II . एन एस ई उप नियम के अध्याय XIII के उप नियम (4) की धारा (क) को निम्नलिखित के माध्यम से संशोधित किए जाने का प्रस्ताव है : -

IV . एन एस ई उप नियमों के अध्याय- XIII के क्रमशः उप नियम 12, 13, 14 , और 15 के रूप में निम्नलिखित धाराएं जोड़े जाने का प्रस्ताव है ।

12) संगत प्राधिकारी निवेशक संरक्षण निधि ट्रस्ट के साथ परामर्श से प्रत्येक तीन वर्ष में किसी एक निवेशक से एकल दावे के विरूद्ध उपलब्ध क्षतिपूर्ति की राशि की समीक्षा करेगा और क्रमिक रूप से वृद्धि करेगा । संगत प्राधिकारी तय की गई क्षतिपूर्ति की सीमा और उसमें किसी परिवर्तन को प्रेस विज्ञप्ति के माध्यम से और एक्सचेंज की वेबसाइट के माध्यम से जनता को प्रसारित करेगा ।
(13) निवेशक संरक्षण ट्रस्ट निवेशकों के व्यक्तिगत दावे की पात्रता अथवा अन्यथा के संबंध में चूककर्ता समिति की सलाह ले सकता है ।
(14) संगत प्राधिकारी निवेशक दावों की प्रोसेसिंग और निपटान में सुविधा के लिए निवेशक संरक्षण निधि ट्रस्ट को प्रशासनिक सहायता प्रदान करने की व्यवस्था करेगा ।
(15) सट्टात्मक लेन- देनों अथवा जो झूठे अथवा कपटपूर्ण हैं, से उठने वाले दावाकर्ताओं के दावे निवेशक संरक्षण निधि से क्षतिपूर्ति के पात्र नहीं होंगे।

नेशनल सिक्यूरिटीज़ क्लीयरिंग कारपोरेशन लिमिटेड' पंजीकृत कार्यालय : एक्सचेंज प्लाजा , सी-1 , ब्लॉक जी, बांद्रा-कुर्ला काम्पलेक्स, बांद्रा ( पूर्व) ,मुंबई -400051 एनएससीसीएल नियमों (फ्यूचर एंड आप्शन खंड) के मसौदा संशोधन, जैसा नीचे दिए गए है, भारत के राजपत्र में सामान्य धारा अधिनियम , 1897 की धारा 23 के उपबंधों के अनुसार आलोचना के लिए प्रकाशित किए जाते हैं । कोई व्यक्ति एनएससीसीएल नियम (फ्यूचर एंड आप्शन खंड) के प्रस्तावित संशोधनों पर किन्हीं प्रेक्षणों को लिखित में अधोहस्ताक्षरी को राजपत्र में इस प्रकाशन की तारीख से पन्द्रह दिन के अंदर एक्सचेंज प्लाजा , सी-1 , ब्लॉक जी, बांद्रा- कुर्ला काम्प्लेक्स, बांद्रा ( पूर्व) , मुंबई को भेज सकता है । उपरोक्त तारीख के बाद प्राप्त होने वाले प्रेक्षणों पर मसौदा संशोधनों पर विचार करते समय ध्यान में नहीं रखा जाएगा ।
1. एनएससीसीएल नियम (फ्यूचर एंड आप्शन खंड) के अध्याय- IV में नियम 5(10 क) के रूप में निम्नलिखित धारा जोड़ा जाना प्रस्तावित है ;

नियम 5 (10) में कुछ भी होने के बावजूद, संगत प्राधिकारी अपने अनन्य विवेक से एफएंडओ खंड की क्लीयरिंग सदस्यता को किसी अन्य व्यक्ति अथवा सत्ता को अंतरित करने की अनुमति दे सकता है, जो ऐसे निबंधनों ओर शर्तों के अधीन होगी जैसाकि संगत प्राधिकारी अपने अनन्य विवेक से समय - समय पर निर्धारित करता है ।

