[भाग III-खण्ड 1 से मुक्त हो । ऐसे संगठन का निर्माण करते समय परमाणु ऊर्जा की विशिष्ट आवश्यकताओं, क्षेत्र की नवीनतम, उसकी गतिविधियों के सामरिक तथा इसके अंतर्राष्ट्रीय एवं राजनीतिक महत्व को ध्यान में रखना होगा ।

परमाणु ऊर्जा विभाग मुम्बई-400001 , दिनांक 27 दिसम्बर 2004 सं. एईसी -1 ( 2 )/04/24--राष्ट्रपति ने निर्णय लिया है कि परमाणु ऊर्जा आयोग के गठन सम्बन्धी भारत सरकार के दिनांक 1 मार्च, 1958 के संकल्प सं. 13/ 7/58- प्रशा. , ( समय- समय पर यथा संशोधित ) के पैराग्राफ 3 ( ए ) को संशोधित कर निम्नानुसार पढ़ा जाए :
पैराग्राफ 3 (ए)
आयोग में पूर्णकालिक और अंशकालिक सदस्य होंगे और सदस्यों की संख्या तीन से कम और ग्यारह से अधिक नहीं होगी। 2. तद्नुसार, समय- समय पर यथासंशोधित सरकार के दिनांक 1 मार्च, 2004 के संकल्प सं. 13 /7/58- प्रशा. की एक प्रति इसके साथ प्रेषित है ।
2. गंभीरतापूर्वक विचार के पश्चात् भारत सरकार ने लगभग रेलवे बोर्ड के मॉडल पर आधारित पूर्ण कार्यकारी तथा वित्तीय शक्तियों- युक्त परमाणु ऊर्जा आयोग की स्थापना करने का निर्णय लिया है । यह आयोग , पूर्ववर्ती वैज्ञानिक अनुसंधान विभाग में दिनांक 10 अगस्त 1948 की अधिसूचना सं. एफ-402/डीएसआर/ 48 , जिसे एतद्वारा निरस्त किया जाता है, के द्वारा स्थापित आयोग को प्रतिस्थापित करेगा । 3. आयोग का गठन :
(क) अयोग में पूर्ण कालिक एवं अंशकालिक सदस्य होंगे और आयोग के कुल सदस्यों की संख्या तीन से कम एवं ग्यारह से अधिक नहीं होगी ।
( ख ) भारत सरकार के परमाणु ऊर्जा विभाग में सचिव , आयोग के पदेन अध्यक्ष होंगे ।
(ग) आयोग का एक सदस्य, सदस्य, वित्त होगा जो परमाणु ऊर्जा विभाग में वित्तीय मामलों में भारत सरकार का पदेन सचिव भी होगा ।
4. कार्य :
परमाणु ऊर्जा आयोग के निम्नलिखित उत्तरदायित्व होंगे :--

दिनांक 06 मार्च, 1962 का संकल्प सं. डीएई/सी - 1 - एच दिनांक 24 जनवरी 1981 का संकल्प सं. 3 ( 5 ) -81 - एडमिन. -1 दिनांक 13 अक्तूबर 1983 का संकल्प सं. 3 (5 ) -81- एडमिन .- 1 दिनांक 20 मार्च 1984 का संकल्प सं. एईसी-1 ( 2 ) / 84 दिनांक 17 मार्च 1986 का संकल्प सं. 1 ( 2 ) /86 दिनांक 14 जून 2004 का नोट सं. एईसी-1 ( 2 ) /04 एवं दिनांक 27 दिसम्बर 2004 का नोट सं. एईसी-1 (2 )/04/24 परमाणु ऊर्जा विभाग की स्थापना अगस्त 1954 में हुई और तब से परमाणु ऊर्जा के शांतिपूर्ण उपयोग के बारे में अनुसंधान एवं विकास कार्यों में महत्वपूर्ण एवं तीव्र गति से प्रगति हुई है और भविष्य के लिए एक बहुत ही व्यापक कार्यक्रम तैयार किया गया है, जिसका मूल उद्देश्य भारत को परमाणु ऊर्जा के उपयोग हेतु आवश्यक सभी मूलभूत पदार्थों के उत्पादन में सक्षम बनाना तथा परमाणु बिजलीघरों की श्रृंखला का निर्माण करना है जो देश में विद्युत शक्ति के उत्पादन में वृद्धि हेतु अपना योगदान देंगे । इन विकास कार्यों के लिए एक ऐसे संगठन की आवश्यकता है जिसके पास गहन तकनीकी एवं आर्थिक सिद्धान्तों पर आधारित अपनी योजनाएं तैयार करने एवं उन्हें क्रियान्वित करने का पूर्ण अधिकार हो और जो सभी अनावश्यक प्रतिबन्धों या गैर लचीले नियमों ( क ) प्रधानमंत्री के विचारार्थ एवं अनुमोदन के लिए परमाणु ऊर्जा विभाग की नीति तैयार करना ।
( ख ) परमाणु ऊर्जा विभाग का प्रत्येक वर्ष का बजट तैयार करना एवं सरकार से इसे अनुमोदित कराना ।
(ग ) परमाणु ऊर्जा से सम्बन्धित सभी मामलों में सरकार की नीति का कार्यान्वयन करना ।
5. संसद द्वारा अनुमोदित बजट प्रावधानों की सीमा के अन्दर परमाणु ऊर्जा विभाग के कार्यों को करने के लिए आयोग के पास भारत. सरकार की प्रशासनिक एवं वित्तीय दोनों शक्तियां सन्निहित होंगी । 6. अध्यक्ष :
(क) परमाणु ऊर्जा विभाग में भारत सरकार के सचिव की हैसियत से अध्यक्ष , तकनीकी मामलों में निर्णय लेने तथा परमाणु नीति से सम्बन्धित मामलों पर सरकार को परामर्श देने के लिए प्रधानमंत्री के अधीन उत्तरदायी होंगे नीतिगत एवं सम्बन्धित मामलों में आयोग की सभी सिफारिशें अध्यक्ष के माध्यम से प्रधानमंत्री को प्रस्तुत की जाएंगी ।
( ख ) अध्यक्ष को आयोग के अन्य सदस्यों के प्रस्तावों को अस्वीकृत करने का अधिकार होगा, सिवाय सदस्य, वित्त के, जिन्हें किसी भी वित्तीय मामले , जिसमें वे अध्यक्ष से सहमत नहीं हैं, को प्रधानमंत्री तथा वित्त मंत्री को भेजने हेतु मांग करने का अधिकार होगा ।
(ग ) अध्यक्ष द्वारा लिए गए निर्णयानुसार आयोग के किसी भी सदस्य को समय - समय पर जारी सामान्य या विशिष्ट आदेशों के तहत अपनी ओर से शक्तियों एवं दायित्वों के प्रयोग हेतु प्राधिकृत किया जा सकता है । भाग III-खण्ड 1 ]

