सा.का.नि. 227. केन्द्रीय सरकार , सीमा सुरक्षा बल अधिनियम , 1968 ( 1968 का 47 ) की धारा 141 की उप- धारा ( 2 ) के खण्ड ( ख ) और ( ग ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , सीमा सुरक्षा बल ( इंजीनियरी अधिकारी ) भर्ती नियम , 2000 का और संशोधन करने के लिए निम्नलिखित नियम बनाती है ; अर्थात्:-

1. ( 1 ) इन नियमों का संक्षिप्त नाम सीमा सुरक्षा बल ( इंजीनियरी अधिकारी ) भर्ती ( संशोधन ) नियम , 2007 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. सीमा सुरक्षा बल ( इंजीनियरी अधिकारी ) भर्ती नियम 2000 की अनुसूची में : -

( 1 ) अधीक्षक इंजीनियर/कमांडेंन्ट के पद से संबंधित क्रम संख्यांक के सामने:-

(क) स्तम्भ 1 के अधीन , विद्यमान प्रविष्टियों के स्थान पर , निम्नलिखित प्रविष्टियां रखी जाएंगी , अर्थात्:-

"कमांडेन्ट ( संकर्म) । " ;

(ख) स्तम्भ 2 के अधीन , विद्यमान प्रविष्टियों के स्थान पर, निम्नलिखित प्रविष्टियां रखी जाएंगी, अर्थात्:-

"*03(तीन) (2007)

*कार्यभार के आधार पर परिवर्तन किया जा सकता है । ";

(ग) स्तम्भ 5 में , विद्यमान शीर्षक के स्थान पर , निम्नलिखित शीर्षक रखा जाएगा , अर्थात्:-

" चयन पद या अचयन पद । " ;

(घ) स्तम्भ 5 के अधीन विद्यमान प्रविष्टियों के स्थान पर निम्नलिखित प्रविष्टयां रखी जाएंगी , अर्थात्:-- "चयन ।";

(ङ) स्तम्भ 11 के शीर्षक में " पदों का प्रतिशत " शब्दों को " रिक्तियों का प्रतिशत " शब्दों द्वारा प्रतिस्थापित किया जाएगा;

( च) स्तम्भ 11 के अधीन , विद्यमान प्रविष्टियों के स्थान पर, निम्नलिखित प्रविष्टियां रखी जाएंगी , अर्थात्:-

" 33-1/3% प्रोन्नति द्वारा , जिसके न हो सकने पर प्रतिनियुक्ति द्वारा;

66-2/3% प्रतिनियुक्ति द्वारा;

(छ) स्तम्भ 12 के अधीन विद्यमान प्रविष्टियों के स्थान पर , निम्नलिखित प्रविष्टियां रखी जाएंगी:-

L प्रोन्नति:

ऐसा सेकेंड - इन- कमांड ( संकर्म ) जिसने समूह ' क ' में पन्द्रह वर्ष सेवा या समूह ' क ' और समूह ' ख ' ( राजपत्रित ) सेवा में बीस वर्ष की सम्मिलित सेवा की हो जिसमें से कम से कम दो वर्ष नियमित सेवा सेकेन्ड - इन-कमांड (संकर्म) की श्रेणी में की हो और जिसके पास सिविल इंजीनियरी में डिग्री हो ।

IL प्रतिनियुक्ति:

(क) केन्द्रीय अर्द्ध सैनिक बलों के ऐसे अधिकारी :-

(i ) जिन्होंने नियमित आधार पर सदृश पद धारण किया हुआ है , या 12000-375-16500 रु. की श्रेणी में दो वर्ष सेवा की है और समूह ' क' में पन्द्रह वर्ष की सेवा या समूह ' क ' और समूह ' ख ' राजपत्रित में बीस वर्ष की सम्मिलित सेवा की हो ; और

(ii ) जिसके पास सिविल इंजीनियरी में डिग्री है ; और

(iii ) सिविल संकर्म के निष्पादन में दस वर्ष का अनुभव ।

(ख) केन्द्रीय सरकार या राज्य सरकार के ऐसे अधिकारी : -

(i ) जिन्होंने नियमित आधार पर सदृश पद. धारण किया हुआ है , या जिन्होंने 12000-375-16500 रु. के या समतुल्य वेतनमान में उस श्रेणी में पाँच वर्ष नियमित सेवा की है ; और

( ii ) जिसके पास सिविल इंजीनियरी में डिग्री है ; और

(iii ) सिविल संकर्म के निष्पादन में दस वर्ष का अनुभव ।

(पोषक प्रवर्ग के ऐसे विभागीय अधिकारी , जो प्रोन्नति की सीधी पंक्ति में हैं , प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे । इसी प्रकार प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे । प्रतिनियुक्ति की अवधि , जिसके अन्तर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्तिकी अवधि साधारणतया तीन वर्ष से अधिक नहीं होगी । प्रतिनियुक्ति द्वारा नियुक्ति के लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 52 वर्ष से अधिक नहीं होगी । )

(2) कार्यपालक इंजीनियर ( सिविल ) /सेकेंड- इन- कमाण्ड के पद से संबंधित क्रम संख्यांक 2 के सामने :-

"सेकेन्ड- इन- कमांड ( संकर्म ) । ";

( ख ) स्तम्भ 2 के अधीन , विद्यमान प्रविष्टियों के स्थान पर , निम्नलिखित प्रविष्टियां रखी जाएंगी , अर्थात्: -

" *02 (दो) (2007 )

*कार्यभार के आधार पर परिवर्तन किया जा सकता है । " ;

(ग ) स्तम्भ 5 के अधीन , विद्यमान प्रविष्टियों के स्थान पर , निम्नलिखित प्रविष्टियां रखी जाएंगी , अर्थात्:-

"चयन ।";

L प्रोन्नति :

ऐसा उप कमांडेंट ( संकर्म ) जिसने समूह ' क ' में ग्यारह वर्ष की सेवा की हो या समूह ' क' और समूह ' ख' ( राजपत्रित ) में सम्मिलित सोलह वर्ष सेवा की हो जिसमें से कम से कम दो वर्ष नियमित सेवा उप कमांडेंट ( संकर्म) की श्रेणी में की हो ।

II प्रतिनियुक्ति:

(क) केन्द्रीय अर्द्ध सैनिक बलों के ऐसे अधिकारी:-

(i ) जिन्होंने नियमित आधार पर सदृश पद धारण किए हुए हैं, या 10,000-15,200 रु. की श्रेणी में दो वर्ष नियमित सेवा की हो और समूह ' क ' में ग्यारह वर्ष की सेवा या समूह ' क ' और समूह 'ख ' राजपत्रित में सोलह वर्ष की सम्मिलित सेवा की हो; और