2. (1) एनएससीसीएल नियम (फ्यूचर एंड आप्शन खंड) के अध्याय- IV में मौजूदा नियम 10 को नियम 10 के तहत धारा (1 ) के रूप में क्रमांकित किए जाने का प्रस्ताव है ; और
( ii) निम्नलिखित धारा को एनएससीसीएल नियम ( फ्यूचर एंड आप्शन खंड) के अध्याय- IV में नियम 10 के तहत धारा (2) के रूप में जोड़े जाने का प्रस्ताव है और

किसी क्लीयरिंग सदस्य की मृत्यु पर उसकी एफएंडओ खंड की सदस्यता समाप्त करने पर प्रतिभूति जमा राशियां, अन्य धनराशियां, कोई अतिरिक्त जमाराशि, चाहे वे नकद, बैंक गारंटियों, प्रतिभूतियों अथवा अन्यथा, अथवा क्लीयरिंग कारपोरेशन के पास पड़ी प्रतिभूतियां हों को ऐसे ढंग से निपटा जाएगा जैसाकि संगत प्राधिकारी समय- समय पर निर्धारित करता है।

4 भारतीय प्रतिभूति और विनिमय बोर्ड ( सेबी ) द्वारा उनके दिनांक जनवरी , 2005 के पत्र सं. एमआरडी/डीएसए/डीएसई/ 30098 / 05 द्वारा विधिवत् रूप से अनुमोदित नया उप- नियम सं. 246(3 ) जोड़कर तथा विद्यमान उप - नियम सं. 224क में संशोधन करके दिल्ली स्टॉक एक्सचेंज एसोसिएशन लिमिटेडं के उप- नियमों में संशोधन करना।
संशोधित उप-नियम सं. 224क
224क : संविदा नोट इलैक्ट्रानिक फार्म में जारी करना संस्थागत निवेशक 01 जुलाई , 2004 से लेनदेन संबंधी निम्नलिखित ब्यौरों का पालन करेंगे । 1.0 जैसा कि एक्सचेंज के संबंधित विनियम में जैख किया गया है , सदस्य संविदा नोट निर्धारित फार्मेट में इलैक्ट्रानिक फार्म में जारी कर सकते हैं ऊ डिजिटल हस्ताक्षर द्वारा अधिप्रमाणित हो , बशर्ते सदस्यों ने सूचना प्रौद्योगिकी अधिनियम , 2000 के अंतर्गत प्रमाणनकर्ता प्राधिकारी से डिजिटल हस्ताक्षर प्रमाण- पत्र प्राप्त किया हो ।
1.1 निर्धारित फार्मेट में भौतिक संविदा नोट में दी गई सभी मानक पूर्व- मुद्रित शर्तें सम्मिलित होंगी और उन उप- नियमों के संबंधित खंड भी सम्मिलित होंगे जिनके अध्यधीन उक्त संविदा नोट जारी किया जा रहा है ।
1.2 सदस्य सूचना प्रौद्योगिकी अधिनियम, 2000 के प्रावधानों का अनुमालन करते हुए एक्सचेंज के संबंधित विनियमों के अनुसार इलैक्ट्रानिक संविदा के अभिलेखा की साट प्रति इस रूप में रखेगा कि उनसे कोई छेड़छाड़ न की जा सके।
