सा.का.नि. 274.- भारतीय बॉयलर विनियमावली , 1950 में आगे संशोधन करने हेतु, जिसे भारतीय बॉयलर अधिनियम , 1923 ( 1923. का 5 ) की धारा 28 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए केन्द्रीय बॉयलर बोर्ड द्वारा किए जाने का प्रस्ताव है, कुछ विनियमों से संबंधित निम्नलिखित मसौदा एतद्वारा उन सभी व्यक्तियों के सूचनार्थ प्रकाशित किया जाता है , जिनकी इससे प्रभावित होने की संभावना है जैसा कि उक्त अधिनियम की धारा 31 की उप- धारा ( 1 ) के तहत अपेक्षित है और एतद्वारा नोटिस दिया जाता है कि उक्त मसौदे पर उस तारीख से पैंतालीस दिन बीत जाने के बाद विचार किया जाएगा , जिस तारीख को इस अधिसूचना के प्रकाशन वाला राजपत्र जनता को उपलब्ध कराया जाएगा । 2. उक्त मसौदे से संबंधित समस्त आपत्तियों अथवा सुझावों पर जो विनिर्दिष्ट की गई अवधि के भीतर किसी भी वयक्ति से प्राप्त होंगे केंद्रीय बॉयलर बोर्ड विचार करेगा ।

3.. आपत्तियां और सुझाव , यदि कोई हों, सचिव , केंद्रीय बॉयलर बोर्ड, वाणिज्य और उद्योग मंत्रालय ( औद्योगिक नीति और संवर्धन विभाग ) , उद्योग भवन , नई दिल्ली -110011 को भेजे जाएं ।

मसौदा विनियम

1. ( 1 ) इन विनिमयों को भारतीय बॉयलर ( तृतीय संशोधन ) विनियम , 2006 कहा जाए ।

(2 ) ये शासकीय राजपत्र में उनके अंतिम रूप से प्रकाशन के पश्चात् लागू हो जाएंगे ।

2. भारतीय बॉयलर विनियमावली, 1950 में ( जिन्हें इसमें इसके पश्चात् उक्त विनियम कहा गया है ) , के विनियम 4 , खंड (ग) के उपखंड ( iii ) में निम्नलिखित सम्मिलित किया जाएगा, नामत :

" नोट : दाब भागों 200MW और अधिक बॉयलर क्षमता की असेंबली ड्राइंग के लिए , ड्रम हेतु 1:50 तथा सामान्य असेंबली ड्राइंग हेतु 1: 100 पैमाने का प्रयोग किया जाएगा । "

3. उक्त विनियमों के विनियम 39 के लिए निम्नलिखित विनियम प्रतिस्थाति किया जाएगा, नामतः

" 39. फ्लैटनिंग टेस्ट

( 1 ) नीचे दिए गए सूत्र से गणना करके , बिना दरार या कमी के लक्षण दिखाये ट्यूब के एक, खंड को जो 63 मि. मी. से छोटा न हो , दो समानांतर चपटी सतहों के बीच गणना की गई दूरी पर प्लोटों के बीच चपटा किया जाएगा ।

e = स्थिरांक, नीचे दिए गए भांति

e = 0.07 कार्बन स्टील के लिए जिसमें अधिकतम विनिर्दिष्ट कार्बन 0.18 % से ऊपर हो

e = 0.09 कार्बन स्टील के लिए जिसमें अधिकतम विनिर्दिष्ट कार्बन 0.18 % या कम हो

( 2 ) ( क) प्रथम चरण के दौरान , जो कि तन्यता का परीक्षण है नीचे 39 ( 5 ) में दिये गये के अलावा , जोड़ रहित ट्यूब के अंदर , बाहर या सिरों की सतह परं या वेल्ड की गई ट्यूबों की भीतरी या बाहरी कोई भी दरारःया टूटन नहीं होनी चाहिए ।

( ख ) द्वितीय चरण के दौरान , जो अकाट्यता का परीक्षण है , तब तक चपटा करने का काम किया जाएगा जब तक नमूना टूट नहीं जाता या ट्यूब की विपरीत दीवारें मिल नहीं जातीं । संपूर्ण फ्लैटनिंग टेस्ट के दौरान लैमिनेटिड या अकाट्यता रहित पदार्थ , का प्रमाण या अपूर्ण वेल्ड का पता चलना अस्वीकार किए जाने का कारण बनेगा । :

( 3 ) चपटा करने से पहले परीक्षण नमूने में सतह की अपूर्णताएं, लेकिन प्लैटनिंग टेस्ट के प्रथम चरण में पता चलने पर तैयार अपेक्षाओं के अनुसार आंकी जाएंगी ।

