In the circumstances , it is therefore most humbly prayed that this Hon'ble Court may graciously be pleased to allow the present election petition and thereby: ---
(A) To declare the election of the respondent Nos . 1 and 2 to the Council of State from the State of Haryana held on 28-6-2004 as void; and
(B) To further declare that the votes , if cast , of the 6 MLAs along with the rejected vote should be counted in favour of the Petitioner and to further declare that the petitioner has been duly elected ; and

(C) To further declare that the petitioner has been duly elected in the election to the Council of States from the State ofHaryana held on 28-6-2004; and
(D) The election petition may be accepted with costs: and
(E) Pass such order and further orders as this Hon'ble Court may deem fit and proper in the facts and circumstances of the case .
And for this act of kindness , the petitioner as is duty bound shall ever pray .

This petition has been filed under Section 80, 80A, 81 and 84 read with Sections 98 , 100( 1 ) (d) ( iii) ( iv) and under Section 101 (a) of the Representation of the People's Act, 1951 with a prayer for declaring the election of the return candidates , respondents herein held on 2-8-2004 as void to the biennial election to the Council of the States (Rajya Sabha) from the State of Haryana on 28-6-2004 . A further prayer has also been made for issuance of direction to declare the petitioner to be duly elected for the Council of States from the State of Haryana .
The petition is founded on the orders dated 25-6-2004 passed by the worthy Speaker of Haryana Legislative Assembly disqualifying six MLAs , namely , Bhim Sen Mehta , Jai Parkash Gupta, Rajinder Singh Bisla , Karan Singh , Jagjit Singh and Dev Raj Diwan , During the pendency of the petition an application was filed by the petitioner on which the following order was passed :-
"C. M. No. 6 - E of 2005 in E. P. No. 1 of 2004 . Present : Mr. Sumeet Goel , Advocate , for the petitioner , Mr. D. S. Nalwa , Advocate Mr. Sukhbir Singh , Advocate
An application has been moved by Mrs. Kiran Chaudhary , petitioner praying that in view of the fact that six members of the Haryana State Legislative Assembly have filed six writ petitions in the Hon'ble Supreme Court bearing Nos. 287 , 290, 291 , 292, 293 and 294 of 2004 challenging the disqualification order(s ) passed by the Speaker of the Haryana Vidhan Sabha , wherein the following order has been passed :-
"Admitted .
Petitioners, in all these petitions would continue to function as members of the Haryana State Lagislative Assembly . Status as Members of Assembly is protected pending further orders . They will be permitted to draw all allowances and perquisites admissibles as members of State Assembly. They are permitted to attend the proceeding of the Assembly but they shall not cast vote in any proceeding in Assembly including election as member of State Legislature .
The petitioners would be at liberty to mention for early hearing of the matter . Any action consequent upon the impugned order will be subject to the final order that may be passed . "
and in view of the fact that the decision of this issue would have material bearing on the decision of the Election Petition, this Court may adjourn the hearing of the Election petition since die granting liberty to the election petitioner to revive the same as and when the above mentioned writ petitions are decided.
To this being done , the learned counsel for the respondents have no objection : Accordingly, the Election Petition is adjourned sine die .

Mr. Hawa Singh Hooda , Learned Senior Counsel for the petitioner states that the orders passed by the Speaker on 25-6-2004 were challenged before Hon'ble the Supreme Court in six separate petitions and those writ petitions have now been dismissed by a common order on 11-12-2006. The Judgement is now reported as Jagjit Singh Vs. State of Haryana (2006) II SCC. It is thus evident that orders of the Speaker disqualifying the aforementioned six MLAs have been upheld by Hon'ble the Supreme Court .
Inthe aforementioned situation , Mr. Hooda state that the controversy in the Election Petition does not remain alive . Since , no cause of action survives the Election petition fails and the same is dismissed . No costs.

आ. अ. 34.-यतः , निर्वाचन आयोग का समाधान हो गया है कि केरल विधानसभा के लिए साधारण निर्वाचन , 2006 , जो नीचे की सारणी के स्तम्भ ( 2 ) में विनिर्दिष्ट निर्वाचन क्षेत्रों से हुआ है , स्तम्भ ( 3 ) में उसके नाम के सामने विनिर्दिष्ट निर्वाचन लड़ने वाला प्रत्येक अभ्यर्थी, लोक प्रतिनिधित्व अधिनियम , 1951 तथा तद्धीन बनाए गए नियमों द्वारा अपेक्षित उक्त सारणी के स्तम्भ (4 ) में यथा दर्शित अपने निर्वाचन व्ययों का लेखा दाखिल करने में असफल रहा है ;
और , यतः , उक्त अभ्यर्थियों ने सम्यक् सूचना दिए जाने पर भी उक्त असफलता के लिए या तो कोई कारण अथवा स्पष्टीकरण नहीं दिया है तथा निर्वाचन आयोग का यह समाधान हो गया है कि उनके पास उक्त असफलता के लिए कोई पर्याप्त कारण या न्यायौचित्य नहीं है;
अतः , अब , उक्त अधिनियम की धारा 10- क के अनुसरण में निर्वाचन आयोग एतद्वारा , नीचे की सारणी के स्तम्भ ( 3 ) में विनिर्दिष्ट व्यक्तियों को संसद के किसी भी सदन के या किसी राज्य की विधान सभा अथवा विधान परिषद् के सदस्य चुने जाने और होने के लिए इस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निरर्हित घोषित करता है ;

आ. अ. 35.-यतः, निर्वाचन आयोग का समाधान हो गया है कि आन्ध्र प्रदेश राज्य से विधानसभा , 2005 के उप- निर्वाचन के लिए जो नीचे की सारणी के स्तम्भ ( 2 ) में विनिर्दिष्ट निर्वाचन क्षेत्रों में हुआ है , स्तम्भ (3 ) में उसके सामने विनिर्दिष्ट निर्वाचन लड़ने वाला प्रत्येक अभ्यर्थी, लोक प्रतिनिधित्व अधिनियम , 1951 तथा तद्धीन बनाए गए नियमों द्वारा यथा अपेक्षित उक्त सारणी के स्तम्भ ( 4 ) में यथा दर्शित विधि द्वारा अपेक्षित रीति से निर्वाचन व्ययों का लेखा दाखिल करने में असफल रहा है;
