का.नि.आ. 37.- रक्षा संकर्म अधिनियम , 1903 ( 1903 की 7 ) की धारा 3 द्वारा प्रदत्त शक्तियों का इस्तेमाल करते हुए केंद्र सरकार एतद्वारा घोषणा करती है कि नीचे दी गई अनुसूची में उल्लिखित भूमि रक्षा संकर्म के निकटवर्ती होने के कारण , नामतः असम राज्य के नौगांव जिला में तेजपुर गुवाहाटी सड़क पर मिसा रक्षा विस्थापना इसे भवनों तथा जमीन से ऊपर 1000 गज तक तथा धरातल से नीचे 500 गज तक अन्य बाधाओं से मुक्त रखे जाने के उद्देश्य से इसके उपयोग तथा अधिभोग पर उर्पयुक्त अधिनियम की धारा 7 के खंड ( ख ) और ( ग ) में निर्दिष्ट प्रतिबंध लगाया जाना आवश्यक है ।

रक्षा संकर्म, नामतः असम राज्य के नौगांव जिला में तेजपुर गुवाहटी सड़क पर मिसा, सियाली खाती , आमलुखी 2 से 4 गांवों में तथा मिसा चाय बागान संख्या 2 पर स्थित मिसा रक्षा विस्थापना , की बाहरी चाहरदीवारी से चारों तरफ 1000 गज़ की दूरी के भीतर वाले क्षेत्र में आने वाली समस्त भूमि ।
2. उपर्युक्त भूमि की योजना से संबंधित रेखाचित्र नक्शे का निरीक्षण उपायुक्त, जिला नौगांव , असम राज्य के कार्यालय में किया जा सकता है ।

In exercise of the powers conferred by Section 3 ofthe Works of Defence Act , 1903 (7 of 1903 ) , the CentralGovernment hereby declares that it is necessary to impose restrictions specified in clauses (b) and ( C) of Section 7 ofthe said Act upon the use and enjoyment of the land described in the Schedule given below, being land lying in the vicinity of work of defence , namely, Misa defence establishment on road Tezpur- Guwahati in Naugaon District in the state ofAssam, in order that the said land may be kept free from buildings and other obstructions upto 1000 yards above ground and upto 500 yards below the surface .
SCHEDULE
All the land comprised in the area lying within the distance of 1000 yards all around from the outer boundary wall of the works of Defence , namely, Misa defence establishment or road Tezpur -Guwahati at villages Misa, Siyale Khati , Aamlukhi 2 to 4 and Misa Tea Garden No.2 in Naugaon District in the state ofAssam.
2.A sketch plan of the said land may be inspected in the office of the Deputy Commissioner , Naugaon, Assam.

का.नि.आ. 38.- राष्ट्रपति , संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , और सेना समूह ' घ ' (अनौद्योगिक) भर्ती नियम , 2001 को , जहां तक उनका संबंध सेना की निम्नतर विरचनाओं में बूट निर्माता के पद ( सैनिक इंजीनियरी सेवा में पदों को छोड़कर ) से है , उन बातों के सिवाय अधिक्रांत करते हुए , जिन्हें ऐसे अधिक्रमण से पूर्व किया गया है , सेना की निम्नतर विरचनाओं में बूट निर्माता के पद ( सैनिक इंजीनियरी सेवा में पदों से भिन्न ) के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाते हैं , अर्थात्:-
1. संक्षिप्त नाम और प्रारंभ ( 1 ) इन नियमों का संक्षिप्त नाम सेना (सैनिक इंजीनियरी सेवा में पदों से भिन्न ) समूह ' ग ' ( बूट निर्माता ) भर्ती नियम, 2008 है ।
(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. पद-संख्या , वर्गीकरण और वेतनमान उक्त पद की संख्या , उसका वर्गीकरण और उसका वेतनमान वह होगा जो इन नियमों से उपाबद्ध उक्त अनुसूची के स्तम्भ (2 ) से स्तम्भ ( 4 ) में विनिर्दिष्ट हैं ।
3. भर्ती की पद्धति , आयु- सीमा , अर्हताएं आदि उक्त पद पर भर्ती की पद्धति, आयु सीमा , अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो उक्त अनुसूची के स्तम्भ ( 5 ) से स्तम्भ ( 14 ) में विनिर्दिष्ट हैं ।
4. निरर्हता : वह व्यक्ति,-
(क) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित है विवाह किया है ; या
(ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है ,
उक्त पद पर नियुक्ति का पात्र नहीं होगा :
परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह , ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं तो वह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेगी । 5. शिथिल करने की शक्ति : जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके , इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , शिथिल कर सकेगी। 6. व्यावृत्ति: इन नियमों की कोई बात , ऐसे आरक्षण , आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों , अनुसूचित जनजातियों , भूतपूर्व सैनिकों और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है । [भाग II-खण्ड 4 ]

