का.नि.आ. 53.-राष्ट्रपति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए रक्षा लेखा विभाग में ज्येष्ठ निजी सचिव के पद पर भर्ती की पद्धति को विनियम करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्;-
1 ) इन नियमों का संक्षिप्त नाम रक्षा लेखा विभाग ( ज्येष्ठ निजी सचिव ) नियम , 2007 है । 1. सक्षिप्त नाम और प्रारंभ. (
(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत होंगे ।
2. पदों की संख्या, वर्गीकरण एवं वेतनमान, उक्त पदों की संख्या, इसका वर्गीकरण और उनसे संबद्ध वेतनमान इन नियमों के साथ संलग्न अनुसूची के स्तम्भ 2 से 4 में विनिर्दिष्ट हैं ।

5. स्थानान्तरण का दायित्व. ज्येष्ठ निजी सचिव भारत में कहीं भी स्थानांतरण के दायित्वाधीन होंगे ।
6. निरर्हताएं:-
(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है , विवाह किया है; या
(ख) जिसने अपने पति या अपनी पत्नी के जीवित होते हुए किसी व्यक्ति से विवाह किया है उक्त सेवा में नियुक्ति का पात्र नहीं होगा ।

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।
7. नियम शिथिल करने की शक्ति, जहां केन्द्रीय सरकार की यह राय हो कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके , इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी ।
8. व्यावृत्ति इन नियमों की कोई भी बात , ऐसे आरक्षणों , आयु सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनपर सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों , भूतपूर्व सैनिकों तथा अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबन्ध करना अपेक्षित है । पद का नाम

टिप्पण : जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में, जिन्होंने अपनी अर्हक/पात्रता सेवा पूरी कर ली है , प्रोन्नति के लिए विचार किया जा रहा हो वहां उनसे ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा परन्तु यह तब जब कि उनके द्वारा की गई ऐसी अर्हक/पात्रता सेवा, अपेक्षित अर्हक/पात्रता सेवा के आधे से अधिक से या दो वर्ष से, इनमें से जो भी कम हो , कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित , जिन्होंने ऐसीअर्हक/पात्रता सेवा पहले ही पूरी कर ली है , अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वक पूरी कर ली हो । 261 भारत का राजपत्र: अक्तूबर6, 2007/आश्विन 14 , 1929

S.R.O. 53. In exercise of the powers conferred by the proviso to Article 309 of the Constitution the President hereby makes the following rules regulating the method of recruitment to the post of Senior Private, Secretary in the Defence Accounts Department , namely :-
1. Short title and commencement ( 1) These rules may be called the Defence Accounts Department (Senior Private Secretary) Rules , 2007
(2)They shall come into force on the date of their publication in the Official Gazette .
2.Number of Post, classification and scale of pay . The number ofthe said post, its classification and the scale of pay attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules.
3. Controlling authority. The post shall be administratively controlled by the Controller General of Defence Accounts under the Ministry of Defence (Finance).
4. Method of Recruitment, age limit, qualifications etc. The method of recruitment to the said post, age limit , qualifications and other matters connected therewith shall be as spécified in Columns 5 to 13 of the said Schedule .
5. Liability for transfer . The Senior Private Secretary shall be liable to transfer anywhere in India.
6. Disqualifications. No person:-
(a) who has entered into or contracted a marriage with a person having a spouse living; or
(b) who, having a spouse living, has entered into or contracted a marriage with any person,
shall be eligible for appointment to the said post:
Provided that the Central Government may , if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.
7. Power to relax:-Where the Central Government is of the opinion that it is necessary or expedient to do so, it mayby order , for reasons to be recorded in writing and in consultation with the Union Public Service Commission relax any of the provisions of these rules with respect to any class or category of persons .
8. Saving:-Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes, Ex -Servicemen and any oter special categories ofpersons in accordance with the orders issued by the Central Government from time to time in this regard .

