सा०का०नि० 32.- यतः वाणिज्य और उद्योग मंत्रालय ( केन्द्रीय बॉयलर बोर्ड ) भारत सरकार के दिनांक 8 सितम्बर, 2004 की अधिसूचना संख्या सा.का. नि. 312 के तहत इसके द्वारा प्रभावित होने वाले संभावित व्यक्तियों से आपत्तियां तथा सुझाव, उक्त अधिसूचना से संबंधित राजपत्र की प्रतियां जनता को उपलब्ध कराने की तारीख से पैंतालीस दिन की अवधि समाप्त होने तक मांगने के लिए भारतीय बॉयलर अधिनियम, 1923 (1923 का 5 ) की धारा 31 की उप- धारा ( 1 ) , जो दिनांक 18 सितम्बर , 2004 के भारत के राजपत्र के भाग II, खण्ड 3 , उपखण्ड (i ) में है, द्वारा यथा अपेक्षित भारतीय बॉयलर अधिनियम, 1950 में और संशोधन करने के लिये कुछ विनियमों के मसौदे प्रकाशित किये गये थे;

और जबकि उक्त राजपत्र की प्रतियां आम जनता को 27 सितम्बर, 2004 को उपलब्ध करा दी गई थी; और जबकि विनिर्दिष्ट अवधि के भीतर कोई आपत्तियां अथवा सुझाव प्राप्त नहीं हुए थे;

अतः अब भारतीय बॉयलर अधिनियम , 1923 की धारा 28 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्रीय बॉयलर बोर्ड द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्रीय बॉयलर बोर्ड एत‌द्वारा भारतीय बॉयलर विनियम, 1950 में आगे और संशोधन करने के लिए निम्नलिखित विनियम बनाती है, नामत :-

1. ( 1 ) इन विनियमों को भारतीय बॉयलर ( संशोधन ) विनियम , 2005 कहा जायेगा ।

[PART 11-SEC. 3 (1 ) ] ( 2) ये विनियम सरकारी राजपत्र में उनके प्रकाशन की तारीख से प्रभावी होंगे ।

2.'भारतीय बॉयलर विनियम , 1950 ( जिसे इसके पश्चात् उक्त विनियम कहा जायेगा ) में विनियम 57 के खण्ड ( ख ) के लिए निम्नलिखित खंड प्रतिस्थापित किया जायेगा, नामतः :-

" ( ख ) अन्य राष्ट्रीय अथवा अन्तर्राष्ट्रीय मानकों के अनुरूप वैल्डड ट्यूबें जो बॉयलर सुपर हीटर और हीट एक्सचेंजर ट्यूबों के रूप में प्रयोग के लिए उपयुक्त होने के कारण प्रायः प्रयोग में लाए जाने के लिए जानी जाती हैं, और जिन्हें विशिष्ट रूप से इन विनियमों द्वारा निषेध नहीं किया गयाहै, को भी उपयोग किया जा सकता है बशर्ते कि ऐसी ट्यूबें इन विनियमों की अपेक्षाओं को पूरी करती हों और इन विनियमों के अनुसार प्रमाणित हों।

बशर्ते यदि ट्यूबों का इन विनियमों के अन्तर्गत अपेक्षित दबाव पर हाइड्रोलिक परीक्षण नहीं किया गया है , जो निरीक्षण प्राधिकारी निर्माता/फेब्रीकेटरों की वर्कशापों अथवा प्रयोगकर्ता के परिसरों में अपेक्षित दबाव पर हाइड्रोलिक परीक्षण देखने के पश्चात् ऐसी ट्यूबों को स्वीकार कर सकता है । " ;

3. उक्त विनियमों में , 151 विनियम में, खंड ( i ) में, शुरू के पैराग्राफ में, " सभी बट्ट वेल्डिड जोड़ों" शब्दों के लिए " बट्ट वेल्डिड जोड़ों जैसा कि खंड ( ज ) में निर्दिष्ट किया गया है " शब्दों को प्रतिस्थापित किया जायेगा ।

4. उक्त विनियम में, विनियम 266 में, खंड ( छ ) के लिए, निम्नलिखित खंड प्रतिस्थापित किया जाएगा, नामत :-

