सं. IV- 14014/7/2004- एन आई- II-- भारत सरकार ने दिनांक 29 अक्तूबर, 2004 की शुद्धिपत्र अधिसूचना के साथ पठित दिनांक 12 अक्तूबर, 2004 की अधिसूचना सं . IV- 14014/7/2004- एन.आई.- II के तहत ' शास्त्रीय भाषाओं ' के रूप में भाषाओं की एक नई श्रेणी सृजित की थी और ' शास्त्रीय भाषाओं' के रूप में वर्गीकरण के लिए भाषाओं की पात्रता को निर्धारित करने के लिए निम्नलिखित मानदण्ड निर्धारित किए गए थे : --

(i ) उस भाषा के ग्रन्थों/हजारों वर्षों से अधिक समय से संकलित इतिहास की प्राचीनता ।

( ii ) प्राचीन साहित्य/ग्रन्थ की विषय- वस्तु जिसे वक्ताओं द्वारा पीढ़ियों से एक बहुमूल्य विरासत समझा जाता है । ( iii ) साहित्यिक परम्परा मूल होनी चाहिए और अन्य भाषा समुदाय से ग्रहण की गई नहीं होनी चाहिए ।

(iv) शास्त्रीय भाषा और शास्त्रीय साहित्य की आधुनिक भाषा और आधुनिक साहित्य से भिन्नता होने के कारण शास्त्रीय भाषा और इसके बाद के रूप या उसकी उप - शाखाओं के बीच कोई अंतराल भी हो सकता है । 2. तमिल भाषा को, दिनांक 12 अक्तूबर, 2004 की उपर्युक्त उल्लिखित अधिसूचना के पैरा 3 के तहत ' शास्त्रीय भाषा ' के रूप में अधिसूचित किया गया ।

3. भारत सरकार ने अब दिनांक 12 अक्तूबर, 2004 की अधिसूचना के पैरा 2 ( 1 ) में निम्नलिखित के अनुसार संशोधन करने का निर्णय लिया है : --

" उस भाषा के ग्रन्थों/संकलित इतिहास की 1500-2000 वर्षों से अधिक समय से प्राचीनता " ।

4. यह भी अधिसूचित किया जाता है कि ' संस्कृत भाषा ' उपर्युक्त मानदंड को पूरा करती है और उसे ' शास्त्रीय भाषा ' के रूप में वर्गीकृत किया जाएगा ।

5. दिनांक 12 अक्तूबर , 2004 की अधिसूचना के अन्य सभी प्रावधान अपरिवर्तनीय रहेंगे ।

[भाग I-खण्ड 1 2. समिति के कार्य -

यह समिति संबंधित विभाग के कामकाज में हिन्दी के उत्तरोत्तर प्रयोग से संबंधित मामलों में सलाह देगी ।

कार्यकाल- 3.

समिति के सदस्यों का कार्यकाल सामान्य रूप से समिति के गठन की तिथि से निम्नलिखित बातों के अधीन तीन वर्ष का होगा ।

(क) जो संसद सदस्य समिति के सदस्य नामित किए गए हैं, वे संसद सदस्य न रहने पर इस समिति के सदस्य नहीं रह सकेंगे , और

(ख) यदि कार्यकाल के बीच में स्थान रिक्त होता है तो उस स्थान पर नियुक्त सदस्य तीन वर्ष के कार्यकाल की शेष अवधि के लिए ही सदस्य रहेगा ।

4. सामान्य-

समिति का मुख्यालय नई दिल्ली में होगा किन्तु समिति अपनी बैठकें किसी अन्य स्थान पर भी कर सकती है ।

5. यात्रा भत्ते तथा अन्य भत्ते -

रामिति की बैठकों में भाग लेने के लिए गैर- सरकारी सदस्यों को राजभाषा विभाग के दिनांक 22जनवरी 1987 के कार्यालय ज्ञापन सं० II/20034/4/ 86- रा ० भा ० (क -2) में निहित दिशा- निर्देशों के अनुरूप और भारत सरकार द्वारा समय- समय पर यथासंशोधित निर्धारित दरों एवं नियमों के अनुसार यात्रा भत्ता एवं दैनिक भत्ता दिया जाएगा ।

आदेश

आदेश दिया जाता है कि इस संकल्प की प्रति राष्ट्रपति सचिवालय , प्रधानमंत्री कार्यालय, मंत्रिमण्डल सचिवालय, संसदीय कार्य मंत्रालय , लोकसभा सचिवालय , राज्यसभा सचिवालय, योजना आयोग, भारत के नियंत्रक एवं महालेखा परीक्षक, समिति के सभी सदस्यों और भारत सरकार के सभी मंत्रालयों तथा विभागों को भेजी जाए ।

यह भी आदेश दिया जाता है कि यह संकल्प आम जानकारी के लिए भारत के राजपत्र में प्रकाशित किया जाए ।

संकल्प

(सं. 2/3/2005-वि.वि.- II

राष्ट्रीय साझा न्यूनतम कार्यक्रम में निर्धारित नीति के अनुसरण में भारत सरकार ने " राष्ट्रीय निवेश कोष " के नाम एवं शैली से एक अलग निधि का गठन करने का निर्णय लिया है जिसके उद्देश्य, संरचना, निवेश नीति एवं प्रशासनिक व्यवस्थाएं नीचे दिए गए अनुसार होंगी : -

क. उद्देश्य

(i) केन्द्रीय सार्वजनिक क्षेत्र के उद्यमों के विनिवेश से प्राप्त अर्थागम को राष्ट्रीय निवेश कोष में जमा कराया जाएगा जिसे भारत की संचित निधि से अलग रखा जाएगा । ( ii) राष्ट्रीय निवेश कोष का संग्रह स्थायी प्रकृति का होगा ।

(iii) संग्रह को कम किए बिना सरकार को स्थायी आय प्रदान करने के लिए कोष की प्रबन्ध व्यवस्था व्यावसायिक तौर पर की जाएगी । कोष के संग्रह की प्रबन्ध व्यवस्था चुनिन्दा सार्वजनिक क्षेत्र के म्युच्युअल फंडों को सौंपी जाएगी ।

(iv) कोष से होने वाली वार्षिक आय के 75 % हिस्से का उपयोग सामाजिक क्षेत्र की उन चुनिन्दा योजनाओं का वित्त पोषण करने के लिए किया जाएगा जो शिक्षा, स्वास्थ्य एवं रोज़गार को बढ़ावा दें। कोष की शेष 25 % वार्षिक आय का उपयोग लाभप्रद तथा पुनरूद्धार योग्य केन्द्रीय सार्वजनिक क्षेत्र के उद्यमों, जो पर्याप्त लाभ अर्जित करते हैं, की पूंजी निवेश संबंधी आवश्यकताओं को पूरा करने के लिए किया जाएगा ताकि विस्तार/विविधिकरण के वित्त पोषण के लिए उनके पूंजी आधार को बढ़ाया जा सके । ख. संरचना एवं प्रशासनिक व्यवस्था