1.3 संविदा नोट सदस्य द्वारा निर्धारित फार्मेट ( आइएन 515 मैसेजिंग फार्मेट ) में इलैक्ट्रानिक फार्म में जारी किया जाएगा और उसे अभिरक्षक और/ अथवा संस्थागत निवेशक को भेजा जाएगा ।
1.4 यदि संविदा नोट के संबंध में सीधे संस्थागत निवेशक द्वारा कार्रवाई की जाती है तो , संस्थागत निवेशक आइएफएन 598 मैसेजिंग फार्मेट का उपयोग करते हुए सदस्य को संविदा नोट की स्वीकृति अथवा अस्वीकृति की कारोबारी पुष्टि भेजेगा । अभिरक्षक आइएफएन 548 मैसेजिंग मानक फार्मेट का उपयोग करते हुए सदस्य को ऐसे संविदा नोट की स्वीकृति अथवा अस्वीकृति की पुष्टि भी 2-440 GI/2004
भेजेगा
1.5 यदि संविदा नोट के संबंध में कार्रवाई अभिरक्षक द्वारा संस्थागत निवेशक की ओर से की जाती है तो, अभिरक्षक संस्थागत निवेशक आइएफएन 548 मैसेजिंग फार्मेंट का उपयोग करते हुए सदस्य को संविदा नोट की स्वीकृति अथवा अस्वीकृति की पुष्टि भेजेगा।
1.6 संस्थागत निवेशक अपने अभिरक्षक को भेजे जाने वाले आइएफएन 540 से आइएफएन 543 मैसेजिंग फार्मेटों में अभिरक्षक को निम्नलिखित प्रकार के कारोबार के लिए निपटान संबंधी निर्देश भेजेगा:
(क ) आइएफएन 540 समाशोधन गृह क्रय कारोबार के लिए निपटान संबंधी निर्देश। (ख) आइएफएन 541 सुपुर्दगी बनाम भुगतान (डीवीपी ) क्रय कारोबार के लिए निपटान संबंधी निर्देश ।
(ग) आइएफएन 542 समाशोधन गृह विक्रय कारोबार के लिए निपटान संबंधी निर्देश। (घ) आइएफएन 543 सुपुर्दगी बनाम भुगतान (डीवीपी) विक्रय कारोबार के लिए निपटान संबंधी निर्देश।
1.7 अभिरक्षक आइएफएन 544 से आइएफएन 547 मैसेजिंग फार्मेटों में संरथागत निवेशक को निपटान के निष्पादन की पुष्टि/ अस्वीकृति संबंधी निर्देश निम्नलिखित प्रकार से भेजेगा :
(क) आइएफएन 544 : आइएफएन 540 मैसेजिंग फार्मेट में प्राप्त किसी निर्देश की पुष्टि/अस्वीकृति।
(ख) आइएफएन 545 : आइएफएन 541 मैसेजिंग फार्मेट में प्राप्त किसी निर्देश की पुष्टि/अस्वीकृति।
(ग) आइएफएन 546 : आइएफएन 542 मैसेजिंग फार्मेट में प्राप्त किसी निर्देश की पुष्टि/अस्वीकृति।
(घ) आइएफएन 547 : आइएफएन 543 मैसेजिंग फार्मेट में प्राप्त किसी निर्देश की पुष्टि/अस्वीकृति।
1.8 यदि कोई संदेश ( ऊपर उल्लिखित कार्यकलापों के लिए ) एक उपयोगकर्ता से दूसरे उपयोगकर्ता को एसटीपी केंद्रीकृत हब फ्रेमवर्क का उपयोग करके 36

