नेशनल बोर्ड ऑफ ट्रेड लिमिटेड , इन्दौर द्वारा अधिसूचना वायदा अनुबन्ध (विनियमन ) अधिनियम, 1952 (1952 का 74) की धारा ( 11 ) की उपधारा ( 1 ) एवं वाणिज्य व उद्योग मंत्रालव, भारत सरकार को अधिसूचना क्रमांक 957 (दिनांक 20 मार्च 1975 ) के तहत नेशनल बोर्ड ऑफ ट्रेड लिमिटेड द्वारा इसकी उपविधियों में किये गये निम्नलिखित संशोधन जिन्हें कि वायदा अनुबन्ध (विनियमन) नियम, 1974 के नियम 11 ( b ) के अधीन अधिसूचित किया गया है, जिस हेतु दिनांक 16 फरवरी 2005 को निदेशक वायदा बाजार आयोग द्वारा अनुमोदन प्राप्त किया गया है । 1. उपविधि क्रमांक 1305 (a) ( i) से ( iv) तक के प्रावधान निम्न प्रावधानों से स्थानापन्न हों :-
(अ) समस्त व्ययों, वैधानिक दैयताओं एवं करों को चुकाने के बाद कम्पनी के शेष शुद्ध धिक्य को निम्न प्रकार से बाँटा जावेगा:--
( i ) आधिक्य का 45% ( पंतालीस प्रतिशत ) आधारभूत सुविधाएं एवं विकास कोष में ले जाया जावेगा , जिसे कि समयन् समय पर निदशक्र मण्डल के निदेशानुसार प्रयोग किया जावेगा ।
(ii ) आधिक्य का 5% (पांच प्रतिजत ) विकास सम्बन्धी गतिविधियों हेतु संचिता किरा जायेगा, जिसे कि वायदा बाजार आयोग के परामर्श से प्रयोग क्रिया जावेगा ।
(iii ) आधिषय का 2.5% ( पच्चीस प्रतिशत) व्यापार गारन्टी कोष में ले जाया जावेगा ।
( iv) एवं आधिक्य की शेष राशि को संचय एवं आधिक्य में हस्तान्तरित किया जावेगा ।
2. उपविधि क्रमांक 1-305 का वर्तमान प्रावधान ( b) समाप्त किया गया है ।

दिअहमदाबाद कमोडिटी एक्सचेंज लिमिटेड, अहमदाबाद स्थान: अहमदाबाद दिनांक 12 मार्च, 2005
(1) उपविधि 141( ग) -क्रेता के लिए यह आवश्यकः होगा कि वह एक्सचेंज द्वारा 10 प्रतिशत की, जम्मा धनराशि प्राप्त होने के 5 दिनों के अन्दर विक्रेता को भुगतान पूरा कर देगा और यदि वह ऐसा करने में असमर्थ रहता है तब उस स्थिति में एक्सचेंज अपने पास उसकी अवशिष्ट बची 10 प्रतिशतः जमा धनराशि को जन्ताकार लेगा और सुपर्वगी की अवशिष्ट धनराशि का भरमा विद्योती करें कर देगा । उस स्थिति में क्रेता एक्सचेंज को एक 100/- प्रति मेट्रिक टन का अर्थदण्ड भुगतान करने का जिम्मेदार होगा और साथ हो एक्सचेंज द्वारा भुगतान करने में व्यय हुई लगा , यदि कोई हो, तो उसका भी भुगतान करने का जिम्मेदार होना ।

विद्यमान उपविधि 127 (घ ) में निम्नलिखित नया
उपबन्ध जोड़ा जाये-
विद्यमान उरविधि 141 (क ) में निम्नलिखित उपबंध विलुप्त किया जाए--
"तथपपिः प्रतिबन्ध यह है कि निदेशक मण्डल जब ठीक समझे तब साधारण बहुमत से प्रस्ताव पारित कर' तथा वायदा बाजार आयोग की सहमति से उक्त पंकरग शल्क कौ बदल सकता है । "
किन्तु यदि विक्रेता या उसका अभिकर्ता सेन्ट्रल वेयर हाउसिंग कार्पोरेशन के गोदाम से या राज्य सरकार के वेयरहाउसों से या एक्सचेंज द्वारा आमोदित गोदामों से माल को सुपुर्दग्रो करता है तो उसे उपर्युक्त प्रकार से वणित 3 प्रतिशत को बनराश जना करने के उत्वच से छुट रहेग्रो । (3) अविधि 1 (40) पुत्री केन्द्र को परिभाषा निम्न प्रकार से परिवर्तितः की जने ।
NOTIFICATION BY NATIONAL BOARD OF TRADE LIMITED , INDORE "सुपुर्दणो केन्द्र" से आशय उस निर्धारित क्षेत्र से हैं जिनक भीतर के गोदाम अवस्थित हो जिनसे निविदाकर्ता करेंः माल'को सुप-चरति करनी है और'उक्त क्षेत्र नगर पालिका निगम के क्षेत्र के भीतर हो जब वह क्षेत्र नगर पालिका के अन्तर्गत आता हो और ग्राम पंचायत/ नगरपालिका के सीमा क्षेत्र के भीतर हो जब वह क्षेत्र ग्राम पंचायत/ नगर पालिका अन्र्तगत आता हो ।
टिपगों-यदि मुर,देवो केके भोके क्षेत्र में परि वहन के गमनागमन पर कोई प्रतिबन्ध हो तो. निविद कर्ता माल को उन गोदामों में नही ले जाएगा जहां ऐसा प्रतिबंध लागूहो ।