राष्ट्रीय निवेश कोष का संचालन चयनित कोष प्रबंधकों द्वारा विभागीय प्रबंधन योजना की "स्वैच्छिक पद्धति" के तहत किया जाएगा, जो सेबी के दिशा- निर्देशों द्वारा नियंत्रित होती है । राष्ट्रीय 1194

निवेश कोष के सभी क्रियाकलापों का पर्यवेक्षण , कोष के मुख्य कार्यकारी अधिकारी द्वारा किया जाएगा जो भारत सरकार के संयुक्त सचिव/अपर सचिव रैंक के एक अधिकारी होंगे । राष्ट्रीय निवेश कोष के कार्यकलापों के विभिन्न पहलुओं के संबंध में मुख्य कार्यकारी अधिकारी को सलाह देने के लिए सरकार द्वारा एक अंशकालिक सलाहकार बोर्ड की नियुक्ति की जाएगी जिसमें अपेक्षित सुविज्ञता रखने वाले तीन प्रतिष्ठित व्यक्ति सम्मिलित होंगे ।

ग. निवेश नीति

(i) मोटे तौर पर निवेश नीति संग्रह को कम किए बिना स्थायी आय प्रदान करने की है । (ii) राष्ट्रीय निवेश कोष के लिए निवेश नीति सलाहकार बोर्ड की सलाह के आधार पर मुख्य कार्यकारी अधिकारी द्वारा तैयार की जाएगीं, ताकि यह सुनिश्चित किया जा सके कि कोष प्रबंधकों द्वारा किए जाने वाले वास्तविक निवेश के सन्दर्भ में सरकार का किंचित मात्र ही संबंध हो ।

(ii) "स्वैच्छिक पद्धति के अधीन कोष प्रबंधकों को केवल विस्तृत दिशा- निर्देश ही दिए जाएंगे जिनके अन्तर्गत कोर्ष प्रबंधकों द्वारा अलग -अलग निवेश स्वतंत्र रूप से किए जाएंगे। निवेश के माध्यम और उन माध्यमों में निवेश की सीमा निर्दिष्ट करते हुए और अधिक विस्तृत दिशा- निर्देश उन करारों में अलग से विनिर्दिष्ट किए जाएंगे जो सरकार की ओर से कोष के प्रबंधकों तथा मुख्य कार्यकारी अधिकारी के बीच सम्पन्न किए जाएंगे ।

(iv) चयनित कोष प्रबंधकों को निधियों का आबंटन, कोष प्रबंधकों को भुगतान किए जाने वाले प्रबंधन शुल्क तथा प्रभारों के बारे में बातचीत आदि जैसे अन्य संचालनात्मक ब्यौरों के संबंध में सलाहकार बोर्ड की सलाह के आधार पर मुख्य कार्यकारी अधिकारी द्वारा निर्णय लिया जाएगा ।

(v) कोष के कार्यकलापों, उभरती बाजार प्रवृत्तियों और भावी सम्भावनाओं की नियमित समीक्षा तथा निगरानी के लिए उपयुक्त तंत्र प्रणालियां स्थापित की जाएंगी ।

घ. लेखांकन क्रियाविधि

(i) केन्द्रीय सार्वजनिक क्षेत्र के उद्यमों के विनिवेश से प्राप्त धनराशि को भारत की संचित निधि में नामित शीर्ष के अधीन जमा कराया जाएगा। तत्पश्चात, समुचित अनुमोदन लेने के बाद इन धनराशियों को विनिवेश विभाग द्वारा भारत की संचित निधि से विनियोजित किया जाएगा और कोष के मुख्य कार्यकारी अधिकारी के माध्यम से चयनित कोष प्रबंधकों को अन्तरित किया जाएगा । 1195 भाग I-खण्ड 1 ]

(ii) इसी प्रकार कोष से होने वाली आय को भारत की संचित निधि में जमा कराया जाएगा और व्यय विभाग द्वारा समय - समय पर अनुमोदित विनियोजन योजना के अनुसार विशिष्ट प्रयोजनों के लिए उसमें से विनियोजित किया जाएगा ।

आदेश

आदेश दिया जाता है कि इस संकल्प की एक- एक प्रति भारत सरकार के सभी मंत्रालयों/विभागों को प्रेषित कर दी जाए ।

सं . 5 ( 18 )/2002-लैदर 10 वीं पंचवर्षीय योजना (2002-2007 ) के तहत भारत के योजना आयोग द्वारा स्थापित चमड़ा और चमड़ा वस्तु उद्योग पर कार्य समूह की सिफारिशों के परिणामस्वरूप , एतद्वारा यह अधिसूचित किया जाता है कि भारत ' - सरकार ने चमड़ा उद्योग से सभी खंडों नामतः टेनरीज , फुटवियर , फुटवियर घटकों , चमड़ा वस्तुओं और परिधानों में आधुनिकीकरण तथा प्रौद्योगिकी उन्नयन के लिए 290 करोड़ रुपये के परिव्यय से भास्तीय चमड़ा विकास कार्यक्रम ( आईएलडीपी ) के अधीन एकीकृत चमड़ा क्षेत्र विकास योजना (आईएलडीपी) तैयार की है । अधिसूचना के साथ दिनांक 3 नवम्बर , 2005 का एक समसंख्यक कार्यालय ज्ञापन संलग्न है जिसमें इस योजना के कार्यान्वयन के लिए दिशानिर्देश दिए गए हैं ।

विषय : - चमड़ा क्षेत्र का एकीकृत विकास ।

सं. 5 ( 18 ) 2002- चमड़ा--

भारतीय चमड़ा उद्योग रोजगार और निर्यात संभावना में अपने योगदान की दृष्टि से भारतीय अर्थव्यवस्था में एक महत्वपूर्ण स्थान रखता है । कच्ची सामग्री का मजबूत आधार होने के बावजूद विश्व बाजार में भारत का हिस्सा बहुत कम है । विश्व बाजारों में अधिक हिस्सा प्राप्त करने के उद्देश्य से दक्षता व मात्रात्मक किफायत लाने के लिए विशेषज्ञों ने चमड़ा क्षेत्र के विभिन्न भागों में पूंजी का समावेश , दक्षता में वृद्धि और आधुनिकीकरण करने की आवश्यकता पर बल दिया है ।

2. चमड़ा क्षेत्र की आवश्यकताओं के मूल्यांकन के आधार पर , चमड़ा उद्योग के सभी भागों नामतः टेनरीज , फुटवियर , फुटवियर संघटकों, जीनसाजी , चमड़ा वस्तुओं और परिधानों में 290 करोड़ रुपये के परिव्यय से आधुनिकीकरण और प्रोद्योगिकी उन्नयन की एक व्यापक योजना सरकार द्वारा अनुमोदित की गई है । " चमड़ा क्षेत्र का एकीकृत विकास " (आईडीएलएस ) शीर्षक से एक योजना को 10 वीं योजना अवधि ( 2002-2007 ) के दौरान कार्यान्वित किया जायेगा । यह योजना तत्काल प्रभाव अर्थात 3 नवंबर , 2005 से लागू हो जायेगी ।