(4) सतह अपूर्णताओं के कृत्रिम फटन अस्वकार करने का कारण नहीं होंगे ।

( 5 ) जब कम अनुपात D- टू- t अनुपात ट्यूबलर उत्पादों का परीक्षण हो , तो क्योंकि छः और बारह बजने के स्थानों पर आंतरिक सतह पर ज्यामिति के कारण डाला गया तनाव अत्यधिक होता है , अतः यदि D-टू- अनुपात 10 से कम हो पदार्थ का कार्बन तत्व 0.25 % से अधिक हो, तो इन स्थानों पर दरारें अस्वीकार करने का कारण नहीं बनेंगीं । "

4. उक्त विनिमयों के विनियम 260 हेतु, निम्नलिखित प्रतिस्थापित किया जाएगा , नामतः

" 260. तन्यता परीक्षण

( क) पदार्थ के विभिन्न ग्रेडों के लिए तन्यता शक्ति विनियम 9 के खंड ( घ ) में विनिर्दिष्ट सीमाओं के भीतर होगी । ( ख ) कमरे के तापमान पर, अपर यील्डं प्वाइंट, कमरे के तापमान पर विनिर्दिष्ट न्यूनतम तन्यता शक्ति के 50 % से कम नहीं होगा । (ग ) , टूट दीर्धीकरण प्रतिशत में (N-Rm )/c से कम नहीं होगा ।

N = 50 मिमी से अधिक प्लेट मोटाई के लिए 95 अथवा 50 मिमी तक की प्लेट मोटाई के लिए 100 का गुणवत्ता सूचकांक

C = 2.2 केवल गेज लंबाइयों L = 5d, या L = 5.65/ VA, के लिए

[ भाग II- खण्ड 3 (i ) ]

(घ) उन्नत तापमान ( Et ) पर 0.2 % की प्रूफ सीमा पर दबाव की न्यूनतम मूल्य को नीचे दी गई तालिका में दिये अनुसार कमरे के तापमान ( R₂० ) न्यूनतम विनिर्दिष्ट तनाव स्ट्रेंथ को अनुपात के मूल्य ( Et/R₂ ) द्वारा गुणा करके गणना किया जा सकता है : -

*स्वीकृति प्रयोजनार्थ अपेक्षित कोई भी परीक्षण 300 ° C से कम के तापमान के लिए 300° C पर किया जायेगा ( इन तापमानों पर पहले के परीक्षणों के रिकाड़ों की अनुपस्थिति में ) जिसमें प्रूफ दबाव का मामला कमरे के तापमान पर विनिर्दिष्ट न्यूनतम तनाव स्ट्रेंथ से गणना द्वारा प्राप्त मूल्य से कम तथा 300° C के लिए 0.36 प्रूफ अनुपात से ज्यादा नहीं होगा ।

5. उक्त विनियमों के विनियम 376 में खण्ड ( ff) के लिए निम्नलिखित खण्ड को प्रतिस्थापित किया जाएगा , नामतः " ( ff ) विशेष रूप से विद्युत ऊर्जा सृजन के लिए प्रयोग किये गये बॉयलरों हेतु निरीक्षण परिशिष्ट JA के उपबंघों के अनुसार किया जाएगा ।"

6. उक्त विनियमों के विनियम 520 में, निम्नलिखित को सम्मिलित किया जाएगा, नामतः

"नोट-100 कि.ग्रा. से. मी तथा इससे अधिक के कार्यशील दाब पर संचालित बॉयलरों के लिए इकोनोमाइजर बिना फीड वाटर सिस्टम के लिए फीड वाटर डिस्चार्ज पाइपिंग इंलेट आइसोलेटिंग वाल्व को मैकेनिकल रिलीफ डिवाइस के उपबंध के साथ बॉयलर डिजाइन प्रेसर के आधार पर डिजाइन किया जा सकता है ताकि पाइपिंग सिस्टम को संप्रेषित किया जा रहा बॉयलर फीड पंप ( बीएफपी ) शट ऑफ प्रेसर को रोका जा सके और ऐसा फीड वाटर सिस्टम के साथ बॉयलर का फीड वाटर लाइन में पिछले आहसोलेशन वाल्व हाइड्रो परीक्षण किया जाएगा । "

7. उक्त विनियमों के परिशिष्ट JA हेतु निम्नलिखित परिशिष्ट प्रतिस्थापित किया जाएगा, नामतः

"परिशिष्ट JA"

क. 50 कि.ग्रा. /से.मी अथवा इससे अधिक दबाव पर कार्य करने वाले और 20 वर्ष तक पुराने विद्युत उपयोगिता बॉयलर (1) 50 कि.ग्रा. /से.मी अथवा इससे अधिक दबाव पर कार्य करने वाले और 20 वर्ष तक पुराने बॉयलर, जो विद्युत सृजन हेतु भाप बना रहे हैं, का निरीक्षण विनियम 390 में दी गयी प्रक्रिया के अनुसार किये गये निरीक्षण की तारीख से 12 महीने की अवधि समाप्त होने के बाद नीचे दिये गये विवरण के अनुसार किया जाएगा और राज्य में संबंधित बॉयलरों के निरीक्षक द्वारा निम्नलिखित रिकार्ड, जो कि संबंधित निरीक्षक को क्रियाशील प्रमाणपत्र की अवधि के समाप्त होने के कम से कम 30 दिन पूर्व उपलब्ध कराया जायेगा, के निरीक्षण के जरिये फिटनेस प्रमाणपत्र जारी किया जाएगा बशर्ते यह सन्तुष्ट हो कि बॉयलर को 12 महीने की अवधि के लिए और आगे चलाने की अनुमति दी जा सकती है ।

