आ. अ. 92.-निर्वाचक रजिस्ट्रीकरण नियम , 1960 के नियम 23 के उप-नियम ( 1 ) के द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए तथा उपर्युक्त विषय पर विद्यमान अधिसूचना का अधिक्रमण करते हुए, भारत निर्वाचन आयोग , एतद्वारा , प्रभागीय आयुक्त , नागालैण्ड को ऐसे अधिकारी के रूप में पदाभिहित करता है जिनके समक्ष उक्त नियमों के नियम 20 या 21 या 21 क के अधीन नागालैण्ड राज्य में सभी विधान सभा निर्वाचन क्षेत्रों के निर्वाचक रजिस्ट्रीकरण अधिकारियों के निर्णयों पर अपील की जाएगी।

आ. अ. 93. लोक प्रतिनिधित्व अधिनियम, 1950 ( 1950 का 43 ) की धारा 13 - क की उप - धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , भारत निर्वाचन आयोग मध्य प्रदेश सरकार के परामर्श से एत‌द्वारा डॉ. विजय एस. पाटिदार, आई.ए.एस. के स्थान पर श्री जितेन्द्र शंकर माथुर , आई.ए.एस. ( एम पी 1982 ) को उनके कार्यभार ग्रहण करने की तारीख से आगामी आदेशों तक के लिए मध्य प्रदेश राज्य के मुख्य निर्वाचन अधिकारी के रूप में नामित करता है ।

2. श्री माथुर मध्य प्रदेश सरकार के अधीन सभी पदभार या किसी कार्य के पदभारों को तत्काल सौंप देंगे या धारण करना समाप्त कर देंगे, जो कि वे ऐसा पदभार ग्रहण करने से पहले धारण कर रहे थे ।

3. श्री माथुर , मुख्य निर्वाचन अधिकारी , मध्य प्रदेश के रूप में कार्य करते हुए, मध्य प्रदेश सरकार के अधीन किसी भी प्रकार का कोई अतिरिक्त कार्यभार ग्रहण नहीं करेंगे सिवाय इसके कि उनको राज्य सचिवालय में निर्वाचन विभाग के प्रभारी , सरकार का सचिव पदाभिहित किया जाएगा ।

In exercise of the powers conferred by sub - section ( 1 ) of Section 13A of the Representation of the People Act , 1950 (43 of 1950 ) , the Election Commission of India in consultation with the Government of Madhya Pradesh hereby nominates Shri Jitendra Shankar Mathur , IAS ( MP: 1982) as the Chief Electoral Officer for the State of Madhya Pradesh with effect from the date he takes over charge and until further orders vice Shri Dr. Vijay S. Patidar , IAS .

2. Shri Mathur shall cease to hold and hand over forthwith the charge of all or any charges of work under the Government of Madhya Pradesh , which he may be holding before such assumption of office .

3. Shri Mathur while functioning as the Chief Electoral Officer , Madhya Pradesh shall not hold any additional charge whatsoever under the Government of Madhya Pradesh except that he should be designated Secretary to the Government in charge of Election Department in the State Secretariat.

आ. अ. 94.-यतः, आयोग का समाधान हो गया है कि नीचे की सारणी के स्तम्भ ( 2 ) में विनिर्दिष्ट महाराष्ट्र विधान सभा , 2004 के साधारण निर्वाचन में जो स्तम्भ ( 3 ) में विनिर्दिष्ट निर्वाचन क्षेत्र से हुआ है, स्तम्भ ( 4 ) में विनिर्दिष्ट निर्वाचन लड़ने वाला प्रत्येक अभ्यर्थी उसके नाम के सामने स्तम्भ ( 5 ) में यथा दर्शित अपने निर्वाचन व्ययों का लेखा , लोक प्रतिनिधित्व अधिनियम, 1951 तथा तद्दीन बनाए गए नियमों के द्वारा यथा अपेक्षित रीति से दाखिल करने में असफल रहा है ;

