सा.का.नि. 160.—राष्ट्रपति, संविधन के अनुच्छेद 148 के खण्ड ;5द्ध के साथ पठित अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए तथा भारतीय लेखापरीक्षा और लेखा विभाग में कार्यरत व्यक्तियों के संबंध् में भारत के नियंत्राक और महालेखापरीक्षक से परामर्श के उपरांत, केन्द्रीय सिविल सेवा ;छुट्‌टीद्ध नियमावली, 1972 में संशोध्न करने के लिए एतद्‌द्वारा निम्नलिखित अगले नियम बनाती हैं, अर्थात्‌ :—

1. ;1द्ध ये नियम केन्द्रीय सिविल सेवा ;छुट्‌टीद्ध ;संशोध्नद्ध नियमावली, 2011 कहलाएंगे ।

;2द्ध ये नियम सरकारी राजपत्रा में इनके प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. केन्द्रीय सिविल सेवा ;छुट्‌टीद्ध नियमावली, 1972 में, ;इसके आगे उक्त नियमावली में यथा संदभतद्ध, नियम 27 में, उप-नियम ;2द्ध में, खण्ड ;खद्ध के लिए, निम्नलिखित खण्डों को प्रतिस्थापित किया जाए, अर्थात्‌, :—

फ्;गद्ध जब कोई सरकारी कर्मचारी सेवा से निष्कासित अथवा पदच्युत किया जाता है, अर्( वेतन छुट्‌टी का क्रेडिट उस कलैण्डर माह जिसमें उसे सेवा से निष्कासित अथवा पदच्युत किया जाता है, के पूर्ववर्ती कलैण्डर माह में कलैण्डर माह के अंत तक 5/3 दिन प्रति पूर्ण कलैण्डर माह की दर से अनुमत होगाऋ

G.S.R. 160.—In exercise of the powers conferred by the proviso to article 309 read with clause (5) of article 148 of the Constitution and after consultation with the Comptroller and Auditor General of India in relation to persons serving in the Indian Audit and Accounts Department , the President hereby makes the following rules further to amend the Central Civil Services (Leave) Rules, 1972, namely :—

1. (1) These rules may be called the Central Civil Services (Leave) (Amendment) Rules, 2011.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Central Civil Services (Leave) Rules, 1972, (hereinafter referred to as the said rules), in rule 27, in sub-rule (2), for clause (b), the following clauses may be substituted, namely,—

"(b) When a Government Servant is removed or dismissed from service, credit of earned leave shall be allowed at the rate of 2½ days per completed calendar month up to the end of the calendar month preceding the calendar month in which he is removed or dismissed from Service;

(c) When a Government Servant dies while in service, credit of earned leave shall be allowed at the rate of 2½ days per completed month of service up to the date of death of the Government Servant." 3. In the said rules, in rule 29, in sub-rule (2), for clause (c), the following clauses shall be substituted, namely,—

"(c) When a Government Servant is removed or dismissed from service, credit of half pay leave shall be allowed at the rate of 5/3 days per completed calendar month up to the end of the calendar month preceding the calendar month in which he is removed or dismissed from service;

(ca) When a Government servant dies while in service, credit of half pay leave shall be allowed at the rate of 5/3 days per completed month of service up to the date of death of the Government Servant."

सा.का.नि. 161.—राष्ट्रपति, संविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त अध्किारों का प्रयोग करते हुए और मानव संसाध्न विकास मंत्राालय ;शिक्षा विभागद्ध में रीडर-सह-सहायक के पद के भर्ती नियम, 1999 का अध्क्रिमण करते हुए केवल ऐसे अध्क्रिमण से पहले किए गए अथवा छोड़े गए कार्यों को छोड़कर, मानव संसाध्न विकास मंत्राालय, उच्चतर शिक्षा विभाग में रीडर-सह-सहायक के पद की भर्ती प्रक्रिया को विनियमित करने के लिए अवरलिखित नियम बनाती हैं, अर्थात्‌ :—

1. लघु शीर्षक और आरंभ.—;1द्ध इन नियमों को मानव संसाध्न विकास मंत्राालय, उच्चतर शिक्षा विभाग ;रीडर-सह-सहायकद्ध भर्ती नियम, 2011 कहा जाएगा ।

;2द्ध ये शासकीय राजपत्रा में प्रकाशन की तारीख से लागू होंगे ।

2. पदों की संख्या, वर्गीकरण, वेतन बैंड और ग्रेड वेतन/वेतनमान.—उक्त पदों की संख्या, इनका वर्गीकरण और उनसे संब( वेतनमान इन नियमों में संलग्न अनुसूची के कालम 2 से 4 में विनिदष्ट किए गए अनुसार होंगे ।