(क) सुपर हीटर तथा रीहीटर के लिए आपरेशन आंकड़े डाटा अधिग्रहण प्रणाली (डीएएस ) के उत्पादन से अप्रासंगिक होते हैं । (ख) पिछले वर्ष के दौरान बन्द किये जानें के कारणों सहित बन्द किये जाने तथा की गई कार्रवाई का इतिहास । (ग ) वर्ष के दौरान बॉयलर प्रेसर पुर्जा पर किये गये किसी गैर- विधवंसकारी परीक्षण का रिकार्ड ।

( घ ) बॉयलर की जल की गुंणवत्ता ऐसे -बॉयलरों की जरूरत के अनुसार रखी जानी चाहिए और ऑन लाइन गुणवत्ता के आंकड़े प्रस्तुत किये जाने चाहिएं ।

(ङ ) बॉयलर ट्यूब के असफल होने का रिकार्ड ( स्थापना स्थल , मरम्मत की गई/बदली गई ट्यूबों की संख्या ) । ( 2) विनियम 390 में यथा दिये गये 24 महीनों की समाप्ति के पश्चात् निरीक्षण बॉयलरों के संबंधित निरीक्षक द्वारा किया जायेगा । फिर भी, यदि प्रमाणपत्र की अवधि के समाप्त होने से पूर्व तथा प्रमाणन के 6 माह बाद यदि किसी समय 15 दिन अथवा उससे अधिक के लिए बन्दकिये जाने की योजना बनती है तो बॉयलरों के निरीक्षक को विधिवत् सूचित किया जायेगा ताकि उक्त बन्द होने की अवधि के दौरान पूर्ण निरीक्षण किये जाने की योजना बनायी जा सके ।

ख. 50 कि.ग्रा. /से.मी के दबाव ( प्रेसर ) तथा 20 वर्ष तक कार्य करने वाले बॉयलर

(1). विद्युत जनित्रण हेतु भाप सृजन वाले 50 कि.ग्रा. /से.मी के दबाव पर कार्य करने वाले तथा 20 वर्ष तक पुराने बॉयलर विनियम 390 में दी गई प्रक्रिया के अनुसार किये गये निरीक्षण की तारीख 12 माह की समाप्ति पर कार्यशील दबाव के समतुल्य दबाव पर हाइड्रोलिक परीक्षण के अध्यधीन होंगे और राज्य में संबंधित बॉयलरों के निरीक्षक द्वारा फिटनेस प्रमाणपत्र जारी किया जायेगा और पैराग्राफ क पर आरेशन रिकार्ड से सन्तुष्ट हो जाने पर वह 12 महीने की दूसरी अवधि के लिए चलाये जाने की अनुमति देगा । 1616

[PART II- SEC. 3 (i) ] (2) विनियम 390 में यथा दिये गये 24 महीनों की समाप्ति के पश्चात् निरीक्षण बॉयलरों के संबंधित निरीक्षक द्वारा किया जायेगा । फिर भी, यदि प्रमाणपत्र की अवधि के समाप्त होने से पूर्व तथा प्रमाणन के 6 माह बाद यदि किसी समय 15 दिन अथवा उससे अधिक के लिए बन्द किये जाने की योजना बनती है तो बॉयलरों के निरीक्षक को विधिवत् सूचित किया जायेगा ताकि उक्त बन्द होने की अवधि के दौरान पूर्ण निरीक्षण किये जाने की योजना बनायी जा सके । ग. 50 कि.ग्रा./से.मी अथवा उससे अधिक दबाव पर काम करने वाले , एवं 20 वर्ष से अधिक पुराने बॉयलर

(1) विद्युत उत्पादन के लिए भाप का सृजन करने वाले वे बॉयलर जो 50 कि. ग्रा./से . मी. अथवा उससे अधिक दबाव पर कार्य कर रहे हों तथा 20 वर्ष से अधिक पुराने हों, विनिमय 390 में किए गए प्रावधान के अनुसार निरीक्षण की तारीख से बारह माह की अवधि समाप्त होजाने पर कार्य करने वाले दबाव से 1.25 गुना अधिक दबाव पर हाईड्रोलिक परीक्षण से गुजरने और राज्य के संबंधित बॉयलर निरीक्षक सेफिटनेस प्रमाणीकरण प्राप्त करने की शर्त के अधीन होंगे , और पैरा संख्या क में दी गई स्थितियों और अपेक्षाओं को पूरा करने पर उन्हें आगे और बारह माह की अवधि के लिए काम करने की अनुमति दी जाएगी ।

