सा.का.नि. 123.- भारतीय बायलर विनियम , 1950 का और संशोधन करने के लिए कतिपय प्रारूप विनियम भारतीय बायलर अधिनियम, 1923 ( 1923 का 5 ) की धारा 31 की उपधारा ( 1 ) की अपेक्षानुसार भारत के राजपत्र भाग 2 , खंड 3 , उपखंड ( 1 ) तारीख 27 अक्तूबर, 2007 में भारत सरकार के वाणिज्य और उद्योग मंत्रालय ( औद्योगिक नीति और संवर्धन विभाग ) (केन्द्रीय बायलर बोर्ड ) की अधिसूचना संख्यांक सा.का.नि. 218 , तारीख 15 अक्तूबर , 2007 द्वारा प्रकाशित किए गए थे जिसमें उन सभी व्यक्तियों से जिनके उससे प्रभाषित होने की संभावना थी, उस तारीख से जिसको उक्त राजपत्र की प्रतियां जनता को उपलब्ध करा दी गई थीं, पैंतालिस दिन की अवधि के अवसान तक आक्षेप और सुझाव आमंत्रित किए गए थे;

और उक्त राजपत्र की प्रतियां तारीख 18 दिसंबर, 2007 को जनता को उपलब्ध करा दी गई थीं;

और किसी व्यक्ति से इस अधिसूचना में अंतर्विष्ट संशोधनों की बाबत विनिर्दिष्ट अवधि के भीतर कोई आक्षेप या सुझाव प्राप्त नहीं हुएहैं;

अतः अब केन्द्रीय बायलर बोर्ड , भारतीय बायलर अधिनियम , 1923 ( 1923 का 5 ) की धारा 28 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, भारतीय बायलर विनियम, 1950 का और संशोधन करने के लिए निम्नलिखित विनियम बनाता है , अर्थात्:-

[PART II-SEC . 3 ( i ) ] 1. ( 1 ) इन विनियमों का संक्षिप्त नाम भारतीय बायलर ( संशोधन ) विनियम , 2008 है ।

(2 ) ये राजपत्र में उनके अंतिम प्रकाशन से प्रवृत्त होंगे ।

2. भारतीय बायलर अधिनियम , 1950 ( जिसे इसमें इसके पश्चात् उक्त विनियम कहा गया है ) , कं विनियम 16 के खंड ( 1 ) में " परीक्षण प्रमाण पत्र में यदि कार्यशील दबाव नहीं दिया गया हो , तो परीक्षण प्रमाण पत्र में दिए गए परीक्षा दबाव को 1.5 से भाग देकर प्राप्त होने वाला दबाव हो अधिकतम कार्यशील दबाव माना जाएगा " शब्दों और अंकों का लोप किया जाएगा;

3. उक्त विनियमों के विनियम , 56 के खंड ( i ) में " परीक्षण प्रमाण पत्र में यदि कार्यशील दबाव नहीं दिया गया हो , तो परीक्षण प्रमाण पत्र में दिए गए परीक्षण दबाव को 1.5 से भाग देकर प्राप्त होने वाला दवाव ही अधिकतम कार्यशील दनात्र माना जाएगा " शब्दों और अंकों का लांघ किया जाएगा;

4. उक्त विनियमों के विनियम 98 क में खंड ( iv ) के स्थान पर निम्नलिखित खंड रखा जाएगा , अर्थात्:-

"( iv ) परीक्षण-यह सुनिश्चित करने के लिए कि इन विनियमों का अनुपालन किया गया है , भालाकाओं पर प्रत्येक एक वर्ष के पश्चात् प्रारंभिक आवधिक परीक्षण किए जाएंगे । " ।

B. उक्त विनियमों के विनियम 392 में खंड ( थ ) का लोप किया जाएगा ।

9. उक्त विनियमों के विनियम 392 में खंड ( 3 ) में,

( i ) उपखंड (i ) और उपखंड ( ii ) में " यांत्रिक या अथवा वैद्युत अभियांत्रिकी " शब्दों के स्थान पर , जहां - जहां वे आते हैं " यात्रिक इंजीनियरी " शब्द रखे जाएंगे ;

