सा.का.नि. 199.—राष्ट्रपति, संविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और केन्द्रीय जल और विद्युत अनुसंधन केन्द्र, पुणे ;अध्ीक्षकद्ध भर्ती नियम, 2004 और केन्द्रीय जल और विद्युत अनुसंधन केन्द्र, पुणे ;समूह 'ग'द्ध भर्ती नियम, 1983 को, उन बातों के सिवाय अध्क्रिांत करते हुए, जिन्हें ऐसे अध्क्रिमण से पहले किया गया है या करने का लोप किया गया है, जल संसाध्न मंत्राालय के केन्द्रीय जल और विद्युत अनुसंधनशाला, पुणे में सहायक इंजीनियर और कनिष्ठ इंजीनियर के पदों पर भर्ती की प(ति का विनियमन करने के लिए निम्नलिखित नियम बनाती हैं, अर्थात्‌ :—

1. संक्षिप्त नाम और प्रारंभ.—;1द्ध इन नियमों का संक्षिप्त नाम जल संसाध्न मंत्राालय, केन्द्रीय जल और विद्युत अनुसंधनशाला, पुणे, सहायक इंजीनियर और कनिष्ठ इंजीनियर, समूह 'ख' पद, भर्ती नियम, 2011 है ।

;2द्ध ये राजपत्रा में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. लागू होना.—यह नियम इससे उपाब( अनुसूची के स्तम्भ ;1द्ध में विनिदष्ट पदों को लागू होंगे ।

3. पद संख्या, वर्गीकरण, वेतन बैंड और ग्रेड वेतन या वेतनमान.—उक्त पदों की संख्या, उनका वर्गीकरण, वेतन बैंड और ग्रेड वेतन या वेतनमान वे होंगे, जो उक्त अनुसूची के स्तंभ ;2द्ध से ;4द्ध में विनिदष्ट हैं ।

5. निरर्हता.—वह व्यक्ति,—

;कद्ध जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या

;खद्ध जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्रा नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह, ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी । 6. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखब( करके तथा संघ लोक सेवा के आयोग से परामर्श करके, इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी ।

7. व्यावृति.—इन नियमों की कोई बात, ऐसे आरक्षण, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

ऐसे कनिष्ठ इंजीनियर, जिन्होंने उस श्रेणी में पांच वर्ष नियमित सेवा की है ।[भाग IIखण्ड 3(i)] भारत का राजपत्रा : जुलाई 2, 2011/आषाढ़ 11, 1933 795 ;11द्ध टिप्पण 1 : प्रोन्नति के लिए न्यूनतम अर्हक सेवा की संगणना करने के प्रयोजन के लिए किसी अध्किारी द्वारा 1-1-2006 से पहले या उस तारीख से जिससे छठे केन्द्रीय वेतन आयोग की सिपफारिशों पर आधरित पुनरीक्षित वेतन संरचना का विस्तार किया गया है, नियमित आधर पर की गई सेवा को, सिवाय उस दशा के जहां एक से अध्कि पूर्व पुनरीक्षित वेतन का साधरण ग्रेड वेतन या वेतनमान सहित एक श्रेणी में विलय हो गया है और जहां यह लाभ केवल उस पद ;उन पदोंद्ध पर विस्तारित होगा जिसके लिए ग्रेड वेतन या वेतनमान बिना किसी उयन का साधरण प्रतिस्थापन ग्रेड है उक्त वेतन आयोग की सिपफारिशों के आधर पर विस्तारित तत्स्थानी ग्रेड वेतन या वेतनमान पर की गई सेवा समझी जाएगी ।

टिप्पण 2 : पहली जनवरी, 2006 की प्रास्थिति में नियमित रूप से नियुक्त ज्येष्ठ तकनीकी सामूहिक रूप से तकनीकी से ज्येष्ठ होगा ।