का.नि.आ. 54.-राष्ट्रपति , भारत के संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , हॉस्टल आवास का आबंटन ( रक्षा लेखा विभाग पूल ) नियम 1993 का और संशोधन करते हुए निम्मलिखित नियम बनाते हैं , अर्थात्:-
1 ( 1 ) इन नियमों का संक्षिप्त नाम हॉस्टल आवास का आबंटन ( रक्षा लेखा विभाग पूल ) संशोधन नियम , 2007 है । (2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. हॉस्टल आवास का आबंटन ( रक्षा लेखा विभाग पूल ) नियम, 1993 में, -
(क) नियम 5 के उप नियम 4 के पश्चात् निम्नलिखित अंतःस्थापित किया जाएगा , अर्थात्:-
"( 5) अधिकारी या स्टाफ, जिन्हें नियमित निवास स्थान के बदले हॉस्टल आवास आबंटित किया गया है , को गैर- परिवार स्टेशनों पर स्थानान्तरण होने पर उन्हें भी उनके परिवार के लिए अपने अंतिम डयूटी स्टेशन पर निवास स्थान रखने की अनुमति सक्षम प्राधिकारी द्वारा अनुज्ञप्त होंगी जो निम्नलिखित शर्तों, जो समय समय पर विनिर्दिष्ट की जाएं, को पूरा करते हों, अर्थात्:-
(क) अधिकारी द्वारा सामान्य अनुक्रम में रक्षा लेखा विभाग या सामान्य पूल आवास के अधीन आवास के आबंटन के लिए आवेदन किया गया हो " ।
(ख) यद्यपि हॉस्टल आवास को रखने के लिए अनुज्ञा देने के पश्चात् भी अधिकारी का नाम रक्षा लेखा विभाग या साधारण पूल निवास स्थान प्रतीक्षा सूची में होना चाहिए ।
(ग) उपरोक्त नियमों के अधीन सक्षम प्राधिकारी या आबंटन प्राधिकारी संबंधित रक्षा लेखा प्रधान नियंत्रक या रक्षा लेखा नियंत्रक या रक्षा लेखा महानियंत्रक होंगे ।

S.R.O. 54. In exercise of the powers conferred by proviso to article 309 of the Constitution, the President hereby makes the following rules further to amend the Allotment of Hostel Accommodation (Defence Accounts Depart- ment Pool ) Rules, 1993 , namely :-
1 (1) These rules may be called the Allotment of Hostel Accommodation (Defence Accounts Department Pool ) AmendmentRules, 2007
(2) They shall come into force on the date of their publication in the Official Gazette .
2. In the Allotment of Hostel Accommodation (Defence Accounts Department Pool ) Rules , 1993 .
(a) after sub -rule 4 ofrule 5, the following shall be inserted, namely:-
"(5) The officers or staffwho have been allotted hostel accommodation in lieu of regular residential accommo- dationwill also be allowed to retain the accommodation by the Competent Authority for their family at the last duty station on their transfer to non- family stations specified from time to time on fulfillment of following conditions , namely:-
(a) The officer should have applied for allotment of residential accommodation under Defence Ac- countsDepartment or General pool accommodation in the normal course.
(b) The name of the officer should figure in the wait list meant for allotment of Defence Accounts Department orGeneral pool accommodation even after permission for retention of hostel accommo- dation isgranted.
(c) The Competent Authority or Allotting Authority under the above rules will be the concerned Principal Controller of Defence Accounts or Controller of Defence Accounts or Controller General ofDefence Accounts .