( ii ) उपखंड ( iii ) के पश्चात् निम्नलिखित उपखंड अंतःस्थापित किया जाएगा , अर्थात्:-

" ( iiiक) विशेष वर्ग बायलर मरम्मतकर्ता- फर्म के स्वाभी के पास ही यांत्रिकी या बेल्डिग इंजीनियरी में डिग्री होगी साथ ही उसके पास बेल्डिग प्रौद्योगिकी में न्यूनतम तीन वर्ष की अवधि के लिए विशेषित अनुभव होगा या फर्म के रोल पर स्थायी रूप से यात्रिकी या बेल्डिग प्रौद्योगिकी मेंन्यूनतम तीन वर्ष की अवधि के लिए विशेषित अनुभव के साथ एक इंजीनियर नियोजित होगा जिसके पास यांत्रिक या बेल्डिंग इंजीनियरी में डिग्री होऔर इन विनियमों के उपबंधों के अनुसार स्थायी रूप से बेल्डरों को नियोजित किया गया हो । बेल्डरों के पास टंग्सटन इनर्ट गैस (टीआईजी) बेहिंडग करने के लिए विधिमान्य प्रमाण पत्र भी होगा ।";

10. उक्त विनियमों के विनियम 554क में,

।।. उक्त विनियमों के विनियम 608 के स्थान पर निम्नलिखित विनियम रखा जाएगा, अर्थात्:-

"608. आयु और अनुभव कोई अभ्यर्थी जो इन विनिययों के अधीन किसी प्रमाण पत्र के लिए अर्हित होने की भांप करता है , 18 वर्ष को आयु से कम का नहीं होगा और उसने औद्योगिक प्रशिक्षण संस्थान से नियमित शिक्षुता प्राप्त की हो या किसी औद्योगिक संगठन से नियमित शिक्षुता प्राप्त की हो जिसके उपरांत किसी औद्योगिक कर्मशाला में बेल्डर के रूप में कम से कम एक वर्ष का नियमित कार्यानुभव हो । ";

[ PART 11-SEC. 3( i ) ] 12. उक्त विनियमों के प्ररूप-18 में क्रम सं. 3 और उससे संबंधित प्रविष्टियों के स्थान पर निम्नलिखित क्रम सं. और प्रविष्टियां रखी जाएंगी अर्थात्:-

G.S.R. 123. Whereas, certain draft regulations further to amend the Indian Boiler Regulations , 1950 were published, as required by sub -section ( 1 ) of Section 31 of the Indian Boilers Act , 1923 (5 of 1923 ), in Part -Il, Section 3 , sub-section (i ) of the Gazette of India dated the 27th October , 2007 vide notification of the Government of India in the Ministry ofCommerce and Industry (Department of Industrial Policy and Promotion) ( Central Boilers Board ) number G.S.R. 218, dated the 15th October, 2007 for inviting objections and suggestions from all persons likely to be affected thereby till the expiry of the period of forty-five days from the date on which the copies of the said Gazette notification were made available to the public;

And whereas, the copies of the said Gazette were made available to the public on the 18th December, 2007;

And whereas, no objections or suggestions have been received from any person within the specified period in respect of the amendments contained in this notification;

Now, therefore, in exercise of the powers conferred by Section 28 of the Indian Boilers Act, 1923 (5 of 1923), the Central Boilers Board hereby makes the following regulations further to amend the Indian Boiler Regulations , 1950 , namely:-

1. (1 )These regulations may be called the Indian Boiler (Amendment) Regulations ,2008 .

(2)They shall come into force on the date of their publication in the Official Gazette .