टिप्पण: आयु सीमा अवधारित करने के लिए निर्णायक तारीख भारत में अभ्यर्थियों से आवेदन प्राप्त करने के लिए नियत की गई अंतिम तारीख होगी । ( न की वह अंतिम तारीख जो असम, मेघालय , अरूणाचल प्रदेश , मिजोरम , मणिपुर , नागालैण्ड, त्रिपुरा , सिक्किम, जम्मू- कश्मीर राज्य के लद्दाख खंड , हिमाचल प्रदेश के लाहौल और स्पिति जिले तथा चम्बा जिले के पांगी उपखण्ड , अंदमान और निकोबार द्वीप या लक्षद्वीप के अभ्यर्थियों के लिए विहित की गई है । रोजगार कार्यालयों के माध्यम से की जाने वाली भर्ती की दशा में , आयु सीमा अवधारित करने के लिए निर्णायक तारीख वह अंतिम तारीख होगी जिस पर रोजगार कार्यालयों से नाम भेजने के लिए कहा गया है ।

भर्ती की पद्धति : भर्ती सीधे होगी या प्रोन्नति द्वारा या प्रतिनियुक्ति/आमेलन द्वारा तथा विभिन्न पद्धतियों द्वारा भरे जाने वाले पदों की प्रतिशतता ।

आमेलनः रक्षा मंत्रालय की निम्नतर विरचनाओं में सदृश या समतुल्य या उच्चतर श्रेणी में सेवारत व्यक्ति जो व्यवसाय के कर्तव्यों से अवगत हों । टिप्पणः प्रत्येक काडर की ज्येष्ठता और प्रोन्नति का रखरखाव पृथक रूप से किया जाएगा ।

$.R.O . 38. In exercise ofthe powers conferred by the proviso to article 309 ofthe Constitution and in supersession ofthe Army Group ' D' (Non - Industrial ) Recruitment Rules , 2001 in so far as they relate to the post of Boot Maker in the lower formations of Army, (excluding the posts in the Miilitary Engineering Service ) except as respects things done or omitted to be done before such supersession , the President hereby makes the following rules regulating the method of recruitment to the post of Boot Maker in the lower formations of the Army (other than the posts in the Military Engineering Service) , namely:-
1. (1) Short title and commencement . ( 1 ) These rules may be called the army (other than the posts in the MilitaryEngineering Service ) Group ' C' ( Boot Maker) Recruitment Rules , 2008 .
(2) They shall come into force on the date of their publication in the Official Gazette .
2. Number of post , classification and scale of pay. The number of posts , its classification and the scale ofpay attached thereto, shall be as specified in columns (2) to (4) of the said Schedule annexed to these rules.
3 Method of recruitment , age limit , qualifications , etc. The method of recruitment, age limit, qualification and other matters relating to the said post, shall be as specified in columns (5) to ( 14 ) of the said Schedule.
4 Disqualification.- No person ,
(a) who has entered into or contracted a marriage with a person having a spouse living, or

shall be eligible for appointment to the said post :
Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing , exempt any person from the operation of this rule .
5. Power to relax.-Where the Central Government is of the opinion that it is necessary or expedient so to do , it may, by order , for reasons to be recorded in writing relax any of the provisions of these rules with respect to any class or category of persons .
6. Saving. Nothing in these rules shall affect reservation , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes , Ex- serviceman and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.