" ह) मरम्मत के पश्चात्रेडियोग्राफिकल जांच- मरम्मत किए गए सभी क्षेत्र अनुमोदित तकनीकों द्वारा रेडियोग्राफिक या रेडियोस्कोपिक जांच के अध्यधीन होंगे ";

5. उक्त विनियमों में, 365 विनियम में " खण्ड ( ख ) में, उप खंड ( 2 ) में, मद ( ii ) के पश्चात् निम्नलिखित को शामिल किया जाएगा, नामतः -

** ( iii ) अनफायरड बॉयलरों के निर्माण में जब डिसड एन्ड गर्म सतह का रूप नहीं लेते हैं तो आई एस 2825 के अनुरूप कोल्ड स्पन डिसङ् एन्डस प्रयोग किया जा सकेगा " ।

6. उक्त विनियमों में, 382 विनियम में, खंड ( क) में, " त्रिपुरा टी आर " शब्दों के पश्चात् " उत्तरांचल यू आर " शब्दों को शामिल किया जाएगा ।

7. उक्त विनियमों में, 391 ( क) विनियम में, खंड ( ख ) में, उप खंड ( ii ) में " तकनीकी सलाहकार ( बॉयलर ) " शब्दों के लिए " मुख्य बॉयलर निरीक्षक " शब्दों को प्रतिस्थापित किया जाएगा ।

नामतः- 8. उका विनियमों में, 561 विनियम में, खंड ( ख ) में, उप खंड ( vii ) में, टिप्पण ( 2 ) के पश्चात् निम्नलिखित को शामिल किया जाएगा, ( 3 ) सभी बट्ट वेल्डिड जोड़ों की रेडियोग्राफिक रेडियोस्कोपी अथवा अल्ट्रासोनिक परीक्षण मैगनेटिक पार्टिकल निरीक्षण अथवा लिक्विड डाई पेनिट्रेंट निरीक्षण जैसी अन्य अनुमैंदित विधियों द्वारा अविनाशक जांच की जायेगी। जब वेल्डिड संघटकों पर रेडियोग्राफी के बदले रेडियोग्राफिक परीक्षण किया जाना होगा तो निम्नलिखित अपेक्षाओं को पूरा करना होगा , अर्थात्:-

( क ) निरीक्षण प्राधिकारी के अनुमोदनार्थ एक लिखित प्रक्रिया प्रस्तुत की जायेगी और उसमें निम्नलिखित शामिल किये जायेंगे: - ( i ) पदार्थ तथा मोटाई रेंज

( ii ) उपकरण योग्यताएं

( iii ) परीक्षण वस्तु विश्लेषण योजना

(iv ) रेडियोस्कोपिक पैरामीटर

(v ) छाना प्रसंस्करण पैरामीटर

(vi) छात्र प्रदर्शन पैरामीटर

(vii) छाया प्राप्ति अपेक्षिताएं

(viii ) स्वीकृति अस्वीकृति मानदंड कोड संदर्भ 145 भारत का राजपत्र: जनवरी 29, 2005/माघ 9 , 1926

(ix) कार्य निष्पादन मूल्यांकन

(x) आपरेटर की पहचान

( ख ) रेडियोस्कोपिक छाया की गुणवत्ता बढ़ाने हेतु एक इमेज प्रोसेसर की सहायता से प्रणाली को समर्थन दिया जायेगा और प्रणाली कार्य- निष्पादन गुणवत्ता इन्हें दर्शायेगा:--

(i ) 3 की पतला खंड वैषम्य संवेदनशीलता

(ii ) 2 की मोटा खंड वैषम्य संवेदनशीलता

(iii ) प्रति एम एम 3 लाइन जोड़ा का स्थानक विभेदन

( iv ) आई क्यू आई संवेदनशीलता- जब तार के आई क्यूआई का प्रयोग किया जाए तब जोड़ की मोटाई का 2 तार के व्यास धुरी प्रणाली कीन्यूनतम संवेदनर्शतां की धुरी की ओर उन्मुख होगी ।