दी दिल्ली स्टॉक एक्सचेंज एसोसिएशन लिमिटेड भेजा जाता है तो ऐसे संदेश की पुष्टि/ अस्वीकृति भी एसटीपी केंद्रीकृत हब फ्रेमवर्क का उपयोग करके भेजी जाएगी ।
1.9 मैसेजिंग फार्मेट ( आइएफएन 515 ) निम्नलिखित प्रकार से संशोधित हो जाएगा :
(क ) संविदा नोट एक्सचेंज के जिन संबंधित उप-नियमों/नियमों/विनियमों के अंतर्गत जारी किया जा रहा है , प्रत्येक संविदा नोट पर उनका उल्लेख करने की अनिवार्य अपेक्षा को निम्नलिखित प्रकार से संशोधित किया गया है :
1. यह अपेक्षा अनिवार्य नहीं बल्कि वैकल्पिक है ।
2. सदस्य यह सुनिश्चित करेगा कि संविदा नोट एक्सचेंज के जिन संबंधित उप- नियमों/नियमों/विनियमों के अंतर्गत जारी किया जा रहा है , उनका उल्लेख सदस्य ग्राहक करार और सदस्य- उपदलाल- ग्राहक करार के बीच त्रिपक्षीय करार ( यदि लागू हो तो ) में किया जाए ।
3. उपर्युक्त प्रावधान के लिए विद्यमान फील्ड को हटाया नहीं जाएगा और इसका उपयोग एक ग्राहक से दूसरे ग्राहक को अभ्युक्तियां ( यदि कोई हो तो) संप्रेषित करने के लिए मुक्त पाठ फील्ड के रूप में किया जाएगा । (ख) प्रत्येक सविदा नोट के लिए ' समेकित स्टाम्प शुल्क का भुगतान ' की शर्त का उल्लेख सदस्य-ग्राहक करार और सदस्य- उपदलाल- ग्राहक करार के बीच त्रिपक्षीय करार ( यदि लागू हो तो ) में किया जाएगा। उक्त शर्त का उल्लेख प्रत्येक संविदा नोट के मुक् पाठ फील्ड में ( जैसा किमद 3 ( क (iii ) में उल्लेख किया गया है/किया जाए।
() बाज़ार के प्रकारों की अनुपूरक श्रेणी को दर्शाने के लिए ' बाजार के प्रकार ' वाले फील्ड (फील्ड 70 ई ) में ' टीटी ' अर्थात् व्यापार के लिए व्यापार तथा ' ओटी ' अर्थात् अन्य की एक श्रेणी सम्मिलित की जाएगी ।

उप- नियमों में संशोधन क्रमशः
(घ) संविदा नोट में आर्डर के समय को अनिवार्य फील्ड के रूप में निर्धारित किया गया था। आर्डर के समय को अब वैकल्पिक फील्डों में सम्मिलित किया जाएगा।
(ड. ) जिन प्रतिभूतियों का अभौतिकीकरण नहीं किया गया है, इसलिए उनका कोई आइएसआइएन कोड नहीं है। ऐसी प्रतिभूतियों के लिए ( जहां आइएसआइएन संख्या उपलब्ध नहीं है ) वहां एसटीपी उपयोगकर्ताओं को आइएसआइएन संख्या के फील्ड में एक्सचेंज द्वारा दिया गया प्रतिभूति कोड प्रविष्ट करना होगा। यदि एक्सचेंज के प्रतिभूति कोड की संख्या की लंबाई 12 अक्षरों की निर्धारित फील्ड लंबाई से कम हो तो कोड लिखते समय उसमें उससे पूर्व शून्य लगाए जाएंगे ।
(च) लेखा परीक्षा के प्रयोजन के लिए पूरी जानकारी रखने की दृष्टि से यह स्पष्ट किया जाता है कि यदि इलैक्ट्रानिक संविदा नोट अस्वीकार कर दिया जाता है तो अभिरक्षक को (मैसेजिंग फार्मेट आइएफएन 548 में ) अथवा निधि प्रबंधक को (मैसेजिंग फार्मेट आइएफएन 598 में ) सदस्य को अस्वीकृति संदेश भेजना आवश्यक होगा । सदस्य केवल अस्वीकृति संदेश प्राप्त होने पर ही अस्वीकृत संविदा नोट को रद्द करेगा और नई संख्या देते हुए एक नया संविदा नोट जारी करेगा । (छ) निर्धारित किए गए संदेश मानकों में पहचानवाली कोड संख्याओं की प्रविष्टि को मानक स्वरूप प्रदान करने की दृष्टि से यह स्पष्ट किया जाता है कि विभिन्न संस्थाओं द्वारा निम्नलिखित कोड संख्याओं का उपयोग किया जाएगा ।
1. सदस्य : सेबी की पंजीकरण संख्या (जब तक प्रत्येक सदस्य के लिए मैपिन पहचान संख्या उपलब्ध न हो ) 2. म्युच्युअल फंड और म्युच्युअल फंडों की स्कीमेंः म्युच्युअल फंडों के लिए सेबी की पंजीकरण संख्या और स्कीमों कं लिए एक्सचेंज द्वारा जारी विशिष्ट 37 भाग IV]