( ii ) जिनके पास सिविल इंजीनियरी में डिग्री है; और

(iii ) सिविल संकर्म में दस वर्ष का अनुभव ।

(ख) केन्द्रीय सरकार या राज्य सरकार के ऐसे अधिकारी : -

(i ) जिन्होंने नियमित आधार पर सदृश पद धारण किए हुए हैं , या 10,000-15,200 रु. के वेतनमान में पांच वर्ष की नियमित सेवा की हो; और

(ii ) जिनके पास सिविल इंजीनियरी में डिग्री है; और

( iii ) सिविल संकर्म के निष्पादन में दस वर्ष का अनुभव ।

(पूर्व पद के मानक के अनुसार पोषक प्रवर्ग के ऐसे विभागीय अधिकारी , जो प्रोन्नति की सीधी पंक्ति में हैं , प्रतिनियुक्तिपर नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे । इसी प्रकार , प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे । प्रतिनियुक्ति की अवधि, जिसके अन्तर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवधि साधारणतया तीन वर्ष से अधिक नहीं होगी । प्रतिनियुक्ति द्वारा नियुक्ति के लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 52 वर्ष से अधिक नहीं होगी ) ।

(3) कार्यपालक इंजीनियर ( सिविल )/उप कमांडेन्ट के पद से संबंधित क्रम संख्यांक 3 के सामने :-

(क ) स्तम्भ 1 के अधीन , विद्यमान प्रविष्टियों के स्थान पर, निम्नलिखित प्रविष्टियां रखी जाएंगी , अर्थात्:-

" उप कमांडेन्ट ( संकर्म ) । ";

( ख) स्तम्भ 2 के अधीन, विद्यमान प्रविष्टियों के स्थान पर , निम्नलिखित प्रविष्टियां रखी जाएंगी , अर्थात्:-

" *05 ( पांच) (2007 )

*कार्यभार के आधार पर परिवर्तन किया जा सकता है । " ;

(ग) स्तम्भ 5 में विद्यमान प्रविष्टियों के स्थान पर, निम्नलिखित प्रविष्टियां रखी जाएंगी, अर्थात्:-

"चयन ।";

(घ) स्तम्भ 11 के अधीन , विद्यमान प्रविष्टियों के स्थान पर, निम्नलिखित प्रविष्टियां रखी जाएंगी, अर्थात्: - " प्रोन्नति द्वारा , जिसके न हो सकने पर प्रतिनियुक्ति द्वारा । ";

(ङ) स्तम्भ 12 के अधीन विद्यमान प्रविष्टियों के स्थान पर, निम्नलिखित प्रविष्टियां रखी जाएंगी , अर्थात्:-

L प्रोन्नति:

II प्रतिनियुक्ति:

(क) अर्द्ध सैनिक बलों के ऐसे अधिकारी:-

(i ) जिन्होंने नियमित आधार पर सदृश पद धारण किये हुए हैं, या 8000-13500 रु. की श्रेणी में छह वर्ष नियमित सेवा की है ; या समूह ' क ' और समूह ' ख ' राजपत्रित में ग्यारह वर्ष की सम्मिलित सेवा को हो ।

(ii ) जिसके पास सिविल संकर्म के निष्पादन में आठ वर्ष का अनुभव है , या

(ख) केन्द्रीय सरकार या राज्य सरकार के ऐसे अधिकारी:-

(i ) जिन्होंने नियमित आधार पर सदृश पद धारण किए हुए हैं, या 8000-13500 रु. की श्रेणी में छह वर्ष नियमित सेवा की है या 6500-10500 रु. के या समतुल्य वेतनमान की उस श्रेणी में दस वर्ष नियमित सेवा की है; और

(ii ) जिनके पास सिविल इंजीनियरी में डिग्री है; और

(iii) सिविल संकर्म के निष्पादन में आठ वर्ष का अनुभव ।

(4 ) सहायक इंजीनियर ( सिविल ) /सहायक कमांडेंट से संबंधित क्रम संख्यांक 4 के सामने:--

(क) स्तम्भ 1 के अधीन , विद्यमान प्रविष्टियों के स्थान पर, निम्नलिखित प्रविष्टियां रखी जाएंगी , अर्थात्:-

" सहायक कमांडेंट (संकर्म ) । ";

(ख ) स्तम्भ 2 के अधीन , विद्यमान प्रविष्टियों के स्थान पर , निम्नलिखित प्रविष्टियां रखी जाएंगी , अर्थात्:-

*23 (तेईस ) ( 2007)

*कार्यभार के आधार पर परिवर्तन किया जा सकता है । " ;

(ग ) स्तम्भ 3 के अधीन , विद्यमान प्रविष्टियों के स्थान पर , निम्नलिखित प्रविष्टियां रखी जाएंगी , अर्थात्: - " साधारण केन्द्रीय सेवा , समूह ' क' राजपत्रित , अननुसचिवीय इंजीनियरी ( योधक ) । " ;

(घ) स्तम्भ 4 के अधीन , विद्यमान प्रविष्टियों के स्थान पर, निम्नलिखित प्रविष्टियां रखी जाएंगी , अर्थात्:- "8000-275-13500 रु.";

(ङ) स्तम्भ 5 में , विद्यमान प्रविष्टियों के स्थान पर , निम्नलिखित प्रविष्टियां रखी जाएंगी , अर्थात्:- "चयन । ";

(च ) स्तम्भ 8 के अधीन , विद्यमान प्रविष्टियों के स्थान पर , निम्नलिखित प्रविष्टियां रखी जाएंगी अर्थात्:-

(क) " किसी मान्यता प्राप्त संस्था/विश्वविद्यालय से सिविल इंजीनियरी में डिग्री । " ;

(ख ) शारीरिक मापदंड अभ्यर्थियों के लिए न्यूनतम अपेक्षाएं निम्नवत् है :

पुरुष

ऊंचाई 165 से.मी.

सीना ( बिना फुलाए ) 81 से.मी.

(5 से.मी. न्यूनतम विस्तार सहित )

( ii) अभ्यर्थी को अंतर्जानु, स्पाट पैर, स्फीत सिरा या तिर्यक आंखों वाला नहीं होना चाहिए और उनकी उच्च दृष्टिरंग दृष्टि होनी चाहिए । अभ्यर्थियों की इशारा के परीक्षण और साथ ही एन्डरिच - ग्रीन लेंटर्न परीक्षण रंग दृष्टिकी जांच की जाएंगी । उन्हें मानसिक और शारीरिक रूप से अच्छे स्वास्थ्य का होना चाहिए और उन्हें किसी भी शारीरिक विकृति का नहीं होना चाहिए जिससे कर्त्तव्यों के दक्ष पालन में व्यवधान हो । (घ ) शारीरिक दक्षता परीक्षण लिखित परीक्षा और साक्षात्कार में अर्ह होना चाहिए ।

(छ) स्तम्भ-11 के अधीन , विद्यमान प्रविष्टियों के स्थान पर, निम्नलिखित प्रविष्टियां रखी जाएंगी , अर्थात्:- "66-2/3% प्रोन्नति द्वारा जिसके न हो सकने पर प्रतिनियुक्ति द्वारा 33-1 /3 % सीधी भर्ती द्वारा , "

