का.नि.आ. 42.- राष्ट्रपति, संविधान के अनुच्छेद 309 के. परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, नौसेना समूह ' ख ' (वैज्ञानिक कर्मचारिवृंद पद ) भर्ती नियम, 2003 का संशोधन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:-
1. ( 1) इन नियमों का संक्षिप्त नाम नौसेना समूह ' ख ' ( वैज्ञानिक कर्मचारिवृंद पद ) भर्ती ( संशोधन ) नियम, 2005 है । (2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे । 2. नौसेना समूह ' ख ' ( वैज्ञानिक कर्मचारिवृंद पद ) भर्ती नियम, 2003की अनुसूचीमें :-
(1 ) स्तंभ 5 में, शीर्षक के स्थान पर, निम्नलिखित शीर्षक रखा जाएगा अर्थात्:- " चयन अथवा अचयन पद । " ;
(2) क्रम संख्यांक 1 में वर्णित पद के सामने, स्तंभ 13 के अधीन, " प्रोन्नति/पुष्टि के संबंध में विचार करने के लिए समूह ' ख' विभागीय प्रोन्नति समितिः " के स्थान पर , "समूह ' ख' विभागीय प्रोन्नति समिति (प्रोन्नति के संबंध 1857 GI/2005

S.R.O. 42. In exercise of the powers conferred by the proviso to article 309 ofthe Constitution, the President hereby makes the following rules to amend the Navy Group 'B' (Scientific Staff Posts) Recruitment Rules , 2003 , namely:-
1. (1) These rules may be called the Navy Group 'В ' (Scientific Staff Posts) Recruitment (Amendment ) Rules,2005.

(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Schedule to the Navy Group ' B ' ( Scientific StaffPosts) Recruitment Rules, 2003 ,
(1) for the heading in column 5 , the following heading shall be substituted, namely :- "Whether selection post or non- selection post.";
(2) against the post appearing at serial number 1, under column 13 , for the words " Group ' B ' Departmental Promotion Committee for considering promotion/ confirmation :-" , the words " Group ' B ' Departmental Promotion Committee ( for considering promotion) consisting of: -" shall be substituted;
(3) against the post appearing at serial number 3 , under column 5, for the entry , the following entry shall be substituted , namely " Selection" .

का.नि.आ. 43.- रक्षा संकर्म अधिनियम , 1903 ( 1903 का 7) की धारा 3 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, केन्द्र सरकार एतद्वारा घोषित करती है कि नीचे अनुसूची में उल्लिखित भूमि के महाराष्ट्र राज्य में अनुसंधान एवं विकास स्थापना ( इंजीनियर्स ) , दिघी, पुणे के आस- पास होने की वजह से, इस भूमि के प्रयोग तथा उपभोग पर उक्त अधिनियम की धारा 7 के खण्ड ( ग ) में विनिर्दिष्ट प्रतिबंध लगाना आवश्यक है ताकि उक्त भूमि को इस अधिसूचना के सरकारी राजपत्र में प्रकाशन की तारीख से भवनों तथा अन्य अवरोधों से मुक्त रखा जा सके ।
2. उक्त भूमि के रेखाचित्र का निरीक्षण कलेक्टर, पुणे के कार्यालय में किया जा सकता है ।

महाराष्ट्र राज्य में अनुसंधान एवं विकास स्थापना ( इंजीनियर्स ) , दिघी, पुणे-411015 के बाहरी प्राचीर के शीर्ष से 110 गज की दूरी के भीतर आने वाले क्षेत्र की सारी भूमि ।

S.R.O. 43. In exercise of the powers conferred by Section 3 of the Works of Defence Act, 1903 ( 7 of 1903 ), the Central Government hereby declares that it is necessary to impose the restrictions specified in clause ( c) of Section 7
[PART II-SEC . 4] of the said Act upon the use and enjoyment of the land described in the Schedule hereunder, being land in the vicinity of Research and Development Establishment (Engrs), Dighi , Pune-411015 in the State of Maharashtra, in order that the said land may be kept free from buildings and other obstructions from the date of publication ofthis notification in the Official Gazette .
2. A sketch plan of the said land may be inspected inthe Office of the Collector, Pune .

In the English version of the notification ofthe Government of India, in the Ministry of Defence number 11375 /RR/ ST/DGAFMS/DG- 2B/706/D (Appts) , dated the 28th June , 2002, published vide S.R.O. number 150, dated the 28th June, 2002 and at pages 354 to 356 in Part II, Section 4 ofthe Gazette of India, at page 355, for rule 5 read -' 5 ' " power to relax :- Where the Central Government is of the opinion that it is necessary or expedient so to do, it may , by order and for reasons to be recorded in writing, and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons ."