(2) विनिमय 390 में यथा दिये गये 24 महीनों की समाप्ति के पश्चात् निरीक्षण बॉयलरों के संबंधित निरीक्षक द्वारा किया जायेगा । फिर भी , यदि प्रमाणपत्र की अवधि के समाप्त होने से पूर्व तथा प्रमाणन के 6 माह बाद यदि किसी समय 15 दिन अथवा उससे अधिक के लिए बन्दकिये जाने की योजना बनती है तो बॉयलरों के निरीक्षक को विधिवत् सूचित किया जायेगा ताकि उक्त बन्द होने की अवधि के दौरान पूर्ण निरीक्षण किये जाने की योजना बनायी जा सके । ' घ. 50 कि.ग्रा. /से.मी तक के दबाव पर काम करने वाले और 20 वर्ष से अधिक पुराने बॉयलर

50 कि.ग्रा./से.मी तक के दबाव पर काम करने वाले और 20 वर्ष से अधिक. पुराने बॉयलरों का विनियम 390 में किए गए प्रावधान के अनुसार प्रति वर्ष निरीक्षण के अधीन होना जारी रहेगा ।

(CENTRAL BOILERS BOARD)

New Delhi, the 30th October, 2006

G. S. R. 274. The following draft of certain regulations further to amend the Indian Boiler Regulations, 1950, which the Central Boilers Board proposes to make in exercise of the powers conferred by Section 28 of the Indian Boilers Act, 1923 (5 of 1923 ) , is hereby published, as required by sub - Section ( 1) of Section 31 of the said Act, for the information ofall persons likely to be affected thereby and notice is hereby given that the said draft will be taken into consideration after the expiry of a period of forty - five days from the date the Gazette containing the publication of this notification is made available to the public ;

2. Any objections or suggestions which may be received from any person with respect to the said draft within the period so specified will be considered by the Central Boilers Board;

3. Objections or suggestions , if any, may be forwarded to the Secretary, Central Boilers Board, Ministry of Commerce and Industry (Department of Industrial Policy and Promotion) , Room No. 238 , Udyog Bhavan, New Delhi - 110011 .

DRAFT REGULATIONS

1. (1) These regulations may be called the Indian Boiler (Third Amendment) Regulations , 2006 .

(2) They shall come into force after final publication in the Official Gazette.

2. In the Indian Boiler Regulations, 1950 ( hereinafter referred to as the said regulations ) , in regulation 4, in sub- clause (iii ) of clause (c), the following shall be inserted, namely:--

"Note: For pressure parts , assembly drawings of boiler capacity 200 MW and above , the scale to be used is 1:50 for drum and 1: 100 for General Assembly drawing. ".

3. For regulation 39 of the said regulations , the following regulation shall be substituted, namely:-

"39. FLATTENING TEST.-

(1) A section of the tubes not less than 63 mm in length shall be flattened cold between two parallel flat surfaces to a distance between the plates (H) as calculated by the formula given below, without showing any sign of acrack or flaw. H=

(2)(a) During, the first step , which is a test for ductility, no crack or break, except as provided for in 39 (5 ) below, shali occur on the inside , outside , or end surfaces in seamless tubes , or on the inside or outside surfaces of welded tubes .

(b) During the second step which is a test for soundness , the flattening shall be continued until the specimen breaks or the opposite walls of the tube meet. Evidence of laminated or unsound material , or of incomplete weld that is revealed during the entire flattening test shall be cause for rejection.

(3) Surface imperfections in the test specimen before flattening, but revealed during the first step of the flattening test , shall be judged in accordance with the finished requirements .

(4) Superficial ruptures resulting froni surface imperfection shall not be cause for rejection.

(5) When low D - to- t ratio tubular products are tested , because the strain imposed due to geometry is unreason- ably high on the inside surface at the six and twelve o ' clock location, cracks at these locations shall not be cause for rejection if the D tot ratio is less than 10 and the carbon content of the material is more than 0.25 %. " .

4. For regulation 260 of the said regulations , the following regulation shall be substituted, namely:---

"260. Tensile tests

(a) The tensile strength of different grades of material shall be within the limits specified in clause (d) ofregula- tion 9 .

(b) The upper yield point at room temperature shall be not less than 50 % of the specified minimum tensile strength at room temperature .

*Fortemperatures lower than 300 °C any test required for acceptance purposes ( in the absence of records of previous tests at these temperatures) shall be made at 300° C, in which case the proof stress shall be not less than value obtainedby calculation from the specified minimum tensile strength at room temperature and the above proof- ratio of0.36 for300 °C.".

