2. तदर्थ पदोन्नति निम्नलिखित शर्तों के अध्यधीन है:-- नई दिल्ली, दिनांक 7 सितम्बर 2007

(i ) तदर्थ पदोन्नति अनिश्चित काल तक ग्रेड में निरंतर बने रहने अथवा नियमित नियुक्ति हेतु चयन सूची में शामिल किए जाने अथवा चयन ग्रेड में वरिष्ठता के दावे का अधिकार प्रदान नहीं करती ।

(ii ) तदर्थ नियुक्ति किसी भी समय बिना कारण बताए समाप्त कीजा सकती है ।

और जबकि उक्त श्री उपेन्द्र सिंह बघेल, आईपीएस के अभ्यावेदन पर सक्षम प्राधिकारी द्वारा विचार किया गया था तथा उनके अपने मूल संवर्ग में लौटने के लिए एक माह का समय दिया गया था तथा इस निर्णय की सूचना उन्हें दिनांक 21.05.2007 के पत्र के तहत दे दी गई थी तथा उनको यह भी सूचित किया गया था कि उनके सेवा संबंधी मामले का निपटान संवर्ग में कार्यभार ग्रहण करने के बाद किया जा सकता है;

2. तदर्थ पदोन्नति निम्नलिखित शर्तों के अध्यधीन है:--

और जबकि उक्त श्री उपेन्द्र सिंह बघेल , आईपीएस ने उपर्युक्त निदेश का अनुपालन नहीं किया और उन्होंने एक और अभ्यावेदन प्रस्तुत कर दिया जिसमें उन्होंने मूल संवर्ग में लौटने के लिए और समय माँगा तथा मूल संवर्ग में लौटने से पहले पदोन्नति और तैनाती के लिए अनुरोध किया;

( i) तदर्थ पदोन्नति अनिश्चित काल तक ग्रेड में निरंतर बने रहने अथवा नियमित नियुक्ति हेतु चयन सूची में शामिल किए जाने अथवा चयन ग्रेड में वरिष्ठता के दावे का अधिकार प्रदान नहीं करती ।

(ii ) तदर्थ नियुक्ति किसी भी समय बिना कारण बताए समाप्त की जा सकती है ।

और जबकि सक्षम प्राधिकारी ने उक्त अभ्यावेदन पर विचार किया और उक्त श्री उपेन्द्र सिंह बघेल, आईपीएस को एक अंतिम अवसर प्रदान करने का निर्णय लिया और उन्हें दिनांक 11 अक्तूबर, 2007 के पत्र की प्राप्ति के 30 दिन के भीतर संवर्ग में वापस लौटने के लिए सूचित किया । उन्हें यह भी सूचित किया गया था कि यदि वे उपर्युक्त निदेशों का पालन नहीं करते हैं तो भारत सरकार उनके मामले में अखिल भारतीय सेवा ( छुट्टी ) नियम के 7 ( 2 ) के उपबंधों को लागू करने के लिए स्वतंत्र होगी;

(iii ) उपर्युक्त नियुक्ति आदेश केन्द्रीय प्रशासनिक अधिकरण , प्रधान बेंच, नई दिल्ली के दिनांक 11.01.2007 के एम . ए. सं. 2170/2006, ओ.ए. सं. 2793/2005, एम.ए. सं. 2710/2005 के विषय पर आधारित होगा ।

और जबकि उक्त श्री उपेन्द्र सिंह बघेल , आईपीएस ने उपर्युक्त सलाह पर कोई प्रतिक्रिया नहीं की;

और जबकि इस मामले की सक्षम प्राधिकारी द्वारा पुनरीक्षा की गई तथा उन्हें एक और अवसर प्रदान करने का निर्णय लिया गया तथा उन्हें 7 दिन के भीतर अपने मूल संवर्ग में वापस लौटने की सलाह देते हुए दिनांक 17 दिसम्बर, 2007 को एक पत्र भेजा गया तथा उन्हें ईमेल" के द्वारा भी यह सूचना भेजी गई;

सं. 24009/85/99- आईपीएस II जबकि श्री उपेन्द्र सिंह बघेल, आईपीएस ( कर्नाटक : 88 ) संयुक्त राष्ट्र में प्रतिनियुक्ति पर गए थे तथा उन्होंने 05.02.2000 से यूनाईटेड नेशन्स इन्टरनेशनल क्रिमिनल ट्रिब्यूनल फॉर रवान्डा में अन्वेषक के पद पर कार्यभार ग्रहण किया था । तत्पश्चात् उनकी प्रतिनियुक्तिको समय - समय पर बढ़ाया जाता रहा तथा उनकी अंतिम बार बढ़ाई गई प्रतिनियुक्ति की अवधि 04.02.2005 को समाप्त हो गई;