पात्रता

3 . प्रौद्योगिकी उन्नयन पर 3 नवंबर , 2005 को या इसके बाद जीव्यक्षम व बैंक स्वीकार्य कार्यक्रम आरंभ करने वाले टेनरीज , चमड़ा उत्पाद , चमड़ा संघटक और फुटवियर संघटक क्षेत्र के सभी मौजूदा एकक इस योजना के तहत सहायता पाने के पात्र हैं ।

वित्तीय सहायता

4. इस योजना में वित्तीय सहायता की परिकल्पना की गई है जिसके अंतर्गत प्रौद्योगिकी उन्नयन/आधुनिकीकरण और/ अथवा विस्तार हेतु लघु उद्योगों को संयंत्र और गशीनों की लागत 1198

[भाग I-खण्ड 1 के 30 प्रतिशत तक और अन्य एककों अर्थात ( गैर-लघु एककों) को संयंत्र और मशीनों की लागत के 20 प्रतिशत तक अनुदान की व्यवस्था होगी जिसकी अधिकतम सीमा दोनो प्रकार के उद्योगों के लिए 50 लाख रुपये होगी । अपने स्वयं के संसाधनों का निवेश करने वाले एककों के लिए भी निवेश अनुदान उपलब्ध होगा ।

कार्यान्वयन प्रबंध

5. उक्त योजना को दो सार्वजनिक क्षेत्र उपक्रमों के माध्यम से कार्यन्वित किया जायेगा जिसमें से एक टेनरी के लिए सी.एल.आर.आई. चेन्नई में और अन्य चगड़ा वस्तुओं तथा परिधानों जीनसाजी , चमड़ा फुटवियर और चमड़ा संघटकों के लिए एफ.डी.आई. नोएडा में है । इस योजना के लिए सिडवी नोडल एजेंसी होगी । इस योजना के अंतर्गत वित्तीय सहायता का लाभ उठाने के इच्छुक किसी भी औद्योगिक एककं को संबंधित चमड़ा क्षेत्रों के लिए संबंधित सार्वजनिक क्षेत्र उपक्रम अर्थात एफ.डी.आई. , नोएडा और सी.एल.आर.आई. चेन्नई को निर्धारित फार्म में आवेदन देना होगा । तकनीकी मूल्यांकन के बाद सार्वजनिक क्षेत्र उपक्रम उक्त आवेदन एकक की पन्द्रह दिन के भीतर वाविस लौटा देगा । तब एकक ऋण के लिए संबंधित बैंक में आवेदन करेगा । परियोजना का वित्तीय गूल्यांकन करने के बाद बैंक अपनी स्वीकृति प्रदान करेगा और औपचारिक स्वीकृति सहित आवेदन को संबंधित सार्वजनिक क्षेत्र उपक्रम के पास भेज देगा । फिर सार्वनिक क्षेत्र उपक्रम इसे विषय- निर्वाचन समिति को प्रस्तुत करेगा और विषय-निर्वाचन समिति द्वारा योजना के तहत वित्तीय सहायता की स्वीकृति प्रदान की जायेगी । सार्वजनिक क्षेत्र उपक्रम विषय- निर्वाचन समिति के सचिवालय के रूप में कार्य करेगा ।

विषय- निर्वाचन समिति की संरचना कार्यालय ज्ञापन के साथ संलग्न विस्तृत दिशानिर्देशों में विनिर्दिष्ट की गई है ।

6. जायेगी । सिडवी द्वारा वित्तीय सहायता गशीने स्थान पर पहुँच जाने के बाद ही जारी की परियोजना निगरानी और मूल्यांकन

दिशानिर्देश विषय : चमड़ा क्षेत्र का एकीकृत विकास ( आईडीएलएस )

उद्देश्य

1.0

भारतीय चमड़ा उद्योग रोजगार और निर्यात संभावना में अपने योगदान की दृष्टि से भारतीय अर्थव्यवस्था में एक महत्वपूर्ण स्थान रखता है । चूंकि भारत में चमड़ा उद्योग बहुत लंबे समय तक लघु क्षेत्र के लिए आरक्षित था, इसलिए चमड़ा क्षेत्र में निवेश का स्तर बहुत कम है जिसके फलस्वरूप उत्पादन आधार छोटा हुआ है और उत्पादकता खराब रही है । अप्रचलित प्रौद्योगिकी, मानकीकरण' की कमी और खराब विपणन अवसंरचना इस क्षेत्र के अपनी क्षमता के अनुरूप न बढ़ पाने से जुड़े अन्य कारक रहे हैं । भारतीय अर्थव्यवस्था के समग्र स्वास्थय के प्रति इस उद्योग के महत्व , इसकी रोजगार क्षमता और प्रौद्योगिकी उन्नयन की ऐतिहासिक पिछले शेष को ध्यान में रखते हुए विशेषज्ञों द्वारा इस बात पर बल दिया गया है कि विश्व बाजार में प्रतिस्पर्धा क्षमता में सहायता और सुधार प्रदान करने के उद्देश्य से चमड़ा उद्योग के लिए पूँजी तक समय पर और पर्याप्त पंहुच रखना अनिर्वाय है ताकि अपने प्रौद्योगिकी स्तर को उन्नत बनाया जा सके ।

पूर्ववर्ती को ध्यान में रखते हुए वर्तमान योजना का उद्देश्य मौजूदा टेनरीज , फुटवियर , फुटवियर संघटक और चमड़ा उत्पाद एककों को उन्नत बनाने में मदद करना है जिसके फलस्वरूप उत्पादकता के लाभ , क्षमता का सही आकार निर्माण , लागत में कमी , डिजाइन और विकास होगा । योजना का उद्देश्य प्रौद्योगिकी उन्नयन के लिए सकारात्मक वातावरण और उत्पादकता के लाभों , बरबादी के अल्पीकरण , क्षमता के सही आकार- निर्माण , लागत में कभी डिजाइन व विकास के माध्यम से वैश्वीय प्रतिस्पर्धात्मकता प्राप्त करने हेतु पर्यावरण प्रभाव का सृजन करना है ।

2.0 पात्रता मानदंड

उक्त अधिसूचना की तारीख को अथवा इसके बाद प्रौद्योगिकी उन्नयन पर जीव्यक्षम और बैंक स्वीकार्य कार्यक्रम आरंभ करने वाले टेनरीज , चमड़ा वस्तु, जीनसाजी, चगड़ा फुटवियर और फुटवियर संघटक क्षेत्र सहित चमड़ा और चगड़ा उत्पाद संबंधी सभी मौजूदा एकक सहायता पाने के पात्र हैं । किसी भी ऐसे एकक को एक मौजूदा एकक माना जायेगा जो कम से कम तीन वर्षों से विद्यमान हो और जिसे 3 नवंबर , 2005 को कम से कम दो वर्षों से नकद लाभ हुआ हो । 1200

[भाग I-खण्ड 1 2.2 सिडबी/बैंकों से निधि प्राप्त आधुनिकीकरण कार्यक्रमों के साथ-साथ ऐसे कार्यक्रम भी सहायता पाने के पात्र होंगे जो गौजूदा उत्पादन एककों द्वारा अपने स्वयं के संसाधनों से आरंभ किए गए हों ।