( ग ) प्रतिनिधित्व वाले जोड़ के भाग विशेष के साथ सह - सम्बद्धिकरण हेतु रेडियोस्कोपों को उचित रूप से चिह्नित किया जायेगा । (घ) निरीक्षणकारी प्राधिकारी द्वारा यथा विनिर्दिष्ट रेडियोस्कोपिक जांच की तारीख के बाद पर्याप्त अवधि के लिए रेडियोस्कोपिक जांच आंकड़ों का निर्माता के संयंत्र में वीडियोटेप, मैग्नेटिक डिस्क अथवा आप्टिकल डिस्क में रिकार्ड और भंडारण किया जायेगा । रिकार्ड रिटेंशन अवधि में किसी भी समय दक्ष रेडियोस्कोपिक जांच रिकार्ड प्रत्यावर्तन उपलब्ध कराया जाएगा और यह परीक्षण वस्तु के लिए अनुरेखनीय होगा। (ङ) जब रेडियोस्कोपिक जांच के फलस्वरूप मरम्मत कर दी जाती है तो मरम्मत की कामयाबी का मूल्यांकन करने के लिए उसी रेडियोस्कोपिक तकनीक का प्रयोग करके मरम्मत किये गये भागों की पुनः जांच की जायेगी।

( च ) रेडियोस्कोप जांच संबंधी आंकड़ों की उचित व्याख्या करने में सहायता पहुंचाने के लिए प्रयोग में लायी गयी तकनीक के ब्यौरे आंकड़ों के साथ दिए जायेंगे । कम से कम उक्त सूचना में अनुमोदित प्रक्रिया संबंधी अपेक्षाएं और प्रणाली निष्पादन के परीक्षण संबंधी आंकड़े सम्मिलित होंगे ।

9. उक्त विनियम में, प्रपत्र IV में, निम्नलिखित टिप्पण को अंत में शामिल किया जाएगा, नामतः-

" टिप्पण : जहां स्टील का विनिर्माण एक निर्माता द्वारा होता है, जो एक सुप्रसिद्ध स्टील निर्माता के रूप में नहीं जाना जाता, उसका परीक्षण प्रमाण- पत्र निरीक्षक अधिकारी द्वारा हस्ताक्षरित होगा " ।

G.S.R. 32. Whereas certaindraft regulations further to amend the Indian Boiler Regulations , 1950 were published, as required by sub - section ( 1 ) of Section 31 of the Indian Boilers Act , 1923 (5 of 1923 ) , in Part II, Section 3 , sub- section ( is of the Gazette of India, dated the 18th September , 2004 vide notification of the Government of India in the Ministry of Commerce and Industry ( Department of Industrial Policy and Promotion ) (Central Boilers Board ) number G.S.R. 312, dated the 8th September , 2004 , for inviting objections and suggestions from all persons likely to be affected thereby till the expiry of the period of forty - five days from the date on which the copies of the Gazette containing the said notification were made available to the public;

And whereas the copies of the said Gazette were made available to the public on the 27th September, 2004 ;

And whereas , no objections or suggestions have been received within the specified period in respect of the amendments contained in this notification;

Now, therefore , in exercise of the powers conferred by Section 28 of the Indian Boilers Act , 1923 , the Central Boilers Board hereby makes the following regulations further to amend the Indian Boiler Regulations , 1950 , namely:-

1 (1) These regulations may be called the Indian Boiler (Amendment ) Regulations , 2005.

12) They shall come into force on the date of their publication in the Official Gazette .

2. In the Indian Boiler Regulations, 1950 (hereinafter referred to as the said regulations ) , in regulation 57, for clause (b) , the following clause shall be substituted, namely :-

"(b) The welded tubes conforming to other national or international standard which are known to be commonly used as being suitable for use as boiler, superheater or heat exchanger tubes and not specifically prohibited by these regulations can also be used provided such tubes satisfy the requirements of these regulations and are certified as per these regulations :

Provided that if the tubes are not hydraulically tested at the pressure required under this regulations , the Inspecting Authority may accept such tubes after witnessing hydraulic test at the required pressure at the maker's or fabricator's works or user's premises";

3. In the said regulations, in regulation 151, in clause ( i ) , in the opening paragraph, for the words "All butt welded joints" , the words " Butt welded joints as indicated in clause (h) " shall be substituted.

