आ. अ. 103.-यतः निर्वाचन आयोग का समाधान हो गया है कि 7 - महेन्द्रगढ़ लोक सभा निर्वाचन क्षेत्र से लोक सभा के साधारण निर्वाचन, 2004 के लिए निर्वाचन लड़ने वाले श्री नरेश , गांव सुखराली तहसील व जिला गुड़गांव , रिवाड़ी, हरियाणा लोक प्रतिनिधित्व अधिनियम , 1951 तथा तद्धीन बनाए गए नियमों के अधीन अपने निर्वाचन व्ययों का लेखा दाखिल करने में असफल रहा है; और यतः , श्री नरेश ने सम्यक् सूचना दिए जाने पर भी उक्त असफलता के लिए कोई कारण अथवा स्पष्टीकरण नहीं दिया है और निर्वाचन आयोग का यह समाधान हो गया है कि उनके पास उक्त असफलता के लिए कोई पर्याप्त कारण या न्यायौचित्य नहीं है;
अतः , अब, निर्वाचन आयोग , उक्त अधिनियम की धारा 10 - क के अनुसरण में श्री नरेश को संसद के किसी भी सदन के या किसी राज्य कीविधान सभा अथवा विधान परिषद् के सदस्य चुने जाने और होने के लिए इस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निरर्हित घोषित करता है ।

New Delhi, the 8thAugust, 2005
O. N. 103. Whereas , the Election Commission is satisfied that Shri Naresh, Vill . Sukhrali Tehsil & Districts Gurgaon, Rewari , Haryana a contesting candidate for the General Election to Lok Sabha, 2004 from 7 -Mahendergarh Parliamentary Constituency has failed to lodge account of his election expenses as required by the Representation of the People Act , 1951 and Rules and Order made thereunder, and
Whereas, Shri Naresh has not furnished any reason or explanation for the said failure even after due notice and the Election Commission is thus satisfied that he has no good reason or justification for the said failure ;
Now, therefore, in pursuance of Section 10A of the Representation of the People Act, 1951 , the Election Commission hereby declares the said Shri Naresh, to be disqualified for being chosen as , and for being , a member of either House of the Parliament or of the Legislative Assembly or Legislative Council of a State for a period of three years from the date ofthis order.

आ. अ. 104.-यतः निर्वाचन आयोग का समाधान हो गया है कि नीचे की सारणी के स्तम्भ ( 2 ) में यथा विनिर्दिष्ट छत्तीसगढ़ राज्य से लोक सभा के लिए हुए साधारण निर्वाचन , 2004 के लिए जो स्तम्भ ( 3 ) में विनिर्दिष्ट निर्वाचन क्षेत्र से हुआ है स्तम्भ ( 4 ) में उसके सामने विनिर्दिष्ट निर्वाचन लड़ने वाला प्रत्येक अभ्यर्थी, लोक प्रतिनिधित्व अधिनियम, 1951 तथा तद्धीन बनाए गए नियमों द्वारा अपेक्षित उक्त सारणी के लाम्भ ( 5 ) में तथा दर्शित अपने निर्वाचन व्ययों का रोखा दाखिल करने में असफल रहा है,
और, यतः , उक्त अभ्यर्थियों ने सम्यक् सूचना दिए जाने पर भी उक्त असफलता के लिए कोई कारण अथवा स्पष्टीकरण नहीं दिया है और निर्वाचन आयोग का यह समाधान हो गया है कि उक्त असफलता के लिए उनके पास कोई पर्याप्त कारण या न्यायौचित्य नहीं है;
अतः , अब , निर्वाचन आयोग, उक्त अधिनियम की धारा 10 - क के अनुसरण में नीचे की सारणी के स्तम्भ ( 4 ) में विनिर्दिष्ट व्यक्तियों को संसद के किसी भी सदन के या किसी राज्य/संघ राज्य क्षेत्र की विधान सभा अथवा विधान परिषद् के सदस्य चुने जाने और होने के लिए इस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निरर्हित घोषित करता है :-