(ज) स्तंभ-12 केअधीन , विद्यमान प्रविष्टियों के स्थान पर, निम्नलिखित प्रविष्टियां रखी जाएंगी ।

Ⅰ. प्रोन्नति:

ऐसे निरीक्षक ( संकर्म ) जिसने उस श्रेणी में तीन वर्ष नियमित सेवा की है ।

टिप्पण:-6500-200-10500 रु. की श्रेणी में तीन वर्ष नियमित सेवा वाले सहायक इंजीनियर ( सिविल ) सहायक कमांडेन्ट की श्रेणी में विद्यमान पदधारियों की उपयुक्ता पर भी विभागीय प्रोन्नति समिति द्वारा विचार किया जाएगा । यदि उन्हें उपयुक्त समाना जाता है तो उसे उच्चतर श्रेणी में प्रोन्नत किया गया समझा जाएगा यदि उसे उपयुक्त नहीं समझा जाता है तो उसका मामला प्रत्येक वर्ष पुनिर्विलोकित किया जाएगा , ऐसे समय तक, वह निचली श्रेणी में पदधारण करता रहेगा ।

IL प्रतिनियुक्ति:

(क) अर्द्ध सैनिक बलों के ऐसे अधिकारी:-

(i ) जिन्होंने नियमित आधार पर सदृश पद धारण किया हुआ है , या जिन्होंने 6500-10500 रु. की श्रेणी में तीन वर्ष नियमित सेवा की है ; और

(ii ) सिविल संकर्म के निष्पादन में पांच वर्ष का अनुभव ।

(ख) केन्द्रीय सरकार या राज्य सरकारों के ऐसे अधिकारी:

(i ) जिन्होंने नियमित आधार पर सदृश पद धारण किए हुए हैं या 6500-10500 रु. के वेतनमान में उस श्रेणी में पांच वर्ष नियमित सेवा की है; और

(ii ) जिनके पास सिविल इंजीनियरी में डिग्री है ; और

(iii ) सिविल संकर्म में पांच वर्ष का अनुभव ।

II. प्रतिनियुक्ति:

(क ) केन्द्रीय अर्द्धसैनिक बलों के ऐसे अधिकारी :-

(i ) जिन्होंने नियमित आधार पर सदृश पद धारण किए हुए हैं , या 8000-13500 रु. की श्रेणी में छह वर्ष नियमित सेवा की है , या समूह ' क' और समूह ' ख ' राजपत्रित सेवा में ग्यारह वर्ष की सम्मिलित सेवा कीहो ।

( ii ) विद्युत संकर्म के निष्पादन में आठ वर्ष का अनुभव ।

(ख) केन्द्रीय सरकार या राज्य सरकारों के ऐसे अधिकारी :-

(i ) जिन्होंने नियमित आधार पर सदृश पद धारण किए हुए हैं , या 8000-13500 रु. की श्रेणी में छह वर्ष नियमित सेवा की हो या 6500-10500 रु. या समतुल्य वेतनमान में उस श्रेणी में दस वर्ष नियमित सेवा की हो, और

( ii ) जिसके पास विद्युत इंजीनियरी में डिग्री हो; और

( iii ) विद्युत संकर्म के निष्पादन में आठ वर्ष का अनुभव ।

(पोषक प्रवर्ग के ऐसे विभागीय अधिकारी , जो प्रोन्नति की सीधी पंक्तिमें है , प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे । इसी प्रकार , प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्तिके लिए विचार किए जाने के पात्र नहीं होंगे । प्रतिनियुक्ति की अवधि , जिसके अन्तर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवधि साधारणतया तीन वर्ष से अधिक नहीं होगी । प्रतिनियुक्ति द्वारा नियुक्तिके लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 52 वर्ष से अधिक नहीं होगी । ) 1117 [ भाग II-खण्ड 3(i) ]

( ii ) अभ्यर्थी को अंतर्जानु , स्पाट पैर , स्फीत, सिरा या तिर्यक आंखों वाला नहीं होना चाहिए और उनकी उच्च दृष्टि होनी चाहिए । अभ्यर्थियों की इशारा के परीक्षण और साथ ही एन्डरिच ग्रीन लेंटर्न परीक्षण रंग दृष्टि की जांच की जाएंगी । उन्हें मानसिक और शारीरिक रूप से अच्छे स्वास्थ्य का होना चाहिए और उन्हें किसी भी शारीरिक विकृति का नहीं होना चाहिए जिससे कर्त्तव्यों के दक्ष पालन में व्यवधान हो ।

टिप्पण: 6500-200-10500 रु. की श्रेणी में तीन वर्ष की नियमित सेवा वाले सहायक इंजीनियर (विद्युत) /सहायक कमाण्डेन्ट की श्रेणी में विद्यमान पदधारियों की उपयुक्ता पर भी विभागीय प्रोन्नति समिति द्वारा विचार किया जाऐगा । यदि उसे उपयुक्त समझा जाता है तो उसे उच्चतर श्रेणी में प्रोन्नत किया गया समझा जाएगा । यदि उसे उपयुक्त नहीं समझा जाता है तो उसके मामले का प्रत्येक वर्ष पुर्नविलोकन किया जाएगा , ऐसे समय तक, वह निचली श्रेणी में पदधारण करता रहेगा ।

II. प्रतिनियुक्ति:

(क) अर्द्ध सैनिक बलों के ऐसे अधिकारी : -

(i ) जिन्होंने नियमित आधार पर सदृश पद धारण किया हुआ हैं , या 6500-10500 रु. की श्रेणी में तीन वर्ष नियमित सेवा की हो; ओर

(ii ) विद्युत संकर्म के निष्पादन में पांच वर्ष का अनुभव ।

(ख) केन्द्रीय सरकार/ राज्य सरकारों के ऐसे अधिकारी: -

(i ) जिन्होंने नियमित आधार पर सदृश पद धारण किया हुआ हो या 6500-10500 रु. या समतुल्य वेतनमान में उस श्रेणी में पांच वर्ष नियमित सेवा की हो; और

( ii ) जिनके पास विद्युत इंजीनियरी में डिग्री हो; और

(iii) विद्युत संकर्म के निष्पादन में पांच वर्ष का अनुभव ।

टिप्पण 2: पोषक वर्ग के ऐसे विभागीय अधिकारी , जो प्रोन्नति की सीधी पंक्ति में हैं , प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे । इसी प्रकार , प्रतिनियुक्ति व्यक्तिप्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे ।

सा.का.नि. 228.- केंद्रीय सरकार , सीमा सुरक्षा बल अधिनियम , 1968 ( 1968 का 47 ) की धारा 141 की उपधारा ( 2 ) के खण्ड ( ख) और खण्ड ( ग ) द्वारा प्रदत्त, शक्तियों का प्रयोग करते हुए, सीमा सुरक्षा बल , वायु स्कंध में सूबेदार ( भंडारी ) के योधक पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाती है , अर्थात्: -