2. In the Indian Boiler Regulations , 1950 (hereinafter referred to as the said regulations ) , in regulation 46, in clause (i ), thewords and figures " In the absence of working pressure indicated in the Test Certificate that the test pressure indicated in the Test Certificate divided by 1.5 shall be the maximum working pressure" shall be omitted;

3. In the said regulations , in regulation 56 , in clause ( i ), the words and figures " In the absence of working pressure indicated in the Test Certificate that the test pressure indicated in the Test Certificate divided by 1.5 shall be the maximum working pressure " shall be omitted;

4. In the said regulations, in regulation 98A, for clause (iv ) , the following clause shall be substituted , namely:-

"(iv) Test - The rods shall be subjected to initial tests and periodic tests after every one year to ensure that the requirement of these regulations are fulfilled." ;

5. In the said regulations , in regulation 125, in clause ( a) , for the word and figures "5/8 inch " , the word and figures "20 mm" shall be substituted;

6. In the said regulations , in regulation 166, for the words and figures

8. In the said regulations , in regulation 392 , clause ( 9 ) shall be omitted;

9. In the said regulations , in regulation 392, in clause (3 ) ,

(i ) in sub - clauses (i ) and ( ii ) , for the words "mechanical or electrical engineering " , wherever they occur, the words "mechanical engineering " shall be substituted .

(ii) after sub - clause ( iii ) , the following sub - clause shall be inserted, namely:--

"( iii a ) Special class boiler repairer The owner of the firm himself shall have a degree in mechanical or weldung engineering alongwith specialized experience in welding technology for a minimum period of three years or the firm shall have on its rolls a permanently employed engineer having a degree in mechanical or welding engineering alongwith specialized experience in welding technology for a minimum period ofthree years and have permanently employed welders as per the provisions of these regulations. The welders should also have valid certificate for canying out Tungsten Inert Gas( TIG) welding.";

10. In the said regulations , in regulation 554A , for the words and figures

11. In the said regulations , for regulation 608, the following regulation shall be substituted , namely:-

"608. Age and experience A candidate who wishes to qualily for a certificate under these regulations shall not the less than 18 years of age and shall have undergone a regular apprenticeship from a recognized industrial training institute [ भाग 1 ]- खण्ड 3 ( i) ]

or one year regular apprenticeship from an industrial organization followed by at least one year regular on job experience as awelder in a workshop of industry.";

12, In the said regulations , in Form - XVIII , for serial number 3 and the entries relating thereto, the following serial number and entries shall be substituted , namely:-

"3. Classification applied for

(a) Special Class ( Boiler Pressure> 125kg /cm²) (b) Class I (Boiler Pressure > 40kg / cm² and≤ 125kg./cm² )

(d) Class 111 (Boiler Pressure ≤ 17.5kg /cm²) Note:Ahigher Class repairer would be eligible to undertake lower class works /jobs. " .

सा.का.नि. 124.- राष्ट्रपति, संविधान के अनुच्छेद 309 के परंतुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए और राष्ट्रीय संग्रहालय . नई दिल्ली समूह ' क ' और समूह ' ख' पर्ती नियम , 1963 , को जहां तक उनका सम्बन्ध संग्रहपाल ( पुरातन्य ) , संग्रहपाल ( प्रकाशन ) और संग्रहपाल ( जनसंपर्क ) के पदों से है , उन बातों के सिवाय अधिक्रांत करते हुए , जिन्हें ऐसे अधिक्रमण से पूर्व किया गया है या करने का लोप किया गया है , संस्कृति मंत्रालय में समूह ' क ' पदों पर भर्ती की पद्धति का विनियमन करते हुए निम्नलिखित नियम बनाते हैं, अर्थात

1. संक्षिप्त एवं प्रारम्भ ( 1 ) इस नियमों का संक्षिप्त नाम संस्कृत्ति मंत्रालय , राष्ट्रीय संग्रहालय , नई दिल्ली, समूह ' क ' पद भर्ती नियम, 2008 है ।

(2 ) ये राजपत्र में अपने प्रकाशन की तारीख को प्रवृत्त होंगे ।

2. लागू होना.-ये नियम उनके साथ संलग्न अनूसूची के स्तम्भ । में विनिर्दिष्ट पदों पर लागू होंगे ।