2.3 उक्त योजना के तहत वित्तीय सहायता केवल ऐसी परियोजनाओं के लिए ही उपलब्ध होगी जिनके लिए सिडबी/वित्तीय संस्थाओं द्वारा योजना के वर्तमान दिशानिर्देशों के तहत 3 नवंबर , 2005 को अथवा इसके बाद ऋण मंजूर किया गया हो.। स्व-निधि-पोषित आधुनिकीकरण योजना के मामले में उक्त योजना के तहत वित्तीय सहायता केवल ऐसी परियोजनाओं के लिए उपलब्ध होगी जिनके लिए मशीने खरीदने के आदेश 3 नवंबर , 2005 को अथवा इसके बाद दे दिए गए हों और बशर्ते कि वर्तमान योजना के तहत आवेदन करते समय आवश्यक दस्तावेज प्रारूप के अनुसार दायर किए जार जा रहे हों ।

2.4 नये स्थानों पर पुनः स्थापित हो रहे और पर्यापरण संबंधी समस्याओं के समाधान सहित आधुनिकीकरण विस्तार पैकेजों की अपेक्षा करने वाले मौजूदा एकक भी पात्र होंगे ।

2.5 संबंधित एकक द्वारा प्रस्तुत परियोजना का मूल्यांकन किसी वित्तीय रूप से जीव्यक्षम तथा बैंक स्वीकार्य परियोजना द्वारा किया जाना चाहिए । परियोजना से निम्नलिखित परिणाम प्राप्त होने चाहिए:

[ i] एकक मूल्य प्राप्ति में प्रदर्शनीय वृद्धि और/अथवा

उत्पादन क्षमताएं और/अथवा

[ ii ]

प्रदूषण नियंत्रण मानंदडों का बेहतर अनुपालन ।

योजना का दायरा

3.0

प्रौद्योगिकी उन्नयन में निम्नलिखित शामिल होंगें:

3.1 प्रौद्योगिकी उन्नयन , उत्पादकता वृद्धि, परिष्कृत पर्यावरणीय सुरक्षोपायों , लागत नियंत्रण के जरिये वैश्विक प्रतिस्पर्धात्मकता तथा बरबादी का न्यूनतमीकरण ।

3.2 मशीनरी सुविधाओं का उन्नयन और आधुनिकीकरण जिसमें शामिल हैं मशीनरी सुविधाओं की स्थापना संबंधी इन प्लांट ले आउट तथा सिविल एवं संबद्ध कार्य किंतु इसमें भवन और दूसरी संबद्ध अवसंरचनाएं शामिल नहीं हैं । 1201 भाग I-खण्ड 1 ]

3.3 डिजाइन और विक्रॉस के द्वारा उत्पाद विविधीकरण हेतु उपाय , हार्डवेयर एवं प्रौद्यागिकीय सहायता जिसमें आई.टी. समाधान और नेटवर्किंग तथा ई गवर्नेन्स शामिल हैं ।

3.4 संयत्र की आंतरिक परिस्थितिकी में सुधार , चमड़ा फिनिशिंग सुविधाओं के उन्नयन एव कामगारों की सुरक्षा हेतु किए जाने वाले उपाय ।

3.5 व्यक्तिगत उत्पादन इकाई स्तरों पर सुरक्षित पर्यावरण प्रबंधन योजनाओं के कार्यान्वयन हेतु उपाय जिसमें शामिल हैं टैनरियों में पिट टैक्नोजॉजी का प्रतिस्थापन अथवा सयंत्र के भीतर प्रदूषण नियंत्रण, उपकरणों की स्थापना जैसे कि क्रोम रिकवरी ।

3.6 गुणवत्ता नियंत्रण और परीक्षण प्रणालियों हेतु उपाय तथा इकाई स्तर पर व्यक्तिगत उत्पादन उपक्रमों के लिए सरकारी विनियमों द्वारा विनिर्दिष्ट सभी अनिवार्य उपाय ।

3.7 फुटवेयर अपर इकाइयों के लिए क्लोनिंग रूप सुविधाओं में वृद्धि तथा फुटवेयर घटकों के लिए उत्पादन सुविधाओं का सृजन

3.8 इन हाउस अनुसंधान और विकास सुविधाओं का निर्माण तथ नमूना बनाने की सुविधाओं की स्थापन्ना ।

3.9 योजना के तहत शामिल करने के लिए , किसी मौजूदा इकाई में विद्यमान गशीनरी को बदलकर निम्नलिखित प्रकार की मशीनरी को स्थापित करना और/अथवा विस्तार करने के कार्यकलापों के लिए पात्रता होगी :

i. टैनरियों को आधुनिकी करण

अनुबंध - ख

ii . फुटवेयर इकाइयों और फुटवेयर घटक इकाइयों का आधुनिकीकरण

अनुबंध - ग

चमड़े की वस्तुओं का आधुनिकीरण

iv . चगड़े के परिधानों का आधुनिकीरण

V. जीनसाजी इकाइयों का आधुनिकीकरण

3.10 विषय निर्वाचन समिति , ऊपर न. गिनाये गए किसी अन्य कार्यकलापों के लिए तथा वर्तमान दिशा- निर्देशों में विनिर्दिष्ट न की गई मशीनों को आधुनिकीकरण योजना में शामिल करने के लिए राष्ट्रीय संस्थाओं की सलाह ले सकती है , बशर्ते उनका परिणाम स्पष्ट और व्यवहार्य सुधारों के रूप में सामने आए जिससे प्रौद्योगिकी उन्नयन हो सके । इसी प्रकार , विषय निर्वाचन समिति, विशेषज्ञ संस्था की सलाह पर किसी [भाग -खण्ड 1 1202

कार्यकलाप / मशीनरियों की सूची को हटा सकती ' है । लेकिन विविधीकरण को नया उद्यग माना जाएगा और उसकी अनुगति नहीं दी जाएगी ।

3.11 वर्तमान इकाइयों के पास ऊपर बतायी गई भांश्वि एकल अथवा बहु- कार्यकलापों को चुनने का विकल्प होगा , जिसमें 50 लाख रुपये की कुल सहायता सीमा लागू होगी आधुनिकीकरण के लिए माड्युलर प्रयासों की अनुमति सामान्यतः प्रयोगों के बीच न्यूनतम 6 माह के अंतराल पर तथा पहले के आधुनिकीरण माज्युल्स का सफलतापूर्वक पूरा करने पर दी जाएगी । किंतु विषय- निर्वाचन समिति एक से अधिक बार आधुनिकीकरण हेतु आवेदनों पर इनके आधार पर निर्णय लेगी क) प्रथम बार के आवेदकों को न्यायोचित और उचित सहायता और ख ) आवेदक की प्रतिस्पर्धात्मक योग्यता जैसा वित्तीय संस्थाओं/बैंकों/सिडबी द्वारा किए गए वित्तीय मूल्यांकनों तथा तकनीकी मूल्यांकनो द्वारा प्रमाणित हो ।