7. सदस्य, वित्त :
सदस्य, वित्त परमाणु ऊर्जा विभाग से सम्बन्धित वित्तीय मामलों में भारत सरकार की शक्तियों का प्रयोग करेंगे सिवाय उन शक्तियों के जो विभाग के पास निहित हैं या भविष्य में विभाग को प्रदान या प्रत्यायोजित की जाएंगी ।
8. आयोग के पास अपनी कार्यविधि से सम्बन्धित नियम बनाने की शक्ति होगी । अध्यक्ष द्वारा निर्धारित समयों एवं संस्थानों पर आयोग की बैठकें आयोजित की जाएंगी ।

The Department of Atomic Energy was established in August, 1954 and since then research and development in the peaceful uses of atomic energy have made important and rapid strides and a greatly expanded programme is envisaged for the future, in the course of which India should be able to produce all the basic materials required for the utilisation of atomic energy and build a series of atomic power stations, which will contribute increasingly to the production of electric power in the country . These developments call for an organisation with full authority to pian and implement the various measures on sound technical and economic principles and free from all non-essential restrictions or needlessly inelastic rules . The special requirements of atomic energy, the newness of the field, the strategic nature of its activities and its international and political significance have to be borne in mind in devising such an organisation .
2. After careful consideration , the Government of India have decided to establish an Atomic Energy Commission with full executive and financial powers , modelled , more or less , on the lines of the Railway Board. This commission will replace the Commision set up in the late Department of Scientific Research Notification No. F-402/DSR/48 , dated 10th August , 1948 , which is hereby cancelled.
3. CONSTITUTION OF THE COMMISSION ( a) The Commission shall consist of full- time and part- time members and the total number of members shall not be less than three and not more than eleven .
(b) The Secretary to the Government of India in the Department ofAtomic Energy shall be the ex - officio Chairman of the Commission .
(c) A member of the Commission shall be the Member for Finance , who shall also be ex - officio Secretary to the Government of India in the Department of Atomic Energy in financial matters .
4. FUNCTIONS
The Atomic Energy Commission shall be responsible :
(a) for formulating the policy of the Department of Atomic Energy for the consideration and approval of the Prime Minister ;
(b ) for preparing the budget of the Department ofAtomic Energy for each financial year and getting it approved by Government; and
(c) for the implementation of Government's policy in all matters concerning atomic energy .
5. Within the limits of the budget provision , approved by Parliament, the Commission shall have the powers of PART III-SEC . 1 ]
theGovernment of India, both administrative and financial , for carrying out the work of the Department of Atomic Energy.
6. CHAIRMAN
(a) The Chairman in his capacity as Secretary to the Government of India in the Department of Atomic Energy shall be responsible under the Prime Minister for arriving at decisions on technical questions and advising Government on matters of atomic policy. All recommendations of the Commission on policy and allied matters shall be put up to the Prime Minister through the Chairman.
(b) The Chairman shall have the power to overrule the other members of the Commission , except that the Member for Finance shall have the right to ask that any financial matter , in which he does not agree with the Chairman , be referred to the Prime Minister and the Finance Minister.
(c) The Chairman may authorise any member of the Commission to exercise on his behalf, subject to such general or special orders as he may issue from time to time, such of his powers and responsibilities as he maydecide.
7. MEMBER FOR FINANCE
The Member for Finance shall exercise the powers of the Government of India, in financial matters concerning the Department of Atomic Energy except in so far as such powers have been, or may in future be, conferred on or delegated to the Department.
8. The Commission shall have power to frame its own rules of procedure . The Commission shall meet at such times and places as may be fixed by the Chairman .