1. संक्षिप्त नाम और प्रारम्भ ( 1 ) इन नियमों का संक्षिप्त नाम सीमा सुरक्षा बल , वायु स्कंध सूबेदार ( भंडारी ) भर्ती नियम , 2007 है । (2 ) ये राजपत्र में उनके प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. पद-संख्या , वर्गीकरण और वेतनमान उक्त पद की संख्या , उसका वर्गीकरण और उसका वेतनमान वह होगा , जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ ( 2 ) से स्तंभ (4 ) में विनिर्दिष्ट हैं ।

3. भर्ती की पद्धति , आयु- सीमा , अर्हताएं आदि . उक्त पद पर भर्ती की पद्धति , आयु सीमा , अर्हताएं और उससे संबंधित अन्य बातें वें होंगी जो उक्त अनुसूची के स्तंभ ( 5 ) से स्तंभ ( 14 ) में विनिर्दिष्ट हैं ।

4. निरर्हता-वह व्यक्ति-

(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है , विवाह किया है , या

(ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है , उक्त पदों में से किसी पर नियुक्ति का पात्र नहींहोगा :

परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी ।

5. चिकित्सक दृष्ट्या योग्यता. इन नियमों में किसी बात के होते हुए भी , केवल वे व्यक्ति जो चिकित्सा प्रवर्ग शेप में हैं , इन नियमों के उपबंधों के अधीन नियुक्ति के लिए पात्र होंगे ।

स्पष्टीकरण - इन नियमों के प्रयोजन के लिए , " शेप-1 " से यथा नीचे परिभाषित चिकित्सा प्रवर्ग अभिप्रेत है : -

( i ) कोड अक्षर शेप ( एस.एच.ए.पी.ई. ) जो निम्नलिखित कृत्य का प्रतिनिधित्व करते हैं, द्वारा उपदर्शित दिए गए घटकों के अधीन अधिकारी की योग्यता निर्धारित करने के पश्चात्, चिकित्सा अधिकारी द्वारा किया गया चिकित्सा वर्गीकरण : -

(ii ) प्रत्येक घटक के अधीन किसी अधिकारी की कार्यक्षमता प्रत्येक कोड अक्षर के सामने अंक 1 से 5 तक गिरती कार्यक्षमता उपदर्शित करते हुए दर्शाई जाएगी और कोड अक्षर के पश्चात् अंक लिखे जाएंगे सिवाय उसके द्वारा जहां कोई अधिकारी सभी घटकों में श्रेणी-1 में है , वहां उसका प्रवर्ग एस , एच , ए, पी , ई , लिखने के बजाए शेप -1 लिखकर दर्शाया जा सकेगा , इन अंकों का साधारण मूल्यांकन निम्नानुसार है : -

(का) कहीं भी सभी कर्त्तव्यों के लिए योग्य ।

( ख) सभी कर्त्तव्यों के लिए योग्य किंतु क्या कर्त्तव्यों में तीव्र कठिनाई या दोनों कानों या आंखों की श्रवण शक्ति दृष्टि की तीक्षणता की मांग अंतरग्रस्त है या नहीं, पर निर्भर करते हुए कर्त्तव्यों के प्रकार और नियोजन योग्यता क्षेत्रों के अनुसार परिसीमाएं हो सकती हैं ।

(गः) " एस" घटक को छोड़कर नेमी या निष्क्रिय कर्त्तव्यों के लिए योग्य किंतु उच्च स्थान ( 2700 मीटर से अधिक ) अत्यधिक ठंड क्षेत्रों या पहाड़ी भूखंडों पर और लंबे कर्त्तव्य भारों के लिए नियोजन योग्यता की परिसीमाएं हो सकती हैं ।

(घ ) अस्पताल में भर्ती या बीमारी की छु‌ट्टी के कारण कर्त्तव्यों के लिए अस्थायी रूप से अयोग्य ।

(ङ) कर्त्तव्यों के लिए स्थायी रूप से अयोग्य ।

6. अधिवर्षिता: ( 1 ) इन नियमों के उपबंधों के अधीन नियुक्त किया गया कोई व्यक्ति उस मास के , जिसमें वह सत्तावन वर्ष की आयु प्राप्त करता है , अंतिम दिन के अपराहन में सेवानिवृत्त होगा :

परंतु यह कि वह व्यक्ति, जिसके जन्म की तारीख किसी मास की पहली तारीख होगी , सत्तावन वर्ष की आयु प्राप्त करने के पूर्ववर्ती मास के अंतिम दिन के अपराह्न में सेवानिवृत्त होगा ।

( 2) किसी भी व्यक्ति को सत्तावन वर्ष की सेवानिवृत्ति की आयु के परे सेवा में विस्तार मंजूर नहीं किया जाएगा । 1141

7. शिथिल करने की शक्ति जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके, इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी ।.

8. व्यावृत्तिः: इन नियमों की कोई बात , ऐसे आरक्षण, आयु- सीमा में छूट और अन्य स्यिायतों पर प्रभाव नहीं डालेगी, जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय- समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जन जातियों, भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

टिप्पण 1- पोषक प्रवर्ग के ऐसे विभागीय अधिकारी , जो प्रोन्नति की सीधी पंक्तिमें हैं , प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे । इसी प्रकार प्रतिनियुक्ति व्यक्ति प्रोन्नति द्वारा नियुक्तिके लिए विचार किए जाने के पात्र नहीं होंगे ।

टिप्पण 2- प्रतिनियुक्ति की अवधि , जिसके अन्तर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन/विभाग में इस नियुक्तिसे ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्ति की अवधि है। साधारणतया तीन वर्ष से अधिक नहीं होगी । टिप्पण 3- प्रतिनियुक्ति पर नियुक्ति के लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 52 वर्ष से अधिक नहीं होगी ।

G.S.R. 228. In exercise of the powers conferred by clauses ( b) and (c) of sub - section (2) of Section 141 of the Border Security Force Act , 1968 (47 of 1968 ) , the Central Government hereby makes the following rules , regulating the method of recruitment to the Combatised post of Subedar ( Storeman ) in the Border Security Force , Air Wing, namely:

1. Short title and commencement. ( 1 ) These rules may be called the Border Security Force , Air Wing Subedar (Storeman) Recruitment Rules , 2007.

(2) They shall come into force on the date of their publication in the Official Gazette .

2. Number of post , classification and scale of pay . The number of the said post , its classification and scale of pay attached thereto shall be as specified in columns (2) to (4) of the Schedule annexed to these rules .

3. Method of Recruitment, age limit , qualificaitons etc. The Method of recruitment to the said post, age limit . qualifications and other matters relating thereto shall be as specified in columns ( 5) to ( 14) of the aforesaid Schedule .