लागू होगा और प्रत्येक एक्सचेंज के लिए उसी फार्मेट में अलग- अलग करार करने की आवश्यकता होगी ) , एकसमान जोखिम प्रकटीकरण प्रलेख , सदस्य- उपदलाल करार का उपयोग करेंगे । ग्राहक कोड संख्या ( जब तक किसी म्युच्युअल फंड की प्रत्येक स्कीम के लिए मैपिन पहचान संख्या उपलब्ध न हो)
( ख ) सदस्य अपने ग्राहकों की संतोषजनक रूप से पहचान करेगा। यदि आवश्यक हो तो वह ग्राहकों से कोई अतिरिक्त जानकारी मांग सकता है ताकि वह ग्राहक के पूर्ववृत्त के बारे में स्वयं को संतुष्ट कर सके । सदस्य ग्राहक के बारे में जानकारी यथावश्यक रूप से उपलब्ध करेगा।
3. विदेशी संस्थागत निवेशक और उप-खातेः विदेशी संस्थागत निवेशक के लिए सेबी की पंजीकरण संख्या और उप - खाते के लिए एक्सचेंज द्वारा जारी विशिष्ट ग्राहक कोड संख्या ( जब तक प्रत्येक विदेशी संस्थागत निवेशकों और उनके उप- खातों के लिए मैपिन (ग) पहचान संख्या उपलब्ध न हो )
4. अभिरक्षक : सेबी की पंजीकरण संख्या ( जब तक कि प्रत्येक अभिरक्षक के लिए मैपिन पहचान संख्या उपलब्ध न हो )
5. एसटीपी सेवा प्रदाता और एसटीपी केंद्रीकृत हब : मैपिन पहचान संख्या
6. निक्षेपागार और एक्सचेंज/समाशोध

पहचान संख्या
ग्राहक पंजीकरण फार्म प्राप्त करने की आवश्यकता के मामले में भारतीय प्रतिभूति और विनिमय बोर्ड द्वारा पंजीकृत विदेशी संस्थागत निवेशक , म्युच्युअल फंडों , उद्यम पूंजी फंडों और विदेशी उद्यम पूंजी निवेशकों, अनुसूचित वाणिज्य बैंकों , बहुपक्षीय और द्विपक्षीय विकास वित्तीय संस्थाओं, राज्य औद्योगिक विकास निगमों, बीमा विनियामक विकास प्राधिकरण ( आइआरडीए ) के पास पंजीकृत बीमा कंपनियों तथा कंपनी अधिनियम, 1956 की धारा 4क के अंतर्गत यथापरिभाषित सार्वजनिक वित्तीय संस्थाओं को छूट दी जा सकती है । इसके अतिरिक्त, सदस्य और ये ग्राहक अपने स्वविवेक पर सदस्य- ग्राहक करार निष्पादित करने तथा जोखिम प्रकटीकरण प्रलेखों की विषय - वस्तु ऐसे ग्राहकों की जानकारी में लाने की आवश्यकता के बारे में निर्णय ले सकते हैं । 7. वित्तीय संस्थाओं , बैंकों आदि, जैसे अन्य संस्थागत निवेशक : एक्सचेंजों द्वारा जारी विशिष्ट ग्राहक कोड संख्या (जब तक प्रत्येक संस्थागत निवेशक के लिए मैपिन पहचान संख्या उपलब्ध ( न हो)
घ) मॉडल त्रिपक्षीय करार की अपेक्षा 1 दिसम्बर, 2004 से लागूहोगी।

