सं. गैबैपवि. 189 /मुमप्र ( पी.के. ) 2006. भारतीय रिज़र्व बैंक, इस बात से संतुष्ट होने पर कि जनता के हित में प्रणाली को देश के हित में विनियमित करने हेतु बैंक को समर्थ बनाने के लिए गैर बैंकिंग वित्तीय कंपनियाँ स स्वीकरण ( रिज़र्व बैंक ) निदेश , 1998 को संशोधित करना आवश्यक है, भारतीय रिज़र्व बैंक अधिनियम, 1934 ( 19 की धारा 45ञ , 45ञक , 45 ट तथा 45 ठ द्वारा प्रदत्त शक्तियों और इस संबंध में उसे सक्षम बनाने वाली सभी शक्तियों का करते हुए, 31 जनवरी 1998 की अधिसूचना सं . DFC. 118/DG ( SPT)-98 में अंतर्विष्ट निदेशों को तत्काल प्रभात से निम्नवत संशोधित करता है अर्थात--
1. पैराग्राफ 2 ( 1 ) में खंड ( i ) से पहले निम्नलिखित खंड अंकित किया जाएगा :
(ia) " परिसंपत्ति वित्त कंपनी " का तात्पर्य उस कंपनी से है जो वित्तीय संस्था है; जिसका प्रधान कारोवार गतिविधियों में सहायक भौतिक परिसंपत्तियों, जैसे आटोमोबाइल, ट्रैक्टरों, लेथ मशीनों, जनरेटर सेटौं, मटीरियल हैडिलिंग उपकरणों, स्वचालित एवं सामान्य प्रयोजन की औद्योगिक मशीनों , का विसपोचूण
2. पैराग्राफ 2 ( 1 ) के खंड ( ii ) को हटाया जाएगा ।
3. पैराग्राफ 2 ( 1 ) के खंड ( iv ) को हटाया जाएगा ।

4. पैराग्राफ 2 ( 1 ) के खंड ( viii ) को निम्नलिखित से प्रतिस्थापित किया जाएगाः
" ऋण कंपनी" से तात्पर्य है ऐसी कंपनी से जो वित्तीय संस्था है जो अपने खुद के कार्यकलापों के अलावा अन्य किसी कार्यकलाप के लिए ऋण अथवा अग्रिम अथवा अन्य किसी प्रकार से वित्त प्रदान करती है; परंतु इसमें परिसंपत्ति वित्त कंपनी शामिल नहीं है । "
5. पैराग्राफ 2 ( 1 ) के खंड ( xi ) में " किराया खरीद वित्त कंपनी अथवा उपकरण पट्टादायी कंपनी" शब्दों को " परिसंपत्ति वित्त कंपनी" शब्दों से प्रतिस्थापित किया जाएगा ।
6. पैराग्राफ 2 ( 3 ) के खंड (ii ) में " किराया खरीद वित्त कंपनी अथवा उपकरण पट्टादायी कंपनी " शब्दों को " परिसंपत्ति वित्त कंपनी " शब्दों से प्रतिस्थापित किया जाएगा ।
7. पैराग्राफ 2 ( 3 ) के खंड (ii ) से जुड़ा नोट हटाया जाएगा ।
8. पैराग्राफ 4 के उप पैराग्राफ 4 के शीर्षक में " उपकरण पट्टादायी कंपनी( उपकं) अथवा किराया खरीद वित्त कंपनी ( किखविकं) " शब्दों को " परिसंपत्ति वित्त कंपनी( पविकं ) " शब्दों से प्रतिस्थापित किया जाएगा । 9. पैराग्राफ 4 के उप पैराग्राफ 4 की पहली पंक्ति में " उपकरण पट्टादायी कंपनी अथवा किराया खरीद वित्त कंपनी" शब्दों को " परिसंपत्ति वित्त कंपनी " शब्दों से प्रतिस्थापित किया जाएगा ।
10. पैराग्राफ 4 ( 1 ) के खंड ( i ) के परंतुक में " उपकरण पट्टादायी अथवा किराया खरीद वित्त कंपनी" शब्दों के स्थान पर " परिसंपत्ति वित्त कंपनी " शब्द प्रतिस्थापित किये जाएंगे ।
11. पैराग्राफ 4(4) ( क) तथा ( ख) के उप- शीर्षक में संक्षेपाक्षर " उपदा/ किखविकं " को " पविकं " संक्षेपाक्षर से प्रतिस्थापित किया जाएगा ।
12. पैराग्राफ 4 (4 ) के उप पैराग्राफ ( क ) तथा ( ख ) में " उपकरण पट्टादायी कंपनी अथवा किराया खरीद वित्त कंपनी" शब्दों को " परिसंपत्ति वित्त कंपनी" शब्दों से प्रतिस्थापित किया जाएगा ।

