आ. अ. 18. लोक प्रतिनिधित्व अधिनियम , 1950 ( 1950 का 43 ) की धारा 13 क की उप- धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , भारत निर्वाचन आयोग गोवा सरकार के परामर्श से एतदद्वारा श्री राजीव यादुवंशी , आई.ए.एस. के स्थान , पर श्री रमेश नेगी, आई.ए.एस. ( ए.जी.एम.यू.टी 1984 ) को दित्तांक 02-04-2007 से आगामी आदेशों तक के लिए गोवा राज्य के मुख्य निर्वाचन अधिकारी के रूप में नामित करता है ।
O. N. 18. In exercise of the powers conferred by sub -section (1 ) of Section 13A of the Representation of the Poeple Act, 1950 (43 of 1950), the Election Commission of India , in consultation with the Government of Goa , hereby nominates Shri Ramesh Negi , IAS (AGMUT : 1984) as the Chief Electoral Officer for the State of Goa with effect from 02-04-2007 and until further orders vice Shri Rajiv Yaduvanshi , IAS.
2. श्री रमेश नेगी गोवा सरकार के अधीन सभी पदभार या किसी कार्य के पदभारों को धारण करना समाप्त कर देंगे या सौंप देंगे , जो कि वे दिनांक 02-04-2007 को उनके मुख्य निर्वाचन अधिकारी , गोवा का पदभार ग्रहण करने से पहले , धारण कर रहे थे ।
2. Shri Ramesh Negi shall cease to hold and hand over the charge of all or any charges of work under the Government of Goa, which he may be holding before his assumption of office of the Chief Electoral Officer , Goa on02-04-2007.
3. श्री रमेश नेगी मुख्य निर्वाचन अधिकारी , गोवा के रूप में कार्य करते हुए गोवा सरकार के अधीन किसी भी प्रकार का कोई अतिरिक्त कार्यभार ग्रहण नहीं करेंगे सिवाय इसके कि उनको राज्य सचिवालय में निर्वाचन विभाग के प्रभारी , सरकार का सचिव पदाभिहित किया जायेगा ।

उप-निर्वाचन 1 जनवरी , 2006 को अर्हता की तारीख के संदर्भ में पुनरीक्षित विद्यमान निर्वाचक नामावलियों के आधार पर कराए जाएंगे ।

आदेश से, विषय : महाराष्ट्र राज्य में 16 - इरन्दोल, 17 - जलगाँव और 22--रामटेक संसदीय निर्वाचन क्षेत्रों से लोक सभा के लिए उप-निर्वाचन-निर्वाचक नामावली का पुनरीक्षण।