३. पदों की संख्या , वर्गीकरण और वेतनमान -उक्त पदों की संख्या, उनका वर्गीकरण और उनके वेतनमान वे होंगे जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ 2 से स्तंभ 4 में विनिर्दिष्ट हैं ।

4. भर्ती की पद्धति , आयु-सीमा , अर्हताएं, आदि उक्त पदों पर भर्ती की पद्धति , आयु सीमा , अर्हताएं तथा उनसे संबंधित अन्य बातें वे होंगी जो पूर्वोक्त अनुसूची के स्तंभ 5 से स्तंभ 14 में विनिर्दिष्ट हैं ।

5. निरर्हता. वह व्यक्ति ,

(क ) जिसने ऐसे व्यक्ति से , जिसका पति या जिसकी पत्नी जीवित है , विवाह किया है ; ग्रा

( ख ) जिसने अपने पति या पत्नी के जीवित रहते किसी व्यक्ति से विवाह किया है,

उक्त पद पर नियुक्ति का पात्र नहीं होगा:

परंतु यदि केन्द्रीय सरकार का यह समाधान हो जाता है कि ऐसा विवाह ऐसे व्यक्ति और वित्त्रात्त के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य आधार हैं , तो वह किसी व्यक्ति को इस नियम कं प्रवर्तन से छूट दे सकेंगी ।

6. शिथिल करने की शक्ति-जहां केन्द्रीय सरकार की यह रश्य है कि ऐसा करना आवश्यक या समीचीन है , वहां वह उसके लिए जो कारण हैं उन्हें लंखबद्ध करक , तथा संघ लोक सेवा आयोग से परामर्श करके, इन नियमों के किस उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी ।

7. व्यावृत्ति, इन नियमों की कोई बात , ऐसे आरक्षण , आयु सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका कंन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों , अनुसूचित जनजातियों , भूतपूर्व सैनिकों , और अन्ध विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

1. किसी मान्यताप्राप्त विश्वविद्यालय से आवश्यक अर्हता में उल्लिखिद विषयों में से किसी एक विषय में पी.एच.डी. डिग्री अथवा समतुल्य

2 ऐसे विभागीय उपसंग्रहाध्यक्ष ( पुरातत्त्व) एवं उपसंग्रहाध्यक्ष ( प्रागैतिहासक पुरातत्व ) , जो उस श्रेणी में पांच वर्ष की नियमित सेवा सहित 8000- 13500 रु . के वेतनमान में कार्यरत है, पर भी बाहरी व्यक्तियों के साथ विचार किया जाएगा । यदि उनका इस पद पर नियुक्ति हेतु चयन हो जाরা है तो इस पद को प्रोन्नति द्वारा भरा समझा जाएगा ।

टिप्पण 1. पोषक प्रवर्ग के ऐसे विभागीय अधिकारी , जो प्रोन्नति की सीश्री पंक्तिमें हैं , प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के भात्र नहीं होंगे । इसी प्रकार , प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे ।

टिप्पण 2.- प्रतिनियुक्ति/संविदा की अवधि , जिसके अंतर्गत केन्द्र सरकार के उसी या किसी अन्य संगठन विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर बाह्य पद पर प्रतिनियुक्त को अधि है , साधारणतया तीन वर्ष से अधिक नहीं होगी ।

टिप्पण 3.- प्रतिनियुक्ति पर नियुक्ति ( जिसके अंतर्गत अल्पकालिक संविदा भी है ) के लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी ।

2. ऐसे विभागीय प्रोडक्शन अधिकारी जिन्होंने 6500-10500 रु. के वेतनमान की उस श्रेणी में आठ वर्ष नियमित संवा की है और ऐसे विभागीय उपसंग्रहाध्यक्ष ( प्रदर्शनी ) जिन्होंने 8000-135000 रु . के वेतनमान की उस श्रेणी में पांच वर्ष नियमित सेवा की है , बाहरी व्यक्तियों के साथ भी विचार किया जाएगा और यदि वह इस पद पर नियुक्ति हेतु चयन किया जाता है तो वह इस पद को प्रोन्नति द्वारा भरा समझा जाएगा ।

