(घ) चर्मशोधनशाला के पुनः आवंटन तथा संचालन के लिए संबंधित मंत्रालयों/विभागों/अन्य निकायों से आवश्यक स्वीकृति प्राप्त की जानी चाहिए । वाणिज्य और उद्योग मंत्रालय (औद्योगिक नीति और संवर्धन विभाग ) नई दिल्ली, दिनांक 16 मार्च 2006
गौरी सिंह निदेशक सं. 5 ( 18 )/2002- लेदर औद्योगिक नीति और संवर्धन विभाग की दिनांक 03 नवम्बर , 2005 की अधिसूचना सं. 5 ( 18 )/2002-लेदर के साथ जारी किए गए दिशा- निर्देशों के पैरा 5.1.3 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए जांच समिति, इस बात से संतुष्ट हुई है कि ऐसा करना जन- हित में आवश्यक था , एतद्वारा भारत सरकार, वाणिज्य और उद्योग मंत्रालय ( औद्योगिक नीति और संवर्धन विभाग ) की अधिसूचना संख्या 5(18)/2002- लेदर दिनांक 03 नवम्बर, 2005 में निम्नलिखित संशोधन करती है, नामेत:--
विषय : -- मानव संसाधन विकास मंत्रालय (माध्यमिक और उच्चतर शिक्षा विभाग ) संकल्प प्रतिलिप्याधिकार प्रवर्तन सलाहकार परिषद्-- मुख्य संकल्पमें संशोधन
उक्तअधिसूचना में , --
( 1 ) दिशानिर्देशों में
(i) पैरा 2.1 के नीचे तथा पैरा 2.2 के पहले निम्नलिखित पंक्तियों को पैरा 2.1.1 के रूप में जोड़ा जाये;
सरकार ने मानव संसाधन विकास सं. 7-4/2003- आई.सी.-- मंत्रालय (माध्यमिक और उच्चतर शिक्षा विभाग ) में सरकार के दिनांक 22फरवरी , 2005 के समसंख्यक संकल्प में निम्नलिखित संशोधन करने का निर्णय लिया है जो 8 मार्च , 2006 से प्रभावी होंगे , यथा : --
उक्तसंकल्पमें, --
पैरा सं. 4 ( 1 ) में उल्लिखित " अपर सचिव " के स्थान पर निम्नलिखित प्रतिस्थापित किया जाएगा--
अध्यक्ष;" सचिव " , माध्यमिक और उच्चतर शिक्षा विभाग, मानव संसाधन विकास मंत्रालय ( पदेन)
आदेश
" न्यायालय के आदेशों के कारण कोलकाता ( पश्चिम बंगाल ) तथा इरोड ( तमिलनाडु ) स्थित बन्द हुए चर्मशोधनशालाओं ( टेनरी ) को जारी की गई अधिसूचना के उपरोक्त दिशा-निर्देशों के पैरा 2.1 में निर्धारित मौजूदा एकक के रूप में विचार किए जाने के लिए 3 नवम्बर, 2005 को अस्तित्व के 3 वर्ष तथा कम से कम दो वर्ष के लिए नकद लाभ प्राप्त करने की धारा में निम्नलिखित शर्तों के अध्यधीन छूट प्रदान की जायेगी: --
(क) न्यायालय के आदेश के कारण बन्द किये जाने से पूर्व चर्मशोधनशाला को 3 वर्ष की अवधि के लिए अस्तित्व में होना चाहिए;
यह आदेश दिया जाता है कि इस आदेश की एक- एक प्रति राज्य सरकारों तथा संघ शासित प्रदेश प्रशासनों , भारत सरकार के सभी मंत्रालयों तथा विभागों, मंत्रिमंडल सचिवालय , प्रधानमंत्री कार्यालय , संसदीय कार्य विभाग, लोक सभा सचिवालय, राज्य सभा सचिवालय, राष्ट्रपति सचिवालय, योजना आयोग को भेजी जाए ।
(ख ) न्यायालय के आदेश के कारण चर्मशोधनशाला को बन्द किए जाने से पूर्व दो वर्ष के लिए नकद लाभ प्राप्त करना चाहिए;
यह भी आदेश दिया जाता है कि इस संकल्प को भारत सरकार के राजपत्र में आम सूचनार्थ प्रकाशित किया जाए ।
( ग ) चर्मशोधनशाला को नये स्थान का पुनः आवंटन होना चाहिए तथा सामान्य बहिःस्राव संयंत्र का सदस्य होना चाहिए; तथा

In exercise of the powers conferred by para 5.1.3 of the guidelines issued alongwith Department of Industrial Policy and Promotion's Notification No. 5 ( 18 ) 2002- Leather dated November 3 , 2005 , the Screening Committee being satisfied that it is necessary in public interest to do so , hereby makes the following amendments in the Notification of the Government of India in the Ministry of Commerce and Industry (Department of Industrial Policy and Promotion) No. 5 (18) 2002- Leather dated November 3 , 2005 , namely :--
In the said Notification ,-
(I) in the guidelines ,-
(i) Below para 2.1 and above para 2.2 the following lines may be added as para 2.1.1.- "Tannery closed down on account of Court Orders at Kolkata (West Bengal) and Erode (Tamil Nadu ) will be granted relaxation of the clause of 3 years existence and having cash profits for at least two years on November 3 , 2005 for being considered as an existing unit stipulated in para 2.1 of the above- mentioned guidelines of the Notification issued , subject to the following conditions :-
(a) the tannery should have been existence for a period of 3 years prior to closure on account of court order ;
(b) the tannery should have a cash profit for two years before the closure on account of the Court Order;
(c) the tannery should have relocated to a new place and should be a member of a Common Effluent Treatment Plant ; and (d) necessary clearance from concerned Ministries/Departments/Other Bodies

No. 7-4/2003- IC .-The Government of India have decided to make the following amendment in the Resolution of the Government of India in the Ministry of Human Resource Development ( Department of Secondary and Higher Education) of even number dated the 22nd February, 2005 , witheffect from March 8, 2006, namely:-

For Paragraph no . 4 (i ) in place of " Additional Secretary " the following shall be substituted:-

ORDER