4. In the said regulations , in regulation 266 , for clause (g) , the following clause shall be substituted , namely :

"(g) Radiographical Examination after Repairs All repaired areas shall be subjected to Radiographic or Radioscopic examination by the approved techniques ." ;

5. In the said regulations , in regulation 365 in clause (b ) , in sub -clause (2 ) , after item (ii ); the following shall be inserted, namely:

"(iii) In the construction of unfired boilers when the dished ends do not form of the heating surface , cold spun dished ends conforming to IS : 2825 may be used. " :

6. In the said regulations , in regulation 382, in clause (a) , after the words " Tripura words "Uttaranchal UR" shall be inserted. TR" , the 7. In the said regulations , in regulation 391A, in clause (b ) , in sub -clause (ii ) , for the words , " Technical Adviser (Boilers)" , the words , " Chief Inspector of Boilers " shall be substituted.

8 In the said regulations, in regulation 561, in clause (b), in sub - clanse (viii ) , after Note (2 ) , the following shall be inserted, namely :

"(3 ) All butt welded joints shall be subjected to non -destructive examination by radiographic, radioscopy or other approved methods such as ultrasonic testing, magnetic particle inspection or liquid dye penetrant inspection. When radioscopic examination is to be performed in lieu of radiography on welded components , the following requirements shall be met , namely :-

(a) Awritten procedure shall be submitted for approval to the Inspecting Authority which shall contain the following:-

(1) material and the thickness range;

(ii) equipment qualifications ;

(iii) test object scan plan;

(iv) radioscopic parameters ;

(v) image processing parameters ;

(vi) image display parameters;

(vii) image archiving requirements ;

(viii) accept-reject criteria (Code reference);

(ix) performance evaluation;

(x) operator identification.

[PART II-SEC. 3 (i ) ] (b) The system shall be aided with an image processor to enhance the quality of the radioscopic images and system performance quality shall exhibit-

(1) a thin section contrast sensitivity of 3%;

(ii) a thick section contrast sensitivity of 2%;

(iii) a spatial resolution of 3 line pairs per mm;

( iv ) IQI sensitivity---2% of the joint thickness when wire IQI's are to be used, the wire diameter axis shall be oriented along the axis of the least sensitivity of the system.

(d) The radioscopic examination data shall be recorded and stored on videotape , magnetic disk or optical disk at the maker's plant for a sufficient period after the date of radioscopic examination as specified by the Inspecting Authority , efticient radioscopic examination record recall shall be made available at any time over the record retention period and shall be traceable to the test objects .

(e) When repair has been performed as a result of radioscopic examination , the repaired areas shall be re - examined using the same radioscopic technique to evaluate the effectiveness of the repair .

(f) To aid in proper interpretation of the radioscopic examination data , the details of the technique used shall accompany the data. As a minimum , the information shall include the approved procedure requirements and system performance test data . " ;

9. In the said regulation, in Form IV, the following Note shall be inserted at the end , namely : -

Note: Where the steel is manufactured by a maker , who is not recognised as a Well- known Steel Maker , the certificate of test shall be signed by the Inspecting Authority."

सा. का. दि. 33.- राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, दंत चिकित्सा पद भर्ती नियम, 1997 में संशोधन करने हेतु निम्नलिखित और नियम बनाते हैं , अर्थात्:-

1. ( 1 ) इन नियमों को दंत चिकित्सा पद भर्ती ( संशोधन ) नियम, 2005 कहा जाएगा ।

(2) ये सरकारी राजपत्र में उनके प्रकाशन की तिथि से प्रवृत्त हो जाएंगे ।

2. दंत चिकित्सा भर्ती नियम , 1997 में अनुसूची में कालम 11 के अंतर्गत ' नोट ' के स्थान पर निम्नलिखित नोट को प्रतिस्थापित किया जाएगा , अर्थात्: -

"NOTE : Vacancies caused by the incumbent being away on transfer on deputation or long illness or on study leave or under other circumstances for a duration of one year or more may be filled by the appointing authority on transfer on deputation basis from officers of Central Government or State Governments or Union Territories.