और, यतः उक्त अभ्यर्थियों ने निर्वाचन आयोग द्वारा सम्यक् सूचना दिए जाने पर भी उक्त असफलता के लिए कोई कारण अथवा स्पष्टीकरण नहीं दिया है या उनके द्वारा दिए गए अभ्यावेदनों पर, यदि कोई हो , विचार करने के पश्चात् निर्वाचन आयोग का यह समाधान हो गया है कि उनके पास उक्त असफलता के लिए कोई पर्याप्त कारण या न्यायौचित्य नहीं है;

अतः , अब निर्वाचन आयोग उक्त अधिनियम की धारा 10 - क के अनुसरण में नीचे की सारणी के स्तम्भ ( 4 ) में विनिर्दिष्ट व्यक्तियों को संसद के किसी भी सदन के या किसी राज्य या संघ राज्य क्षेत्र की विधान सभा अथवा विधान परिषद् के सदस्य चुने जाने और होने के लिए इस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निरर्हित घोषित करता है :-

आ. अ. 97. जबकि निर्वाचन आयोग का समाधान हो गया है कि नीचे की सारणी के स्तम्भ ( 2 ) में यथा विनिर्दिष्ट अक्तूबर , 2004 में दिल्ली राष्ट्रीय राजधानी राज्य क्षेत्र से हुए विधान सभा के उप- निर्वाचन के लिए जो स्तम्भ ( 3 ) में तद्नुरूपी विनिर्दिष्ट निर्वाचन क्षेत्र से हुआ है, के स्तम्भ (4 ) में उसके सामने विनिर्दिष्ट निर्वाचन लड़ने वाला प्रत्येक अभ्यर्थी , लोक प्रतिनिधित्व अधिनियम , 1951 तथा तद्धीन बनाए गए नियमों द्वारा अपेक्षित उक्त सारणी के स्तम्भ ( 5 ) में यथा दर्शित अपने निर्वाचन व्ययों का लेखा दाखिल करने में असफल रहा है ;

और , जबकि, उक्त अभ्यर्थियों ने सम्यक् सूचना दिए जाने पर भी उक्त असफलता के लिए कोई कारण अथवा स्पष्टीकरण नहीं दिया है तथा निर्वाचन आयोग का यह समाधान हो गया है कि उनके पास उक्त असफलता के लिए कोई पर्याप्त कारण या न्यायौचित्य नहीं है;

अतः , अब निर्वाचन आयोग उक्त अधिनियम की धारा 10 - क के अनुसरण में नीचे की सारणी के स्तम्भ ( 4 ) में विनिर्दिष्ट व्यक्तियों को संसद के किसी भी सदन के या किसी राज्य/ संघ राज्य क्षेत्र की विधान सभा अथवा विधान परिषद् के सदस्य चुने जाने और होने के लिए इस आदेश की तारीख से तीन वर्ष की कालावधि के लिए एतद्वारा निरर्हित घोषित करता है : -

O.N. 97.- Whereas , the Election Commission is satisfied that the contesting candidates specified in column (4) ofthe table below at the Bye- Election to the Legislative Assembly held from National Capital Territory of Delhi in October , 2004 as specified in column (2) and held from constituencies correspondingly specified in column (3 ) against their names have failed to lodge account of their election expenses , as shown in column ( 5) of the table , as required by the Representation ofthe People Act , 1951 , and to Rules made there under .

And whereas , the said candidates have not furnished any reason or explanation for the said failure even after due notice of the Election Commission and the Election Commission is satisfied that they have no good reason or justification for the said failure;

Now, therefure , in pursuance of section 10A of the said Act , the Election Commission hereby declares the persons specified in column (4 ) of the table below to be disqualified for being chosen as, and for being, a member of either House of the Parliament or of the Legislative Assembly or Legislative Council of a State/Union Territory for a period of three years from the date of this order .