5. In regulation 376 of the said regulations , for clause ( ff) , the following clause shall be substituted, namely:-

"(ff) For boilers used exclusively for electric power generation, the inspection shall be carried out in accordance with the provisions of Appendix JA. " .

6. In regulation 520 of the said regulations , the following shall be inserted , namely:--

"Note- For boilers operating at working pressure 100 kg./sq.cm. and above, feed water discharge piping for feed water system without economizer inlet isolating value can be designated based on boiler design pressure with provision of mechanical relief device, to prevent Boiler Feed Pump (BFP) shut off pressure being communicated to the piping system and with such a feed water system, boiler shall be hydro tested upto the last isolation valve in the feed water line . " .

7. ForAppendix JA to the said regulations, the following appendix shall be substituted , namely:-

"APPENDIX JA

[See regulation 376( ff) ]

A. Power Utility Boilers working at a pressure 50 kg/cm² or more and upto 20 years of age

(1) The boilers working at a pressure 50 kg/cm² or more and upto 20 years of age , generating steam for power generation shall be inspected as detailed below after the expiry of twelve months from the date of inspection carried out in accordance with the procedure provided in regulation 390 and certification of fitness shall be issued by the concerned Inspector of Boilers in the State, through inspection of the following records which shall be made available to the concerned Inspector of Boilers at least thirty days before the expiry of the operating certificate, provided he is satisfied that the boiler can be allowed to be operated for a further period of twelve months .

(a) Operation data for superheater and reheater temperature excursions from the output of Data Acquisition System (DAS) .

(b) History of Shut downs during the previous year with their causes and actions taken.

(d) Water quality to the boiler is maintained up to the requirement of such boilers and on line data of the qualitybe provided.

(e) Boiler tube failure record (location, number of tubes repaired/ replaced) .

1619 (2) Inspection shall be carried out by the concerned Inspector of Boilers at the expiry of twenty-four months as provided in regulation 390. However, in case shutdown of fifteen days or more is planned any time before expiryofthe certification period and after six months of the certification , the Inspector of Boilers shall be duly informed so that complete inspection can be scheduled during the said shut down period.

B. Boiler working at a pressure up to 50 kg/ cm² and up 20 years of age.

(1) The boiler working at a pressure upto 50 kg/ cm² and up to 20 years of age generating steam for power generation shall be subjected to Hydraulic Test at pressure equivalent to the working pressure at the expiry of twelve months from the date of inspection carried out in accordance with the procedure provided in regulation 390 and certification of fitness by the concerned Inspector of Boilers in the State , and having satisfied with the operation records as at paragraph A, shall be allowed for running for another period of twelve months .

(2) Inspection shall be carried out by concerned Inspector of Boilers at the expiry of twenty -four months as provided in regulation 390. However, if shutdown of fifteen days or more is planned any time before expiry ofthe certifcation period and after six months of the certification, Inspector of Boilers shall be duly informed so that inspection can be scheduled during the said shut down period..

C. Boilers working at a pressure 50 kg/ cm² or more , and more than 20 years of age.

(1) Boiler working at a pressure 50 kg/cm² or more and more than 20 years of age , generating steam for power generation, shall be subjected to Hydraulic test at a pressure 1.25 times the working pressure at the expiry of twleve months from the date ofinspection as provided in regulation 390 and certification of fintness by the concerned Inspector of Boilers in the State, and having satisfied the conditions and requirements as at paragraph A, shall be allowed running for another period of twelve months.

(2) Inspection shall be carried out by the concerned Inspector ofBoilers at the expiry of twenty -four months as provided in regulation 390. However, if shut down offifteen days or more is planned any time before expiry of the certification period and after six months of the certification, Inspector of Boilers shall be duly informed so that inspection can be scheduled during the the said shut down period.

D. Boiler working at a pressure upto 50 kg/ cm² and more than 20 years of age:

Boiler working at a pressure up to 50 kg/cm² and more than 20 years ofage shall continue to be subjected to inspection every year as provided in regulation 390 ..

सा.का. नि. 276. राष्ट्रपति संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और समन्वेषी मात्स्यिकी परियोजना तथा उसके आस्थान ( समूह " ग " और समूह " घं " पद ) भर्ती नियम , 1977 को, जहां तक उनका संबंध तकनीकी सहायक के पद से है, उन बातों के सिवाय अधिक्रांत करते हुए जिन्हें ऐसे अधिक्रमण से पूर्व किया गया है या करने का लोफकिया गया है , कृषि मंत्रालय , पशुपालन , डेयरी और मत्स्यपालन विभाग के अधीन भारतीय मात्स्यिकी सर्वेक्षण , मुंबई में वैज्ञानिक सहायक के पद पर भर्ती की पद्धति का विनियमित करने के लिए निम्नलिखित नियम बनाते हैं , अर्थात्

