: बँपविवि. सं. आरईटी बीसी . 24 / 12.01.001 / 2007-2008--भारतीय रिज़र्व बैंक अधिनियम, 1934 की धारा 42 की उप धारा ( 1 ) के अंतर्गत प्रदत्त शक्तियों का प्रयोग करते हुए तथा 20 अप्रैल, 2007 की अधिसूचना बैंपविवि. सं. आरईटी बीसी. 83 / 12.01.001 / 2006-2007 के आंशिक आशोधन में, भारतीय रिज़र्व बैंक एतद्वारा अधिसूचित करता है कि 20 अप्रैल 2007 की अधिसूचना बैंपविवि. सं . आरईटी बीसी. 85 / 12.01.001 /2006-2007 में दी गई छूटों के अधीन प्रत्येक अनुसूचित वाणिज्य बैंक 4 अगस्त 2007 को प्रारंभ होने वाले पखवाड़े से उसकी कुल मांग तथा मीयादी देयताओं का 7 प्रतिशत आरक्षित नकदी निधि अनुपात ( सीआरआर ) बनाए रखे ।

" आन्ध्र प्रदेश राज्य के कृष्णा ज़िले के विजयवाडा रुरल मण्डल में स्थित निडमनूर, गूडवल्ली, डोनीतकूर और प्रसदमपाडु राजस्व गाँव के सम्बन्धित इलाकों । "

" सुंदरगढ़ जिले के पानपोष तहसील में कुआरमुण्डा, चड्रि हरिहरपुर, बीजाबहाल, तेलीपोष , कालोसिहिरिया, जमुनानाकी के राजस्व गाँव शामिल हैं । "

जहाँ अनुसूची-। में उल्लिखित नियोक्ताओं ने [ इसमें इसके पश्चात उक्त स्थापना कहा गया है । कर्मचारी भविष्य निधि और प्रकीर्ण उपबंध अधिनियम 1952, [1952 का 19 ] की धारा 17 की उपधारा (2क) के अन्तर्गत छूट के विस्तार के लिए आवेदन किया है । जिसे इसमें इसके पश्चात उक्त अधिनियम कहा गया है ।
चूंकि केन्द्रीय भविष्य निधि आयुक्त इस बात से संतुष्ट है कि उक्त स्थापना के कर्मचारी कोई अलग अंशदान या प्रीमियम की अदायगी किए बिना जीवन बीमा के रूप में भारतीय जीवन बीमा निगम / अनुमोदित निजी बीमा कंपनी अर्थात बजाज एलायंज जीवन बीमा निगम लिमिटेड को सामूहिक बीमा स्कीम का लाभ उठा रहे हैं जो कि ऐसे कर्मचारी के लिए कर्मचारी निक्षेप सहबध्द बीमा स्कीम , 1976 के अन्तर्गत स्वीकार्य लाभों से अधिक अनुकूल है जिसे इसमें इसके पश्चात् स्कीम कहा गया है ।
अतःउक्त अधिनियम की धारा 17 की उपधारा (2क) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए तथा श्रम मंत्रालय भारत सरकार केन्द्रीय सरकारकेन्द्रीय भविष्य निधि आयुक्त की अधिसूचना सं. तथा तिथि जो प्रत्येक स्थापना के नाम के सामने दर्शायी गयी है , के अनुसरण में तथा संलग्न अनुसूची- ।। की निर्धारित शर्तों के रहते हुए केन्द्रीय भविष्य निधि ने उक्त स्कीम के सभी उपबंधों के संचालन से प्रत्येक उक्त. स्थापना को आगे 3 वर्षों की अवधि के लिए छूट प्रदान कर दी हैं । जैसा कि संलग्न अनुसूची । में उनके नाम के सामने दर्शाया है ।

