आ. अ. 60. जबकि निर्वाचन आयोग का समाधान हो गया है कि नीचे की सारणी ( 2 ) में यथा विनिर्दिष्ट उत्तराखण्ड राज्य से विधान सभा के साधारण निर्वाचन के लिए जो स्तम्भ ( 3 ) में विनिर्दिष्ट निर्वाचन क्षेत्र से हुआ है , स्तम्भ ( 4 ) में उसके सामने विनिर्दिष्ट निर्वाचन लड़ने वाला प्रत्येक अभ्यर्थी, लोक प्रतिनिधित्व अधिनियम , 1951 तथा तद्धीन बनाए गए नियमों द्वारा अपेक्षित उक्त सारणी के स्तम्भ ( 5 ) में यथा दर्शित अपने निर्वाचन व्ययों का लेखा दाखिल करने में असफल रहा है ;
और जबकि, उक्त अभ्यर्थियों ने सम्यक् सूचना दिए जाने पर भी उक्त असफलता के लिए या तो कोई कारण अथवा स्पष्टीकरण नहीं दिया है या उनके द्वारा दिए गए अभ्यावेदनों पर यदि कोई हो , विचार करने के पश्चात् निर्वाचन आयोग का यह समाधान हो गया है कि उनके पास उक्त असफलता के लिए कोई पर्याप्त कारण या न्यायोचित्य नहीं है ;
अतः , अब, निर्वाचन आयोग एतद्द्वारा उक्त अधिनियम की धारा 10 - क के अनुसरण में नीचे की सारणी के स्तम्भ ( 4 ) में विनिर्दिष्ट व्यक्तियों को संसद के किसी भी सदन के या किसी राज्य/ संघ राज्य क्षेत्र की विधान सभा अथवा विधान परिषद् के सदस्य चुने जाने और होने के लिए इस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निरर्हित घोषित करता है।

O.N. 60. Whereas , the Election Commission is satisfied that each of the contesting candidates specified in column(4) of the table below at the General Elections to the Legislative Assembly in the State of Uttarakhand as specified in column (2) held from the Constituency specified in column (3 ) against his name has failed to lodge the account of his election expenses as required by the Representation of the People Act, 1951 and the rules made thereunder as shown in column (5) of the said table;
And, whereas , the said candidates have either not furnished any reason or explanation for the said failure even after due notices and/or the Election Commission , after considering the representation made by them , if any , is satisfied that they have no good reason or justification for the said failure ;
Now, therefore, in pursuance of Section 10A of the said Act, the Election Commission hereby declares the persons specified in column (4) of the table below to be disqualified for being chosen as , and for being a member of either house of the Parliament or of the Legislative Assembly or Legislative Council of a State /Union Territory for a period of three years from the date of this order:

आ. अ. 61.-यतः , पश्चिम बंगाल विधान सभा उप निर्वाचन , 2006 में पश्चिम बंगाल राज्य के 85 - बोंगांव विधान सभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले अभ्यर्थी श्री विस्वेस्वर मोण्डल , रातेपाडा, चंपक सारणी , पो.आ. तथा पुलिस थाना बोंगांव , जिला उत्तर 24 परगना, पं. बंगाल , ने लोक प्रतिनिधित्व अधिनियम 1951 तथा तद्धीन बनाए गए नियमों द्वारा अपेक्षित, अपने निर्वाचन व्ययों का कोई लेखा दाखिल नहीं किया है ;
और यतः , श्री बिस्वेस्वर भोण्डल ने निर्वाचन आयोग द्वारा सम्यक सूचना दिए जाने पर भी उक्त असफलता का कोई कारण अथवा स्पष्टीकरण नहीं दिया है ;
और यतः , निर्वाचन आयोग का यह समाधान हो गया है कि उक्त अभ्यर्थी के पास उक्त असफलता का कोई पर्याप्त कारण या न्यायोचित्य नहीं है ,
अतः , अब , निर्वाचन आयोग उक्त अधिनियम की धारा 10 - क के अनुसरण में एतद्वारा श्री विस्वेसवर मोण्डल को संसद के किसी भी सदन के या किसी राज्य/संघ राज्य क्षेत्र की विधान सभा अथवा विधान परिषद् के सदस्य चुने जाने और होने के लिए इस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निरर्हित घोषित करता है ।