4. Disqualification . No person ,-

(a) who , has entered into or contracted a marriage with a person having a spouse living ; or

b) who , having a spouse living, has entered into or contracted a marriage with any person,

( shall be eligible for appointment to the said posts :

Providedthat the Central Government may , if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operation of this rule.

5. Medical Fitness . Notwithstanding any thing contained in these rules , only those persons who are in medical category SHAPE - I , shall be eligible for appointment under the provisions of these rules . Explanation . For the purpose of this rule , " SHAPE - I " means Medical Category defined as under :-

(i) Medical classification done by Medical Officer after assessing fitness of the officer under given factors indicated by the code letters SHAPE , which represent the following function :-

(ii) Functional capacity of an officer under each factor will be denoted by numeral 1 to 5 against each code letter. indicating declining functional efficiency and the numerals will be written next to the code letter , except that where an officer is in Grade - I in all factors , his category may be denoted by writing SHAPE - I instead of writing SHAPE, General evaluation of these numerals is as under:-

(a) Fit for all duties any where .

(d) Temporarily unfit for duties on account of hospitalization or sick leave .

6. Superannuation. ( 1 ) A person appointed under the provisions of these rules shall retire from service on the afternoon of the last day of the month in which he attains the age of fifty seven years :

Providedthat the person whose date of birth is the first of a month shall retire on the afternoon ofthe last day of the preceding month of attaining the age of fifty seven years .

(2) No person shall be granted extension in service beyond the age of retirement of fifty seven years .

7. Power to relax. Where the Central Government is of the opinion that it is necessary or expedient so to do , it may, by order, for reasons to be recorded in writing, relax any of the provisions of these rules with respect to any class orcategory of persons.

8. Saving. Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes, Scheduled Tribes, Other Backward Classes , Ex -Servicemen and other special categories of persons in accordance with the orders , issued by the Central Government from time to time in this regard.

Note III The maximum age limit for appointment by deputation shall not be exceeding 52 years as on the closing date of receipt of applications .

सा.का.नि. 229. - संविधान के अनुच्छेद 148 के खण्ड ( 5 ) के साथ पठित अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुाए , राष्ट्रपति एतद्द्वारा केन्द्रीय सिविल सेवा ( छुट्टी ) नियमावली , 1972 में आगे संशोधन करने के लिए निम्नलिखित नियम बनाते हैं अर्थात्: - 1. (1 ) इन नियमों को केन्द्रीय सिविल सेवा ( छुट्टी ) संशोधन नियमावली , 2007 कहा जाए ।

(2 ) ये सरकारी राजपत्र में उनके प्रकाशन की तारीख से प्रवृत्त होंगे ।

2. केन्द्रीय सिविल सेवा ( छुट्टी ) नियमावली , 1972 में नियम 51 के स्थान पर निम्नलिखित नियम को प्रतिस्थापित किया जाएगा अर्थात्: - "51. अध्ययन छुट्टी की अधिकतम मात्रा ( 1 ) अध्ययन छुट्टी जो केन्द्रीय स्वास्थ्य सेवा अधिकारी को छोड़कर किसी सरकारी कर्मचारी को स्वीकृत की जा सकती है , की अधिकतम मात्रा निम्न प्रकार होगी-

(क) किसी एक समय में साधारणतयाः बारह माह; तथा

(ख ) उसकी पूरी सेवा के दौरान , कुल मिलाकर चौबीस माह ( इसमें अध्ययन अथवा अन्य किसी नियम के अंतर्गत स्वीकृत किए गए प्रशिक्षण हेतु इसी प्रकार की छुट्टियां शामिल हैं ) ।

2. केन्द्रीय स्वास्थ्यसेवा के अधिकारियों के संबंध में स्नातकोत्तर योग्यता प्राप्त करने के छत्तीस माह की अध्ययन छुट्टी इस शर्त पर स्वीकृत की जा सकती है कि कोई केन्द्रीय स्वास्थ्य सेवा अधिकारी जिसको ऐसी छुट्टी स्वीकृत की जाती है, नियम 53 के उप- नियम (4 ) के अंतर्गत अध्ययन अवधि के पूरा होने के बाद 5 वर्षों की अवधि के लिए सरकार की सेवा करने हेतु एक बॉण्ड प्रस्तुत करेगा " ।

GSR. 229. In exercise of the powers conferred by the proviso to article 309 read with clause (5) of article 148 of the Constitution , the President hereby makes the following rules further to amend the Central Civil Services (Leave) Rules , 1972 , namely:

1. (1) These rules may be called the Central Civil Services (Leave) Amendment Rules, 2007.

(2) They shall come into force from the date of their publication in the Official Gazette .

2. Inthe Central Civil Services (Leave) Rules, 1972, for rule 51 , the following rule shall be substituted , namely:-

"51. Manximum amount of study leave: ( 1 ) The maximum amount of study leave , which may be granted to a Government servant , other than Central Health Service Officers , shall be-

(a) Ordinarily twelve months at any one time , and

(b)During his entire service , twenty - four months in all (inclusive of similar kind of leave for study or training granted under any other rules) .

(2) In respect of Central Health Service Officers , study leave may be granted for thirty - six months for acquiring post graduate qualification , subject to the condition that a Central Health Service Officer who has been granted such study leave shall execute a bond under sub - rule (4) of rule 53 to serve the Government for a period of five years after completion of the study course " .

सा.का.नि. 230. कृषि उपज ( श्रेणीकरण और चिन्हांकन ) अधिनियम , 1937 ( 1937 का 1 ) की धारा 3 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , सत्तु श्रेणीकरण और चिन्हांकन नियम, 2007 का प्रारूप , भारत के राजपत्र, भाग II , खंड 3 , उपखंड ( i ) में अधिसूचना संख्यांक सा.का.नि. 49, तारीख 17 मार्च , 2007 के अधीन प्रकाशित किया गया था , जिसमें ऐसे सभी व्यक्तियों से , जिनके उनसे प्रभावित होने की संभावना है, उस तारीख से , जिसको राजपत्र में प्रकाशित उक्त अधिसूचना की प्रतियां जनता को उपलब्ध कराई गई थीं, पैंतालीस दिन के भीतर सुझाव और आक्षेप मांगे गए थे।

और उक्त अधिसूचना की प्रतियां जनता को 17 अप्रैल , 2007 को उपलब्ध करा दी गई थीं । और उक्त प्रारूप नियमों के संबंध में जनतः से प्राप्त आक्षेप और सुझावों पर सम्यक् रूप से विचार कर लिया गया है।

अतः अब , केंद्रीय सरकार , कृषि उपज ( श्रेणीकरण और चिन्हांकन ) अधिनियम , 1937 की धारा 3 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, निम्नलिखिव नियम बनाती है , अर्थात्:-

नियम

1. संक्षिप्त नाम और प्रारंभ

(1 ) इन नियमों का संक्षिप्त नाम सत्तु श्रेणीकरण और चिन्हांकन नियम, 2007 है ।

(2) ये एक अनाज या मिलेट से या उनके संयोजन से विनिर्मित सत्तु को लागू होंगे ।

(3) ये राजपत्र में उनके अन्तिम प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. परिभाषाएं: - इन नियमों में , जब तक कि संदर्भ से अन्यथा अपेक्षित न हो,-