1. संक्षिप्त नाम और प्रारंभ. ( 1 ) इन नियमों का संक्षिप्त नाम भारतीय मात्स्यिकी सर्वेक्षण ( वैज्ञानिक सहायक ) भर्ती नियम , 2006है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद -संख्या , वर्गीकरण और वेतनमान, उक्त पद की संख्या , उसका वर्गीकरण और उसका वेतनमान वह होगा , जो इन नियमों से उपाबद्ध अनुसूची के स्तम्भ ( 2 ) से स्तम्भ ( 4 ) में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति , आयु सीमा , और अर्हताएं , इत्यादि. उक्त पद पर भर्ती की पद्धति, आयु-सीमा , अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो 'उक्त अनुसूची के स्तम्भ ( 5 ) से स्तभ ( 14 ) में विनिर्दिष्ट हैं ।

In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession ofthe Exploratory Fisheries Project and its base (Group C and D posts) Recruitment Rules, 1977, in so far as they relate to the post of Technical Assistant, expect as respects things done or omitted to be done before such supersession , the President hereby makes the following rules regulating the method of recruitment to the post of Scientific Assistant in Fishery Survey of India, Mumbai under the Ministry of Agriculture (Department of Animal Husbandry, Dairying and Fisheries) , namely :--

1. Short title and commencement ( 1 ) These rules may be called the Fishery Survey of India (Scientific Assistant ) Recruitment Rules , 2006:

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Number of post , its classification and scale of pay. The number of the said post, its classification and the scale of pay attached thereto shall be as specified in columns 2 to 4 of the Schedule annexed to these rules .

3. Method of recruitment , age-limit, and qualifications , etc. The method of recruitment, age -limit, qualifications and other matters relating to the said post shall be as specified in columns 5 to 14 of the said Schedule.

4. Disqualifications . No person,-

(a) who has entered into or contracted a marriage with a person having a spouse living, or

(b) who, having a spouse living , has entered into or contracted a marriage with any other person, shallbe eligible for appointment to the said post :

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operation of this rule.

5. Power to relax. ---Where the Central Government is of the opinion that it is necessary or expedient so to do itmay,by order and for reasons to be recorded in writing relax any of the provisions of these rules with respect to any class or category of persons .

6. Saving.--Nothing in these rules shall affect reservation, relaxation of age limit and other concessions required tobe provided for the Scheduled Castes , the Scheduled Tribes , Ex- servicemen, the Other Backward Classes and other special categories of persons in accordance with the orders issued by the Central Government from time to time im this regard.

3. भर्ती की पद्धति , आयु-सीमा और अन्य अर्हताएं आदि. - उक्त पद पर भर्ती की पद्धति , आयु सीमा , अर्हताएं और उससे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तम्भ ( 5 ) से स्तम्भ ( 14 ) में विनिर्दिष्ट हैं ।

4. निरर्हता.- वह व्यक्ति,

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है, विवाह किया है, या

(ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी अन्य व्यक्ति से विवाह किया है ,

उक्त पद पर नियुक्ति का पात्र नहीं होगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी। 5. शिथिल करने की शक्ति. जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जोकारण हैं उन्हें लेखबंद्ध करके, तथा संघ लोक सेवा आयोग से परामर्श करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत आदेश द्वारा शिथिलः कर सकेगी

6. व्यावृत्ति: -इन नियमों की कोई बात ऐसे आरक्षणों, आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनकां केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों , अनुसूचित जनजातियों, भूतपूर्व सैनिकों, अन्यपिछड़े वर्गों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

टिप्पण : जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में जिन्होंने अपनी अर्हक/ पात्रता सेवा पूरी कर ली है , प्रोन्नति के लिए विचार किया जा रहा हो वहां उनके ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा परंतु यह तब जब कि उसके द्वारा की गई ऐसी अर्हक/पात्रता सेवा, अपेक्षित अर्हक/पात्रता सेवा के आधे से अधिक से या दो वर्ष से इनमें से जो भी कम हो , कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित जिन्होंने ऐसी अर्हक/पात्रता सेवा पहले ही पूरी कर ली है , अगली उच्चतर श्रेणी में

प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली हो प्रतिनियुक्ति ( जिसके अंतर्गत अल्पकालिक संविदा भी है ) :

केन्द्रीय सरकार/राज्य सरकारों/ संघ राज्य क्षेत्रों ( जिनके अंतर्गत उनके सहयोजित मात्स्यिकी संगठन भी है ) / भारतीय वैज्ञानिक औद्योगिक अनुसंधान परिषद आदि के अधीन ऐसे अधिकारी (क) ( 1 ) जो नियमित आधार पर सदृश पद धारण किए हुए हैं, या

(2 ) जिन्होंने 5000-8000 रु. के वेतनमान में उस श्रेणी में तीन वर्ष की नियमित सेवा कीहै या समुल्य, और

निम्नलिखित शैक्षिक अर्हताएं रखता हो;