का.नि.आ. 55. - राष्ट्रपति , भारत के संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, सरकारी निवास स्थान आबंटन ( रक्षा लेखा विभाग पूल ) नियम , 1986 को और संशोधित करते हुए निम्नलिखित नियम बनाते हैं, अर्थात्:-
1. ( 1 ) इन नियमों का संक्षिप्त नाम सरकारी निवास स्थान आबंटन ( रक्षा लेखा विभाग पूल ) संशोधन नियम, 2007 है (2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे।
2. सरकारी निवास स्थान आबंटन ( रक्षा लेखा विभाग पूल ) नियम , 1986 में-
( क ) नियम 2 के खण्ड ( ज ) में द्वितीय परन्तुक के बाद निम्नलिखित अंतःस्थापित किया जाएगा , अर्थात्:-
" परन्तु यह और भी कि किसी कार्मिक द्वारा पूर्व में की गई सेवा की गणना पूर्वीकता तारीख के निर्धारण के लिए की जाएगी चाहे कार्मिक ने सेवान्त प्रसुविधाएं जैसे पेंशन और ग्रेच्यूटी ले लिए हैं तथा पूर्वीकता की तारीख के अवधारण करने के लिए पूर्व की कुल सेवा में से सेवा में व्यवधान की अवधि घटा दी जाएगी"।
(ख ) नियम 3 में: -
( i ) उप नियम ( 2 ) के स्थान पर निम्नलिखित रखा जाएगा , अर्थात्: -
( 2 ) कोई अधिकारी अपने ड्यूटी स्थान या उससे लगी हुई नगरपालिका क्षेत्र में अपने या अपने परिवार के किसी सदस्य के नाम से मकान का स्वामी है, सरकार द्वारा समय - समय पर विनिर्दिष्ट ऐसे लाइसेंस शुल्क का भुगतान करके वह इन नियमों के अधीन सरकारी आवास के आबंटन का पात्र होगा किन्तु उपर्युक्त आबंटन आवास की उपलब्धता पर निर्भर करेगा।
( ii ) उपनियम ( 3 ) के स्थान पर निम्नलिखित प्रतिस्थापित किया जाएगा , अर्थात्: -
(3) " जहां , इन नियमों के अधीन किसी अधिकारी को सरकारी निवास स्थान के आबंटन के पश्चात् आबंटित कर दिया जाता है , वह या उसके कुटुम्ब का कोई अन्य सदस्य उसके ड्यूटी स्थल या उससे संलग्न नगरपालिका क्षेत्र में मकान का निर्माण करता है अथवा मकान का स्वामी बन जाता है , वहां ऐसा अधिकारी सरकार द्वारा समय समय पर विनिर्दिष्ट लाइसेंस शुल्क का भुगतान करने , मकान पूर्ण होने या किराए पर दिए जाने या काबिज होने , जो भी पहले हो, की तारीख से एक मास के भीतर इसकी सूचना सम्पदा अधिकारी या आबंटन प्राधिकारी को देगा " । ( ग ) नियम 7 के खण्ड ( ग ) के बाद निम्नलिखित अंतःस्थापित किया जाएगा , अर्थात्: -
(घ) " इन नियमों में किसी बात के होते हुए भी , सा.नि. 317 - बी-8 और भारत सरकार , शहरी विकास मेत्रालय , सम्पदा निदेशालय के तारीख 6 नवम्बर , 1984 और तारीख 10 नवम्बर, 1987 के कार्यालय ज्ञापन सं. 12035 ( 6 )/ 83- पीओएल -11 में अंतर्विष्ट उपबंधों के अनुसार स्टेशन पर क्वार्टरों की आपूर्ति तथा मांग के आधार पर सम्पदा अधिकारी महिलाओं के लिए एक पृथक पूल रेखेंगे । "
(घ ) नियम 9 के उप- नियम 5 के पश्चात् निम्नलिखित उप- नियम अंतःस्थापित किया जाएगा , अर्थात्: -
" (6) आरक्षित या नियुक्ति आवास विभाग द्वारा आरक्षित या नियुक्ति निवास स्थान के रूप में विशिष्ट रिहायशी निवास स्थान (टाइप -5 या टाइप -6) को अधिसूचित कर सकेगा जो उसी पदधारी को आबंटित हो सकेगा जिस पद के लिए आवास आरक्षित किया गया है ।
(7 ) पद का पदधारी , जिसके लिए आरक्षित निवास स्थान निश्चित किया गया है , पदधारिता की अवधि में आवास का काबिज माना जाएगा जब तक कि इन नियमों के अधीन आबंटन को बदल नहीं दिया जाता या निलंबित नहीं कर दिया जाता ।
( 8 ) कोई आरक्षित या नियुक्ति निवास स्थान पर उस अधिकारी द्वारा अधिभोग आशयित है जो वास्तव में उस पर पर है । बंटन केवल पदधारिता की अवधि के दौरान ही अस्तित्व में रहेगा तथा पदधारिता में बदलाव के तत्काल पश्चात् से उत्तराधिकारी पदधारी के निवास स्थान का आबंटिती हो जाता है । सामान्यतया उत्तराधिकारी पदधारी के लिए यह आवश्यक हो जाता है कि वह निवास स्थान का तत्काल कब्जा ले । इन बातों के होते हुए भी बाहर जाने वाले पदधारी या उसके परिवार को वित्तीय नियम , 45 के अधीन किराए का भुगतान करने पर सक्षम प्राधिकारी द्वारा एक माह की अवधि के लिए निवास स्थान को रखने की अनुमति दी जा सकती है; परन्तु, पद के नए पदधारी के हितों के विपरीत न होगा और निवास स्थान को आसानी से दिया जा सके तथा इसमें सरकार को कोई राजस्व हानि या अतिरिक्त लागत निहित न हो ।
(9 ) उन मामलों में जहां अधिकारी को परिवार निवास स्थान हेतु वर्जित स्टेशन पर तैनात किया जाता है तथा वह अपने पररिवार को पिछले ड्यूटी स्थान पर रखने का हकदार है तो उसे उपलब्धता के अनुसार वैकल्पिक उपयुक्त निवास स्थान उपलब्ध कराया जाएगा (अधिकारी को आबंटित निवास स्थान के टाइप का ध्यान दिए बिना ) 265 भारत का सजपत्र अवशृंबर 6, 2007/आश्विन 14, 1929