टिप्पण 1.-प्रोन्नति के लिए पात्रता सूची अधिकारियों द्वारा संबंधित श्रेणी में या पद के लिए विहित अर्हक सेवा पूरा कर लेने की तारीख के प्रति निदेश से तैयार की जाएगी ।

टिप्पण 2.- पोषक प्रवर्ग के ऐसे विभागीय अधिकारी , जो सीधी पदोन्नति के पात्र हैं , प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे। इसी प्रकार , प्रतिनियुक्ति व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे ।

टिप्पण 1. पोषक प्रवर्ग के ऐसे विभागीय अधिकारी , जो प्रोन्नति की सीधी पंक्ति में है, प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे । इसी प्रकार , प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे ।

G.S.R. 124. In exercise of the powers conferred by the proviso to article 309 of the Constitution and in supersession ofthe National Museum , New Delhi Group ' A' and Group ' B ' Recruitment Rules, 1963 in so far as theyrelate to the posts ofKeeper ( Archaeology ), Keeper (Publication) and Keeper ( Publication Relation ) except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment to the Group' A' posts in the Ministry of Culture , namely :-

1. Short title and commencement.-( 1 ) These rules may be called the Ministry ofCulture, National Museum , New Delhi, Group' A' Posts Recruitment Rules , 2008.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. Application. These rules shall apply to posts specified in column 1 of the Schedule annexed to these rules.

3. Number of posts, classification and scale of pay.-The number of said posts , their classification and scale of pay attached thereto shall be as specified in columns 2 to 4 of the said Schedule,

4.Method of recruitment, age limit, qualifications, etc.-The method of recruitment , age lirnit, qualifications and other matters relating thereto shall be as specified in columns 5 to 14 of the aforesaid Schedule.

5. Disqualification. No person,

(a)who has entered into or contracted a marriage with a person having a spouse living , or (b) who, having a spouse living , has entered into or contracted a marriage with any person, shalt be eligible for appointment to the said post:

Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule.

6. Power to relax.-Where the Central Government is of the opinion that it is necessary or expedient so to do, it may ,byorder, for reasons to be recorded in writing and in consultation with the Union Public Service Commission , relax any of the provisions of these rules with respect to any class or category of persons.

7. Saving. Nothing in these rules shall affect reservations , relaxation of age limit and other concessions required to be provided for the Scheduled Castes , the Scheduled Tribes, ex -servicemen and other special categories ofpersons in accordance with the orders issued by the Central Goverument from time to time in this regard.

1. ( 1 ) इन नियमों का संक्षिप्त नाम दिल्ली दुग्ध योजना विश्लेषक भर्ती ( संशोधन ) नियम , 2008 है ।

(2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत होंगे ।

2. दिल्ली दुग्ध योजना ( विश्लेषक ) भर्ती नियम, 2005 की अनुसूचि में-

(i ) नियम 3 के हिन्दी पाठ में संशोधन की आवश्यकता नहीं है ।

(ii ) . नियम 4 के हिन्दी पाठ में संशोधन की आवश्यकता नहीं है ।

(iii ) अनुसूचि में,-

(क) स्तंभ (8 ) में शीर्षक के अधीन " वांछनीय " उप शीर्षक के स्थान पर निम्नलिखित रखा जाए , अर्थात्:-

(1) These rules may be called the Delhi Milk Scheme Analyst Recruitment (Amendment) Rules,2008.

(2) They shall come into force on the date of their publication in the Official Gazette.

2. In the Delhi Milk Scheme (Analyst) Recruitment Rules, 2005 ,-

(1) in rule 3, the letter " a " occurring after the word " as " shall be omitted,

(ii) in rule 4, in clause (a), for the word "contracted" , the word "contracted " shall be substituted;

(ii) in the Schedule,

(a) under the heading in column (8 ), for the sub- heading "Desirable: ", the following shall be substituted, namely:-
