आ.अ. 43. -लोक प्रतिनिधित्व अधिनियम , 1950 ( 1950 का 43 ) की धारा 13 क की उपधारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , भारत निर्वाचन आयोग , राष्ट्रीय राजधानी क्षेत्र दिल्ली सरकार के परामर्श से एतद्वारा श्री राजेश कुमार श्रीवास्तव , आई.ए.एस. के स्थान पर श्रीमती सतबीर सिलास बेदी , आई. ए. एस. ( एजीएमयू 1986 ) को उनके कार्यभार ग्रहण करने की तारीख से आगामी आदेशों तक के लिए राष्ट्रीय राजधानी क्षेत्र दिल्ली के मुख्य निर्वाचन अधिकारी के रूप में नामित करता है।
2. श्रीमती सतबीर सिलास बेदी , राष्ट्रीय राजधानी क्षेत्र दिल्ली सरकार के अधीन सभी पदभार या किसी कार्य के पदभारों को तत्काल सौंप देंगी या धारण करना समाप्त कर देंगी , जो कि वे ऐसा पदभार ग्रहण करने से पहले धारण कर रही थीं ।
3. श्रीमती सतबीर सिलास बेदी मुख्य निर्वाचन अधिकारी , राष्ट्रीय राजधानी क्षेत्र दिल्ली के पद पर कार्य करते हुए , राष्ट्रीय राजधानी क्षेत्र दिल्ली सरकार के अधीन किसी भी प्रकार का कोई अतिरिक्त कार्यभार ग्रहण नहीं करेंगी सिवाय इसके कि उनको राष्ट्रीय राजधानी क्षेत्र दिल्ली के सचिवालय में निर्वाचन विभाग के प्रभारी, सरकार का सचिव पदाभिहित किया जायेगा।

ELECTION COMMISSION OF INDIA

O.N. 43. In exercise of the powers conferred by Sub- section (1 ) of Section 13A of the Representation of the People Act, 1950 (43 of 1950) , the Election Commission of India in consultation with the Government of National Capital TerritoryofDelhi hereby nominates Smt . Satbir Silas Bedi, IAS (AGMU: 1986) as the Chief Electoral Officer for the National CapitalTerritory of Delhi with effect from the date she take over charge and until further orders vice Shri Rajesh Kumar Srivastava, IAS .
2. Smt . Satbir Silas Bedi shall cease to hold and hand over forthwith the charge of all or any charges of work under the Government of National Capital Territory of Delhi , which he may be holding before such assumption of office .
3. Smt . Satbir Silas Bedi while functioning as the Chief Electoral Officer, National Capital Territory of Delhi shall not hold any additional charge whatsoever under the Governrnent of National Capital Territory of Delhi except that she should be designated Secretary to the Government in charge of Election Department in the Secretariat of National Capital TerritoryofDelhi.

आ.अ. 44.-यतः , उड़ीसा राज्य में 09 खुन्टा ( अ. ज. जा. ) विधान सभा निर्वाचन क्षेत्र से उड़ीसा विधान सभा , के लिए 2004 साधारण निर्वाचनों में निर्वाचन लड़ने वाली श्रीमती उषामणि सिंह , लोक प्रतिनिधित्व अधिनियम, 1951 और उसके अधीन बनाए गए नियमों और आदेशों द्वारा अपेक्षित अपने निर्वाचन व्ययों का कोई लेखा दाखिल करने में असफल रही हैं;
और, यतः , श्रीमती उषामणि सिंह ने उक्त असफलता के लिए निर्वाचन आयोग द्वारा सम्यक सूचना दिए जाने पर भी कोई कारण अथवा स्पष्टीकरण नहीं दिया है;
अतः , निर्वाचन आयोग का यह समाधान हो गया है कि उक्त अभ्यर्थी के पास उक्त असफलता के लिए कोई पर्याप्त कारण अथवा न्यायोचित्य नहीं है;
अतः , अब , उक्त अधिनियम के नियम 10 क के अनुसरण में, निर्वाचन आयोग , श्रीमती उषामणि सिंह को संसद के किसी भी सदन का या राज्य/ संघ राज्य क्षेत्र की विधान सभा या विधान परिषद् का सदस्य होने या चुने जाने के लिए इस आदेश की तारीख से 3 वर्ष की अवधि के लिए, एतद्वारा निरर्हित घोषित करता है।

