सं. 29 - सीए/ लॉ/डी-185/ 2008-- चार्टर्ड एकाउन्टेण्ट्स विनियम, 1988 के विनियम 18 के साथ पठित चार्टर्ड एकाउन्टेण्ट... अधिनियम, 1949 की धारा 20 की उपधारा ( 2 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, भारतीय चार्टर्ड एकाउन्टेण्ट्स संस्थान की परिषद् द्वारा, एतद्वारा , यह अधिसूचित किया जाता है कि माननीय दिल्ली उच्च न्यायालय ने , उक्त अधिनियम की धारा 21 ( 6 ) ( ग ) के अनुसरण में, चार्टर्ड एकाउन्टेण्ट संदर्भ संख्या 9/2005 में 25 सितम्बर, 2007 को यह आदेश किया था कि श्री के. के. गुप्ता , एफसीए, चार्टर्ड एकाउन्टेण्ट, ई -173 , ( एलजीएफ ) , कालकाजी , नई दिल्ली-110019 और साथ ही ई -80 , लाजपत नगर-1 , बेसमेंट, नई दिल्ली -110024 ( सदस्य सं. 83716 ) , को चार्टर्ड एकाउन्टेण्ट अधिनियम, 1949 की द्वितीय अनुसूची के भाग 1 के खण्ड ( 6 ) , ( 7 ) , ( 8 ) और ( 9 ) के अंतर्गत वृत्तिक अवचार और चार्टर्ड एकाउन्टेण्ट अधिनियम , 1949 की धारा 21 के साथ पठित धारा 22 के अधीन " अन्य अवचार " का भी दोषी पाए जाने के कारण उनका नाम एक वर्ष की अवधि के लिए सदस्यों के रजिस्टर से हटा दिया जाए। तद्नुसार, यह सूचित किया जाता है कि उक्त श्री के. के. गुप्ता का नाम तारीख 1 अक्तूबर 2008 से एक वर्ष की अवधि के लिए सदस्यों के रजिस्टर से हटा दिया जाएगा । उक्त अवधि के दौरान वह माननीय दिल्ली उच्च न्यायालय के उक्त आदेश के निबन्धनानुसार चार्टर्ड एकाउन्टेण्ट के रूप में व्यवसाय नहीं करेंगे ।

No.29 - CA/Law / D - 185 / 2008 : In exercise of the powers conferred by sub - section ( 2 ) of Section 20 of The Chartered Accountants Act , 1949 read with Regulation 18 of the Chartered Accountants Regulations , 1988 , it is hereby notified by the Council of the Institute of Chartered Accountants of India that the Hon'ble High Court of Delhi has , in pursuance of Section 21 ( 6 ) ( c) of the said Act , in Chartered Accountant Reference No.9 / 2005 , ordered on 25th September , 2007 that the name of Shri K.K Gupta , FCA , Chartered Accountant , E - 173 ( LGF ) , Kalkaji , New Delhi 110019 , also at E -80 , Lajpat Nagar- 1 , Basement , New Delhi 110024 ( M.No.83716 ) be removed from the Register of Members for a period of one year for having been found guilty of professional misconduct falling within the meaning of clauses ( 6 ) , ( 7 ) , ( 8 ) & ( 9 ) of Part 1 of the Second Schedule to the Chartered Accountants Act , 1949 and also guilty of " other misconduct " under Section 22 read with Section 21 of the Chartered Accountants Act , 1949. Accordingly , it is hereby informed that the name of the said Shri K.K. Gupta shall stand removed from the Register of Members for a period of one year w.c.f. 1st October , 2008. During that period he shall not practise as a Chartered Accountant. in terms of the said order of the Hon'ble High Court of Delhi .
