यह नियुक्तिकेन्द्रीय सचिवालय सेवा नियम, 1962 के नियम 12( 1) के अन्तर्गत सी.एस.एस. के सेलेक्शन ग्रेड में नियुक्ति के लिए, सी.एस. एस. नियम 1962 के नियम 12 ( 4 ) एवं सी.एस.एस. ( ग्रेड-1 में पदोन्नति एवं सेलेक्शन ग्रेड) नियमन 1964 , जिसमें समय - समय पर सुधार होता रहा है, के अन्तर्गत हुई है। उपर्युक्त अधिकारी की पारस्परिक वरिष्ठता/वरीयता दिनांक 25.5.2005 के कार्मिक एवं प्रशिक्षण विभाग के कार्यालय ज्ञापन सं. 4/24/2004 सी.एम- I (i) के अनुबंध के अनुसार होगी चाहे वास्तविक नियुक्ति की तारीख कोई भी हो । चूंकि चयन सूची 1994 के उपर्युक्त अधिकारी के संदर्भ में उनकी अभिस्वीकृति सेवा 01.07.1994 से जारी है,. उनका वेतन निर्धारण 01.07.1994 से नोशनल आधार पर होगी । तथापि अधिकारी को वास्तविक वित्तीय लाभ उनके उपसचिव के पद पर नियुक्ति की तारीख से ही प्राप्त होंगे ।

I ( i ) के अनुसरण में पूर्ति तथा निपटान महानिदेशालय में, उपसचिव ( तदर्थ ), केन्द्रीय सचिालय सेवा के ग्रेड-1 में उपर्युक्त अधिकारी की वरीयता का क्रमदिनांक 14.11.05 के उपर्युक्त उल्लिखित का. ज्ञा. के अनुबंध में दिए गए क्रम के अनुसार होगा चाहे ग्रेड-1 में उनकी नियुक्ति की वास्तविक तिथि कोई भी क्यों न हो । चयन सूची -2000 के अवर सचिव पद पर अधिकारी की यह नियुक्ति , श्री ओझा और सुश्री प्रीति श्रीवास्तव बनाम भारत संघ और अन्य तथा भारत संघ बनाम विजय कुमार एवं अन्य द्वारा उच्चन्यायालय में दायर की गई रिट याचिका के अन्तिम निर्णय के शर्ताधीन होगी । लम्बे समय तक चलने वाली मुकदमेबाजी के कारण और इन पैनलों पर की जाने वाली कार्रवाई के लम्बित हो जाने के कारण , चूंकि इस प्रकार के पैनलों के लिए निर्धारित अवधि के अन्दर नियमित चयन सूची नहीं बनाई जा सकी, अतः अवर सचिव के रूप में नोशनल आधार पर उनका वेतन निर्धारण के लिए यह समझा जाएगा कि उनकी नियुक्ति 1.7.2000 से प्रभावी है । तथापि, वास्तविक लाभ केवल उस तारीख से होंगे जिस तारीख को अधिकारी की अवर सचिव के पद पर नियुक्ति हुई थी/है । उक्त अधिकारी उस तिथि से वेतन पुर्निधारण के मद्देनजर मिलने वाले बकाया राशि के हकदार होंगे जिस तिथि से कार्मिक एवं प्रशिक्षण विभाग द्वारा अवर सचिव के पद पर उनकी वास्तविक नियुक्ति केन्द्रीय रूप से आदेशित है । इसके अतिरिक्त, अधिकारी को अपने वेतन के निर्धारण के लिए विकल्प का लाभ लेने का अधिकार भी होगा जैसा कि 204
