सं. 24012/27/99 - आईपीएस II- यतः श्री सत्य सुन्दर त्रिपाठी , आई पी एस ( एनएल : 89 ) को नागालैण्ड सरकार द्वारा दिनांक 11.11.2000 से 30.6.2001 तक के लिए 232 दिनों की अवधि की असाधारण छुट्टी (ई ओ एल ) स्वीकार की गई थी जिसे दिनांक 1.7.2001 से 31.12.2002 तक के लिए और ( एक ) वर्ष 6 (छः ) माह की अवधि के लिए बढ़ाया गया था ।
और यतः उन्होंने उक्त छुट्टी के लिए अपरिहार्य कारणों/परिस्थितियों के कारण आवेदन किया था परन्तु बाद में यह जानकारी में आया कि उन्होंने लंदन स्कूल आफ इकोनोमिक्स में डाक्टरल रिसर्च प्रोग्राम में प्रवेश ले लिया है ।
और यतः उन्होंने और 6 माह की असाधारण छुट्टी के लिए आवेदन किया था जिसे स्वीकार नहीं किया गया और उनसे नागालैण्ड सरकार के दिनांक 19 अगस्त, 2003 के पत्र संख्या पीओएल-1/पीएफ/2/90 के तहत तत्काल कार्य पर वापिस आने को कहा गया था । और यतः श्री त्रिपाठी को दिनांक 8.12.03 को एक कारण बताओ नोटिस भी जारी किया गया कि ड्यूटी से अनाधिकृत रूप से अनुपस्थित रहने के लिए उनके खिलाफ अनुशासनिक कार्यवाही क्यों न की जाए;
और यतः उक्त श्री सत्य सुन्दर त्रिपाठी को अखिल भारतीय सेवा (छुट्टी) नियम 1955 के नियम 7 ( 2 ) ( क ) के उपबंधों के अंतर्गत 4 अगस्त, 2005 को एक नोटिस जारी किया गया था जिसमें उनसे यह स्पष्टीकरण मांगा गया था कि चूंकि उन्होंने न ही 8.12.2003 के ज्ञापन का कोई उत्तर भेजा और न ही उसकी पावती भेजी, इसलिए उक्त नियम का उपबंध उनके मामले में क्यों न लागू किया जाए;
और यतः उक्त श्री सत्य सुन्दर त्रिपाठी ने अपने दिनांक 5 जनवरी , 2006 के पत्र के द्वारा 1 जनवरी , 2004 से सेवा से त्यागपत्र देने की अपनी इच्छा व्यक्त की है ;
और यतः श्री सत्य सुन्दर त्रिपाठी 1.1.2003 से अनाधिकृत रूप से अपनी ड्यूटियों से अनुपस्थित रहे हैं और उनका मामला 1.1.2004 से अखिल भारतीय सेवा ( छुट्टी) नियम, 1955 के नियम 7 ( 2 ) ( क ) के अंतर्गत आता है;
और यतः श्री सत्य सुन्दर त्रिपाठी को अपनी अनधिकृत अनुपस्थिति के कारण स्पष्ट करने का उचित अवसर प्रदान किया गया है जिसके संबंध में उन्होंने 1.1.2004 से अपना त्यागपत्र देकर अपना प्रत्युत्तर भी भेज दिया है ।
और यतः अब, राष्ट्रपति अखिल भारतीय सेवा ( छुट्टी ) नियम, 1955 के नियम 7 (2 ) ( क ) के उपबंधों द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए श्री सत्य सुन्दर त्रिपाठी , आई पी एस ( एन एल : 89 ) को उनकी अनधिकृत अनुपस्थिति की तारीख के एक वर्ष से अर्थात् 1.1.2004 से पुलिस सेवा से त्यागपत्र दिया हुआ मानते हैं । उन्हें उसी तारीख से भारतीय पुलिस सेवा से कार्यमुक्त किया जाता है और तदनुसार इसे अधिसूचित किया जाता है ।

AND WHEREAS he had applied for extension of the EOL for another period of 6 months which was not sanctioned and he was asked to return to join his duties by the Government of Nagaland vide their letter No. POL-1/ PF/2/90 , dated 19th August, 2003 ;
AND WHEREAS a notice was also issued to Shri Tripathy on 8.12.2003 to show cause as to why 396
disciplinary proceedings be not initiated against him under the provisions of the All India Services (Discipline & Appeal ) rules for his unauthorised absence;
AND WHEREAS the said Shri Satya Sunder Tripathy was issued with a Notice under the provisions of Rule 7 ( 2 ) (a) of the All India Services (Leave ) Rules , 1955 on 4th August , 2005 , calling for his explanation as the why the provisions of the said rule should not be invoked in his case, as he had neither responded nor even acknowledged the receipt of the memo dated 8.12.2003 ;
AND WHEREAS the said Shri Satya Sunder Tripathy has since conveyed his willingness to resign from service from 1 January, 2004 vide his letter dated 5th January, 2006;
AND WHEREAS Shri Satya Sunder Tripathy has been unauthorisedly absent from duties from 1.1.2003 and his case is considered to be falling within the ambit of Rule 7(2) ( a) of the All India Services (Leave ) Rules , 1955 from 1.1.2004;
AND WHEREAS a reasonable opportunity to explain the reasons for his unauthorised absence has been given to Shri Satya Sunder Tripathy to which he has also responded by tendering his resignation from 1.1.2004;