3. भर्ती प(ति, आयु-सीमा और अर्हताएं आदि.—इन पदों के लिए भर्ती की प(ति, आयु-सीमा, अर्हताएं तथा इनसे संब( अन्य मामले उक्त अनुसूची के कालम 5 से 14 में विनिदष्ट किए गए अनुसार होंगे ।

4. अयोग्यता.—कोई भी व्यक्ति,—

;कद्ध जिसने ऐसे व्यक्ति के साथ विवाह किया हो अथवा विवाह के संबंध् में अनुबंध् किया हो जिसका पति/पत्नी जीवित हैऋ ;खद्ध जिसने अपने पति/पत्नी के जीवित होते हुए, किसी अन्य व्यक्ति के साथ विवाह किया हो या विवाह के संबंध् में अनुबंध् किया होऋ

उक्त पद पर नियुक्ति के लिए पात्रा नहीं होगा :

बशर्ते कि केन्द्र सरकार इस बात से संतुष्ट हो कि इस प्रकार का विवाह, ऐसे व्यक्ति के संबंध् में और विवाह के दूसरे पक्ष के संबंध् में लागू व्यक्तिगत विध् िके अंतर्गत अनुमत्य है और ऐसा करने के लिए अन्य आधर मौजूद हैं जो किसी भी व्यक्ति को इस नियम के लागू होने से छूट प्रदान करते हैं ।

5. छूट का अध्किार.—जहां पर केन्द्र सरकार का यह मत हो कि ऐसा करना आवश्यक है अथवा समीचीन है, तो वह आदेश के द्वारा, लिखित में रिकार्ड किए जाने वाले कारणों से व्यक्तियों के किसी वर्ग या श्रेणी के संबंध् में इन नियमों के किन्हीं उपबंधें को शिथिल कर सकती है ।

6. प्रतिबंध्.—इस संबंध् में केन्द्र सरकार द्वारा जारी आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष श्रेणी के व्यक्तियों के लिए आरक्षण, आयु-सीमा में छूट तथा उपलब्ध् करायी जाने वाली अन्य रियायतों पर इन नियमों में उल्लिखित किसी भी बात का कोई प्रभाव नहीं पड़ेगा ।

G.S.R. 161.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Ministry of Human Resource Development (Department of Education) Reader-cum-Assistant Recruitment Rules, 1999, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating and the method of recruitment to the post of Reader-cum-Assistant in the Ministry of Human Resource Development, Department of Higher Education, namely :—

1. Short title and commencement.—(1) These rules may be called the Ministry of Human Resource Development, Department of Higher Education, (Reader-cum-Assistant) Recruitment Rules, 2011.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post, classification, Pay Band and Grade Pay/Pay Scale.—The number of the said post, its classification and the Pay Band and Grade Pay/Pay Scale attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed thereto.

3. Method of recruitment, age limit, qualifications, etc.—The method of recruitment, age limit, qualifications and other matters relating to the said post shall be as specified in columns (5) to (14) of the said Schedule.

4. Disqualifications.—No person, —

(a) who has entered into or contracted a marriage with a person having a spouse living; or (b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.—Where the Central Government is of opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing, and in consultation with the Union Public Service Commission, relax any of the provisions of these rules, with respect to any class or category of persons.

6. Saving.—Nothing in these rules shall affect reservations, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, the Other Backward Classes, the Ex-servicemen and other special categories of persons, in accordance with the orders issued by the Central Government from time to time in this regard.

(Period of deputation including period of deputation in another ex-cadre post held immediately preceding this appointment in the same or some other organisation/department of the Central Government shall ordinarily not to exceed three years. The maximum age limit for appointment by deputation shall be not exceeding fifty six years as on the closing date of the receipt of applications.)

Note : For the purpose of appointment on deputation basis, the

service rendered on a regular basis by an officer prior to 1st January, 2006/the date from which the revised pay structure based on the 6th CPC recommendations has been extended, shall be deemed to be service rendered in the corresponding grade pay/pay scale extended based on the recommendations of the Pay Commission except where there has been merger of

more than one pre-revised scale of pay into one grade with a common grade pay/pay scale, and where this benefit will extend only for the post(s) for which that grade pay/pay scale is the normal replacement grade without any upgradation.

