आ. अ. 64.- यतः निर्वाचन आयोग का समाधान हो गया है कि नीचे की सारणी के स्तम्भ ( 2 ) में यथा विनिर्दिष्ट बिहार राज्य से लोक सभा के साधारण निर्वाचन , 2004 के लिए जो स्तम्भ ( 3 ) में विनिर्दिष्ट निर्वाचन क्षेत्र से हुआ है स्तम्भ ( 4 ) में उसके सामने विनिर्दिष्ट निर्वाचन लड़ने वाला प्रत्येक अभ्यर्थी , लोक प्रतिनिधित्व अधिनियम , 1951 तथा तद्दीन बनाए गए नियमों द्वारा अपेक्षित उक्त सारणी के स्तम्भ ( 5 ) में यथादर्शित अपने निर्वाचन व्ययों का कोई भी लेखा दाखिल करने में असफल रहा है ;
और, यतः उक्त अभ्यर्थियों ने , सम्यक् सूचना दिए जाने पर भी उक्त असफलता के लिए कोई कारण अथवा स्पष्टीकरण नहीं दिया है या उनके द्वारा दिये गये अभ्यावेदनों पर यदि कोई हो, विचार करने के पश्चात् यह समाधान हो गया है कि उनके पास उक्त असफलता के लिए कोई पर्याप्त कारण या न्यायौचित्य नहीं है ;
अतः अब , निर्वाचन आयोग उक्त अधिनियम की धारा 10 - क के अनुसरण में नीचे की सारणी के स्तम्भ ( 4 ) में विनिर्दिष्ट व्यक्तियों को संसद के किसी भी सदन के या किसी राज्य संघ राज्य की विधान सभा अथवा विधान परिषद् के सदस्य चुने जाने और सदस्य होने के लिए इस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निरर्हित घोषित करता है:-

आ. अ. 67.- यतः श्री करणी सिंह शेखावत , राजस्थान विधान सभा के लिए दिसम्बर , 2003 में हुए साधारण निर्वाचन में 20 - चुरू विधान सभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले एक अभ्यर्थी को विधि द्वारा अपेक्षित रीति से निर्वाचन व्ययों का लेखा न दाखिल किए जाने के कारण निर्वाचन आयोग द्वारा लोक प्रतिनिधित्व अधिनियम , 1951 की धारा 10क के अधीन 7 जून , 2005 के अपने आदेश सं. 76/राज. /2003 द्वारा तथा जिला निर्वाचन अधिकारी , चुरू की रिपोर्ट जिसमें उक्त अभ्यर्थी द्वारा अपेक्षित रीति से निर्वाचन व्ययों का लेखा प्रस्तुत न करने की सूचना के आधार पर इस आदेश की तारीख से तीन वर्ष की अवधि के लिए निरर्हित घोषित किया गया था ।
जिला निर्वाचन अधिकारी की अनुवर्ती पूरक रिपोर्ट दिनांक 12 जुलाई , 2006 के आधार पर मामले पर विचार करने के बाद , जिसमें सूचना दी गई थी कि अभ्यर्थी ने अब विधि द्वारा अपेक्षित रीति से अपने निर्वाचन व्ययों का लेखा दाखिल कर दिया है तथा इस मामले के सभी पहलुओं को ध्यान में रखते हुए आयोग ने इस पर सहानुभूतिपूर्वक विचार किया है तथा विनिश्चय किया है कि लोक प्रतिनिधिात्व अधिनियम 1951 की धारा ।। के द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए उक्त अधिनियम की धारा 10 के अधीन आयोग के दिनांक 7 जून , 2005 के आदेश के द्वारा श्री करणी सिंह शेखावत पर अधिरोपित अनर्हता , शेष अवधि के लिए हटा ली जाए ।

N. 67 .---Whereas Shri Karni Singh Shekhawat, a contesting candidate for the General Election to Rajasthan Legislative Assembly from 20 - Chru Assembly Constituency held in December, 2003 , was disqualified by the Election Commission of India for failure to file the account of election expenses in the manner required by law vide its order No. 76/ RJ/2003 dated 7th June , 2005 under Section 10 A of the Reprcsentation of People Act , 1951 , for three years from the date of the order on the basis of report of District Election Officer, Churu intimating non - submission of account of election expenses in manner by the said candidate.
After considering the case on the basis of District Election Officer's subsequent supplementary report dated 12th July , 2006 intimating that the candidate had now filed the accounts of election expenses in manner required by law and taking into account of all material facts of the case , the Commission has considered sympathetically and decided that in THE GAZETTE OF INDIA : JULY 22 , 2006/ ASADHA 31 , 1928

exercise of its powers conferred by Section 11 of the Representation of People Act , 1951 , the disqualification of Shri Karni Singh Shekhawat imposed upon him by the Commission's order dated 7th June , 2005 under section 10A of the said Act , be reinoved for the remaining period .

आ. अ. 68.-लोक प्रतिनिधित्व अधिनियम, 1950 ( 1950 का 43 ) की धारा 13-क की उप - धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए भारत निर्वाचन आयोग अण्डमान एवं निकोबार द्वीप समूह के प्रशासन के परामर्श से एतद्वारा श्री चेतन भूषण संघी , आई.ए.एस. के स्थान पर श्री प्रवीन कुमार गुप्ता , आई.ए.एस. (ए.जी.एम.यू.टी. - 1989 ) को उनके कार्यभार ग्रहण करने की तारीख से आगामी आदेशों तक के लिए अण्डमान एवं निकोबार द्वीप समूह के मुख्य निर्वाचन अधिकारी के रूप में नामित करता है ।
2. आयोग , अण्डमान एवं निकोबार द्वीप समूह में पूरे समय के लिए मुख्य निर्वाचन अधिकारी हेतु जोर नहीं दे रहा है और श्री गुप्ता को अपने नियमित अतिरिक्त कार्यभार रखने की अनुमति देता है ।

In exercise of the powers conferred by sub - section ( 1 ) of section 13A of the Representation of the People Act, 1950 (43 of 1950) , the Election Commission of India in consultation with the Administration of the Union Territory ofAndaman & Nicobar Islands hereby nominates Shri Praveen Kumar Gupta, IAS (AGMUT : 1989 ) as the Chief Electoral Officer for the Union Territory of Andaman & Nicobar Islands with effect from the date he takes over charge and until further orders vice Shri Chetan Bhushan Sanghi , IAS .
2. The Commission is not insisting on a full -time Chief Electoral Officer in the Union Territory of Andaman & Nicobar Islands and has allowed Shri Gupta to retain his regular additional charges .