4.0 सहायता का परिमाण एवं स्वरूप

4.1 इस योजना के तहत वित्तीय सहायता, लघु इकाइयों के लिए संयंत्र और मशीनरी की लागत के 30 प्रतिशत तक तथा अन्य इकाइयों (अर्थात गैर- लघु इकाइयों) के लिए संयंत्र और मशीनरी की लागत के 20 प्रतिशत तक निवेश अनुदान के रूप में होगी जिस पर प्रौद्योगिकीय उन्नयन /आधुनिकीकरण और/ अथवा विस्तार हेतु 50 लाख रुपये की अधिकतम सीगा लागू होगी । अपने संसाधनों का निवेश करने वाली इकाइयों के लिए भी निवेश अनुदान उपलब्ध होगा । इस योजना के उद्देश्यों हेतु , लघु उद्योग की परिभाषा वही होगी, परियोजना की स्वीकृति की तारीख पर सरकार द्वारा अधिसूचित की हुई होगी । योजना के तहतं उन्नयन में निम्नलिखित शामिल होंगें :

बिक्री और उत्पाद शुल्क कर,

परिवहन एवं पारगमन बीमा लागत ,

आयात संबंधी शुल्क,

स्थापना एवं शुरू करने संबंधी प्रभार , जिनमें सिविल और विद्युतीय कार्य शामिल हैं , जो मशीन की कुल भूमि लागत के 5 प्रतिशत तक सीमित होंगे ।

5.1.1 कार्यान्वयन एजेंसी विभाग की एक प्रशासनिक इकाई के रूप में होगी , जिसे चमड़ा क्षेत्र के एकीकृत विकास की परियोजना कार्यान्वयन इकाई (पीआईयू) कहा जाएगा । योजना के और बड़े दायरे के दृष्टिगत , पी.आई.यू. दो केंद्रों से कार्य करेगी , एक टैनरियों के लिए सी.एल.आर.आई. चेननई और दूसरा फुटवेयर , फुटवेयर हिस्सों, जीनसाजी , चमड़े की वस्तुओं और परिधानों के लिए एफ.डी.डी.आई. , नोएडा । 1203 भाग खण्ड 1 ]

5.1.2 साहायता जारी करने , निगरानी तथा वित्तीय संस्थाओं , बैंकों व सरकार के साथ संप्पर्क हेतु नोडल एजेंसी भारतीय लघु उद्योग विकास बैंक ( सिडबी ) होगा ।

5.1.3 योजना के कार्यान्वयना हेतु एक विषय-निर्वाचन समिति होगी , जिसे योजना के श्रमावी कार्यान्वयन की जिम्मेदारी दी जाएगी । इसके दायरे में शामिल होंगे , आधुनिकीकरण कार्यक्रम के लिए अपेक्षित मानक संयंत्र और मशीनिरियों के लिए अक्रियाएं तय करना , मानक मूल्य तय करना , सरकार से वित्तीय सहायता प्राप्त करना और सरकार से औद्योगिक इकाइयों कौ वित्तीय सहायता के संवितरण पर अनुवर्ती कार्यवाही की निगरानी करना । इसमें शामिल होंगे:

संयुक्त सचिव (चगड़ा) औद्योगिक नीति और संवर्धन विभाग , चेयरमैन के तौर पर

सिडबी का प्रतिनिधि

सी.एल.आर.आई का नामित व्यक्ति

सी.एल.ई. का नामित व्यक्ति

उद्योगा ( टेनरी) का प्रतिनिधि

उद्योग ( चमड़ा वस्तुएं और परिधान) का प्रतिनिधि

उद्योग (जीनसाजी) का प्रतिनिधि

निदेशक/उप- सचिव ( चमड़ा) संयोजक

चेयरमैन द्वारा यथा नागित दूसरे आमंत्रित व्यक्ति

5.2 आवेदन की विधि

5.2.1 किसी भी इकाई को, जो सरकारी वित्तीय सहायता का लाभ लेना चाहती हो , संबंधित पी.आई.यू. को तीन प्रतियों में निर्धारित आवेदन फार्म (आईडीएलएस- Ⅰ )में सहायता के लिए आवेदन करना होगा । इस फार्म पर एक घोषणा के विलाशर्त समर्थन में एक शपथ- पत्र होना चाहिए । पी.आई.यू. आवेदन की पावती देगा और एक पंजीकरण संख्या आवंटित करेगा । पी.आई.यू. प्राप्त हुए आवेदन का तकनीकी मूल्यांकन पूरा करेगा और आवेदन प्राप्त होने के 15 दिनों के भीतर अपनी सिफारिशों के साथ आवेदन को आवेदक के पास भेज देगा ।

5.2.2 तत्पश्चात इकाई ऋण के लिए निर्धारित फार्ग में संबंधित बैंक/वित्तीय संस्था को आवेदन देगा ।

5.2.3 ऋण स्वीकृत होने पर बैंक अपनी टिप्पणियों और सिफारिशों तथा पी.आई.यू. के स्वीकृति पत्र के साथ आवेदन को वरीयतः एक माह के भीतर अग्रेषित कर देगा (आई डी एल एस- II )

5.2.4 तत्पश्चात पी.आई.यू.. बैंकों के वित्तीय मूल्यांकन और पी.आई.यू. के तकनीकी इनपुट के साथ आवेदन को जांच समिति को निर्णयों व अनुगोदन हेतु प्रस्तुत करेगा । 5.2.5 योजना के तहत वित्तीय सहायता की स्वीकृति विषय निर्वाचन समिति द्वारा प्रदान की जाएगी । निवेश अनुदानों के रूप में सहायता स्वीकृति करने से पहले सिडबी/बैंक द्वारा तकनीकी मूल्यांकन व बैंक योग्यता मूल्यांकन , दोनों को ही , ध्यान में रखा जाएगा । विषय निर्वाचन समिति के निर्णय के एक सप्ताह के भीतर औद्योगिक नीति और संवर्धन विभाग द्वारा सिडबी तथा संबंधित प्रायोजक बैंक को तथा आवेदक की सूचना दे दी जाएगी ।

5.2.6 जिन परियोजनाओं मे ऋण शामिल नहीं होगा , औद्योगिक इकाई को निर्धारित फार्म में सीधे सिडबी को आवेदन करना होगा और वे अपनी विशिष्ट सिफारिशों तथा मूल्यांकन टिप्पण के साथ उसे औद्योगिक नीति और संवर्धन विभाग को भेज देंगे । सिडबी द्वारा स्थल निरीक्षण रिपोर्ट के आधार पर सिडबी के जरिये सरकारी वित्तीय सहायता जारी की जाएगी । सरकारी वित्तीय सहायता के संवितरण से पहले , विषय निर्वाचन समिति के अनुमोदन हेतु अपेक्षित दस्तावेज भी प्रस्तुत किए जाएंगे ।