ज ) सभी बाज़ार सहभागी संस्थागत कारोबार के लिए इलैक्ट्रानिक संविदा नोट सेबी द्वारा निर्धारित संशोधित फार्मेट में जारी करेंगे।
निदेशक बोर्ड की 27 मार्च, 2004 को हुई बैठक में यथा अनुमोदित रूप से विनियम में संशोधन ।

14.3 ( उप- नियम सं. 224क देखें ) इक्विटी बाज़ार और ऋण बाज़ार के लिए इलैक्ट्रानिक फार्म में संविदा नोट इस विनियम के परिशिष्ट ग में यथा निर्धारित रूप से कमशः फार्म ' ग ' और फार्म ' घ ' में अथवा भारतीय प्रतिभूति और विनिमय बोर्ड तथा/ अथवा सेबी के अनुमोदन से एक्सचेंज के निदेशक बोर्ड द्वारा समय - समय पर निर्धारित किए गए ऐसे किसी अन्य फार्म या फार्मों में जारी किए जाएंगे जो उनके अतिरिक्त या उनके संशोधन या उनके प्रतिस्थापन के रूप में हों।

3.12 , प्रतिभूति लेन- देन कर का संग्रहण
प्रत्येक कारोबारी सदस्य एक्सचेंज को उसकी ओर से अथवा उसके संघटदों की ओर से प्रविष्ट किए गए करोधय प्रतिभूतियों संबंधी लेन-देनों के संबंध में प्रतिभूति लेन- देन (एसटीटी) प्रेषित करेगा, जो ऐसे कर के परिकलन और वसूली के लिए समय- समय पर संगत प्राधिकारी द्वारा निर्धारित प्रक्रियाओं के अनुसार होगा। कोई कारोबारी सदस्य, जो समय - समय पर संगत प्राधिकारी द्वारा निर्धारित प्रक्रियाओं के अनुसार भुगतान नहीं करता है, तो वह गैर- भुगतान के ऐसे परिणामों के लिए जिम्मेदार होगा जिसमें कारोबारी सुविधा को हटाना, कारोबारी सदस्य की धनराशियों से विनियोग, रुपया देने को रोकना, आदि शामिल है, परन्तु सीमित नहीं , जैसाकि समय - समय पर निर्धारित किए जाते हैं ।

2.4 प्रतिभूति लेन-देन कर का संग्रहण
क्लीयरिंग कारपोरेशन एक्सचेंज की ओर से प्रतिभूति लेन- देन कर की वसूली करेगा । प्रत्येक क्लीयरिंग सदस्य क्लीयरिंग कारपोरेशन को एक्सचेंज के कारोबारी सदस्य द्वारा उसकी ओर से अथवा उसके संघटकों की ओर से प्रविष्ट किए गए लेन-देनों और ऐसे क्लीयरिंग सदस्य के माध्यम से निकासी किए और निपटाए गए लेन-देनों के संबंध में देयं प्रतिभूति लेन- देन कर क्लीयरिंग कारपोरेशन को प्रेषित करेगा, जो ऐसे कर के परिकलन और वसूली के लिए समय - समय पर संगत प्राधिकारी द्वारा निर्धारित प्रक्रियाओं के अनुसार होगा । कोई क्लीयरिंग सदस्य , जो समय - समय पर संगत प्राधिकारी द्वारा निर्धारित प्रक्रियाओं के अनुसार भुगतान नहीं करता है, तो वह गैर- भुगतान के ऐसे परिणामों के लिए जिम्मेदार होगा जिसमें क्लीयरिंग सुविधा को हटाना, क्लीयरिंग सदस्य की धनराशियों से विनियोग, रुपया देने को रोकना, आदि शामिल है, परन्तु सीमित नहीं, जैसाकि समय- समय पर निर्धारित किए जाते हैं ।

IV . It is proposed to insert the following clauses as Byelaws 12, 13 , 14 and 15 respectively of Chapter XIII of NSE Byelaws .