DFC . 119/ DG ( SPT ) -98 में अंतर्विष्ट निदेशों को तत्काल प्रभाव से निम्नवत संशोधित करता है अर्थात-
1. पैराग्राफ 1 (3 ) के खंड ( ii ) के उपखंड ( ग ) के " किराया खरीद वित्त कंपनी " शब्दों को " परिसंपत्ति वित्त कंपनी" शब्दों से प्रतिस्थापित किया जाएगा ।
2. पैराग्राफ 1 (3 ) के खंड (ii ) के उपखंड ( घ) को हटाया जाएगा ।
3. पैराग्राफ 9डी में " पंजीकरण है " शब्दों के बाद निम्नलिखित शब्द जोड़े जाएंगे:
" ऐसे प्रमाणपत्र में गैर बैंकिंग वित्तीय कंपनी की परिसंपत्ति/ आय के स्वरूप/ पैटर्न का उल्लेख भी होगा जिसके कारण कंपनी परिसंपत्ति वित्त कंपनी, निवेश कंपनी या ऋण कंपनी के रूप में वर्गीकृत होने के योग्य हुई । " 4. पैराग्राफ 11 बी( i ) में " उपस्कर पट्टा कंपनी अथवा किराया खरीद वित्त कंपनी" शब्दों को " परिसंपत्ति वित्त कंपनी" शब्दों से प्रतिस्थापित किया जाएगा।
5. पैराग्राफ 11 बी के तीसरे परंतुक में " उपस्कर पट्टा कंपनी अथवा किराया खरीद वित्त कंपनी" शब्दों को " परिसंपत्ति वित्त कंपनी" शब्दों से प्रतिस्थापित किया जाएगा ।
6. उक्त निदेश के पैराग्राफ 13 में वर्णित छमाही विवरणी( एनबीएस -2 ) के फार्मेट के भाग झ की मद सं. (ii ) (क) में अंकित " उपस्कर पट्टा कंपनी अथवा किराया खरीद वित्त कंपनियाँ" शब्दों को " परिसंपत्ति वित्त कंपनियाँ " शब्दोंसे प्रतिस्थापित किया जाएगा ।

TheReserve Bank of India , having satisfied that, in the public interest, andto enable the Bank to regulate the financial system of the country to its advantage , it is necessary to amend the Norr- Banking Financial Companies Acceptance of Public Deposits ( Reserve Bank) Directions , 1998 , in exercise of the powers conferred by sections 45J , 45JA, 45K and 45L of the Reserve Bank of India Act, 1934 (2 of 1934) and of all the powers enabling it in this behalf, hereby directs that the said directions contained in Notification No.DFC. 118/DG( SPT) -98 dated January 31 , 1998 shall stand amended with immediate effect as follows , namely -
1. In paragraph 2( 1 ), before clause (i ) , the following clause shall be inserted:
" ( ia) "Asset Finance Company " means any company which is a financial institution carrying on as its principal business the financing of physical assets supporting productive / economic activity, such as automobiles, tractors , lathe machines , generator sets, earth moving and material handling equipments, moving on own power and general purpose industrial machines.
2. Clause (ii ) of paragraph 2( 1 ) shall be deleted .
3. Clause (iv) of paragraph 2( 1 ) shallbe deleted.
4. The clause (viii) of paragraph 2(1 ) shall be substituted as under:

5. In clause ( xi ) of paragraph 2 ( 1 ) , for the words "a hire purchase finance company or an equipment leasing company " , the words " an asset finance company" shall be substituted.
6. In clause ( ii) of paragraph 2(3) for the words "a hire purchase finance company or an equipment leasing company " , the words an asset finance company" shali be substituted .
7. The note attached to clause ( ii ) of paragraph 2( 3) shall be deleted.

10. In the proviso to clause (i ) of paragraph 4( 1 ) , for the words " an Equipment Leasing or Hire Purchase Finance Company " , the words " an Asset Finance Company" shall be substituted .
11. Inthe sub-heading of paragraph 4(4) ( a) and (b) , for the abbreviations " EL/ HPFC " the abbreviation " AFC " shall be substituted .

4. In paragraph 11B( i ) , for the words " equipment leasing company or a hire purchase finance company" , the words "Asset Finance Company " shall be substituted .