टिप्पण 3 : जहां ऐसे कनिष्ठ व्यक्तियों के संबंध् में, जिन्होंने अपनी अर्हक या पात्राता सेवा पूरी कर ली है, प्रोन्नति के लिए विचार किया जा रहा हो, वहां उनसे ज्येष्ठ व्यक्तियों के संबंध् में भी विचार किया जाएगा परन्तु यह तब जब कि उनके द्वारा की गई ऐसी अर्हक या पात्राता सेवा, अपेक्षित अर्हक या पात्राता सेवा के आधे से अध्कि से या दो वर्ष से, इनमें से जो भी कम हो, कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित, जिन्होंने ऐसी अर्हक/पात्राता सेवा पहले ही पूरी कर ली है, अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवध् िसपफलतापूर्वक पूरी कर ली हो ।

सीध्ी भर्ती लागू नहीं होता टिप्पण 1 ः पदधरियों की प्रतिनियुक्ति या लंबी बीमारी या अध्ययन छुट्‌टी या किसी अन्य परिस्थितियों के अध्ीन एक वर्ष या उससे अध्कि अवध् िके लिए बाहर रहने के कारण हुई रिक्तियां केंद्रीय सरकार के ऐसे अध्किारियों से प्रतिनियुक्ति के आधर पर भरी जा सकेंगी, — ;कद्ध ;iद्ध जो मूल काडर या विभाग में नियमित आधर पर सदृश पद धरण किए हुए हैंऋ और

G.S.R. 199.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Central Water and Power Research Station, Pune (Suprintendent) Recruitment Rules, 2004, and the Central Water and Power Research Station, Pune (Group 'C') Recruitment Rules, 1983, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the posts of Assistant Engineer and Junior Engineer in the Ministry of Water Resources, the Central Water and Power Research Station, Pune, namely :—

1. Short title and commencement.—(1) These rules may be called the Ministry of Water Resources, the Central Water and Power Research Station, Pune, Assistant Engineer and Junior Engineer, Group 'B' Posts Recruitment Rules, 2011.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Application.—These rule shall apply to the posts specified in column 1 of the Schedule annexed to these rules.

3. Number of posts, classification, pay band and grade pay or pay scale.—The number of said posts, their classification, pay band and grade pay or pay scale attached thereto shall be as specified in columns (2) to (4) of the said Schedule.

4. Method of recruitment, age limit, qualifications, etc.—The method of recruitment, age limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (14) of the aforesaid Schedule.

5. Disqualifications.—No person,—

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

6. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.

7. Saving.—Nothing in these rules shall affect reservation, relaxation of age-limit and other concessions required to provided for the Scheduled Castes, the Scheduled Tribes, ex serviceman and other special Categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

Promotion Promotion :

Junior Engineer with five years regular service in the grade.

Note 1 : For the purpose of computing minimum qualifying service

for promotion, the service rendered on a regular basis by an

officer prior to 1st January, 2006 or the date from which the revised

pay structure based on the recommendations of the Sixth Central

Pay Commission has been extended, shall be deemed to be service

rendered in the corresponding grade pay or pay scale extended

based on the recommendations of the said Pay Commission except

where there has been merger of more than one pre-revised scale

of pay into one grade with a common grade pay or pay scale and

where this benefit will extend only for the post(s) for which that

grade pay or pay scale is the normal replacement grade without

any upgradation.

Note 2 : The regularly appointed Senior Technician in position

1st January, 2006 will be en-block senior to the Technician.

Note 3 : Where Juniors who have completed their qualifying or eligibility service are being considered for promotion, their seniors shall also be considered provided they are not short of the requisite qualifying or eligibility service by more than half of such qualifying or eligibility service, or two years, whichever is less, and have successfully completed their probation period for promotion to the next higher grade along with their juniors who have already completed such qualifying or eligibility service.

3. भर्ती की प(ति, आयु-सीमा, अर्हताएं आदि .—उक्त पदों पर भर्ती की प(ति, आयु-सीमा, अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ;5द्ध से स्तंभ ;14द्ध में विनिदष्ट हैं ।

4. आरंभिक गठन.—इन नियमों की अनुसूची के स्तंभ 1 में विनिदष्ट पद के ऐसे पदधरी, जो इन नियमों के प्रारम्भ से पहले राष्ट्रीय क्षयरोग संस्थान, बंगलौर में नियमित आधर पर नियुक्त किए गए थे, इन नियमों के अध्ीन नियुक्त किए गए समझे जाएंगे और उनके द्वारा उक्त पद पर नियमित आधर पर की गई सेवा की गणना परिवीक्षा, पुष्टि और पेंशन के प्रयोजन के लिए की जाएगी ।

