आ. अ. 70.-यतः कर्नाटक विधान सभा के साधारण निर्वाचन 2004 के लिए 125 - पोरियापटना विधान सभा निर्वाचन क्षेत्र से निर्वाचन लड़ने वाले अभ्यर्थी श्री एच. डी. गणेश, सुपुत्र श्री एच. जे. दासगोण्डा ओलाकोटे रूद्रेश्वरा बाढावाने , पेरियापटना शहर , जिला मैसूर , कर्नाटक को, निर्वाचन आयोग द्वारा लोक प्रतिनिधित्वं अधिनियम , 1951 की धारा 10क के अन्तर्गत इसके तारीख 7 जुलाई, 2005 के आदेश संख्या ( क ) 76/कर्नाटक- वि.स./2005 द्वारा उक्त अधिनियम और तद्धीन बनाए गए नियमों और आदेशों द्वारा अपेक्षित रीति से अपने निर्वाचन व्ययों का लेखा दाखिल करने में असफल रहने के कारण निरर्हत कर दिया गया ।
यतः श्री एच. डी. गणेश ने आयोग के उक्त आदेश को बंगलौर स्थित कर्नाटक उच्च न्यायालय में चुनौती देते हुए रिट याचिका सं. 23047/2005 ( जी. एम. आर ई एस ) दाखिल की है और न्यायालय ने अपने तारीख 25-9-2007 के आदेश द्वारा आयोग के आदेश को अभिखंडित किया है और निदेश दिया है कि श्री गणेश के कथित रूप से लेखे के साथ दाखिल प्रत्यावेदन पर विचार करने के बाद उन्हें निरर्हत किये जाने के मुद्दे की पुनः जांच की जाए तथा श्री गणेश को निदेश दिया है कि लेखे की प्रति और अन्य दस्तावेज जिला निर्वाचन अधिकारी के पास दाखिल करें जो इस मामले में आयोग द्वारा सम्यक विचारार्थ अपनी रिपोर्ट भेजेगा; और

यतः रिट याचिका सं.. 23047/2005 (जी.एम. आर ई एस) तारीख 25-9-2007 में कर्नाटक उच्च न्यायालय के आदेश का अनुपालन करते हुए , श्री गणेश ने अपने निर्वाचन व्ययों का लेखा जिला निर्वाचन अधिकारी के पास 9-11-2007 को दाखिल कर दिया था जिन्होने अपनी रिपोर्ट निर्धारित फार्मेट में आयोग के विचारार्थ प्रस्तुत कर दी है; और
यतः जिला निर्वाचन अधिकारी की उपर उल्लिखित रिपोर्ट और कर्नाटक उच्च न्यायालय के आदेश पर विचार करने के बाद आयोग ने लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 11 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए पत्र सं. 76/कर्ना.वि.स. /2005 तारीख 7 जुलाई , 2005 द्वानी श्री एच. डी. गणेश पर अध्यारोपित निरर्हता को रद्द करने का निर्णय किया है ।
अतः अब , आयोग के आदेश संख्या 76/कर्नाटक- वि.स. /2005 तारीख 7 जुलाई , 2005 में क्रम संख्या 2 पर दिए गए उक्त श्री एच. डी. गणोश का नाम आदेश सं. 76/कर्ना. वि.स./2005 तारीख 7 जुलाई, 2005 से आरम्भ से ही हटा दिया गया माना जाएगा ।

O.N. 70. Whereas , Sh. H. D. Ganesh S/ o H. J. Dasegowada Olakote Rudreshwara Badavane , Periyapatna Town , MyosreDistrict, Karnataka a contesting candidate for the General Election to the Legislative Assembly of Karnataka held in 2004 from 125 - Periyapatna Assembly Constituency was disqualified by the Election Commission of India , vide its order No. 76/KT-LA/2005 dated 7th July, 2005 under Section 10A of the Representation of the People Act, 1951 , for failure to lodge his account of election expenses as required by the said Act and the Rules and order made thereunder ;
Whereas , Shri H.D. Ganesh filed Writ Petition No. 23047/2005 ( GM -RES ) challenging the Commission's Order cited above in the High Court of Karnataka at Bangalore and the Court vide its Order dated 25-9-2007, quashed the Commission's Orderand directed to re- examine the issue of disqualifying Shri Ganesh afresh after considering his representation stated to have been filed alongwith account and further directed Shri Ganesh to file a copy of the account and other papers with District Election Officer who would send report in this matter to the Commission for due consideration by the Commission; and
Whereas , In compliance to the Karnataka High Court's Order in Writ Petition No. 23047/2005 (GM-RES) dated 25-9-2007, Shri Ganesh submitted his account of election expenses with the District Election Officer on 9-11-2007 who has submitted his report in prescribed format for consideration of the Commission; and
Whereas, after taking into consideration the above mentioned report of District Election Officer and High Court of Karnataka's Order, the Commission in exercise of the powers conferred by Section 11 of the Representation of the People Act, 1951 , has decided to revoke the disqualification imposed on Sh . H.D. Ganesh vide letter No. 76/KT- LA/2005 dated 7thJuly,2005;
Now, therefore, the name of the said Sh . H. D. Ganesh appearing at Sl . No. 2 in Commission's Order No. 76/KT- LA/ 2005 dated 7th July, 2005 shall be deemed to have been omitted ab initio from the Order No. 76/KT - LA/2005 dated 7th July, 2005.
