - law 264 in the rules , bye- laws & Regulations of the exchange as approved by Sebi vide its letter No. MRD/DSA/AMEND/3382/ 04 Dated the 17th February , 2004 .
Whereas pursuant to the provisions of Section 10 (4) of the Securities Contracts ( Regulation) Act , 1956, the making or the amendment or revision of any bye - law is subject to the condition of its pre- vious publication , the amended bye - law 264 of the
[মাদ- IV Rules , bye- laws and Regulations of BSE (The Stock Exchange , Mumbai ) was published on the 3rd July , 2004 , in the Gazette of India , for inviting comm- ents thereon.
Since no comments on the abovementioned Bye- law has been received , BSE (The Stock Exchange , Mumbai ) , now therefore hereto publishes Bye - law 264 of the Rules , Bye - laws and Regulations of BSE (The Stock Exchange , Mumbai ) as follows :
"Fees and Charges
264. The fees in arbitration and the charges for submitting and regulating the proceedings of the reference prescribed in the relative Regulation shall be payable in advance and when there is failure , neglect or refusal on the part of a party or parties to pay accordingly the other party shall be respon- sible for making such payment in advance without prejudice however to his right if any to recover the same from such party or parties failing , neglecting or refusing to pay . It shall be a condition precedent to the hearing of any reference that the prescribed fees and charges shall have been paid in advance to the Exchange by the party or parties to the refernce. The Exchange shall collect all such fees and charges and make the necessary payments provided always that no larger sum shall be paid than actually collected.
Provided that , in case of failure , neglect or refusal on the part of a member who has been declared a defaulter against whom a reference to arbitration has been filed, to pay the arbitration fees , the Exchange shall make such payment and recover the same from he assets of such member who has been declared a defaulter .
Provided further , that in case of failure , neglect or refusal on the part of a member , against whom a reference to arbitration has been filed , to pay the arbitration fees , the Exchange shall debit the same from the Security Deposits /Assets of the Member with the Exchange or Clearing House ."