5. निरर्हता.—वह व्यक्ति,—

;कद्ध जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या

;खद्ध जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्रा नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी । 6. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं, उन्हें लेखब( करके, इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी । 7. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षण, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

G.S.R. 200.—In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules regulating the method of recruitment to the Group 'B' posts of Senior Investigator (SOCS) and Social Worker in the National Tuberculosis Institute, Bangalore, namely :—

1. Short title and commencement.—(i) These rules may be called the Ministry of Health and Family Welfare, National Tuberculosis Institute, Bangalore, Senior Investigator (SOCS) and Social Worker Group 'B' post Recruitment Rules, 2011.

(ii) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts, classification and Pay Band and Grade Pay/scale of pay.—The number of posts, their classification and the Pay Band and Grade Pay/scale of pay attached thereto, shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age limit, qualifications, etc.— The method of recruitment, age limit, qualifications and other matters relating to the said post shall be as specified in columns (5) to (14) of the said Schedule.

4. Initial Constitution. —The incumbent of the post specified in column 1 of the Schedule to these rules who were appointed on regular basis in the National Tuberculosis Institute, Bangalore before the commencement of these rules shall be deemed to have been appointed under these rules and the services rendered by them in such post on regular basis shall be taken into account for the purpose of probation, confirmation and pension.

5. Disqualification. —No person,—

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for the said post :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for doing so, exempt any person from the operation of this rule.

6. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

7. Saving.—Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Other Backward Classes, Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

Initial Constitution : The Officer holding the post of Senior Investigator (SOCS) on a regular basis on the date of commencement of the rule shall be deemed to have been appointed at the initial constitution stage to the post.

The Departmental Officers in the feeder category who are in the direct line of promotion shall not be eligible for consideration for appointment on deputation.

Similarly deputationtist shall not be eligible for consideration for appointment by promotion.

Period of deputation including period of deputation in another ex- cadre post held immediately preceding this appointment in the same or some other organisation or department of the Central Government shall ordinarily not exceeding three years. The maximum age limit for appointment by deputation shall be not exceeding 56 years as on the closing date of the receipt of application.

Note : For the purpose of appointment on deputation/absorption basis, the service rendered on a regular basis by an officer prior to 1-1-2006 (date from which the revised Pay structure based on the 6th CPC recommendation has been extended) shall be deemed to be service rendered in the corresponding Grade Pay/Pay Scale extended based on the recommendation of the Pay Commission expect where there has been merger of more than one pre-revised scale of Pay into one Grade with a common Grade Pay/Pay Scale and where this benefit will extend only for the post (s) for which that Grade Pay/ Pay Scale is the normal replacement Grade without any upgradation.

1. संक्षिप्त नाम और प्रारंभ.—;1द्ध इन नियमों का संक्षिप्त नाम वाणिज्य और उद्योग मंत्राालय ;औद्योगिक नीति और संवर्ध्न विभागद्ध नयाचार अध्किारी ;भर्तीद्ध नियम, 2011 है ।

;2द्ध ये राजपत्रा में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद संख्या, वर्गीकरण और वेतनमान.—पद संख्या, उसका वर्गीकरण और उसका वेतन बैंड तथा ग्रेड वेतन/वेतनमान वह होगा जो इन नियमों से उपाब( अनुसूची के स्तंभ ;2द्ध से स्तंभ ;4द्ध में विनिदष्ट हैं ।

3. भर्ती की प(ति, आयु-सीमा और अन्य अर्हताएं आदि.—उक्त पद पर भर्ती की प(ति, आयु-सीमा, अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो पूर्वोक्त अनुसूची के स्तंभ ;5द्ध से स्तंभ ;14द्ध में विनिदष्ट हैं ।

4. निरर्हता.—वह व्यक्ति,—

उक्त पद पर नियुक्ति का पात्रा नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह, ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी । 5. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखब( करके इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी । 6. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षणों, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर जारी किए गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों और अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

G.S.R. 201.—In exercise of the powers conferred by the proviso to article 309 of the Constitution, and in supersession of the Ministry of Commerce and Industry, Department of Industrial Policy and Promotion, Protocol Officer Recruitment Rules, 2001, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules to regulating the method of recruitment to the posts of Protocol Officer in the Department of Industrial Policy and Promotion, Ministry of Commerce and Industry, namely :—