5.2.7 योजना आरंभ होने पर , सिडबी के अधिकार मे सीधे एक अग्रिम राशि दे दी जाएगी । बाद की राशियां , वास्तविक के अनुसार प्रतिपूर्ति आधार पर जारी की जाएंगी । जांच समिति सिडबी को निधियां जारी करने के लिए आवधिक रूप से सहायता एवं सवितरण की आवश्यकता की समीक्षा करेगी ।

5.2.8 योजना के कार्यान्वयन में तकनीकी व दूसरे प्रकार की सहायता के लिए पी.अई.यू. , औद्योगिक नीति और संवर्धन विभाग के प्रति जिम्मेदार होगा । पी.आई.यू. , औद्योगिक नीति और संवर्धन विभाग की कार्यान्वयन शाखा के तौर पर कार्य करेगा तथा त्वरित कार्यवाही , प्रासंगिक डेटाबेस के विकास में विभाग की सहायता करेगा , जिसमें उपकरणों की सूची , मशीनरियों के स्रोत , आदि तथा परियोजनाओं की दक्ष मानीटरिंग हेतु अपेक्षित दस्वावेजीकरण भी शामिल होंगे । पी.अई.यू.. सहायता हेतु आवेदनों से संबंधित गामलों पर औद्योगिक इकाई तथा औद्योगिक नीति और संवर्धन विभाग क बीच लिंक का काम करेगा । 1205 भारत का राजपत्र, दिसम्बर 10 , 2005 ( अग्रहायण 19, 1927)

अन्य निबंधन और शर्तें

6.0

6.1 वित्तीय सहायता संवितरण करने से पहले बैंक/ सिङबी, भारत सरकार की ओर से औद्योगिक इकाई के साथ एक अनुबंध करेगा । संबंधित बैंक द्वारा वित्तीय सहायता केवल तभी जारी की जाएगी , जब गशानें स्थल पर पहुंच जाएं और भारत सरकार की ओर से अन्नबंध हो जाए । यह सहायता गंशीनों की लागत के 30 प्रतिशत और 20 प्रतिशत तक सीमित होगी (क्रमशः लघु तथा गैर-लघु उद्योगों के लिए ) जैसा कि निबंधन और शर्तों में उल्लेख है ।

6.2 सरकारी वित्तीय सहायता जिस प्रयोजन हेतु स्वीकृत की गई है , उसके अलावा किसी अन्य प्रयोजन के लिए उसका उपयोग नहीं किया जा सकता । सरकार द्वारा जारी की गई राशि का उपयोग , उधारकर्ता द्वारा गूलधन चुकाने में चूक करने पर सगायोजन या ब्याज अदा करने के लिए नहीं किया जा सकता ।

6.3 आधुनिकीकरण कार्यक्रम पूरा हो जाने के बाद , औद्योगिक इकाई द्वारा सिडबी को कंपलीशन सर्टिफिकेट प्रस्तुत करना होगा । इस सर्टिफिकेट का फार्मेट विषय- निर्वाचन समिति द्वारा तय किया जाएगा ।

6.4 पूरा कराने की तारीख से , दो वर्षों तक , सरकारी वित्तीय सहायता का लाभ उठाने वाली औद्योगिक इकाई को सिडबी को फार्म आई डी एल एस- III में परिचालनात्मक एवं निष्पादन संबंधी ब्यौरे प्रस्तुत करने होंगे जो उनसे विषय- निर्वाचन समिति को अवगत करायेगा ।

6.5 यदि सरकार वित्तीय सहाता प्राप्त करने के दो वर्षों के भीतर औद्योगिक इकाई काम करना बंद कर देती है , तो उसे प्राप्त की गई वित्तीय सहायता वापस करनी होगी और साथ ही सिडबी की गूल ऋण दर पर इकाई बंद होने की तारीख से सहायता राशि वापस करने की तारीख तक ब्याज भी लिया जाएगा ( जैसा मामला होगा) । अनुपालन न करने की दशा में , संबंधित बैंक आवश्यक कदम उठायेगा ।

6.6 यदि किसी समय पर यह पाया जाता है कि किसी झूठी जानकारी के आधार पर सरकार से वित्तीय सहायता ली गई है , तो औद्योगिक इकाई को सरकारी वित्तीय सहायता वापस करनी होगी और साथ में संवितरण की तारीख से वापस करने की तारीख तक ब्याज भी देना होगा । ब्याज की दर , इस दंडात्मक खंड का प्रयोग करते सगय संबंधित बैंक की मूल ऋण दर होगी ।

6.7 योजना का समग्र तौर पर कार्यान्वयन प्रशासनिक विभग, अर्थात औद्योगिक नीति और संवर्धन विभाग द्वारा आवधिक रूप से किया जाएगा । 1206

4. नीतिगत मुद्दों सहित भंडार के प्रचलन संबंधी पहलुओं के बारे में सुझाव दिना।

5. समिति के गठन की तारीख से छः माह के भीतर अंतिम रूप से तैयार रिपोर्ट प्रस्तुत करमाः ।

Government of India created a new category of languages as ' Classical Languages ' vide Notification No.IV - 14014/ 7/2004- NI - II dated 12th October , 2004 read with the Corrigendum Notification dated 29th October 2004 and the following criteria was laid down to determine the eligibility of languages to be considered for classification as a ' Classical Language ' : -

( i) High antiquity of its early texts/recorded history over a thousand years .

(ii ) A body of ancient literature/texts , which is considered a valuable heritage by generations of speakers .

(iii ) The literary tradition be original and not borrowed from another speech community.

(iv) The classical language and literature being distinct from modern, there may also be a discontinuity between the classical language and its later forms or its offshoots .

2. Tamil Language was notified as a ' Classical Language ' vide para 3 of the aforesaid Notification dated 12th October , 2004.

The Non-official members will be paid travelling and daily allowances for attending the meetings of the Samiti as per the guidelines given in Department of Official Language Office Memorandum No. II/20034/ 4/86 /OL/ ( K - 2 ) dated 22nd January, 1987 and the rates fixed by the Government of India from time to time .

RESOLUTION

No. 2/3/2005-DD- II.-

In pursuance of the policy laid down in the National Common Minimum Programme, the Government of India has decided to constitute a separate fund, with the name and style of the National Investment Fund ' , with the following objectives . structure investment strategy and administrative arrangements.

A Objectives :

(i) The proceeds from disinvestment of Central Public Sector Enterprises will be channelised into the National Investment Fund which is to be maintained outside the Consolidated Fund of India.

(ii) The corpus of the National Investment Fund will be of a permanent nature .

(iii) The Fund will be professionally managed to provide sustainable returns to the Government, without depleting the corpus . Selected Public Sector Mutual Funds will be entrusted with the management of the corpus of the Fund.

(iv) 75% of the annual income of the Fund will be used to finance selected social sector schemes, which promote education. health and employment . The residual 25% of the annual income of the Fund will be used to meet the capital investment requirements of profitable and revivable CPSEs that yield adequate returns , in order to enlarge their capital base to finance expansion/diversification .