( 10 ) पद के पदधारी के लिए जिसके लिए कोई विशेष घर/निवास स्थान आरक्षित किया गया है, यह अनिवार्य होगा कि वह ऐसे आवास का कब्जा ले ।
(ड ) नियम 16 के पश्चात् निम्नलिखित परन्तुक अंतःस्थापित किया जाएगा , अर्थात्:-

S.R.O. 55. In exercise of the powers conferred by proviso to article 309 ofthe Constitution , the President hereby makes the following rules further to amend the Allotment of Government Residences (Defence Accounts Department Pool) Rules 1986, namely:-
1.(1) These rules may be called the Allotment of Government Residences (Defence Accounts Department Pool) Amendment Rules, 2007.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Allotment of Government Residences (Defence Accounts Department Pool) Rules, 1986.
) In rule 2, in clause (h ) , after the Second , proviso , the following shall be inserted, namely:
(a "Provided also that past service rendered by an employee shall be counted for the purpose of determining the date ofpriority even if the officer has drawn terminal benefits like pension and gratuity and periods of break in service shall be deducted from the total of the past service for determining date ofpriority";
(b) In rule 3.
(i ) for sub-rule (2) the followingshall be substituted namely :-
"(2) An officer owning a house either . in his name or in the name ofany ofhis family members at the place ofhis duty or in an adjoining Municipality shall be eligible for allotment of Government accommodation under these rules, on payment of such licence fee as may be specified by Government from time to time provided that the above allotment will be subject to availability of accommodation"
(ii) for sub rule (3), the following shall be substituted namely:
(3) "Where, after a Government accommodation has been allotted to an officer under these rules , he or any 'other member of his family constructs a house or becomes owner of a house at the place of his duty or in an adjoining Municipality, such officer shall notify the fact to the Estate Officer or Allotting Authority within a period of one month from the date on which house is completed or let out or occupied, whichever is earlier on payment of such licence fee as may be specified by Government from time to time" (c) after clause (c) of rule 7, the following shall be inserted namely:-
"(d) Notwithstanding anything contained in these rules, the Estate Officers shall maintain a separate pool for ladies depending upon the supply and demand of the quarters in the station as per the provisions contained in S.R 317-B-8 and Government of India, Ministry of Urban Development, Directorate of Estates, OM No.12035(6)/ 83-Pol - II dated 10th November 1987 and dated 6th November 1984 " .
(d) after sub rule 5 of rule 9, the following sub rule shall be inserted , namely :-
"(6) Reserved or Appointment accommodation.- The Department may. , notify specific residential accommodations Type- V or VI ) as reserved or appointment accommodations which will be allotted to the respective incumbents ofthe post for which the accommodation has been reserved.
(7) The incumbent of the post for whom the reserved accommodation has been earmarked shall be considered to be in occupation of the residence.during the period of his incumbency unless the allotment is changed or suspended under these rules .
(8) Areserved or appointment accommodation his intended for occupation by the officer who actually holds the post.The allotment subsists only during the period of incumbency and immediately on change of incumbency, the successor incumbent becomes the allottee of the residence in question. It will therefore, normally be necessary for the successor incumbent to occupy the residence immediately after taking over. Notwithstanding [PART II-SEC. 4] 266

these considerations , the outgoing incumbent of the post or his family, can be permitted by the Competent authorityto retain such accommodation for a period of one month on payment of rent under FR - 45A, provided that it is not detrimental to the interest of the new incumbent of that post and the accommodation can be conveniently spared and it does not involve any loss of revenue or extra cost to the Government .
(9) In cases where the officer is posted to non- family station and is entitled to retain his or her family at the last duty station , alternate suitable accommodation may be provided as per availability (irrespective of the type of accommodation allotted to the officer) .
(10) It would be mandatory for the incumbent of the post for which a particular house /accommodation has been reserved to occupy such accommodation;
(e) after rule 16, the following proviso shall be inserted, namely:-
"Provided that retention of accommodation at the old duty station in the event of transfer to non - family stations as may be specified from time to time will be governed by separate orders issued by the Government of India from time to time" .