सा.का.नि. 162.—राष्ट्रपति, संविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, और आशुलिपिक ग्रेड-III ;क्षेत्रा संकार्य प्रभाग, राष्ट्रीय प्रतिदर्श सर्वेक्षण संगठनद्ध भर्ती नियमावली, 2000 को उन बातों के सिवाय अध्क्रिांत करते हुए, जिन्हें ऐसे अध्क्रिमण से पहले किया गया है या करने का लोप किया गया है, सांख्यिकी और कार्यक्रम कार्यान्वयन मंत्राालय के क्षेत्रा संक्रिया प्रभाग, राष्ट्रीय प्रतिदर्श सर्वेक्षण कार्यालय में आशुलिपिक श्रेणी-II के पद पर भर्ती की प(ति का विनियमन करने के लिए निम्नलिखित नियम बनाती हैं, अर्थात्‌ :—

R. 162.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Stenographer III (Field Operations Division, National Sample Survey Organization) Recruitment Rules, 2000, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Stenographer Gr. II, in the Field Operations Division, National Sample Survey Office, Ministry of Statistics and Programme Implementation, namely :—

1. Short title and commencement.—(1) These rules may be called the Ministry of Statistics and Programme Implementation, Field Operations Division, National Sample Survey Office (Stenographer Gr. II), Recruitment Rules, 2011.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts, classification, pay band and grade pay.—The number of the said post, its classification, pay band and grade pay attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age limit and qualifications, etc.—The method of recruitment, age limit, qualification and other matters relating to the said post shall be as specified in columns (5) to (14) of the said Schedule.

4. Disqualification.—No person,—

G.S.R. 164.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Central Ground Water Board Senior Technical Assistant (Chemical) Recruitment Rules, 2004, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Senior Technical Assistant (Chemical) in the Ministry of Water Resources, the Central Ground Water Board, namely:—

1. Short title and commencement.—(l) These rules may be called the Ministry of Water Resources, the Central Ground Water Board, Senior Technical Assistant (Chemical), Group 'B' post, Recruitment Rules, 2011.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post, classification, pay band and grade pay or pay scale.—The number of the post, its classification, pay band and grade pay or pay scale attached thereto shall be as specified in columns ( 2) to (4) of the Schedule annexed to these rules.

4. Disqualification.—No person —

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.

6. 1. (1) These rules may be called the Directorate of Plant Protection, Quarantine and Storage, Plant Protection Adviser Recruitment (Amendment) Rules, 2011.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Directorate of Plant Protection, Quarantine and Storage, Plant Protection Adviser Recruitment Rules, 2010 in the Schedule, in column (12),—

(i) under the heading "Promotion" and in Note 1, for words and brackets "Additional Plant Protection Adviser (Central Insecticide Laboratory) or Additional Plant Protection Adviser (Integrated Pest Management) or Additional Plant Protection Adviser (Central Insecticide Board and Registration Committee)" the words and brackets "Additional Plant Protection Adviser (Central Insecticide Laboratory), Additional Plant Protection Adviser (Integrated Pest Management) and Additional Plant Protection Adviser (Central Insecticide Board and Registration Committee)" shall be substituted.

टिप्पण 1 : ऐसे पदधरी भी, जो इन नियमों के प्रारम्भ की तारीख को नियमित आधर पर संयुक्त निदेशक ;कीट विज्ञान या पादप रोग विज्ञान या रसायन विज्ञान या खरपतवार विज्ञान या इंजीनियरीद्ध के पोषक पद धरण किए हुए हैं और जिनके पास किसी मान्यताप्राप्त विश्वविद्यालय से कीट विज्ञान या नेमोटोलॉजी या पादप रोग विज्ञान में मास्टर डिग्री है या खरपतवार विज्ञान में विशेषज्ञता सहित, सस्यविज्ञान में मास्टर डिग्री या कार्बनिक रसायन विज्ञान या विश्लेषणात्मक रसायन विज्ञान या कृषि रसायन विज्ञान में मास्टर डिग्री है, प्रोन्नति के लिए विचार किए जाने के पात्रा होंगे ।

टिप्पण 2 : प्रोन्नति के लिए पात्राता सूची अध्किारियों द्वारा अपनी-अपनी श्रेणी या पद पर विहित अर्हक सेवा पूरी करने की तारीख के प्रतिनिर्देश से तैयार की जाएगी ।

टिप्पण 3 : जहां ऐसे कनिष्ठ व्यक्तियों के संबंध् में, जिन्होंने अपनी अर्हक या पात्राता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो, वहां उनसे ज्येष्ठ व्यक्तियों के संबंध् में भी विचार किया जाएगा परन्तु यह तब जबकि उनके द्वारा की गई ऐसी अर्हक या पात्राता सेवा, अपेक्षित अर्हक या पात्राता सेवा के आधे से अध्कि से या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित, जिन्होंने ऐसी अर्हक या पात्राता सेवा पहले ही पूरी कर ली है, अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवध् िसपफलतापूर्वक पूरी कर ली हो ।