(ख) किसी मान्यता प्राप्त विश्वविद्यालय से समुद्री जीव विज्ञान या प्राणी विज्ञान या समुद्र विज्ञान या मात्स्यिकी विज्ञान में मास्टर डिग्री या समतुल्य केन्द्रीय मात्स्यिकी शिक्षा संस्थान मुंबई से मात्स्यिकी विज्ञान में स्नातकोत्तर डिप्लोमा या समतुल्य ।

टिप्पण: पोषक प्रवर्ग के ऐसे विभागीय अधिकारी , जो प्रोन्नति की सीधी पंक्ति में हैं , प्रतिनियुक्ति पर नियुक्त के लिए विचार किए जाने के पात्र नहीं होंगे । इसी प्रकार प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे । प्रतिनियुक्ति/संविदा की अवधि, जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवधिहै , साधारणतया तीन वर्ष से अधिक नहीं होगी । प्रतिनियुक्ति पर नियुक्ति (जिसके अंतर्गत अल्पकालिक संविदा भी है ) के लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहीं होंगी । तो उसकी संरचना

G.S.R. 277. In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession of the Fishery Survey of India ( Senior Scientific Assistant) Recruitment Rules , 1987 , except as respects things done or omitted to be done before such supersession , the President hereby makes the following rules regulating the method of recruitment to the post of Senior Scientific Assistant in the Fishery Survey of India, Mumbai under the Ministry ofAgriculture (Department of Animal Husbandry, Dairying and Fisheries ) , namely: 1. Short title and commencement .-(1 ) These rules may be called the Fishery Survey of India ( Senior Scientific Assistant) Recruitment Rules , 2006 .

(2) They shall come into force on the date of their publication in the Official Gazette .

2. Number of post , classification and scale of pay.- The number of the said post, its classification and the scale ofpay attached thereto shall be as specified in columns 2 to 4 of the Schedule annexed to these rules.

3.Method of recruitment , age limit and qualifications etc. The method of recruitment, age limit, qualifica- tions and other inatters relating to the said post shall be as specified in columns 5 to 14 of the said Schedule .

4. Disqualification.-No person,

(a) who has entered into or contracted a marriage with a person having a spouse living ; - or

(b) who, having a spouse living , has entered into or contracted a marriage with any person, shall be eligible for appointment to the said post:

Power to relax. - Where the Central Government is of the opinion that it is necessary or expedient so to do , it may, by order, for reasons to be recorded in writing and in consultation with the Union Public Service Commission, relax anyof the provisions of these rules with respect to any class or category of persons .

6. Saving . -Nothing in these rules shall affect reservations , relaxation of age - limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes , Ex - servicemen, Other Backward Classes and other special categories of persons in accordance with the orders issued by the Central Government from time to time in thisregard.

1. ( 1) इन नियमों का संक्षिप्त नाम पृथ्वी विज्ञान मंत्रालय ( भारत मौसम विज्ञान विभाग ) यांत्रिक काडर ( समूह ' ग ' पद ) भर्ती नियम, 2006 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. विज्ञान और प्रौद्योगिकी मंत्रालय ( भारत मौसम विज्ञान विभाग ) यांत्रिक काडर ( समूह ' ग ' पद ) भर्ती नियम , 1999 की अनुसूची में, ---

( 1 ) यांत्रिक सहायक ( औद्योगिक एककों के लिए यांत्रिक कर्मचारिवृन्द ) के पद से संबंधित क्रम सं. 1 के सामने, ( i ) स्तंभ 9 की प्रविष्टि के स्थान पर, निम्नलिखित प्रविष्टि रखी जाएगी, अर्थात्:- " नहीं"

(ii) स्तंभ 11 की प्रविष्टि के स्थान पर , निम्नलिखित प्रविष्टि रखी जाएगी , अर्थात्:- ** शत- प्रतिशत प्रोन्नति द्वारा , जिसके न हो सकने पर सीधी भर्ती द्वारा "

(iii) स्तंभ 12 की प्रविष्टि के स्थान पर , निम्नलिखित प्रविष्टि रखी जाएगी , अर्थात्:

(2 ) यांत्रिक सहायक ( औद्योगिक एककों के लिए बढ़ईगिरी ) के पद से संबंधित क्रम सं. 2 के सामने ,

(i) स्तंभ 9 की प्रविष्टि के स्थान पर , निम्नलिखित प्रविष्टि रखी जाएगी, अंर्थात्:- " नहीं"

( ii ) स्तंभ 11 की प्रविष्टि के स्थान पर , निम्नलिखित प्रविष्टि रखी जाएगी, अर्थात्:--- " शत- प्रतिशत प्रोन्नति द्वारा , जिसके न हो सकने पर सीधी भर्ती द्वारा."