(क) " कृषि विपणन सलाहकार " से भारत सरकार का कृषि विपणन सलाहकार अभिप्रेत है;

(ख ) " प्राधिकृत पैकर " से ऐसा कोई व्यक्ति या व्यक्ति निकाय अभिप्रेत है , जिसे इन नियमों में यथाविनिर्दिष्ट श्रेणी मानकों और प्रक्रिया के अनुसार सत्तु के श्रेणीकरण और चिन्हांकन के लिए श्रेणी प्राधिकार प्रमाण - पत्र अनुदत्त किया गया है;

(ग ) " प्राधिकार प्रमाण- पत्र " से साधारण श्रेणीकरण और चिन्हांकन नियम , 1988 के उपबंधों के अधीन जारी किया गया प्रमाण- पत्र अभिप्रेत है, जो किसी व्यक्ति या व्यक्ति निकाय को श्रेणी अभिधान चिन्हांकन से सत्तु के श्रेणीकरण और चिन्हांकन का प्राधिकार देता है;

ङ) " अनुसूची " से इन नियमों से संलग्न अनुसूची अभिप्रेत है ।

(घ) " साधारण श्रेणीकरण और चिन्हांकन नियम " से कृषि उपज ( श्रेणीकरण और चिन्हांकन ) अधिनियम , 1937 ( 1937 का 1 ) की धारा 3 के अधीन बनाए गए साधारण श्रेणीकरण और चिन्हांकन नियम , 1988 अभिप्रेत है; (

गया है । 3. श्रेणी अभिधान:- सत्तु की क्वालिटी उपदर्शित करने के लिए श्रेणी अभिधान वह होगा, जो अनुसूची 2 के स्तंभ । में वर्णित किया 4. क्वालिटी की परिभाषा: संबंधित श्रेणी अभिधानों द्वारा उपदर्शित क्वालिटी अनुसूची 2 में उल्लिखित किए गए अनुसार होगी । 5. श्रेणी अभिधान चिन्ह श्रेणी अभिधान चिन्ह में प्राधिकार प्रमाण- पत्र संख्यांक , " एगमार्क " शब्द, वस्तु का नाम और अनुसूची 1 में यथावर्णित के सदृश श्रेणी अभिधान को सम्मिलित करने वाले डिजाइन से मिलकर बना " एगमार्क प्रतीक " होगा ।

6. चिन्हांकन और लेबल लगाने की पद्धति ( 1 ) श्रेणी अभिधान चिन्ह प्रत्येक आधान पर ऐसी रीति में सुरक्षित रूप से लगाया या स्पष्ट रूप से और पठनीय रूप में मुद्रित होगा , जो कृषि विपणन सलाहकार या इस निमित्त उसके द्वारा प्राधिकृत किसी प्राधिकारी द्वारा अनुमोदित किया जाए ।

अर्थात्:- 2. प्रत्येक आधान पर श्रेणी अभिधान चिन्ह के अतिरिक्त , निम्नलिखित विशिष्टियां स्पष्ट और पठनीय रूप से चिन्हांकित होंगी , (क) पैकर का नाम और पता;

(ख) पैकिंग या विनिर्माण का स्थान;

(ग) पैकिंग की तारीख; *

(b) के पूर्व सर्वोत्तम;

(ङ) बैच सं.;

(च ) श्रेणी;

(छ) शुद्ध भार;

अधिकतम खुदरा कीमत ( सभी करों सहित) ;

अवरोधी क्रम में भार/ भार में प्रयुक्त संघटक;

(ज) (झ)

ऐसी अन्य विशिष्टियां , जो कृषि विपणन सलाहकार द्वारा विनिर्दिष्ट की जाएं;

(त्रं) (ट) खाद्य अपमिश्रण निवारण नियम , 1955 की कोई अन्य अपेक्षा; और

(ठ) भंडारण स्थिति , यदि कोई हो ।

(3) पैकेजों पर चिन्हांकन के लिए प्रयुक्त स्याही ऐसी क्वालिटी की होगी , जो उत्पाद को संदूषित न करे ।

(4) प्राधिकृत पैकर , कृषि विपणन सलाहकार या इस निमित्त उसके द्वारा प्राधिकृत किसी अधिकारी का पूर्व अनुमोदन प्राप्त करने के पश्चात्, श्रेणीकृत पैकेजों पर अपना निजी व्यापार चिन्ह या व्यापार ब्रान्ड लगा सकेगा, परन्तु वह इन नियमों के अनुसार आधार पर लगाए गए श्रेणी अभिधान चिन्ह द्वारा उपदर्शित क्वालिटी से भिन्न क्वालिटी उपदर्शित न करता हो ।

7. पैकिंग की पद्धति: - ( 1 ) सत्तु को कृषि विपणन सलाहकार या इस निर्मित्त उसके द्वारा प्रांधिकृत किसी अधिकारी द्वारा सम्यक् रूप से अनुमोदित , फूड ग्रेड मैटिरियल से बने उचित अस्तर ( इमरलाईनिंग ) लगे जूट या कपड़े के ठोस, स्वच्छ एवं शुष्क आधानों में, लेमिनेटिड पोलीथिलीन के थैलों, पाऊचों, जलरोधी थैलों या किसी अन्य फूड ग्रेड मैटिरियल में ही पैक किया जाएगा ।

(2 ) आधान किसी कीट ग्रस्तता या फफूंद संदूषण से मुक्त होगा और किसी अवांछनीय या असहनीय गंध से भी मुक्त होगा । *पैकिंग की तारीख नमूने के विश्लेषण के पूरा होने कीतारीख होगी ।

(3) आधान को सुरक्षित रूप से बंद किया जाएगा और ऐसी रीति में सीलबंद किया जाएगा , जो कृषि विपणन सलाहकार या इस निमित्त उसके द्वारा प्राधिकृत किसी अधिकारी द्वारा अनुमोदित की जाए ।

(4 ) प्रत्येक पैकेज में केवल एक श्रेणी अभिधान का सत्तु होगा । एक ही बैच और श्रेणी अभिधान की श्रेणीकृत सामग्री वाले सत्तु की उपयुक्त संख्या या छोटे पैकेट जूट की थैली , लकड़ी के बक्सों, गत्तों के कार्टनों जैसे मास्टर आधानों में और उसी प्रकार , मास्टर आधानों में संबंधित ब्यौरे सहित पैक किए जा सकेंगे ।