The approval of the Director , Forward Market s Commission under sub -section (1 ) of Section (1.1). of the Forward Contracts (Regulation) Act, 1952 (74 of 1932) , read with the Government of India , Ministry of Commerce & Industry Notification No. S. O. 957 dated the 20th March, 1975 has been obtained on 16th February , 2005 to the following amendments made to the bye- laws of National Board of Trade Limited, Indore , the same have been notified under Section ( 11 ) of the said Act and Rule 11 (b) of the Forward Contracts (Regulation) Rules , 1954.
1. The Provisions of the Bye- Law 1305 (a) (i) to (iv) shall be substituted as follows :

statutory dues and taxes be apportioned asfollows :-
(i ) 45% (Forty Five Percentage) of the surplus earmarked for infrastructure and development find which will be utilized as per directives of the Board from time to time .
( ii) 5 % (Five Percentage) of the surplus earmarked for the undertaking pro- motional activities , which will be in utilized in consultation with the For- ward Markets Commission .
(iii ) 25 % ( Twenty Five Percentage) of the surplus to the Trade Guarantee Fund; and
(iv) The Balance transferred to the Reserve and Surplus .
2. The Existing provision (b ) of Bye - Law 1305 shall be deleted .
3. The existing provision of the Bye - Law 1403 (d) shall be substituted as follows :
Five Appropriation of 25 % (Twenty Percentage) of the surplus of the company after meeting out all the expenses and statutory dues and taxes .
4. The Existing clauses ( e) , (f) and ( g) of Bye Law 1403 shall be deleted .

AMENDMENT TO THE BYE - LAWS OF THE AHMEDABAD COMMODITY EXCHANGE LTD . , AHAMEDABAD
In the existing bye - law 141 (C) , the following new clause may be added : ---
(1 ) Bye- law 141 (C) : " Buyer will be required to complete the payment to seller within 5 days of receiving the 10 % deposit amount from the ex- change and if he fail to do so , than Exchange , shall seize his remaining 10 % deposit lying with it and make payment of balance amount of delivery to seller . In that event buyer will be liable to pay penalty of Rs . 160 per MT to the Exchange together with cost if any , incurred by Exchange for making the payment" .
(2) Bye - law 127 ( D) : The figure of Rs , 300/- shall be substituted by the figure Rs . 600/-
The following new clause shall be added to the existing bye - law 127 (D) :-
"Provided however , that the Board of Directors could vary the registration fee stated above when- ever they deem fit by passing a resolution with simple majority and with the consent of Forward Markets Commission . "
(3) Bye - law 1 (49) : The definition of delivery center may be modified as follows : -
"Delivery Centers " means the specified area within which the godowns from which tenderer has to make delivery of commodity, is situated and said area shall be within the Municipal Corporation when it is under Municipal Corporation and within the area limits of gram panchayat/ ngar palika , when it is under the Gram Panchayat/Nagar Palika .
Note : If there is any restriction for movement of transport within the delivery center then the ten- dered shall not take the goods to the godowns where such restriction is in operation .

The approval of the Deputy Director , Forward Market Commission under Sub -section ( 10 of Section II of the Forward Contracts (Regulation) Act, 1952 (74 of 1952) read with the Government of India, Ministry of Commerce and Industry , Notifi- cation No. S. O. 1162 , dated the 4th May , 1960 has been obtained on the 11th March 2005 to the follo- wing amendments made to the bye -laws of the Ahmedabad Commodity Exchange Ltd. Ahmeda- bad, the same having been notified under Section 11 of the said Act and Rule 11 of the Forward Contracts (Regulation) Rules 1954 .
AMENDMENTS TO THE BYE - LAWS In the existing bye-law 141 (A) the following clause is deleted :
"But if the seller or his agent gives delivery from the godown of the Central Warehousing Corpora- tion or from the godown of State Government Warehouses or from the godown approved by the Exchange then he is exempted from depositing the amount of 3 % as stated above" .