2 नियोक्ता ऐसे निरीक्षण प्रभारों का प्रत्येक मास की समाप्ति के 15 दिन के भीतर संदाय करेगा जो केन्द्रीय सरकार उक्त अधिनियम की धारा 17 की उपधारा [ 2- क) के खण्ड के अधीन समय समय पर निर्देश करेंगे ।
3. सामूहिक बीमा स्कीम के प्रशासन में जिसके अन्तर्गत लेखाओं का रखा जाना , विवरणियों को प्रस्तुत किया जाना , बीमा, प्रीमियम का भुगतान , लेखाओं का अन्तरण, निरीक्षण प्रभारो का भुगतान आदि भी है ,के होने वाले सभी व्ययों का वहन नियोक्ता द्वारा किया जाएगा ।
4. नियोक्ता केन्द्रीय सरकार द्वारा अनुमोदित सामूहिक बीमा स्कीन के नियमों की एक प्रति और जब कभी उसमें संशोधन, किया जायेगा तब उस संशोधन की प्रति तथा कर्मचारियों की बहु संख्या की , भाषा में उसकी मुख्य बातों का अनुवाद स्थापना के सुचना पट पर प्रदर्शित करेगा।
5. यदि कोई कर्मचारी जो भविष्य निधि या उक्त अधिनियम के अधीन छूट प्राप्त किसी स्थापना की भविष्य निधि का पहले ही सदस्य है , स्थापना में नियोजित किया जाता है , तो नियोक्ता सामूहिक बीमा स्कीम के सदस्य के रुप में उसका नाम तुरन्त दर्ज करेगा और उसकी बाबत आंवश्यक प्रीमीयम भारतीय जीवन बीमा निगम / अनुमोदित निजी बीमा कंपनी को भुगतान करेगा ।
6. यदि उक्त स्कीम के अधीन कर्मचारियों को उपलब्ध लाभ बढ़ाये जाते हैं तो नियोक्ता सामूहिक बीमा स्कीम के आधीन कर्मचारियों को उपलब्ध लाभों में सामूहिक रुप से वृध्दि किए जाने की व्यवस्था करेगा, जिसमें कि कर्मचारियों के लिए सामूहिक बीमा स्कीम के अधीन लाभ उपबन्ध लाभों से अधिक अनुकूल हों , जो उक्त स्कीम के अधीन अनुज्ञेय है ।
7. सामूहिक बीमा स्कीम में किसी बात के होते हुए भी यदि किसी कर्मचारी की मृत्यु पर इस योजना के अंतर्गत देय धनराशि सदस्य के सामूहिक बीमा योजना का सदस्य होने पर देय राशि से कम है तो नियोक्ता नामिति/विधिक वारिसों को मुआवजे के रूप में उस नुकसान की भरपाई करेगा।
8. सामूहिक बीमा स्कीम के उपबंधों में कोई भी संशोधन संबंधित क्षेत्रीय भविष्य निधि आयुक्त के पूर्व अनुमोदन के बिना नहीं किया जायगा और जहाँ किन्तो संशोधन से कर्मचारियों के हित पर प्रतिकूल प्रभाव पड़ने की सम्भावना हो वहां क्षेत्रीय भविष्य निधि आयुक्त अपना अनुमोदन देने के पूर्व कर्मचारियों को अपना दृष्टिकोण स्पष्ट करने का युक्तियुक्त अवसर देगा ।
9. स्थथापना द्वारा पहले ही अपनाई गई भारतीय जीवन बीमा निगम अनुमोदित निजी बीमा कंपनी की सामूहिक बीमा योजना के अंतर्गत प्रदत्त लाभों में किसी भी कारण से किसी प्रकार की कमी किए जाने पर अगर कर्मचारी व्याप्त नहीं रहते हैं तो स्थापना को प्रदत्त छूट रद्द की जा सकती है ।
10. यदि किसी कारण वश नियोक्ता नियत तारीख के भीतर बीला निगम / अनुमोदित निजी बीमा कंपनी को प्रीमियम का भुगतान करने में असफल रह जाता है और पालिसी व्यपगत होती है तो छूट रद्द की जा सकती हैं ।
11. प्रीमियम के भुगतान में किसी भी प्रकार की चूक छूट प्राप्त नियोक्ता द्वारा की जाती है तो मृत सदस्य के नामिति । नामितों / विधिधक वारिशों को , जो कि अन्यथा उक्त योजना के अंतर्गत व्याप्त होते बीमा लाभ्भ की भुगतान की जिम्मेदारी नियोक्ता की होगी ।
12. सामूहिक बीमा योजना के अंतर्गत व्याप्त किसी सदस्य की मृत्यु होने पर जीवन बीमा निगम मृतक सदस्यके नामिति/नामितों/विधिक वारिसों को बीमाकृत राशि के त्वरिंत भुगतान को सुनिश्चित करेगा और हर हाल में सही ढंग से भरे हुए प्राप्त दावे का निपटान दावे प्राप्ति के एक महीने के भीतर करना होगा।