(5 ) सधु को, समय- समय पर , कृषि विपणन सलाह‌कार द्वारा जारी किए गए निदेशों के अनुसार पैकेटों के आकारों में पैक किया जाएगा । 8. प्राधिकरण प्रमाण-पत्र के अनुदान के लिए विशेष शर्ते प्रत्येक प्राधिकृत पैकर, साधारण श्रेणीकरण और चिन्हांकन नियम, 1988 के नियम ( 3 ) के उप- नियम ( 8 ) में विनिर्दिष्ट साधारण सतर्तों के अतिरिक्त, समय- समय पर, कृषि विपणन सलाहकार द्वारा विहित किए गए निम्नलिखित निदेशों का भी पालन करेगा , अर्थात्:-

( 1) प्राधिकृत पैकर सतु की गुणवता के परीक्षण के लिए साधारण श्रेणीकरण और चिन्हांकन नियम, 1988 के नियम 9 के अनुसार कृषि विपणन सलाहकार या इस निमित्त उसके द्वारा प्राधिकृत किल्ली अधिकारी द्वारा अनुमोदित अहिंत कैमिस्ट द्वारा प्रबंध की जा रही अपनी स्वयं की प्रयोगशाला स्थापित करेगा या राज्य श्रेणीकरण प्रयोगशाला या. इस प्रयोजन के लिए अनुमोदित निजी वाणिज्यिक प्रयोगशाला में पहुंच रखेगा ।

(2) प्रसंस्करण , श्रेणीकरण , संभलाई और पैकिंग के लिए परिसर को पूर्णतः स्वास्थ्यकर और स्वच्छ दशाओं में रखा जाएगा । परिसर में पक्के फ्लोर , प्रकाश और वायु की अच्छी निकास व्यवस्था जैसी पर्याप्त भंडारण सुविधाएं होंगी और वह कृतंक और कीट संदूषण से मुक्त होगा ।

(3 ) प्राधिकृत पैकर और अनुमोदित कैमिस्ट परीक्षण , श्रेणीकरण , पैकिंग , चिन्हांकन , सीलबंदी और अभिलेख के रखे जाने से संबंधित ऐसे सभी निदेशों का पालन करेगा , जो कृषि विपणन सलाहकार या इस निमित्त उस्‌के द्वारा प्राधिकृत किसी अधिकारी द्वारा जारी किए जाएं ।

1. सत्तु मक्का ( जिया मेयज लिन्न ) चना ( साइसर एयरीटीनम ) , जौ ( होर्डियम वलगेयर या होर्डियम दिस्ताकोन ) , गेहूं ( ट्रिटिकम एयस्टीवम लिन्न या ट्रिटिकम वलगेयर या ट्रिटिकम देरुम वेस्फ) के साफ , धुले हुए, शुष्कित , ठोस , अनाज दाने से पृथक या कतिपय अनुपात में संयोजन से भुने हुए और पीसे हुए रूप में दलने के पश्चात् व्युत्पन्न किया जाएगा ।

2. न्यूनतम अपेक्षाएं: -

(i ) सत्तु वांछित उत्कृष्टता से कूटने के पश्चात् चने , मक्के, जौ और गेहूं के स्वच्छ, धुले हुए, शुष्कित और जीवाणु ( भ्रूण) , दानों से चौकर और ठीक ऊपर के छिलके को ( मक्के की दशा में ) हटाकर तैयार किया जाएगा ।

( क) एक समान रंग और आकार का होगा;

(ख) उत्पाद से सहयुक्त विशिष्ट स्वाद , गंध और फ्लेवर से युक्त होगा;

[PART II-SEC. 3( i )) (ग ) कीट संदूषक, जीवित कीटाणु , मृत कीटाणुओं कीट गंध, फफूदी या दमड़ी या लारवा से मुक्त होगा ;

(घ ) कृतक बाल और उत्सर्ग से मुक्त होगा;

(ड) खमीर और पुरानी महक , सीलन या किसी आक्षेपनीय महक से मुक्त होगा;

( च ) धूल , बाहृय पदार्थ ( जिसके अंतर्गत मिलावटी रंग भी है ) या किसी अन्य मिलावटी पदार्थ से मुक्त होगा;

(छ ) किसी फफूंदी या जीवाणु संदूषण से मुक्त होगा ;

(ज ) परिरक्षित, सुगंधित अभिक्रमकों और अन्य खाद्य संयोजनों से मुक्त होगा ।

( ii ) सत्तु में प्रयुक्त सभी संघटक खाद्य अपमिश्रण निवारण नियम , 1955 के उपबंधों के अधीन अनिवार्य अपेक्षाओं के अनुरूप होंगे ।

(iii ) सत्तु विषैले या अनिष्टकर बीजों अर्थात् क्रोटोलेरिया , कार्न गेगला , एरेण्ड बीन्स, धतुरा बीजों , आरगेमोन मैक्सीकाना , खेसरी दाल और अन्य ऐसे बीजों से मुक्त होगा , जो सामान्यतः स्वास्थ्य के लिए हानिकारक माने जाते हैं ।

(iv) सत्तु में यूरिक ऐसिड और एफ्लाटोक्सीन क्रमशः 100 मिलीग्राम और 30 मिलीग्राम प्रति किलोग्राम से अधिक नहीं होगा । (v ) सत्तु स्टार्च कणों के माइक्रोस्कोपिक परीक्षण पर विशिष्ट स्टार्च संरचना प्रदर्श करेगा ।

(vi ) सत्तु विषैली धातुओं ( नियम 57 ) , फसल संदूषणों ( नियम 57क ) , प्राकृतिक रूप से उत्पन्न विषैले पदार्थों ( नियम 57 ख ) कीटनाशकों और जीवनाशी अवशेषों ( नियम 65 ) और ऐसी अन्य खाद्य सुरक्षा अपेक्षाओं के, जो खाद्य अपमिश्रण निवारण नियम, 1955 के उपबंधों के अधीन अधिकथित की जाएं, अवशिष्ट स्तर के भी अनुरूप होगा ।

(ii ) सत्तु सफेद या सफेद से हल्के पीले रंग में होगा । (iii) लेबल पर निम्नलिखित विशिष्टियां चिन्हांकित की जाएंगी :-

G.S.R. 230. Whereas the draft of Sattu Grading and Marking Rules, 2007 , in exercise ofthe powers conferred by Section3 oftheAgricultural Produce (Grading and Marking) Act, 1937 (1 of 1937) was published vide notificationNumber G.S.R.49 dated 17th March, 2007, in the Gazette of India, Part II, Section 3 , sub-section (1 ), inviting objections and suggestions from all persons likely to be affected thereby within fourty five days from the date on which copies of the said notification published in the Gazette of India were made available to the public .

Andwhereas.copies of the said notification were made available to the public on 17th April, 2007. Andwhereas the objections and suggestions received from the public in respect of the said draft rules have been duly considered.

Now, therefore , in exercise of the powers conferred by Section 3 of the Agricultural Produce (Grading and Marking) Act, 1937, the Central Government hereby makes the following rules , namely:

RULES

1. Short title and commencement :----

(1) These rules maybe called the Sattu Grading and Marking Rules, 2007.

(2) They shall apply to Sattu manufactured from single Cereal or Millet or in combination.

