सा.का ० नि० 59.- राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, योजना आयोग अनुसंधान सहायक ( अर्थशास्त्र ) भर्ती नियम, 2004 का संशोधन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:-
1. ( 1 ) इन नियमों का संक्षिप्त नाम योजना आयोग अनुसंधान सहायक ( अर्थशास्त्र ) भर्ती संशोधन नियम, 2005 है।
(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. योजना आयोग अनुसंधान सहायक ( अर्थशास्त्र ) भर्ती नियम, 2004 की अनुसूची के स्तंभ सं. 12 में " प्रोन्नति " शीर्षक के अधीन, की प्रविष्टिके स्थान पर निम्नलिखित प्रविष्टि रखी जाएगी , अर्थात्:-
" ऐसे संगणक श्रेणी I जिन्होंने नियमित आधार पर नियुक्ति के पश्चात् उस श्रेणी में आठ वर्ष की सेवा की है ।
टिप्पण: जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में, जिन्होंने विहित अर्हक पात्रता सेवा पूरी कर ली है , प्रोन्नति के लिए विचार किया जा रहा हो , वहां उनसे ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा परन्तु यह तब जब कि उन्होंने संगणक श्रेणी I में अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली हो। "

G.S.R. 59. In exercise of the powers conferred by the proviso te article 309 of the Constitution, the President hereby makes the following rules to amend the Planning Coumission Research Assistant ( Economics) Recruitment Rules , 2004, namely: ----
1. ( 1 ) These rules may be called the Planning Commission Research Assistant (Economics ) Recruitment (Amendment ) Rules , 2005.
(2) They shall come into force on the date of their publication in the Official Gazette .
2. In the Planning Commission Research Assistant (Economics ) Recruitment Rules , 2004, in the Schedule , in Column No. 12, for the entry under the heading " Promotion " , the following entry shall be substituted , namely:- "Computer Grade I with eight years ' service in the grade rendered after appointment thereto on a regular basis .
Note: Where juniors who have completed the prescribed qualifying eligibility service are being considered for promotion , their seniors shall also be considered provided they have completed the probationary period in the grade of Computer Grade I satisfactorily. "

सा.का.नि. 60.- राष्ट्रपति , संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और स्टाफ कार ड्राइवर, कनिष्ठ गेस्टेटनर आपरेटर, दफ्तरी और पैकर, हथकरघा विकास आयुक्त का कार्यालय, वाणिज्य मंत्रालय भर्ती नियम, 1981 को, जहां तक उनका संबंध कनिष्ठ गेस्टेटनर आपरेटर के पद से है, उन बातों के सिवाय अधिक्रांत करते हुए, जिन्हें ऐसे अधिक्रमण से पूर्व किया गया है , या करने का लोप किया गया है , वस्त्र मंत्रालय , हथकरघा विकास आयुक्त के कार्यालय में कनिष्ठ गेस्टेटनर आपरेटर के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं , अर्थात्: -
1. संक्षिप्त नाम और प्रारम्भ. ( 1 ) इन नियमों का संक्षिप्त नाम गेस्टेटनर आपरेटर, हथकरघा विकास आयुक्त का कार्यालय , वस्त्र मंत्रालय भर्ती नियम, 2005 है ।
(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. आरंभिक गठन.- वे व्यक्ति जो इन नियमों के प्रारंभ होने पर नियमित आधार पर कनिष्ठ गेस्टेटनर आपरेटर के पद धारणं किए हुए थे इन नियमों के अधीन नियुक्त किए गए समझे जाएंगे और उनकी नियमित सेवा को अगली श्रेणी में प्रोन्नति के प्रयोजन के लिए हिसाब में लिया जाएगा ।
3. लागू होना. ये नियम इससे उपाबद्ध अनुसूची के स्तम्भ 1 में विनिर्दिष्ट पदों को लागू होंगे ।
4. पद संख्या, वर्गीकरण और वेतनमान.- उपाबद्ध अनुसूची के स्तंभ 2 से स्तंभ 4 में विनिर्दिष्ट हैं । उक्त पद की संख्या, उसका वर्गीकरण और उसका वेतनमान वह होगा , जो इन नियमों से 5. भर्ती की पद्धति , आयु-सीमा, शैक्षिक अर्हताएं आदि. उक्त पद पर भर्ती की पद्धति, आयु सीमा, शैक्षिक अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ 5 से स्तंभ 14 में विनिर्दिष्ट हैं ।
6. निरर्हता. वह व्यक्ति,-
( क ) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या
(ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,
उक्त पदों पर नियुक्ति का पात्र नहीं होगा:
परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह , ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के 225 भारत का राजपत्र : फरवरी 19 , 2005/माघ 30, 1926

अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।
7. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।
8. व्यावृत्ति.-इन नियमों की कोई बात , ऐसे आरक्षण, आयु - सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य पिछड़े वर्गों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