सा.का.नि. 36.- राष्ट्रपति , संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और अखिल भारतीय मृदा और भू- उपयोग सर्वेक्षण संगठन ( कनिष्ठ मृदा सर्वेक्षक ) भर्ती नियम , 1977 को, उन बातों के सिवाय अधिक्रांत करते हुए , जिन्हें ऐसे अधिक्रमण से पूर्व किया गया है या करने से लोप किया गया है , कृषि मंत्रालय ( कृषि और सहकारिता विभाग ) के अधीन अखिल भारतीय मृदा और भू- उपयोग सर्वेक्षण संगठन में सहायक फील्ड आफिसर के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्: - 1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों का संक्षिप्त नाम अखिल भारतीय मृदा और भू- उपयोग सर्वेक्षण संगठन ( सहायक फील्ड आफिसर । भर्ती नियम , 2005 है ।

2. पद-संख्या , वर्गीकरण और वेतनमान. उक्त पद की संख्या, उसका वर्गीकरण और उसका वेतनमान वह होगा जो इन नियमों से उपाबद्ध अनुसूची के स्तम्भ 2 से स्तम्भ 4 में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति, आयु-सीमा, अर्हताएं आदि . उक्त पद पर भर्ती की पद्धति, आयु सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तम्भ 5 से स्तम्भ 14 में विनिर्दिष्ट हैं ।

4. निरर्हत. वह व्यक्ति, -

(क ) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित हैं, विवाह किया है, या

(ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है ,

उक्त पद पर नियुक्ति का पात्र नहीं होगा:

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह, ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके , तथा संघ लोक सेवा आयोग से परामर्श करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी ।

6. व्यावृत्ति. -इन नियमों की कोई बात, ऐसे आरक्षण , आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय- समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

भर्ती की पति: भर्ती सीधे होगी या प्रोन्नति द्वारा ना

प्रतिनियुक्ति द्वारा या आमेलन द्वारा तथा विभिन्न पद्धतियों द्वारा भरे उगने वाले पदों की प्रतिशतता

प्रोन्नति:

5000-8000 रु . के वेतनमान में ऐसे फील्ड महायकों से जिन्होंने उस श्रेणी में तीन वर्ष नियमित सेवाकी हो।

50 प्रतिशत प्रोन्नति द्वारा , जिसके न हो सकने पर नियुक्ति द्वारा । 50 प्रतिशत प्रतिनियुक्ति द्वारा जिसके

नहो सकने पर मीधी भर्ती द्वारा ।

टिप्पण: जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में, जिन्होंने अपनी अर्हक/पात्रता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो वहां उनसे ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा परंतु यह तब जब कि उनके द्वारा की गई ऐसी अर्हक या पात्रता सेवा, अपेक्षित अर्हक या पात्रता सेवा के आधे से अधिक से या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित, जिन्होंने ऐसी अर्हक या पात्रता सेवा पहले ही पूरी कर ली है , अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली हो ।

प्रतिनियुक्ति:-

केन्द्रीय सरकार या राज्य सरकारों अथवा संघ राज्य क्षेत्र सरकारों के ऐसे अधिकारी: -

( क) ( i ) जो मूल काडर या विभाग नियमित आधार पर सदृश पद धारण किए हैं ; या

( ii ) जिन्होंने मूल काडर या विभाग में 5000-8000 रु. या उसके समतुल्य वेतनमान में नियमित आधार पर नियुक्ति के पश्चात् उस श्रेणी में तीन वर्ष सेवा की हो ।

(ख) जिनके पास स्तंभ ( 8 ) के अधीन सीधी भर्ती किए जाने वाले व्यक्तियों के लिए विहित शैक्षिक अहंताएं और अनुभव हो ।

(पोषक प्रवर्ग के ऐसे विभागीय अधिकारी, जो प्रोन्नति की सीधी पंक्ति में हैं, प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे । इसी प्रकार प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे । प्रतिनियुक्ति जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन या विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवधि है, साधारणतया तीन वर्ष से अधिक नहीं होगी । प्रतिनियुक्ति पर नियुक्ति के लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहीं

G.S.R. 36. In exercise of the powers conferred by the proviso to article 309 of the Constitution, and in supersession of the All India Soil and Land Use Survey Organization (Junior Soil Survey) Recruitment Rules , 1977, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Assistant Field Officer in the All India Soil and Land Use Survey Organization under the Ministry of Agriculture ( Department of Agriculture and Cooperation) , namely :-

1. Short title and commencement . ( 1 ) These rules may be called the All India Soil and Land Use Survey Organization ( Assistant Field Officer) Recruitment Rules , 2005 .

(2) They shall come into force on the date of their publication in the Official Gazette .