और जबकि उक्त श्री उपेन्द्र सिंह बघेल , आईपीएस स्वयं को विदेशी संगठन से कार्यमुक्त कराए बिना बंगलौर आ गए तथा उन्होंने अपने मूल संवर्ग को एक पत्र लिखा जिसमें उन्होंने बताया कि वे केन्द्र सरकार के दिनांक 17.12.2007 के निदेशों का अनुपालन करते हुए उनको रिपोर्ट कर रहे हैं । तत्पश्चात् उक्त श्री उपेन्द्र सिंह बघेल , आईपीएस, सक्षम प्राधिकारी का अनुमोदन प्राप्त किए बिना, वापस संयुक्त राष्ट्र चले गए क्योंकि उन्होंने उस संगठन से केवल छुट्टी ली थी;

और जबकि उक्त श्री उपेन्द्र सिंह बघेल, आईपीएस को संवर्ग प्राधिकारी द्वारा 17.05.2006 को यह सलाह दी गई थी कि वे वापस लौटकर तत्काल अपने मूल संवर्ग अर्थात् कर्नाटक संवर्ग में भारतीय पुलिस सेवा में रिपोर्ट करें;

और जबकि उक्त श्री उपेन्द्र सिंह बघेल, आईपीएस को संवर्ग प्राधिकारी द्वारा 01.07.2006 और 11.09.2006 को पुनः अपने मूल संवर्ग में वापस आने की सलाह दी गई थी;

और जबकि उपर्युक्त मामले पर सक्षम प्राधिकारी द्वारा फिर से विचार किया गया तथा उनकी लगातार अनधिकृत अनुपस्थिति और उनके द्वारा की गई इस मंत्रालय के निदेशों की अवहेलना को ध्यान में रखते हुए, उनके मामले में उक्त नियम 7 ( 2 ) (ग ) के उपबंधों को लागू करना वांछनीय समझा गया;

और जबकि उक्त श्री उपेन्द्र सिंह बघेल, आईपीएस 04.02.2005 के बाद अनधिकृत रूप से संयुक्त राष्ट्र में प्रतिनियुक्ति पर बने हुए हैं और इसलिए उन्हें अखिल भारतीय सेवा ( छुट्टी ) नियम, 1955 के नियम 7( 2 ) ( ग ) के उपबंधों के अंतर्गत 13 मार्च, 2007 को एक नोटिस जारी किया गया जिसमें उनसे यह स्पष्टीकरण मागा गया कि उनके मामले में उपर्युक्त नियम के उपबंध क्यों नहीं लागू किए जाए;

और अतः , अब, राष्ट्रपति, अखिल भारतीय सेवा ( छुट्टी ) नियम, 1955 के नियम 7 ( 2 ) ( ग ) के उपबंधों के द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, यह मानती है कि श्री उपेन्द्र सिंह बघेल, आईपीएस ( कर्नाटक: 88 ) ने इस अधिसूचना के जारी होने की तारीख से भारतीय पुलिस सेवा से त्यागपत्र दे दिया है । श्री उपेन्द्र सिंह बघेल , आईपीएस ( कर्नाटक: 88 ) इसी तारीख से भारतीय पुलिस सेवा से कार्यमुक्त भी हो जाएंगे । तदनुसार यह अधिसूचित किया जाता है ।

भारत की राष्ट्रपति के लिए और उनकी ओर से

के. नटराजन, अवर सचिव और जर्बाक उक्त श्री उपेन्द्र सिंह बघेल, आईपीएस को उक्त सूचना प्राप्त हो गई थी और उन्होंने " ई- मेल " तथा डाक के द्वारा अपना अभ्यावेदन प्रस्तुत करके अपने मूल संवर्ग में वापस आने के लिए कुछ और समय माँगा था तथा वापस आकर कार्यभार ग्रहण करने से पहले अपनी पदोन्नति और तैनाती के लिए अनुरोध किया था;

2. The appointment is subject to the conditions that the ad -hoc promotion shall not confer any right to continue in the grade indefinitely or for inclusion in the Select List for regular appointment or to claim seniority in Grade I. The ad-hoc appointment may be terminated at any point of time without giving any reason therefore .