केन्द्रीय सरकार के ऐसे समूह ' घ ' कर्मचारी जिन्होंने उस श्रेणी में कम से कम चार वर्ष नियमित सेवा कीहो और जो फोटो कापी प्रिन्टर या गेस्टेटनर मशीनों को चलाने और उनके अनुरक्षण में प्रवीण है । ( प्रतिनियुक्ति की अवधि, जिसके अन्तर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन या विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवधि है साधारणतया तीन वर्ष से अधिक नहीं होगी । )
प्रतिनियुक्तिद्वारा नियुक्ति के लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी । 226

G.S.R. 60.-In exercise of the powers conferred by the proviso to article 309 of the Constitution, and in supersession of the Staff Car Driver , Junior Gestetner Operator , Daftry and Packer , Office of the Development Commissioner forHandlooms , Ministry of Commerce Recruitment Rules , 1981 , in so far as it relate to the post of Junior Gestetner Operator, except as respects things done or omitted to be done before such supersession , the President hereby makes the following rules regulating the method of recruitment to the post of Junior Gestetner Operator , in the Office of the Development Commissioner for Handlooms , Ministry of Textiles , namely:-
1. Short title and commencement . ( 1 ) These rules may be called the Ministry of Textiles , Office ofthe Development Commissioner for Handloonis , Junior Gestetner Operator Recruitment Rules , 2005 .
(2) They shall come into force on the date of their publication in the Official Gazette.
2. Initial constitution.-The persons who are holding the posts of Junior Gestetner Operator on regular basis at the commencement of these rules shall be deemed to have been appointed under these rules and their regular service shall be taken into account for the purpose of promotion to the next grade .
3. Application . These rules shall apply to the posts specified in Column 1 of the Schedule annexed hereto.
4. Number of post, classification and scale of pay. The number of post , its classification and the scale ofpay attached thereto shall be as specified in Columns 2 to 4 of the Schedule annexed to these rules .
5. Method of recruitment, age limit , educational qualifications , etc .---The method of recruitment, age limit, educational qualification and other matters relating to the said post shall be specified in columns 5 to 14 of the said Schedule .
4. Disqualifications .---No person,-
(a) Who has encred into or contracted a marriage with a person having a spouse living; or
(b) Who , having a spouse living , nas entered into or contracted a marriage with any person ,
shall be cligible for appointmentto the said post :
Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operation of this rule.
7. Power to relax.-Where the Central Government is of the opinion that it is necessary or expedient so to do , it may, by order and for reasons to be recorded in writing , relax any of the provisions of the rules with respect to any class or category of persons .
8. Saving . Nothing in these rules shall affect reservations , relaxation of age limit, and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes , Ex -servicemen , other backward classes and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

Junior Accounts Officer Recruitment (Amendment ) Rules , 2003 , namely :-
1. ( 1 ) These rules may be called the Ministry of Textiles , Office of the Development Commissioner for Handlooms , Junior Accounts Officer Recruitment ( Amendment ) Rules , 2005.
(2) They shall come into force on the date of their publication in the Official Gazette .
2. In the Ministry of Textiles , Office ofthe Development Commissioner for Handlooms , Junior Accounts Officer Recruitment (Amendment) Rules ,, 2003 , for rule 5, the following rules shall be substituted, namely:-
"Where the Central Government is of the opinion that it is necessary or expedient to do so , it may, by order and for reasons to be recorded in writing, and in consultation with Union Public Service commission relax any of the provisions of the rules with respect to any class or category of persons . "

1. ( 1 ) इन नियमों का संक्षिप्त नाम रेल सेवक ( अनुशासन एवं अपील ) ( द्वितीय संशोधन ) नियम, 2004 है ।
(2 ) ये सरकारी राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे।
2. रेल सेवक ( अनुशासन एवं अपील ) नियम , 1968 के नियम 6 के खंड ( iii- ख ) , के शीर्ष लघु शास्तियों के अधीन, निम्नलिखित खंड को प्रतिस्थापित किया जाएगा:-
" ( iii-ख) बिना संचयी प्रभाव के तथा उसकी पेंशन पर प्रतिकूल प्रभाव डाले बिना, अधिक से अधिक तीन वर्ष से अनधिक अवधिके लिए समय वेतनमान में एक प्रास्थित की कटौटी करके, इसे एक प्रास्थित अवनति की जाएगी । "

G.S.R. 62. In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules further to amend the Railway Servants (Discipline and Appeal ) Rules , 1968 , namely:-
1. ( 1 ) These rules may be called the Railway Servants (Discipline and Appcal) (Second Amendment ) Rulcs, 2004.
(2) 'They shall come into force on the date of their publication in the Official Gazette.
2. In Rule 6 of the Railway Servants ( Discipline and Appeal ) Rules , 1968 , under heading Minor Penalities, for clause (iii -b) , the following clause shall be substituted, namely
"( iii -b) Reduction to lower stage in the time scale of pay by one stage for a period not exceeding three years , without cumulative effect and not adversely affecting his pension; ".