(3) They shall come into force on the date of their final publication in the Official Gazette.

2.Definitions.- In these rules , unless the context otherwise requires,-

(a) "Agricultural Marketing Adviser " means the Agricultural Marketing Adviser to the Government of India;

(b) "Authorised packer" means a person or body ofpersons , who has been granted the certificate of authorization tograde and mark sattu in accordance with the grade standards and procedure as specified in these rules;

(c) "Certificate of Authorisation " means a certificate issued under the provisions of General Grading and Marking Rules , 1988 authorising a person or a body of persons to grade and mark sattu with the grade designation mark;

(d) "General Grading and Marking Rules " means the General Grading and Marking Rules , 1988 made under Section 3 oftheAgricultural Produce (Grading and Marking)Act, 1937 (1 of 1937);

(e) "Schedule" means a Schedule appended to these rules .

3. Grade designation. The grade designation to indicate the quality of the sattu shall be as set out in column lof Schedule II .

4. Definition of quality. The quality indicated by the respective grade designations shall be as mentioned in Schedule II .

5.Grade designation mark.----The grade designation mark shall consist of " AGMARK INSIGNIA" consisting of the design incorporating the certificate of authorization number, the word " AGMARK ", name ofthe commodity and grade designation resembling the one as set out in Schedule

6.Method of marking and labeling.- ( 1 ) The grade designation mark shall be securely affixed to or clearly and indelibly printed on each container in such manner as approved by the Agricultural Marketing Adviser or an officer authorized by him in this behalf.

(2) In addition to the grade designation mark, the following particulars shall be clearly and indelibly marked on each container , -

(a) Name and address of the packer ;

(b) Place of packing or Manufacturing;

(d) Best before ;

(e) Batch number;

(f) Grade;

(g) Net weight;

(h) Maximum retail price ( inclusive ofalltaxes);

(i) Ingredients used in descending order weight/weight;

(j ) Such other particulars as may be specified by the Agricultural Marketing Adviser;

(1) Storage condition, if any .

(3) The ink used for marking on packages shall be of the quality which shall not contaminate the product .

(4) The authorized packer shall , after obtaining prior approval of the Agricultural Marketing Adviser or an officer authorized by him in this behalf, mark his private trade mark or trade brand on the graded packages provided that the same does not indicate quality other than that indicated by the grade designation mark affixed to the container in accordance with these rules .

7. Method of packing.- ( 1 ) Sattu shall be packed only in sound , clean and dry containers made ofjute or cloth bags with suitable inner lining of food grade material , laminated polyethylene or poly propylene or high density polyethylene bags, pouches, water proof bags or any other food grade material duly approved by the Agricultural Marketing Adviser or any officer authorized by him in this behalf.

(2) the container shall be free from any insect infestation or fungus contamination and also free from any undesirable or obnoxious smell . The container and packaging material shall be made of substances which are safe and suitable for their intended use .

(3) the container shall be securely closed and sealed in such manner as approved by the Agricultural Marketing Adviser or an officer authorized by him in this behalf.

* The date of packing shall be the date of completion of the analysis of the sample .

(4) each package shall contain Sattu of one grade designation only. Suitable number or small packets of Sattu containing graded material of the same batch and grade désignation may be packed in a master container such as jute bags , wooden cases , cardboard cartons and the like with details on master containers .

totime. (5) Sattu shall be packed in the pack sizes as per instructions of Agricultural Marketing Adviser issued from time 8.Special conditions for grant of certificate of authorization . In addition to the conditions specified in sub - rule (8) of rule 3 of the General Grading and Marking Rules , 1988 , every authorized packer shall follow the following instructions prescribed by Agricultural Marketing Adviser from time to time :-

(1) The authorized packer shall either set up his own laboratory manned by a qualified chemist approved by the Agricultural marketing Adviser or an officer authorized by him in this behalf in accordance with rule 9 of the General Grading and Marking Rules , 1988 for testing the quality of Sattu or have access to the State Grading Laboratory or Private Commercial Laboratory approved for the purpose:

(2) The premises for processing , grading , handling and packing shall be maintained in perfect hygienic and sanitary conditions . The premises shall have adequate storage facilities with pucca floor , good ventilation for light and air and free from rodent and insect infestation; and

(3) The authorized packer and the approved chemist shall observe all instructions regarding testing , grading . packing, marking, sealing and maintenance of records which may be issued by the Agricultural Marketing Adviser or any other officer authorized by him in this behalf.

Grade designation and quality of Sattu

1. Sattu shall be derived from clean , washed , dried and sound grains of maize ( Zea mays Linn ) , gram ( Cicer arietinum) , barley ( Hordeum vulgare or Hordeum distichon) wheat (Triticum aestivum Linn or Triticum vulgare or Triticumdurum Desf. ) after grinding of roasted and puffed form either single or in combination in certain ratio .

2.Minimum requirements :-

(i) Sattu shall be derived from clean , washed dried and removal of germ (embryo ) , bran and tip cap ( in case of maize) grains of gram , maize, barley and wheat after milling to the desired fineness .

Itshall be-

(a) of uniform color and size;

1153 (b) having characteristic taste , smell and flavour associated with the product;

(d) freefrom rodent hair and excreta;

(e) free from fermented and musty odour , rancidity or any objectionable odour ;

(f) free from dirt, extraneous matter ( including added colours) or any other adulterants;

(g) free from any fungal or bacteria contamination ; and

(h) free from preservatives , flavoring agents and other food additives .

(ii) All ingredients used in Sattu shall conform to the mandatory requirements under the provisions of Prevention ofFood Adulteration Rules , 1955 .

(iii) Sattu shall be free from toxic or noxious seeds namely crotolaria , corn cockle , castor beans, jimson seeds , argemon maxicana, khesari dal and other seeds that are commonly recognized as harmful to health .

( iv) Sattu shall not have uric acid and aflatoxin more than 100 milligrams and 30 micrograms per kilograms respectively.

(v) On microscopic examination of starch particles, Sattu shall exhibit characteristic starch structure .

(vi ) Sattu shall also comply with the residual level of poisonous metals (rule 57) , crop contaminants (rule 57-A) , naturally occurring toxic substances (rule 57 -B ) , insecticides and pesticides residues ( rule 65) and other food safety requirements as laid down under the provisions of Prevention of Food Adulteration Rules, 1955..

3.0 (i) Sattu shall be in sound merchantable condition and fit in all respect for human consumption .

(ii) Sattu shall be of white or white to light yellowish colour .

(iii) The following.particulars shall be marked on the label;

single; if Sattu is derived from single cereal or millet;

mixed; ifSattu is derived from combination of cereals or millets;

spices and salt, if used;

sieve size .

5. Provisions concerning sizing:

Fine: not less than 98 %( by weight) of Sattu shall pass through 500 micron IS- sieve.

Coarse: not less than 98 %( by weight) of Sattu shall pass through 1000 micron IS -sicve.