B. Structure and Administrative Arrangements :

The National Investment Fund will be operated by the selected Fund Managers under the ' discretionary mode of the Portfolio Management scheme , which is governed by the SEBI guidelines. The entire work of the National Investment Fund will be supervised by Chief Executive Officer ( CFO) of the Fund, an officer of the rank of Joint 1239 THE GAZETTE OF INDIA, DECEMBER 10, 2005 ( AGRAHAYANA 19, 1927) .

Secretary / Additional Secretary to the Government of India. A part time Advisory Board consisting of three eminent persons , with the requisite expertise to be appointed by the Government , would advise the CEO on various aspects of the functioning of the Fund.

C. Investment Strategy:

(i) The broad investment strategy is to provide sustainable returns without depleting the corpus.

(ii) The investment strategy for the Fund will be formulated by the Chief Executive Officer ( CEO) based on the advice of the Advisory Board so as to ensure that Government has a hands - off relationship in terms of the actual investment to be doneby the Fund Managers.

(iii ) Only broad guidelines are to be provided under the " discretionary mode " to the Fund Managers , within which individual investments would be made independently by the Fund Managers. More detailed guidelines specifying investment instruments and limits for investment in such instruments will be separately specified in the agreements to be entered into between the Fund Managers and the Chief Executive Officer of the Fund on behalf of the Government.

(iv) Other operational details such as allocation of funds to the selected Fund Managers , negotiations of management fee and charges to be paid to the Fund Managers , etc. will be also decided by the CEO based on the advice of the AdvisoryBoard.

(v) Appropriate mechanisms for regular review and monitoring of the functioning of the Fund, emerging market trends and future prospects will be instituted.

D. Accounting Procedure:

(i) The receipts from disinvestment of CPSEs will be deposited in the Consolidated Fund of India (CFI ) under the designated Head . Thereafter , these amounts would be appropriated from the CFI , with due approval, by the Department of Disinvestment and transferred to the selected Fund Managers through CEO of the Fund.

The Indian Leather Industry occupies a unique position in the Indian economy in terms of its contribution to employment and export potential . In spite of a strong raw material base , India's share in the global market is a meagre one . The experts have emphasized the need for capital infusion capacity addition and modernization in various segments of the leather sector to bring about efficiencies and economies of scale in order to achieve increased share in global markets .

2. Based on the assessed need of the leather sector , a comprehensive scheme.for modernization and technology up gradation in all the segments of the Leather Industry , namely tanneries , footwear , footwear components , saddlery , leather goods and garments , with an outlay of Rs . 290 crore has been approved by the Government . The Scheme titled " Integrated Development of Leather Sector " ( IDLS) will be implemented during the 10th Plan Period (2002-2007 ) . The scheme will be applicable with ir.mediate effect i.e. 3rd November , 2005 .

Eligibility

3. All existing units in tanneries , leather product , leather footwear and footwear components sector undertaking viable and bankable programs on technology up- gradation on or after 3rd November, 2005 are eligible for assistance under this Scheme .

Financial Assistance

4. The financial assistance envisaged under the Scheme will consist of grant to the extent of 30% of the cost of plant and machinery for SSI and 20% of cost of plant & machinery for other units ( i.e. non - small scale units ) subject to a ceiling of Rs . 50 lakh for both categories for technology up - gradation/modernization and/ or expansion . Investment grant would also be available to the units investing their own resources .

Implementation Arrangements

5. The scheme will be implemented through two PIUs one at CLRI , Chennai for tannery and another at FDDI , Noida for leather goods and garments , saddlery , leather footwear and footwear component . SIDBI would be the nodal agency for the Scheme . Any industrial unit desirous of availing financial assistance under this Scheme would apply in the prescribed form to the concerned PIU i.e FDDI , Noida and CLRI , Chennai for respective leather sectors . After technical appraisal , PIU would return the application back to the unit within fifteen days. The unit then would apply to the concerned bank for loan. The bank after financial appraisal of the project would accords its sanction and will forward the application along with formal sanction to the concerned PIU . The same will then be submitted by PIU to the Steering Committee and the sanction of financial assistance under the Scheme would be accorded by the Steering committee . PIU will serve as the Secretariat for the Steering Committee .

Composition of the Steering Committee is specified in the detailed guideline enclosed with the O.M.

GUIDELINES Sub : Integrated Development of Leather Sector ( IDLS )

Objective

1.0

The Indian Leather Industry occupies a unique position in the Indian economy in terms of its contribution to employment and export potential . In spite of a strong raw material base , India's share in the global leather trade is a meagre one . As Leather Industry in India was reserved for Small Scale Sector for a very long time , the level of investment in the Leather Sector is very low resulting in smaller production base , poor productivity . Obsolete technology , lack of standardization and poor marketing infrastructure has been other factors associated with the sector not growing to its potential . Given the significance of this Industry to the overall health of the Indian economy , its employment potential and historical backlog of technology up-gradation , it has been emphasized by experts that in order to assist and improve its competitiveness in the global market , it is essential for the Leather Industry to have access to timely and adequate capital in order to up - grade its technology level .

In light of the foregoing the present scheme is aimed at enabling existing tanneries , footwear , footwear components and leather products units to upgrade leading to productivity gains , right- sizing of capacity, cost cutting , design and development . The scheme targets creation of positive ambience for technology up gradation and environmental impact for attaining global competitiveness through productivity gains , minimization of wastages , right sizing of capacity , cost cutting , design and development etc.

2.0 Eligibility Criteria

All existing units in leather and leather products including tanneries , leather goods , saddlery , leather footwear and footwear component sector undertaking viable and bankable programmes on technology up - gradation on or after the date of notification are eligible for assistance . Any unit in existence for at least three years and having cash profits for at least two years on 3rd November , 2005 would be considered as an existing unit.

2.2 Modernization programmes funded by SIDBI / Banks as well as those programmes undertaken by existing production units from their own resources will be eligible for assistance .

2.3

Financial assistance under the Scheme shall be available only for such projects in which the loan has been sanctioned by SIDBI Banks /FIs on or after 3rd November , 2005 of the scheme under the present guidelines . modernization scheme financial assistance under the scheme shall be available only for such projects where the order for the purchase of machinery has been placed on or after 3rd November , 2005 and subject to necessary documents being filed as per format while making the application under the present scheme .

2.4 Existing units , relocating to new locations , seeking modernization expansion packages , inclusive of solutions to environmental problems , will also be eligible.

2.5 The project submitted by the concerned unit should be assessed to be a financially viable and bankable project . The project should lead to:

[i ] Demonstrable increase in unit value realization and/or

[ii ] Production capacities and/ or

[ iii ] Better compliance of pollution control norms.

3.0 SCOPE OF THE SCHEME

Technology Up- gradation will include the following:

3.1 Measures for technology up - gradation , productivity enhancement, improved environmental safeguards , global competitiveness through cost control and minimization ofwaste.

3.2 Measures for up- gradation and modernization of machinery facilities including in plant lay - out and civil and associated electrical work relating to foundation of machinery facilities but excluding building and other related infrastructure.

3.3 Measures for product diversification by way of design and development , hardware and technology support including IT solutions and net working and È Governance .