O.N. 44. Whereas , Smt. Ushamani Singh a contesting candidate at the General Election to the Orissa Legislative Assembly, 2004 held from 09- Khunta (ST) Assembly Constituency in the State of Orissa has failed to lodge any account of his election expenses , as required by the Representation of the People Act , 1951 and the Rules made thereunder;
And, whereas, Smt. Ushamani Singh has not furnished any reasori or explanation for the said failure even after due notice of the Election Commission;
And, whereas , the Election Commission is satisfied that the said candidate has no good reason or justification for the said failure;
Now, therefore, in pursuance of Section 10A of the said Act, the Election Commission hereby declares Smt. Ushamani Singh to be disqualified for being chosen as and for being a member of either House of the Parliament or ofthe Legislative Assembly or Legislative Council of a State/Union Territory for a period of 3 years from the date of this Order .

आ.अ. 45. - यतः, निर्वाचन आयोग का यह समाधान हो गया है कि उड़ीसा विधान सभा 2005 का उप निर्वाचन , जो स्तम्भ ( 2 ) में विनिर्दिष्ट निर्वाचन क्षेत्र में हुआ है स्तम्भ ( 3 ) में उसके सामने विनिर्दिष्ट निर्वाचन लड़ने वाला प्रत्येक अभ्यर्थी, लोक प्रतिनिधित्व , अधिनियम, 1951 तथा तद्धीन बनाए गए नियमों द्वारा यथा अपेक्षित 'या उक्त सारणी के स्तम्भ ( 4 ) में यथादर्शित विधि द्वारा अपेक्षित रीति से अपने निर्वाचन व्ययों का कोई लेखा दाखिल करने में असफल रहा है;
और , यतः , उक्त अभ्यर्थी ने निर्वाचन आयोग द्वारा सम्यक् सूचना दिए जाने पर भी उक्त असफलता के लिए कोई कारण अथवा स्पष्टीकरण नहीं दिया है और निर्वाचन आयोग का यह समाधान हो गया है कि उनके पास उक्त असफलता के लिए कोई पर्याप्त कारण अथवा न्यायौचित्य नहींहै;
अतः , अब, निर्वाचन आयोग उक्त अधिनियम की धारा 10 क के अनुसरण में नीचे की सारणी के स्तम्भ ( 3 ) में विनिर्दिष्ट व्यक्तियों को संसद के किसी भी सदन के या किसी राज्य संघ राज्य क्षेत्र की विधान सभा अथवा विधान परिषद् के सदस्य चुने जाने और होने के लिए इस आदेश की तारीख से तीन वर्ष की कालावधि के लिए एतद्वारा निरर्हित घोषित करता है: -

O.N. 45. Whereas , the Election Commission is satisfied that each of the contesting canditates specified in column (3 ) of the Table below at the Bye - Electionto the Orissa Legislative Assembly, 2005 held from the constituency specified in column ( 2 ) against his name has either failed to lodge any account of his election expenses or failed to lodge his election expenses in manner required by law as shown in column (4) of the said Table as required by the Representation ofthe People Act, 1951 , and the rules made thereunder;
And, whereas , the said candidates have either not funished any reason or explanation for the said failure even after due notice of the Election Commission after considering the representation if any, made by them, is satisfied that they have no good reason or justification for the said failure;
Now, therefore, in pursuance of Section 10A of the said Act, the Election Commission hereby declares the persons specified in column (3 ) of the Table below to be disqualified for being chosen as and for being , a member of either House of the Parliament or of the Legislative Assembly or Legislative Council of a State /Union Territory for a period of three years from the date of this order.