1. Short title and commencement.—(1) These rules may be called the Ministry of Commerce and Industry (Department of Industrial Policy and Promotion) Protocol Officer (Recruitment) Rules, 2011.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts, classification and scale of pay.—The number of post, its classification and the Pay Band and Grade Pay/ Pay Scale attached thereto, shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age limit and other qualifications, etc. .— The method of recruitment, age limit, qualification and other matters relating to the said post shall be as specified in columns (5) to (14) of the aforesaid Schedule.

4. Disqualification. —No person,—

(a) who had entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.—Nothing in these rules shall affect reservations, and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Ex-servicemen, Other Backward Classes and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

Note : For the purpose of appointment on deputation or absorption basis, the service rendered on a regular basis by an officer prior to 1-1-2006 (the date from which the revised pay structure based on the Sixth CPC recommendations has been extended) shall be deemed to be service rendered in the corresponding grade pay/pay scale extended based on the recommendations of the Pay Commission except where there has been merger of more than one pre-revised scale of pay into one grade with a common grade pay/pay scale, and where this benefit will extend only for the post(s) for which that grade pay/pay scale is the normal replacement grade without any upgradation.

टिप्पण 1 : पोषक प्रवर्ग के ऐसे विभागीय अध्किारी, जो प्रोन्नति की सीध्ी पंक्ति में हैं, प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्रा नहीं होंगे । इसी प्रकार प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्रा नहीं होंगे ।

G.S.R. 202.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Directorate of Economics and Statistics (Economic Officer) Recruitment Rules, 2006, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the post of Economic Officer in the Directorate of Economics and Statistics in the Department of Agriculture and Co-operation of the Ministry of Agriculture, namely :—

1. Short title and commencement.—(1) These rules may be called the Directorate of Economics and Statistics, Economic Officer Recruitment Rules, 2011.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of posts, Classification and Pay Band, Grade Pay or Pay Scale.—The number of the said post, its classification and the Pay Band and Grade Pay or Pay Scale attached thereto, shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.

3. Method of recruitment, age limit and other qualifications, etc.— The method of recruitment, age limit, qualifications and other matters relating to the said post shall be as specified in columns (5) to (13) of the aforesaid Schedule.

4. Disqualification. —No person,— (a) who has entered into or contracted a marriage with person having a spouse living; or (b) who, having a spouse living, has entered into or contracted a marriage with any person,

shall be eligible for appointment to the said post :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order, for reasons to be recorded in writing and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category of persons.

6. Saving.—Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, the Ex-servicemen, the Other Backward Classes and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.

Deputation : Officers under the Central Governments — (a) (i) Holding analogous posts on regular basis in the parent

cadre/Department; or

(ii) with five years' service in the grade rendered after appointment thereto on a regular basis in Pay Band-2 Rs. 9300—34800 with Grade Pay of Rs. 4200 or equivalent in the parent cadre or Department; and

(b) Possessing the educational qualifications experience required for recruits under column (7). Note 1 : The Departmental Officers in the feeder category who are in the direct line of promotion shall not be eligible for consideration for appointment on deputation or absorption. Similarly deputationist shall not be eligible for consideration for appointment by promotion.

Note 2 : Period of deputation including period of deputation in another ex-cadre post held immediately preceding this appointment in the same or some other organisation or department of the Central Government shall ordinarily not to exceed three years. The maximum age limit for appointment by deputation shall not be exceeding 56 years as on the closing date of receipt of application. Note 3 : For the purpose of appointment on deputation basis, the service rendered on a regular basis by an officer prior to 1st January, 2006, that is, the date from which the revised pay structure based on the 6th Central Pay Commission recommendations has been extended, shall be deemed to be service rendered in the corresponding grade pay or pay scale extended based on the recommendations of the Pay Commission except where there has been merger of more than one pre-revised scale of pay into one grade with a common grade pay or pay scale and where this benefit will extend only for the post for which that grade pay or pay scale is the normal replacement Grade without any upgradation.