(12) The relevant authority, in consultation with the Investor Protection Fund Trust, shall review and progressively increase the amount of compensation available against a single claim from an investor every three years . The relevant authority shall disseminate the compensation limit fixed and any change thereof, to the public through a Press Release and also through web site of the Exchange.
(13) The Investor Protection Fund Trust may seek the advice of the Defaulters' Committee as to the eligibility or otherwise of individual claims of investors .
(14) The relevant authority shall arrange to provide administrative assistance to the Investor Protection Fund Trust to facilitate the processing and settlement of investor claims .
(15) The claims of the claimants arising out of speculative transactions or which are sham or collusive shall not be eligible for compensation from the Investor Protection Fund .

224A: Issuance of Contract Notes in electronic form.
The Institutional investors shall follow the following transaction details from July 01 , 2004.
1.0 The members can issue the contract notes in electronic form in the prescribed format as mentioned in the relevant regulation of the exchange , authenticated by means of digital signatures , provided that members have obtained digital signature certificate from the certifying Authority under IT Act , 2000 .
1.1 All the standard pre- printed terms and conditions in the physical contract note and also the relevant clauses of bye - laws subject to which the said contract note is being issued shall be included in the prescribed format .
1.2 The member shall maintain the records of electronic contract in soft non temperable form in accordance with the relevant regulation of the Exchange in compliance with the provisions of the IT Act , 2000 .
1.3 A contract note in electronic form in the prescribed format ( IFN 515 messaging format) shall be issued by the member & sent to the custodian and / or institutional investor .
1.4 In case the contract notes is processed directly by the institutional investor, the institutional investor shall send the trade confirmation of the acceptance or rejection of the contract note to the member by using the IFN 598 messaging format . The custodian shall also send the confirmation of acceptance or rejection of such contract note to the member using the messaging standard IFN 548.
1.5 In case the contract note is processed by the custodian on behalf of the institutional investor, the custodian shall send the confirmation of acceptance or rejection of the contract note to the member by using the IFN 548 messaging format.
1.6 The institutional investor shall send settlement instructions to its custodian in IFN 540 to IFN 543 messaging formats to the custodian for the following trade types:
(a) IFN 540 : settlement instruction for a clearing house buy trade .
(b) IFN 541 : settlement instruction for a delivery- v/s- payment ( DVP) buy trade .
[PART IV (c) IFN 542 settlement instruction for a clearing house sell trade.
(d) IFN 543 : settlement instruction for a delivery-v/s- payment ( DVP) sell trade .
1.7 The custodian shall confirm/ reject the execution ofthe settlement instruction to the institutional investor in IFN 544 to IFN 547 messaging formats in the following manner :
(a) IFN 544 confirmation/ rejection of an instruction received in messaging format IFN 540.
(b) IFN , 545 : confirmation/rejection of an instruction received in messaging format IFN 541 .
(c) IFN 546 : confirmation/rejection of an instruction received in messaging format IFN 542.
(d) IFN 547 confirmation/rejection of an instruction received in messaging format IFN 543 .
1.8 It a message ( for the activities mentioned above) is sent using the STP centralised hub framework from one user to another user, then the confirmation/ rejection for such a message shall also be sent using the STP centralised hub framework .
1.9 The messaging format ( IFN 515) be stand modified as follows:
(a) The mandatory requirement of mentioning the relevant bye-laws/ rules/ regulations of the exchange subject to which the said contract note is being issued on each contract note stands modified in the following manner:
1. The requirement is not mandatory but optional
2. The member shall ensure that the relevant bye- laws/rules/regulations of the exchange subject to which the contract note is being issued, is mentioned in the member client agreement and the tripartite agreement between the member -sub- broker - client agreement ( if applicable) .
3. The existing field for the above provision shall not be deleted and may be used as a free text field for one constituent to communicate remarks ( if any) to another constituent.
(b) The clause of ' payment of consolidated stamp duty' for each contract note shall be mentioned in the member-client agreement and the tripartite agreement between the member - sub-broker- client agreement ( if applicable ) . The said clause may be stated in the free text field (as mentioned in point 3 [a(iii) ] of each contract note.