2. Number of post , classification and scale of pay. The number of the said post, its classification and the scale ofpay attached thereto shall be as specified in columns 2 to 4 of the Schedule annexed to these rules .

3. Method of recruitment, age limit and other qualifications ,etc. The method of recruitment to the said post, age limit, qualifications and other matters relating thereto shall be as specified in columns 5 to 14 of the said Schedule .

4. Disqualification . No person ,-

( a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who , having a spouse living , has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post :

Provided that the Central Government may , if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operation of this rule .

5. Power to relax.- Where the Central Government is of opinion that it is necessary and expedient so to do , it may, by order , for reasons to be recorded in writing and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons .

6. Saving. provided they are not short of the requisite qualifying or eligibility service by more than half of such qualifying or eligibility service or two years whichever is less, and have successfully completed their probation period for promotion to the next higher grade alongwith their juniors who have already completed such qualifying/eligibility service .

Deputation:

Officers or the Central Government or State or Union Territory Governments:

(a) (1) holding analogous posts on regular basis in the parent cadre or department; or

(ii) with three years service in the grade rendered after appointment thereto on a regular basis in the scale of pay of Rs . 5000-8000 or equivalent in the parent cadre or Department; and

(b) possessing the educational qualifications and experience prescribed for direct recruits under column (8) .

(Thedepartmental Officers in the feeder category who are in the direct line of promotion will not be eligible for consideration for appointment on deputation. Similarly, deputationists shall not be eligible for consideration for appointment bypromotion.

Period ofdeputation including period ofdeputation in another ex - cadre post held immediately preceding this appointment in the same or some other organisation or Department of the Central Government shall ordinarily not to exceed three years. The maximum age limit for appointment by deputation shall be not exceeding 56 years as on the closing date of receipt of applications.)

जिन्हें ऐसे अधिक्रमण से पूर्व किया गया है या करने से लोप किया गया है , कृषि मंत्रालय ( कृषि और सहकारिता विभाग ) के अधीन अखिल भारतीय मृदा और भू उपयोग सर्वेक्षण संगठन में फील्ड आफिसर के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्: -

1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों का संक्षिप्त नाम अखिल भारतीय मृदा और भू- उपयोग सर्वेक्षण संगठन (फील्ड आफिसर ) भर्ती नियम, 2005 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद -संख्यो , वर्गीकरण और वेतनमान -उक्त पद की संख्या, उसका वर्गीकरण और उसका वेतनमान वह होगा जो इन नियमों से उपाबद्ध अनुसूची के स्तम्भ 2 से स्तम्भ 4 में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति , आयु सीमा, अर्हताएं आदि उक्त पद पर भर्ती की पद्धति, आयु सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तम्भ 5 से स्तम्भ 14 में विनिर्दिष्ट हैं ।

4. निरर्हता-वह व्यक्ति, -

क ) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, त्रिवाह किया है, या

( ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है ,

उक्त पद पर नियुक्ति का पात्र नहीं होगा:

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधिके अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके, तथा संघ लोक सेवा आयोग से परामर्श करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

6. त्र्यावृत्ति. -इन नियमों की कोई बात , ऐसे आरक्षण , आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों , अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

5500-9000 रु. के वेतनमान में ऐसे सहायक फील्ड आफिसर, जिन्होंने उस श्रेणी में पांच वर्ष की नियमित सेवा की है और जिनके पास किसी मान्यताप्राप्त विश्वविद्यालय से कृषि में स्नातक या समतु गडिग्री हो।

नोट: ( i ) ऐसे विद्यमान पदधारी जो इस अधिसूचना की तारीख को नियमित आधार पर सहायक फील्ड आफिसर का पद धारण किए हुए थे, उन्हें ऐसी अपेक्षा से छूट प्राप्त होगी ।

(ii ) जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में, जिन्होंने अपनी अर्हक या पात्रता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो वहां उनसे ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा परंतु यह तब जब कि उनके द्वारा की गई ऐसी अर्हक या पात्रता सेवा, अपेक्षित अर्हक या पात्रता सेवा के आधे से अधिक से या दो वर्ष से , इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित, जिन्होंने ऐसी अर्हक या पात्रता सेवा पहले ही पूरी कर ली है, अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली हो । यदिविभागीय प्रोन्नति समिति है , तो उसकी संरचना