Whereas , Shri Bisweswar Mondal , Ratepara , Champak Sarani, P.O & P.S Bongaon , Dist: North 24 Parganas, (WB) , a contesting candidate in the Bye Election to the West Bengal Legislative Assembly, 2006 held from 85-Bongaon Assembly Constituency in the State of West Bengal has failed to lodge any account of his election expenses , as required by the Representation of the People Act, 1951 and the Rules made thereunder;
Andwhereas , Shri Bisweswar Mondal has not furnished any reason or explanation for the said failure even after due notice of the Election Commission;
Andwhereas, the Election Commission is satisfied that the said candidate has no good reason or justification for the said failure;
Now, therefore, in pursuance of Section 10 -A of the said Act, the Election Commission hereby declares Shri Bisweswar Mondal to be disqualified for being chosen as and for being a member of either House of the Parliament or of the Legislative Assembly or Legislative Council of a State/Union Territory for a period of 3 years from the date of this order.

आ. अ. 63.-यत 2 - मोरमुगाओ संसदीय निर्वाचन क्षेत्र से निर्वाचित श्री अलेमाओ चर्चिल के त्याग पत्र देने के कारण उत्पन्न हुई रिक्ति को भरने के लिए आयोग की दिनांक 5 अक्टूबर , 2007 की अधिसूचना सं. 100/गोवा- लो.सं. / 1 / 2007 द्वारा लोक सभा के उप निर्वाचन का कार्यक्रम अधिसूचित कर दिया गया था; और
2. यतः , दिनांक 13 अक्तूबर , 2007 नाम निर्देशन की संवीक्षा की तारीख , दिनांक 15 अक्टूबर , 2007 अभ्यर्थिताएं वापस लेने की अंतिम तारीख तथा दिनांक 30 अक्तूबर , 2007 ऐसी तारीख के रूप में नियत की गई, जिसे यदि आवश्यक हुआ तो मतदान होगा; और 3. यतः , गोवा सरकार ने परक्राम्य लिखत अधिनियम , 1881 ( 1881 का 26 ) के अधीन अपनी दिनांक 12 अक्टूबर , 2007 की अधिसूचना सं. 02/02/2006- जी. ए. डी. एच. के द्वारा 13 अक्टूबर , 2007 ( शनिवार ) को ईद-उल-फितर के कारण सार्वजनिक अवकाश घोषित करदिया है;
4. अतः , अब , साधारण खण्ड अधिनियम , 1897 ( 1897 का 10 ) की धारा 21 के साथ पठित लोक प्रतिनिधित्व अधिनियम , 1951 (1951 का 43 ) की धारा 30 के अनुसरण में भारत निर्वाचन आयोग एतद्वारा उक्त निर्वाचन के संबंध में निम्नलिखित आवश्यक परिर्वतन करता है :-
(क) नाम निर्देशन की संवीक्षा की तारीख
15-10-2007 ( सोमवार ) (ख) अभ्यर्थिताएं वापस लेने की अंतिम तारीख
17-10-2007 ( बुधवार) (ग ) वह तारीख जिसको यदि आवश्यक हुआ तो मतदान होगा
31-10-2007 ( बुधवार ) 5. कार्यक्रम की उपरोक्त परिवर्तित अवस्थाएं 12 अक्टूबर , 2007 से प्रभावी माने जाएंगे ।

O.N. 63. Whereas , a schedule for the bye -election to the House of the People for filling the vacancy caused by resignation of Shri Alemao Churchill, elected from 2 - Mormugao Parliamentary Constituency , was notified vide Commission's Notification No. 100/GOA-HP/ 1/2007, dated 5th October, 2007; and
2. Whereas, the 13th October, 2007 has been fixed as the date for scrutiny of nominations , 15th October , 2007 as the last date for the withdrawal of candidatures and 30th October, 2007 as the date on which a poll shall , if necessary, be taken; and
3.Whereas , the Government ofGoa has declared 13th October , 2007 (Saturday) as a " public holiday" on account of " Id-ul - Fitr " under Negotiable Instrument Act, 1881 (26 of 1881 ) vide its Notification No. 2/2/2006-GAD-H , dated 12th October , 2007;
4.Now, therefore, in pursuance of Section 30 of the Representation of the People Act, 1951 (43 of 1951) read with Section 21 of the General Clauses Act, 1897 (10 of 1897) , the Election Commission of India hereby re -appoints to the extent necessary, with respect to the said election : -
(a) the 15th October, 2007 (Monday) as the date for the scrutiny of nominations;
(b) the 17th October, 2007( Wednesday) as the date for withdrawal of candidatures ; and
(c) the 31st October , 2007 ( Wednesday) as the date on which a poll shall , if necessary, be taken;
5. The above revised stages of the schedule shall be deemed to have taken effect from 12th October, 2007 .