(h) All market participants shall issue the electronic contract note for institutional trades inthe modified format prescribed by SEBI .
(c) In the field ' market type' ( field 70E ) a category of ' TT' i.e. trade for trade and ' OT' i.e others shall be added to represent the supplementary category of market types

(d) The order time was prescribed as a mandatory field in the contract note . The order time shall now be included in the optional fields
(e) Securities which are not de- materialised and hence do not have an ISIN code . For such securities (Where ISIN number is not available ) the STP users would be required to input the security code given by the exchange in the ISIN number field . In case the number length of the exchange scrip code is shorter than the prescribed field length of 12 characters , the code shall be prefixed with zeros .
(a) TheMembers shall use the Client Registration Form (Uniform across all the segments and exchanges wherethe member is trading on different segments and exchanges) , Member Clients Agreements (Uniform across all the segments of an exchange . However a separate agreement in the same format would be required for each of the exchanges where the member is trading on different exchanges ) and Model Tripartite agreement between Member - sub broker and clients (Applicable only in cash segment and a separate agreement in the same format would be required for each of the exchange) , Uniform Risk Disclosure Documents , Member Sub broker agreement as specified by Securities & Exchange Board of India.
(b) The Member shall satisfactorily identify his clients . He may seek any additional information from the clients if any so as to satisfy himself about the antecedents of the client . The Member shall provide the clients information as and when required .
(f) In order to maintain a complete audit trail , it is clarified that in case an electronic contract note is rejected , the custodian (in massaging format IFN 548) or the fund manager ( in massaging format IFN 598) shall be required to send a rejection massage to the member . Only on receipt of the rejection massage , the member shall cancel the rejected contract note and issue a fresh contract note bearing a new number.
(g) In order to bring in standardisation in the input of the identification codes in the prescribed messaging standards , it is clarified that the following codes shall be used by the various entities:
1. Members : SEBI registration number (until MAPIN ID is available for every member
(c) The requirement of obtaining Client Registration form may be waived for SEBI registered Foreign Institutional Investor, Mutual Funds , Venture Capital funds and Foreign Venture Capital Investors , Scheduled Commercial Banks , Multilateral and Bilateral Development financial Institutions , State Industrial Development corporations , Insurance Companies registered with Insurance Regulatory Development Authority ( IRDA ) and Public Financial Institutions as defined under section 4A of the Companies Act, 1956. Further the member and these clients may at their discretion, decide about the requirement of entering into Member- client agreement and bringing the contents of risk Disclosure Documents to the notice of such Clients .
(d) The requirement of Model Tripartite Agreement shall be effective from December 1 , 2004.
2. Mutual Funds and Schemes of Mutual Funds SEBI registration number for mutual funds and unique clients code issued by the exchanges for schemes (until MAPIN ID is available for each scheme of a mutual fund)

1. It is proposed to replace the words " in Annexure : 3 " in Regulation 4.3.1 of NSE ( Futures and Options) Trading Regulations with the words " and shall be in such format as may be prescribed by the F&O Segment of the Exchange from time to time. "

It is proposed to replace the words " a model of which is specified in Annexure : 4" and the word " issuing " in Regulation 4.3.2 of NSE ( Futures and Options) Trading Regulations with the words " which shall be in such format as may be prescribed by the F&O Segment of the Exchange from time to time" and " obtaining from " respectively.
3. It is proposed to replace the words " as specified in Annexure : 5 " in Regulation4.3.3 of NSE ( Futures and Options) Trading Regulations with the words " which shall be in such format as may be prescribed by the F & O Segment of the Exchange from time to time. "
4. As consequence of the above proposed amendments , Annexures 3 , 4 and 5 to the NSE ( Futures & Options) Trading Regulations are proposed to be deleted .
