2. मुख्य अनुसंधान अधिकारी के ग्रेड में उपरोक्त अधिकारियों की नियुक्ति, माननीय उच्च न्यायालय , मुम्बई के समक्ष लंबित रिट याचिका सं. 6843/1999 के परिणाम के अधीन रहेगी ।
गोपाल दास , अवर सचिव इस प्रकार की जानकारी चाहने वाले व्यक्तियों को समुचित सहायता प्रदान करेंगे । वे इस संबंध में अपनी ड्यूटी का समुचित निर्वहन करने के लिए आवश्यकतानुसार किसी अन्य अधिकारी की सहायता ले सकते हैं । उपरोक्त अधिनियम के अंतर्गत जिस अधिकारी से सहायता मांगी गई है वो केन्द्रीय सार्वजनिक सूचना अधिकारी को हर प्रकार की सहायता उपलब्ध करायेगा, और उपरोक्त अधिनियम के प्रावधानों का किसी भी प्रकार का उल्लघंन होने की स्थिति में ऐसे किसी अधिकारी को सूचना का अधिकार अधिनियम, 2005 की धारा 5 की उपधारा ( 5 ) के अंतर्गत केन्द्रीय सार्वजनिक सूचना अधिकारी माना जायेगा ।