का.नि.आ. 59 - राष्ट्रपति , संविधान के अनुच्छेद , 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , तटरक्षक संगठन समूह ' ग ' और समूह ' घ ' अग्निशमन कर्मचारिवृंद भर्ती नियम , 2006 का संशोधन करने के लिए निम्नलिखित नियम बनाते हैं, अर्थात्:
1. ( 1 ) इन नियमों का संक्षिप्त नाम तटरक्षक संगठन समूह ' ग ' और समूह ' घ ' अग्निशमन कर्मचारिवृंद भर्ती ( संशोधन ) नियम, 2007 हैं । (2) ये राजपत्र में उनके प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. तटरक्षक संगठन समूह ' ग ' और समूह ' घ ' अग्निशमन कर्मचारिवृंद भर्ती नियम , 2006 की अनुसूची में, -
( 1 ) दमकल ड्राइवर के पद से संबंधित क्रम सं. 2 के सामने, स्तम्भ 8 में, " आवश्यक " शीर्ष के अधीन , " उसके पास भारी यान चलाने की चालन अनुज्ञप्ति हो और कम से कम तीन वर्ष का भारी यान चलाने का अनुभव हो " प्रविष्टि के स्थान पर, निम्नलिखित रखा जाएगा , अर्थात्: - " उसके पास भारी यान चलाने की चालन अनुज्ञप्ति हो और किसी निजी या सरकारी संगठन/संस्था में कम से कम तीन वर्ष का भारी यान चलाने का अनुभव हो"
(2) फायरमैन , श्रेणी-2 के पद से संबंधित क्रम सं. 4 के सामने , स्तम्भ 8 में, विद्यमान प्रविष्टि के स्थान पर निम्नलिखित रखा जाएगा , अर्थात्: -
" (क ) आठवीं कक्षा या समतुल्य उत्तीर्ण होनी चाहिए ।
(ख) श्रमसाध्य कर्तव्यों के पालन करने में शारीरिक रूप से योग्यता और सक्षमता होनी चाहिए। श्रमसाध्य कर्तव्यों को निम्नलिखित शारीरिक मानकों के रूप में परीक्षण किया जाएगा : -
( i ) बिना जूते ऊंचाई-165 सेंटीमीटर । परन्तु यह कि अनुसूचित जनजाति और पहाड़ी इलाकों के अभ्यर्थियों के सदस्यों के लिए 2.5 सेंटीमीटर की रियायत दी जाएगी । 269 [ भाग II-खण्ड4]

(ii ) छाती (बिना फुलाए ) -81.5 सेंटीमीटर ।
(iii ) छाती (फुलाकर ) -85 सेंटीमीटर ।

(v ) क्षमता परीक्षण :
( 1) फायरमैन द्वारा 65.5 किलोग्राम के वजन के आदमी को 96 सैकेंड के भीतर 183 मीटर की दूरी तक उठाकर ले जाना ।
(2) 2.7 मीटर चौड़ी खाई दोनों पैर पार करना ( लम्बी कूदान ) ।
(3 ) हाथ और पैर का प्रयोग करते हुए 3 मीटर उर्ध्याकार रस्सी पर चढ़ना । "

1. ( 1) These rules may be called the Coast Guard Organisation Group ' C ' and Group ' D ' Fire Fighting Staff Recruitment (Amendment) Rules , 2007.
(2) They shall come into force on the date of their publication in the Official Gazette .
2006- 2. In the Schedule to the Coast Guard Organisation Groups ' C' and ' D ' Fire Fighting Staff Recruitment Rules , (i) against serial number 2, relating to the post of Fire Engine Driver , in column 8 , under the heading "Essential" , for the entry "Must be possessing heavy vehicle driving licence with at least three years experience of driving heavy vehicles " , the following shall be substituted, namely:-
"Must be possessing heavy vehicle driving licence with at least three years experience of driving heavy vehicles in any of private or Government organisation/ Institute ."
(ii) against serial number 4, relating to the post of Fireman Grade II , in column 8 , for the entries , the following shall be substituted , namely:
"(a) Must have passed 8th class examination or equivalent.
(b) Must be physically fit and capable of performing strenuous duties . The strenuous duties will be tested as per following physical standards :-
(1) Height without shoes - 165 Cms . provided that a concession of 2.5 Cms in height shall be allowed for members ofthe Scheduled Tribes and candidates of hilly areas.
(ii) Chest (unexpanded) -81.5 Cms
(iii) Chest (on expansion) - 85 Cms
(iv) Weight - 50 Kg (Min.)
(v) Endurance Test :
(1) Carrying a man weighing 63.5 Kgs by fireman lift up to a distance of 183 metres within 96 seconds.
(2) Clearing 2.7 metres wide ditch by landing on both feet (long jump )
(3) Climbing 3 metres vertical rope by hands and feet.