सा.का. नि. 63.- राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए राष्ट्रपति एतद्वारा केन्द्रीय भूमि जल बोर्ड ( अधिकारी सर्वेक्षक ) भर्ती नियम, 1973 में आगे संशोधन करने के लिए निम्नलिखित नियम बनाते हैं , अर्थात्:-
1. ( 1 ) इस नियम को केन्द्रीय भूमि जल बोर्ड (अधिकारी सर्वेक्षक ) भर्ती संशोधन नियम, 2005 कहा जाएगा ।
( 2 ) ये शासकीय राजपत्र में प्रकाशन की तारीख से लागू होगा ।
2. केन्द्रीय भूमि जल बोर्ड ( अधिकारी सर्वेक्षक ) भर्ती संशोधन नियम, 1973 में विद्यमान प्रविष्टियों के लिए अनुसूची के कॉलम १ को निम्नलिखित प्रविष्टियों के द्वारा प्रतिष्ठापित किया जाएगा अर्थात्: -
नहीं;
शैक्षिक योग्यता- नहीं, परन्तु किसी मान्यताप्राप्त विश्वविद्यालय अथवा संस्था से सिविल इंजीनियरिंग अथवा माइनिंग इंजीनियरिंग में डिपलोमा अथवा सिविल इंजीनियरिंग में लाइसेंसिएट अथवा सर्वेक्षण में डिप्लोमा अथवा प्रमाण- पत्र धारक अवश्य होने चाहिए।

2005. 1.( 1) These rules may be called the Central Ground Water Board Officer Surveyor Recruitment Amendment Rules , (2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Central Ground Water Board (Officer Surveyor ) Recruitment Amendment Rules , 1973 , in the Schedule , in column 9 , for the existing entries the following entries shall be substituted, namely :-
"Age-No ;
Educational Qualification- No , but must possess a Diploma in Civil Engineering or Mining Engineering or Licentiate in Civil Engineering or Diploma or Certificate in Surveying from a Recognized University or Institution" .

1.(1) These rules may be called the Ministry of Labour and Employment, Directorate General ofEmployment and Training, Directorate of Training, Stenographers (Group ' C' ) posts Recruitment (Amendment) Rules , 2005 .
(2)They shall come into force on the date of their publication in the Official Gazette.
2. In the Schedule to the Ministry of Labour and Employment, Directorate General ofEmployment and Training, Directorate of Training , Stenographers (Group ' C ' ) posts Recruitment Rules, 2002---
(a) in rule 1, in sub- rule ( 1 ), for the words " Ministry of Labour " , the words " Ministry ofLabour and Employment" shall be substituted;
(b) in the Schedule , against the post of Stenographer Grade II, for the existing entry under column 12, the following entry shall be substituted, namely:-

कॉलम 12 ( ख ) के अंतर्गत
(i ) शैक्षिक अर्हता तथा अनुभव ( i ) में निम्नलिखित को समाविष्ट किया जाए: -

शैक्षिक अर्हता ( i ) तथा शैक्षिक अर्हता के बीच ( ii ) में शब्द " या " को समाविष्ट किया जाए । 234

" नब्बे प्रतिशत प्रोन्नति द्वारा तथा दस प्रतिशत सीधी भर्ती द्वारा " शब्दों के स्थान पर " 90 % प्रोन्नति द्वारा तथा 10% सीधी भर्ती द्वारा " प्रतिस्थापित किया जाए।
कॉलम 14 के अंतर्गत
" प्रत्येक अवसर पर पद पर नियुक्त करने के लिए तथा इन नियमों के किसी प्रावधान में संशोधन या शिथिलता देने के लिए " शब्दों को " सीधी भर्ती करते समय तथा इन नियमों के किसी प्रावधानों को संशोधित करते समय या शिथिलता देते समय " से प्रतिस्थापित किया जाए ।

In the Notification regulating the amendment to the method of recruitment to the Ministry of Urban Development and Poverty Alleviation, Central Public Works Department Group ' A' and Group 'B ' posts of Director (Horticulture ) , Deputy Director ( Horticulture ) and Assistant Director ( Horticulture ) , Recruitment Rules , 2004 , published vide GSR No. 107 -E dated 20th April , 2004 , the following may be substituted:-
1. In Schedule 2 for the post of Deputy Director (Horticulture)
Under Column 12 (b)
0 In Educational Qualification and Experience ( i ) , the following may be inserted:-
"or
Masters Degree in Floriculture and Landscaping/Horticulture from a recognized University / Institute or equivalent ."
( ii) "Period ofdeputation
receipt of applications" appearing at the end , which has been repeated twice , the last entry may be delcted .
2. In schedule 3 for the post of Assistant Director ( Horticulture)
Under Column 8 (i)
In between Educational Qualification (i ) and Educational Qualification ( ii ) the word " or" may be inserted.
Under Column 8 ( ii )
In line two, the words ' Bachelor Degree ' may be substituted by "Masters Degree".
Under Column 11
The words 'Ninety per cent by promotion and ten per cent by direct recruitment' may be substitutedby " 90% by promotion and 10 % by direct recruitment ".
Under Column 14
The words ' for appointmentto the post on each occasion and for amending or relaxing any provision of these rules ' may be substituted with words " while making direct recruitment and while amending or relaxing any provisions of these rules" .