सा.का.नि. 203.—राष्ट्रपति, संविधन के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और उपभोक्ता मामले, खाद्य और सार्वजनिक वितरण मंत्राालय, उपभोक्ता मामले विभाग, भारतीय विध्कि माप विज्ञान संस्थान, रांची में समूह 'ग' और समूह 'घ' पद भर्ती नियम, 2007 को, उन बातों के सिवाय अधिक्रान्त करते हुए जिन्हें ऐसे अधिक्रमण से पहले किया गया है या करने का लोप किया गया है, उपभोक्ता मामले, खाद्य और सार्वजनिक वितरण मंत्राालय, उपभोक्ता मामले विभाग के अध्ीन भारतीय विध्कि माप विज्ञान संस्थान, रांची में समूह 'ग' पदों पर भर्ती की प(ति का विनियमन करने के लिए निम्नलिखित नियम बनाती हैं, अर्थात्‌ :—

1. संक्षिप्त नाम और प्रारंभ.—;1द्ध इन नियमों का संक्षिप्त नाम उपभोक्ता मामले, खाद्य और सार्वजनिक वितरण मंत्राालय, उपभोक्ता मामले विभाग, भारतीय विध्कि माप विज्ञान संस्थान, रांची में समूह 'ग' पद, भर्ती नियम, 2011 है ।

;2द्ध ये राजपत्रा में उनके प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. लागू होना.—ये नियम, इन नियमों से उपाब( अनुसूची के स्तंभ ;1द्ध में विनिदष्ट पदों को लागू होंगे ।

3. पद संख्या, वर्गीकरण और वेतन बैंड और ग्रेड वेतन या वेतनमान.—उक्त पदों की संख्या, उनका वर्गीकरण तथा वेतन बैंड और ग्रेड वेतन वे होंगे, जो इन नियमों से उपाब( अनुसूची केे स्तंभ ;2द्ध से ;4द्ध में विनिदष्ट हैं ।

4. भर्ती की प(ति, आयु-सीमा, अर्हताएं आदि .—उक्त पदों पर भर्ती की प(ति, आयु-सीमा, अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तंभ ;5द्ध से स्तंभ ;14द्ध में विनिदष्ट हैं ।

5. निरर्हता.—वह व्यक्ति,—

;कद्ध जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है या

;खद्ध जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्रा नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधन हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विध्ि के अध्ीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधर हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी । 6. शिथिल करने की शक्ति.—जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं, उन्हें लेखब( करके, इन नियमों के किसी उपबंध् को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत, आदेश द्वारा शिथिल कर सकेगी । 7. व्यावृत्ति.—इन नियमों की कोई बात, ऐसे आरक्षणों, आयु-सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध् में समय-समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों, अन्य पिछड़े वर्गों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध् करना अपेक्षित है ।

G.S.R. 203.—In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Ministry of Consumer Affairs, Food and Public Distribution, Department of Consumer Affairs Group 'C' and 'D' in the Indian Institute of Legal Metrology, Ranchi, Recruitment Rules, 2007, except as respects things done or omitted to have been done before such supersession, the President hereby makes the following rules regulating the method of recruitment to Group 'C' posts in the Indian Institute of Legal Metrology, Ranchi, in the Ministry of Consumer Affairs, Food and Public Distribution, Department of Consumer Affairs, namely :—

1. Short title and commencement.—(1) These rules may be called the Ministry of Consumer Affairs, Food and Public Distribution, Department of Consumer Affairs, Group 'C' posts in the Indian Institute of Legal Metrology, Ranchi, Recruitment Rules, 2011.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Application.—These rules shall apply to the posts specified in column (1) of the Schedule annexed to these rules.

3. Number of posts, classification and pay band, grade pay or scale of pay.—The number of said posts, their classification and pay band, grade pay or scale of pay attached thereto shall be as specified in columns (2) to (4) of the said Schedule.

4. Method of recruitment, age limit, qualifications, etc.—The method of recruitment, age limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (14) of the said Schedule.

5. Disqualification.—No person, —

(a) who has entered into or contracted a marriage with a person having a spouse living; or

(b) who, having a spouse living, has entered into or contracted a marriage with any other person, shall be eligible for appointment to the said posts :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

6. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class or category of persons.

7. Saving.—Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, the Other Backward Classes, Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.