3.4 Measures for improvement in plant ecology , up gradation of leather finishing facilities and worker safety .

3.5 Measures for implementation of secure environmental management plans at the individual production unit levels including replacement of pit technology in tanneries or installation of in plant pollution control devices such as chrome recovery.

3.6 Measures for quality control and testing systems as well as any obligatory measures stipulated by government regulations for individual production enterprises at unit level.

3.7 Addition of closing room facilities for footwear upper units and creation of production facilities for footwear components .

3.8 Creation of in house R & D and testing facilities and establishment of sample making facilities .

3.9 Installation of the following types of machinery in an existing unit by way of replacement of existing machinery and / or expansion will be eligible for coverage under the scheme .

i . Modernization of Tanneries

3.10 Steering committee may seek the advice of National institutions for considering any other activity not listed above and machines not specified in the current guidelines for inclusion under Modernization scheme provided that they lead to visible and viable improvements leading to technology up gradation. Similarly , the Steering Committee may delete an activity/ list of machineries on the advice of expert institution. However, diversification will be treated as new venture and not allowed.

3.11 Existing units will have the option to go for single or multiple activities as mentioned above with overall assistance limit of 50 lakhs . Mod ılar efforts to modernization will be permitted generally with a time interval of at least six months between applications and on the successful completion of the earlier modules of modernization . However , Steering committee will take a view on applications for modernization in multiple numbers of times based on a) fair and equitable assistance to first time applicants and b) competitive merit of the applicant as evidenced by financial appraisals by FIs /Banks / SIDBI and technical appraisal .

4.0 QUANTUM AND NATURE OF ASSISTANCE .

4.1 The financial assistance under the Scheme will be investment grant to the extent of 30% of cost of plant and machinery for SSI and 20% of cost of plant and machinery for other units ( i.e. non SSI units ) subject to a ceiling of Rs . 50 lakh for technology up gradation /modernisation and'or expansion . be available to units investing their own resources . For the purpose of this Scheme, the definition of small - scale industry would be the same as notified by the Government on the date of sanction of the project. The cost of up gradation under the scheme will include:

Bill value of machines ,

Sales and excise tax,

Transportation and transit insurance cost ,

Import related duty,

Installation and commissioning charges including civil and electrical work restricted to 5% of total land cost of machine .

5.0 Implementation Mechanism

5.1 Administrative and Monitoring Setup

5.1.1 The implementing agency would be in the form of an administrative unit of the Department called the Project Implementation Unit (PIU) of the Integrated Development of Leather Sector. In view of larger scope of the scheme PIU will function from two centres one at CLRI , Chennai for Tanneries and other at FDDI , Noida for footwear , footwear components , saddlery , leather goods and garments and saddlery.

5.1.2 The nodal agency for release of assistance , monitoring and interface and coordination with FIs , Banks and the Government would be SIDBI .

5.1.3 There will be a Steering Committee for implementation of the scheme whose mandate would be to ensure effective implementation of the scheme. Its scope would be to lay down procedures , decide normative prices for standard plant and machineries required for the modernisation programme , accord sanction of financial assistance from Government, and monitor and follow up disbursal of financial assistance from Government to the industrial units . It will comprise of:

5.2 Procedure For Application

5.2.1 Any industrial unit desiring to avail itself of the Government financial assistance will have to apply for assistance in a prescribed application form ( IDLS - I ) in triplicate to the concerned PIU . Declaration on the form should be unconditionally supported by an affidavit . PIU shall acknowledge the receipt of application and allot a registration number. PIU shall complete the technical appraisal of the application received and shall send the application along with its recommendation to the applicant within 15 days of the receipt of the application .

5.2.2

for ioan . The unit shall then apply to the concerned Bank/FI in the prescribed form 5.2.3 The bank on sanction of loan will forward the application with their comments and recommendations as well as letter of sanction to PIU preferably within a month ( IDLS - IⅢ ) .

5.2.4 PIU will then present the applications along with financial appraisal from bank and technical inputs from PIU to Screening Committee for decisions and approval .

5.2.5 The sanction of financial assistance under the Scheme will be accorded by the Steering Committee. Both technical appraisal and bankabilit, appraisal by SIDBI/ Bank wiil be taken into consideration prior to the sanctions of the assistance in the form of investment grants . The decision would be conveyed by the DIPP to SIDBI and the sponsoring Bank concerned under intimation to the applicant within a week of the decision ofthe Steering Committee.

5.2.6 In case of projects involving no loan component , the industrial unit will be required to apply in a prescribed form directly to SIDBI and they would forward the same to the DIPP along with their specific recommendations and appraisal note . The Government's financial assistance would be released through SIDBI on the basis of the site inspection report of SIDBI . The requisite documents shall also be submitted for the approval of the Steering Committee prior to disbursement of Governmental financial assistance.

5.2.7 On the commencement of the Scheme an advance amount would be placed directly at the disposal of SIDBI . Subsequent releases would be made on a recoupment 1249 THE GAZETTE OF INDIA , DECEMBER 10 , 2005 ( AGRAHAYANA 19, 1927 )

basis as per the actual . The Screening Committee would periodically review the requirement of assistance as well as disbursal for release of funds to SIDBI .

5.2.8 PIU will be responsible to the DIPP for providing technical and other assistance in the implementation of the scheme . PIU will serve as the implementation arm of DIPP and assist the Department in speedy action , development of relevant database including the lists of devices , sources of machineries etc. as well as documentation required for efficient monitoring of the projects . PIU will serve as the link between the industrial unit and the DIPP on matters relating to the applications for assistance .

6.0 Other Terms & Conditions :

6.1 The Bank/ SIDBI will get an agreement executed on behalf of Government of India with the industrial unit prior to disbursement of financial assistance . Financial assistance will be released by the Banks concerned only on arrival of machines at site and after execution of the agreement on behalf of the Government of India and will be limited to 30 % and 20% of the cost of machines ( for SSI and non SSI respectively ) as stated in the terms of agreement .

6.2 The Government financial assistance cannot be utilized for purposes other than for which it has been sanctioned. The amount released by the Government cannot be utilized towards adjustment of default in repayment of principal and payment of interest by the borrower .

6.3 After completion of the modernisation programme, the industrial unit will be required to submit a completion certificate to SIDBI . The format of the certificate would be decided by the Steering Committee.

6.4 From the date of completion, up to two years , the industrial unit availing the Government financial assistance will be required to submit operational and performance details in form IDLS III to SIDBI who would appraise the Steering Committee of the same .

6.5

In case the industrial unit becomes non - operational within two years of the receipt of Government financial assistance , it will be liable to refund the financial assistance availed , along with the interest to be charged from the date of closure till the date of refund at the prime lending rate of SIDBI ( as the case maybe ) . Incase of non- compliance, the Bank concerned will take necessary legal action .

6.6 In case at any time it is found that financial assistance from Government has been availed of on the basis of any false information , the industrial unit shall be liable to refund the amount of Government financial assistance , along with interest to be 1250

6.7 The overall implementation of the Scheme would be reviewed by the Administrative Department i.e. Department of Industrial Policy & Promotion periodically.