और, यतः , उक्त अभ्यर्थियों ने निर्वाचन आयोग द्वारा सम्यक् सूचना दिए जाने पर भी उक्त असफलता के लिए कोई कारण अथवा स्पष्टीकरण नहीं दिया है या उनके द्वारा दिये गये अभ्यावेदनों पर, यदि कोई हो, विचार करने के पश्चात् निर्वाचन आयोग का यह समाधान हो गया है किउनके पास उक्त असफलता के लिए कोई पर्याप्त कारण या न्यायोचित्य नहीं है;

आदेश
नई दिल्ली , 8 अगस्त, 2005
आ. अ. 111.-यतः , निर्वाचन आयोग का समाधान हो गया है कि आन्ध्र प्रदेश राज्य से विधान सभा 2004 के साधारण निर्वाचन के लिए जो नीचे की सारणी के स्तम्भ ( 2 ) में विनिर्दिष्ट निर्वाचन क्षेत्र में हुआ है स्तम्भ ( 3 ) में उसके सामने विनिर्दिष्ट निर्वाचन लड़ने वाला प्रत्येक अभ्यर्थी, लोक प्रतिनिधित्व अधिनियम, 1951 तथा तद्धीन बनाए गए नियमों द्वारा यथा अपेक्षित उक्त सारणी के स्तम्भ (4 ) में यथा दर्शित विधि द्वारा अपेक्षित रीति से निर्वाचन व्ययों का लेखा दाखिल करने में असफल रहा है;
और, यतः , उक्त अभ्यर्थियों ने निर्वाचन आयोग द्वारा सम्यक् सूचना दिए जाने पर भी उक्त असफलता के लिए कोई कारण अथवा स्पष्टीकरण नहींदिया है । और निर्वाचन आयोग का यह समाधान हो गया है कि उनके पास उक्त असफलता के लिए कोई पर्याप्त कारण या न्यायौचित्य नहींहै;
अतः , अब , निर्वाचन आयोग उक्त अधिनियम की धारा 10- क के अनुसरण में नीचे की सारणी के स्तम्भ ( 3 ) में विनिर्दिष्ट व्यक्तियों को संसदके किसी भी सदन के या किसी राज्य की विधान सभा अथवा विधान परिषद् के सदस्य चुने जाने और होने के लिए इस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निरर्हित घोषित करता है :-

Whereas , the Election Commission is satisfied that each of the contesting candidates specified in column (3) of the Table below at the General Election to the Legislative Assembly, 2004 held from the Constituency specified in the column (2) against his/her name has failed to lodge any account of his /her election expenses and failed to lodge the account in the manner required by law as mentioned in column (4) ofthe said Table, as required by the Representation ofthe PeopleAct, 1951 and the Rules made thereunder,
And, whereas, the said candidates have either not furnished any reason or explanation for the said failure.even after due notice to each of them and the Election Commission is satisfied that they have no good reason or justification for the said failure ;
Now, therefore , in pursuance of Section 10A of the said Act, the Election Commission hereby declares the persons specified in column (3 ) of the Table below to be disqualified for being chosen as and for being, a member of either House of the Parliament or Legislative Assembly or Legislative Council of a State for a period of 3 years froin the date of this order.

आ. अ. 115.-यतः , भारत निर्वाचन आयोग ने अपने दिनांक 1 जुलाई , 2005 के पत्र सं. 23/ज.व क. /2005 के द्वारा दिनांक 01-01-2005 कोअर्हता की तिथि मानकर, जम्मूएवं कश्मीर राज्य में संसदीय तथा विधान सभा निर्वाचन क्षेत्रों के लिए निर्वाचक नामावलियों के गहन पुनरीक्षण का आदेश दिया था तथा उससे संबधित विभिन्न चरणों के लिए अनुसूची नियत किया था ।
यतः , निर्वाचक नामावलियों के उक्त गहन पुनरीक्षण के संबंध में दावों तथा आपत्तियों को दाखिल करने की अवधि के लिए दिनांक 07-07-2005 से 05-08-2005 तक का समय नियत किया गया था ।
यतः राज्य के मुख्य निर्वाचन अधिकारी ने दिनांक 04 अगस्त 2005 के अपने पत्र सं. 2172 /सी ई ओ/ लोक/2004/519 के द्वारा सूचित किया है कि राज्य के विभिन्न राजनैतिक दलों ने यह अनुरोध किया है कि दावों तथा आपत्तियों को दाखिल करने की तिथि को आगे बढ़ाया जाए तथा दावों तथा आपत्तियों को दाखिल करने की तिथि को 4 दिन और अर्थात् 9 अगस्त 2005 तक बढ़ाने का सुझाव दिया है । और,
यतः विचार करने के पश्चात् आयोग, दावों तथा आपत्तियों को दाखिल करने की अवधि को आगे बढ़ाने को सहमत हो गया है, जिसे 5 अगस्त 2005 से 9 अगस्त, 2005 तक समाप्त होना था ।
अत; अब, आयोग निर्वाचक नामावली का निर्वाचक रजिस्ट्रीकरण नियम 1960 की धारा 12 के अनुसरण में, एतद्वारा दिनांक 01-01-2005 को अर्हता की तिथि मानते हुए राज्य में निर्वाचक नामावली के गहन पुनरीक्षण के सन्दर्भ में सभी संसदीय निर्वाचन क्षेत्रों के लिए दावों तथा आपत्तियों को दाखिल करने की अवधि को दिनांक 09 अगस्त 2005 को शामिल करते हुए 4 दिन के लिए और आगे बढ़ाता है ।