टिप्पण 4 : प्रोन्नति के लिए न्यूनतम अर्हक सेवा की संगणना करने के प्रयोजन के लिए, किसी अधिकारी द्वारा, 1 जनवरी, 2006 से पहले, उस तारीख से जिससे छठे केन्द्रीय वेतन आयोग की सिपफारिश पर आधारित पुनरीक्षित वेतन संरचना का विस्तार किया गया है नियमित आधर पर की गई सेवा को, वेतन आयोग की सिपफारिशों के आधर पर विस्तारित तत्स्थायी ग्रेड वेतन या वेतनमान पर की गई सेवा समझी जाएगी ।

Note 1 : The incumbents holding the feeder posts of Joint Director (Entomology or Plant Pathology or Chemistry or Weed Science or Engineering) on regular basis on the date of commencement of these rules and holding Master's degree in Entomology or Nematology or Plant Pathology or a Master's Degree in Agronomy with specialization in Weed Science or Master's Degree in Organic Chemistry or Analytical Chemistry or Agricultural Chemistry from a recognized University or Institute shall also be considered eligible for promotion.

Note 2 : The eligibility list for promotion shall be prepared with reference to the date of completion by the officers of the prescribed qualifying service in the respective grade or post.

Note 3 : Where juniors who have completed their qualifying or eligibility service are being considered for promotion, their seniors would also be considered provided they are not short of the requisite qualifying or eligibility service by more than half of such qualifying or eligibility service or two years, whichever is less, and have successfully completed their probation period for promotion to the next higher grade along with their juniors who have already completed such qualifying or eligibility service.

Note 4 : For the purpose of computing minimum qualifying service for promotion, the service rendered on a regular basis by an officer prior to 1st January, 2006, the date from which revised pay structure based on the Sixth Central Pay Commission recommendation has been extended, shall be deemed to be service rendered in the corresponding Pay or Pay Scale extended based on the recommendations of the Pay Commission.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Directorate of Plant Protection, Quarantine and Storage, Additional Plant Protection Adviser (Central Insecticides Laboratory) Recruitment Rules, 2010, in the Schedule, in column (12), for the heading "Promotion" and the entry relating thereto the following heading and the entry shall be substituted, namely :—

Promotion :

(a) Joint Director (Entomology or Plant Pathology or Chemistry or Weed Science or Engineering) in Pay Band-3 : Rs. 15,600—39,100 plus Grade Pay of Rs. 7,600 with five years regular service in the grade and having a doctorate degree in Entomology or Plant Pathology or Organic Chemistry or Analytical Chemistry or Agricultrual Chemistry or Nematology or Weed Science or a Master degree in Agricultural Engineering or Chemical Engineering from a recognized University or Institute.

Failing which by,

Joint Director (Entomology or Plant Pathology or Chemistry or Weed Science or Engineering) in Pay Band-3 : Rs. 15,600—39,100 plus Grade Pay of Rs. 7,600 with three years regular service in the grade and having 10 years combined regular service in the grades of Joint Director (Entomology or Plant Pathology or Chemistry or Weed Science or Engineering)and Deputy Director (Entomology or Plant Pathology or Chemistry or Weed Science or Engineering) in Pay Band-3 : Rs. 15,600—39,100 plus Grade Pay of Rs. 6,600 and possessing a doctorate degree in Organic Chemistry or Analytical Chemistry or Agricultural Chemistry or Entomology or Nematology or Plant Pathology or Weed Science or a Master degree in Agricultural Engineering or Chemical Engineering from a recognized University or Institute.

Note 1 : The incumbents holding the feeder posts of Joint Director (Entomology or Plant Pathology or Chemistry or Weed Science or Engineering) on regular basis on the date of commencement of these rules and holding Master's degree in Entomology or Nematology or Plant Pathology or a Master's degree in Agronomy with specialization in Weed Science or Master's degree in Organic Chemistry or Analytical Chemistry or Agricultural Chemistry from a recognized university shall also be considered eligible for promotion.

Note 2 : The eligibility list for promotion shall be prepared with reference to the date of completion by the officers of the prescribed qualifying service in the respective grade or post.

Note 3 : Where juniors who have completed their qualifying or eligibility service are being considered for promotion, their seniors would also be considered provided they are not short of the requisite qualifying or eligibility service by more than half of such qualifying or eligibility service or two years, whichever is less, and have successfully completed their period of probation for promotion to the next higher grade alongwith their juniors who have already completed such qualifying or eligibility service.