(iii) स्तंभ 12 की प्रविष्टि के स्थान पर , निम्नलिखित प्रविष्टि रखी जाएगी , अर्थात्

टिप्पण : प्रोन्नति के प्रयोजन के लिए फीडर काडरों में अनुपात , संबंधित फीडर काडर में स्वीकृत पदों की संख्या के अनुसार होगा । यह अनुपात अधिसूचना की तारीख से आरंभ होने वाले प्रत्येक पांच वर्ष के लिए निम्नवत् नियत किया जाएगा ।

(5 ) मैकेनिक श्रेणी- I ( औद्योगिक ) ( जिसके अन्तर्गत मुख्य मैकेनिक के रूप में पदामिहित मैकेनिक श्रेणी 1 है ) के पद से संबंधित क्रम सं. 7 के सामने ,

(i ) स्तंभ 9 की प्रविष्टि के स्थान पर , निम्नलिखित प्रविष्टि रखी जाएगी , अर्थात्: - "नहीं"

(ii ) स्तंभ 11 की प्रविष्टि के स्थान पर, निम्नलिखित प्रविष्टि रखी जाएगी , अर्थात्: - "शत- प्रतिशत प्रोन्नति द्वारा , जिसके न हो सकने पर सीधी भर्ती द्वारा "

(iii ) स्तंभ 12 की प्रविष्टि के स्थान पर, निम्नलिखित प्रविष्टि रखी जाएगी , अर्थात्: -

"प्रोन्नति : ऐसे मैकेनिक श्रेणी- II ( औद्योगिक ) जिन्होंनेअपनी-अपनी श्रेणी में नियमित आधार पर , नियुक्ति के पश्चात् आठ वर्ष की सेवा की है"

(6 ) मैकेनिक श्रेणी- II ( औद्योगिक ) पद से संबंधित क्रम के सामने ,

(i ) स्तंभ 5 की प्रविष्टि के स्थान पर , निम्नलिखित प्रविष्टि रखी जाएगी, अर्थात्:- " लागू नहीं होता "

(ii) स्तंभ 8 की प्रविष्टि के स्थान पर, निम्नलिखित प्रविष्टि रखी जाएगी , अर्थात्:-

1. मैट्रिक या समतुल्य उर्तीण या 10 + 2 पद्धति के अधीन दसवीं उत्तीर्ण ।

2. ( क ) किसी मान्यता प्राप्त औद्योगिक प्रशिक्षण संस्थान से किसी इंजीनियरी व्यवसाय में शिल्पकारी में दो वर्ष का प्रमाण - पत्र पाठ्यक्रम होना चाहिए ।

( ख ) मोल्डर , वैल्डर या चादर धातुकर्मकार जैसे व्यवसायों की दशा में, शिल्पकारी में एक वर्ष का प्रमाण- पत्र : पाठ्यक्रम और किसी मान्यता प्राप्त कर्मशाला से तीन वर्ष का व्यावहारिक अनुभव ।

(iii) स्तंभ 9 की प्रविष्टि के स्थान पर , निम्नलिखित प्रविष्टि रखी जाएगी, अर्थात्:- " नहीं"

( iv) स्तंभ 11 की प्रविष्टि के स्थान पर , निम्नलिखित प्रविष्टि रखी जाएगी , अर्थात्: -

(क) 20 प्रतिशतः प्रोन्नति मेट ( औद्योगिक ) द्वारा ।

(ख) 80 प्रतिशत सीधी भर्ती द्वारा ।

(v) स्तंभ 12 की प्रविष्टि के स्थान पर , निम्नलिखित प्रविष्टि रखी जाएगी , अर्थात्: -

G.S.R. 278.- In exercise of the powers conferred by the proviso to article 309 of the Constitution, the President hereby makes the following rules further to amend the erstwhile Ministry of Science and Technology (IndiaMeteorological Department ) Mechanical Cadres (Group ' C ' posts ) Recruitment Rules , 1999 , namely :-- 1. ( i) These rules may be called the Ministry of Earth Sciences (India Meteorological Department) Mechanical Cadres ( Group ' C' posts ) Recruitment (Amendment ) Rules , 2006 .

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Schedule to the Ministry of Science and Technology (India Meteorological Department) Mechani- cal cadres (Group ' C ' posts ) Recruitment Rules, 1999 ;

(1 ) against serial number 1 relatingto the post of Mechanical Assistant (Mechanical Staff for Industrial Units ) ,- (1) in column 9, for the entry, the following entry shall be substituted, namely:- "No"

(ii) in column 11 , for the entry, the following entry shall be substituted, namely:-

"100% by promotion failing which by direct recruitment"

(iii) in column 12, for the entry, the following entry shall be substituted, namely:---

"Promotion: Mechanic Grade - I ( Industrial or Electrical ) with five years of service in the respective grade rendered after appointment thereto on regular basis " ;

(2) RadioMechanic : 66 posts

(3) Carpenter Grade- I : 04 posts (Non - Industrial)