Whereas the Election Commission had ordered the intensive revision of electoral rolls of all the Parliamentary and Assembly constituencies in the State of Jammu and Kashmir with the reference to 1-1-2005 as qualifying dateand had fixed the schedule for various stages connected therewith vide its letter No. 23 /J & K/2005 dated 1st July 2005; and
Whereas the period for filing claims and objections in connection with the said intensive revision of the electoral rolls was fixed as from 7-7-2005 to 5-8-2005: and.
Whereas the State Chief Electoral Officer, vide his letter No. 2172/CEO /Pub/2004/519 dated 4th August, 2005 has intimated thai the various political parties in the state have requested for cxtending the date for filing claims and objections and has recommended for extending the period for filing claims and objections by four days i.e. upto 9th August, 2005; and Whereas, having considered the matter, the Commission has agreed to extend the period for filing claims and objections which was to expire on 5th August, 2005 to 9th August, 2005;
Now therefore , the Commission in terms of Section 12 of the Registration ofElectors Rules , 1960 , hereby extends the period for filing claims and objections in connection with the intensive revision of electoral rolls w.r.t. 1-1-2005 as qualifying date in respect of all the Parliamentary constituencies in the State by four days i.e. upto and including 9th August, 2005 .

और, यतः , अभ्यर्थियों ने सम्यक् सूचना दिए जाने पर भी उक्त असफलता के लिए कोई कारण अथवा स्पष्टीकरण नहीं दिया है या उनके द्वारा दिए गए अभ्यावेदनों पर यदि कोई हो, विचार करने के पश्चात् निर्वाचन आयोग का यह समाधान हो गया है कि उनके पास उक्त असफलता के लिए कोई पर्याप्त कारण या न्यायौचित्य नहीं है;
अतः , अब , निर्वाचन आयोग , उक्त अधिनियम की धारा 10 - क के अनुसरण में नीचे की सारणी के स्तम्भ (4 ) में विनिर्दिष्ट व्यक्तियों को संसद के किसी भी सदन के या किसी राज्य/ संघ राज्य क्षेत्र की विधान सभा अथवा विधान परिषद् का सदस्य चुने जाने और सदस्य होने के लिए इस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निरर्हित घोषित करता है:-

Whereas , the Election Commission is satisfied that each of the contesting candidates specified in column (4) ofthe Table below at the Bye Election from the 163 -Parbatta to the Legislative Assembly , 2004 from the State ofBihar as specified in column (2) held from the constituency specified in column (3 ) against his/her name has failed to lodge any account ofhis/her election expenses at all as required by the representation of the People Act, 1951 , and the rules made thereunder as shown in column (5) of the said Table;
And, whereas, the said candidates have either not furnished any reason or explanation for the said failure even after due notice ofthe Election Commission , after considering the representation, made by them if any , is satisfied that they have no good reason or justification for the said failure .
Now, therefore, in pursuance of Section 10A of the said Act, the Election Commission hereby declares the persons specified in column (4) of the Table below to be disqualified for being chosen as and for being, a member of either House ofthe Parliament or of the Legislative Assembly or Legislative Council of a State/Union Territory for a period of 3 years from the date of this order:-