whereas the employers ofthe establishment mentioned in Schedule- I (Hereinafter referred to as the said establishment) have applied for exemption under Sub- Section (2A) of Section 17 ofthe Employee's Provident Fund & Miscellaneous Provisions Act, 1952 (19 of 1952) herein after referred to as the said Act.
Andwhereas the Central Provident Fund Commissioner, is satisfied that the employees ofthe said establishments are, without making any separate contribution or payment ofpremium in enjoyment ofbenefits under the Group Insurance Scheme of the Life Insurance Corporation of India/approved private Insurance Company i.e. Bajaj Allianz Insurance Ltd. , in the nature of Life Insurance which are more favourable to such employees to such employees than the benefits admissible under the Employees ' Deposit Linked Insurance Scheme, 1976 (hereinafter referred to as the said Scheme).
Nowtherefore, in exercise of the powre conferred by Sub- Section (2A) of Section 17 of the said Act in continuation of Govt . of India, the Ministry of Labour/CPFC Notification No. and date shown against the name of each of the said establishments from the conditions specified in Schedule- II annexed hereto the Central Provident Fund Commissioner hereby exempt each of the said establishment from the operation of all the provisions of the said scheme & further period of3 years as indicated in attached Schedule- I against their names.

Schedule - II
1. The employer in relation to each of the said establishment ( hereinafter referred to as the employer ) shall submit such returns to the Regional P. F. Commissioner concerned and maintain such account and provide such facilities for inspection, as the Central PF Commissioner may direct from time to time.
2. The employer shall pay such inspection charges as the Central Govt. , may from time to time, direct under clause( A) Sub- Section ( 2A) of Section 17 of the said Act, within 15days from the close of every month.
3. All expenses involved in the administration of the Group Insurance Scheme, including maintenance of account, submission of returns , payment of insurance premia, transfer accounts , payment of inspection charges etc. , shall be borne by the employer.
4. The employer shall display on the Notice Board of the establishment , copy of the rules of the Group Insurance Scheme as approved by the Central Government / Central Provident Fund Commissioner as and when amended alongwith translation of salient feature thereof in the language of the majority of the employees .
5. Where as an employee , who is already a member of the Employees Provident Fund or the Provident Fund of an establishment exempted under the said Act , is employed in his establishment the employer shall immediately admit him as a member of the Group Insurance Scheme and pay necessary premium in respect of him to Life Insurance Corporation of India/ approved private insurance conmpany 6. The employer shall arrange to enhance the benefits available to the employees under the Group Insurance Scheme appropriately if the benefit available to the employees under said scheme are enhanced so that the benefits available under Group Insurance Scheme are more favourable to the employees than the benefits admissible under the said Scheme
7. Not withstanding anything contained in the Group Insurance Scheme, if on the death of an employees the amounts payable under the Scheme be less than the amount that would be payable had the employees been covered under the said scheme. the employer shall pay the difference to the nominee( s ) legal heir( s ) of the employees as compensation
8. No amendment of the provisions of the Group Insurance Scheme shall be made without the prior approval of the Regional Provident Fund Commissioner concerned and where any amendment is likely to effect adversely the interest of the employees his approval , give a reasonable opportunity to the employees to explain point of view.
9. Therefore any reason the employer of the said establishment do not remain covered under the Group Insurance Scheme of the Life Insurance Corporation of India/approved private insurance company as already adopted by the said establishment , for the benefits to the employees under this scheme are reduced in any manner, the exemption shall be liable to be cancelled
10. Where for any reason, the employer fails to pay the premium etc.. within the due date, as fixed by the Life Insurance Corporation of India/ approved private 4-229 G1 / 07 [PART III-SEC . 4 THE GAZETTE OF INDIA, SEPTEMBER 8 , 2007 (BHADRA 17 , 1929)

Insurance Company, and the policy is allowed to lapse , the exemption shall be liable to be cancelled.
11. In case of default , if any made by the employer in payment of premium the responsibility for payment of assurance benefits to the nominees (s ) legal heir ( s ) of deceased member who would have been covered under the said Scheme but for grant of this exemption shall be that of the employer .
12. Upon the death of the member covered under the Group Insurance Scheme, this Life Insurance Corporation of India/ approved private Insurance Company , shall ensure prompt payment of the sum assured to the nominees( s ) and Legal Heir(s ) of the deceased member entitled for it and in any case within one month from the receipt of claims complete in all respect
