2. सीएसएस के ग्रेड-1 के उपर्युक्त अधिकारियों की पारस्परिक वरिष्ठता उनकी संबंधित चयन सूचियों में दिए गए क्रम से निर्धारित होगी, सीएसएस के ग्रेड-1 में उनकीनियुक्ति की वास्तविक तिथि चाहे कुछ भी हो । साथ ही , उपरोल्लिखित चयन सूचियों से अवर सचिवों के पद पर ऊपर उल्लिखित अधिकारियों की नियुक्तिदिल्ली उच्च न्यायालय में श्री आर. के. ओझा और सुश्री प्रीती श्रीवास्तव बनाम भारत संघ तथा भारत संघ बनाम विजय कुमार और अन्य द्वारा दायर विविल रिट याचिकाओं के अंतिम निर्णय के अधीन होगी ।

3. उपर्युक्त अधिकारी उनसे संबंधित चयन सूचियों की । जुलाई से अवर सचिव के रूप में अपना वेतन कल्पित आधार पर नियत करने के पात्र हैं । लेकिन, इन अधिकारियों की बकाया राशि हेतु पात्रता कार्मिक एवं प्रशिक्षण विभाग के केन्द्रीय रूप से जारी आदेश द्वारा अवर सचिव के पद पर उनकी वास्तविक नियुक्तिकी तिथि से वेतन के पुनर्निधारण पर आधारित होगी । ये अधिकारी एफआर-22 के उपबंधों के तहत अपने वेतन निर्धारण के विकल्प कालाभ लेने के भी पात्र होंगे । लेकिन, जिन अधिकारियों को उनकी चयन सूची वर्ष के । जुलाई से पहले तदर्थ अवर सचिव प्रोन्नत किया गया था और उन्होंने पृथक्करण ( स्पिलिट ) विकल्प का लाभ लिया था, वे पुनः इस विकल्प का लाभ लेने के पात्र नहीं होंगे ।