ORDER
NewDelhi , the 20th March , 2007 आ. अ.19. यतः, आयोग ने महाराष्ट्र राज्य में 16 - इरन्दोल , 17- जलगाँव और 22 रामटेक संसदीय निर्वाचन क्षेत्रों से लोक सभा के लिए उप- निर्वाचन के कार्यक्रम की घोषणा की है और उक्त उप-निर्वाचनों के लिए अधिसूचना दिनांक 16-03-2007 को जारी की जा चुकी है ; और
Subject : Bye - elections to the Lok Sabha from the Parliamentary Constituencies of 16 Erandol , 17 -Jalgaon and 22 -Ramtek in the State of Maharashtra-Revision of electoral roll .
2. यतः , लोक प्रतिनिधित्व अधिनियम , 1950 की धारा 21 (2 ) ( क ) ( ii ) के अनुसार , निर्वाचक नामावलियों को, लिखित में रिकार्ड किए जाने वाले कारणों से , निर्वाचन आयोग द्वारा अन्यथा निर्देशित कर दिए जाने तक निर्वाचन क्षेत्र को आवंटित स्थान में आकस्मिक रिक्ति को भरने के लिए प्रत्येक उप- निर्वाचन के पूर्व की अर्हक तिथि के संदर्भ में; विहित रीति से पुनरीक्षित नहीं किया जाएगा; और
O. N. 19. Whereas , the Commission has announced the programme of bye -election to Lok Sabha from the Parliamentary Constitutencies of 16- Erandol , 17- Jalgaon and 22 - Ramtek in the State of Maharashtra and the notification for the said bye- elections has been issued on 16-3-2007 ; and
3. यतः , निर्वाचक नामावली की तैयारी या पुनरीक्षण के संबंध में अर्हता की तारीख अर्थात् उस वर्ष के जनवरी माह का प्रथम दिन जिसमें यह लोक प्रतिनिधित्व अधिनियम 1950 की धारा 14 (ख ) के अनुसार इस प्रकार तैयार या पुनरीक्षित की जाती है ।
2. Whereas , accordingto Section 21 (2) ( a) ( ii) of the Representation of the People Act, 1950 the electoral roll unless otherwise directed by the Election Commission for the reasons to be recorded in writing, be revised in the prescribed manner by reference to the qualifying date before cach bye- election to fill a casual vacancy in a seat allottedto the Constituency ; and
4. यतः , यह आयोग की संगत नीति रही है कि देश के किसी भी भाग को लंबे समय तक प्रतिनिधि विहीन नहीं छोड़ा जाए तथा तदनुसार लोक प्रतिनिधित्व अधिनियम 1951 ( 195 ) का 43 ) की धारा 151 क द्वारा अनुबंधित समय के भीतर इस आकस्मिक रिक्ति को भर दिया जाए; तथा
3. Whereas , the qualifying date in relation to the preparation or revision of electoral roll means the 1st day of the January of the year in which it is so prepared or revised as per Section 14 ( b) of the Representation of the People Act , 1950 ; and
5. यतः , महाराष्ट्र राज्य की निर्वाचक नामावलियों के संबंध में अर्हता की तारीख । जनवरी , 2006 है , 1 अगस्त, 2006 को प्रकाशित की जा चुकी है; तथा
6. यतः , अर्हता की तारीख 1 जनवरी , 2007 के संबंध में निर्वाचक नामावलियों के पुनरीक्षण के लिए प्रक्रिया की घोषणा आयोग द्वारा नहीं की गई है ।
4. Whereas , it has been the consistent policy of the Commission not to leave any part of the country unrepresented for a long time and accordingly to fill the casual vacancy within the time stipulated by Section 151A of the Representation of the People Act, 1951 (43 of1951); and
5. Whereas , the electoral rolls w.r.t. 1st January , 2006 as the qualifying date of the State of Maharashtra have been published on 1st August , 2006 ; and
6. Whereas , the process for revising the electoral roll with qualifying date of 1st January, 2007 has not been announced by the Commission; and 7. यतः, 01-01-2007 को अर्हता की तारीख मानकर इसके संदर्भ में निर्वाचक नामावलियों को पुनरीक्षित किए जाने तक पूर्वोक्त आकस्मिक रिक्तियों को भरने के लिए उप - निर्वाचनों को स्थगित नहीं किया जा सकता, क्योंकि इसका अर्थ यह होगा कि लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 151 क में विनिर्दिष्ट कालावधि से अधिक समय तक निर्वाचन क्षेत्रों को प्रतिनिधि विहीन छोड़ दिया गया है और केन्द्र सरकार से परामर्श करके आयोग को यह प्रमाणित करना होगा कि उक्त कालावधि के भीतर उप - निर्वाचन कराना कठिन है;
8. अतः , अब, आयोग पूर्वोक्त कारणों से लोकप्रतिनिधित्व अधिनियम 1950 की धारा 21 ( 2 ) के परंतुक के साथ पठित धारा 21 (2 ) ( क) ( ii ) के अधीन एतदद्वारा निदेश देता है कि महाराष्ट्र राज्य 16- इरन्दोल संसदीय निर्वाचन क्षेत्र , 17 जलगांव संसदीय निर्वाचन क्षेत्र और 22 -रामटेक संसदीय निर्वाचन क्षेत्र से होने वाले उक्त
7. Whereas, the bye-elections to fill the aforesaid casual vacancies cannot be postponed till the electoral rolls are finally published after revision w.r.t. 1st January , 2007 , as that would mean leaving the constituencies unrepresented beyond the period specified in Section 151 A of the Representation of People Act , 1951 and the Commission will have to certify, in consultation with the Central Govt . that it is difficultto hold the bye-election within the said period; and 61

Now, therefore , the Commission, for the aforesaid reasons , hereby directs under Section 21 (2) (a) (ii ) read with proviso to Section 21 (2) of the Representation of People Act , 1950 that the aforesaid bye -election to 16- Erandol Parlimentary Constituency , 17 - Jalgaon Parliamentary Constituency and 22 - Ramtek Parliamentary Constituency in the State of Maharashtra shall be conducted on the basis of the existing electoral rolls revised w.r.t. 1st January , 2006 as the qualifying date.

2. Dr. Sasadhar Nath shall cease to hold and hand over forthwith the charge of all or any charges of work under the Government of Assam , which he may be holding before such assumption of office.
नई दिल्ली , 21 मार्च, 2007 आ. अ. 20.-लोक प्रतिनिधित्व अधिनियम , 1950 (1950 का43 ) की धारा 13- क की उप- धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , भारत निर्वाचन आयोग असम सरकार के परामर्श से एतंद्वारा श्री प्रनब कुमार खूंड , आई.ए.एस. के स्थान पर डा. सासाधर नाथ , आई.ए.एस. ( ए.एम.: 1988 ) को उनके कार्यभार ग्रहण करने की तारीख से आगामी आदेशों तक के लिए असम राज्य के मुख्य निर्वाचन अधिकारी के रूप में नामित करता है ।
