पुर्नगठित अखिल भारतीय हस्तशिल्प बोर्ड में अध्यक्ष, सदस्य सचिव सहित 24 सरकारी सदस्यों तथा 51 गैर सरकारी सदस्यों को शामिल करते हुए बोर्ड की वर्तमान संख्या 76 सदस्य हो जाएगी ।

आदेश
(एन.आई.टी. अधिनियम 2007 की धारा 36 ( 1 ) के उपबंधों का प्रयोग करते हुए)

जबकि मानव संसाधन विकास मंत्रालय ने अगरतला , जमशेदपुर, एवं रायपुर में स्थित राष्ट्रीय प्रौद्योगिकी संस्थानों में निदेशक के पद पर नियुक्ति की प्रक्रिया अगस्त, 2006 में आरंभ कर दी थी । यह प्रक्रिया इन चयनों हेतु उस समय लागू नियमों के अनुसार अपनाई गई थी। जैसा कि मानव संसाधन विकास मंत्रालय को कार्मिक व प्रशिक्षण विभाग के दिनांक 10 सितावर, 2007 के सं. 4/17/2007 ई.ओ. (एस.एम.-।।) के तहत चयन प्रक्रिया मंत्रिमण्डल की नियुक्ति समिति द्वारा प्रदत्त अनुमोदन के साथ सूचित की गई थी । तथापि , मंत्रिमण्डल की नियुक्ति समिति के अजुगोदव की प्रापित से पहले राष्ट्रीय प्रौद्योगिकी संस्थान अधिनियम, 2007 , 15 अगस्त, 2007 से लागू किया गया था । चूंकि राष्ट्रीय प्रौद्योगिकी संस्थान अधिनियम , 2007 की धारा 17 ( 1) में प्रावधान है कि किसी राष्ट्रीय प्रौद्योगिकी संस्थान के निदेशक की नियुक्ति विजिटर द्वारा की जाएगी , मंत्रिमण्डल की नियुक्ति समिति के अनुमोदन के पश्चात् विधि तथा व्याय अंत्रालय के विचार लिए गए कि क्या राष्ट्रीय प्रौद्योगिकी संस्थान अधिनियम , 2007 लागू होने के कारण इन नियुक्तियों के लिए विजिटर का अनुमोदन अपेक्षित है । विधि तथा न्याय मंत्रालय का अभिमत या कि विजिटर का अनुमोदन राष्ट्रीय प्रौद्योगिकी संस्थान अधिनियम अनुसार प्राप्त किया जा बाहिए । तदनुसार राष्ट्रपति सचिवालय से प्रस्ताव को राष्ट्रपति के राष्ट्रीय प्रौद्योगिकी संस्थान की विजिटर के रूप में अनुमोदन हेतु उनके समक्ष प्रस्तुत करने के लिए अनुरोध किया गया था । राष्ट्रपति सचिवालय से प्रस्ताव इस नोट के साथ वापरा भेज दिया गया कि नियुक्तियों में अपनाई गई चयन प्रक्रिया संगत राष्ट्रीय प्रौद्योगिकी संस्थान अधिनियम , 2007 के अनुसार नहीं थी तथा अनुरोध किया गया था कि उपरोक्त अधिनियम में अई रांगत प्रक्रिया के अनुसार बया प्रस्ताव पुनः प्रस्तुत किया जाए।
2. जबकि राष्ट्रीय प्रौद्योगिकी संस्थान अधिनियम की धारा 17 (1 ) में निदेशक की नियुक्ति की प्रक्रिया विधि दी गई है जो कि निम्नलिखित अनुसार है:-
" 17 (1) किसी संस्थान के निदेशक व उप निदेशक की नियुक्ति. गिजेटर द्वारा सेवा के उनके द्वारा गठित चथन समिति की शिफारि तथा उन निबंधनात की जानी जोक्ति संविधि में विधर्धारित की गड़ है।" 1039 भाग -खण्ड । ]

3. जबकि विजिटर के कार्यालय से प्रस्ताव के वापस आने के बाद मंत्रालय ने मामला अपने हाथ में ले लिया तथा संविधि का प्रारूप तैयार करने की प्रक्रिया शुरू कर दी है , जिसमें राष्ट्रीय प्रौद्योगिकी संस्थान के निदेशक की चयन प्रकिया विधि को निर्धारित किया जा रहा है । तथापि , इसमें समय लग रहा है तथा नियमित निदेशक की अनुपस्थिति में अगरतला , जमशेदपुर और रायपुर के राष्ट्रीय प्रौद्योगिकी संस्थानों को दिन- प्रतिदिन के प्रशासनिक कार्यों में काफी परेशानी हो रही है ।
4. जबकि, ये संस्थान राष्ट्रीय महत्व के हैं तथा बिना नियमित निदेशकों के इन्हें नहीं छोड़ा जा सकता क्योंकि उन्हें संस्थानों के प्रमुख कार्यकारी अधिकारी के तौर पर भी कार्य करना होता है । इसके अतिस्थित नियुक्तियों में और देरी इन तीन राष्ट्रीय प्रौद्योगिकी संस्थानों के अकादमिक हित में भी वहीं है ।
5. जबकि अधिनियम के प्रभावी होने से पहले मंत्रिमण्डल की नियुक्ति समिति राष्ट्रीय प्रौद्योगिकी संस्थानों के निदेशकों की नियुक्ति का अनुमोदन करने में सक्षम थी और उसने 3 निदेशकों की धियुभित को पहले से ही मंजूरी प्रदान कर दी थी, परन्तु कानूनी मामले विभाग से यह सलाह मांगी गई थी कि क्या मंत्रिमण्डल की नियुक्ति समिति के अनुमोदन के आधार पर अगरतला , जमशेदपुर और रायपुर के राष्ट्रीय प्रौधोगिकी संस्थानों के तीन निदेशकों की नियुक्ति को मंजूरी दी जा सकती है ?
6 . जबकि विधायी विभाग ने यह राय व्यक्त की है कि राष्ट्रीय प्रौद्योगिकी संस्थान , 2007 भविष्य लक्षी स्वरूप का होने के कारण विजिटर द्वारा निदेशकों की नियुक्ति सहित इसके प्रावधान इस अधिनियम के प्रवर्तन की तारीख से लागू होंगे जब तक कि इसमें विगत में भूत लक्षी प्रभाव से कुछ जोड़ा न गया हो अथवा कोई लम्बित संव्यवहार न हो जो इस अधिनियम में उपबंध किए गये प्रतीत नहीं होते । इस संदर्भ में चयन प्रक्रिया जो राष्ट्रीय प्रौद्योगिकी संस्थान अधिनियम , 2007 के लागू होने से पूर्व शुरू की गई थी यह अधिकांशतः पूरी हो गई है और रिक्तियों के विज्ञापन के समय से विद्यमान नियमों /प्रक्रिया द्वारा कार्यान्वित की जा सकती है और भविष्य की नियुक्तियां , राष्ट्रीय प्रौद्योगिकी संस्थान अधिनियम , 2007 के प्रावधानों की शर्तों से की जाएगी । तथापि , इस अधिनियम के साथ नियुक्तियों को संगत करने के लिए राष्ट्रीय प्रौद्योगिकी संस्थान अधिनियम , की धारा 36 के प्रावधान जो कठिनाईयों को दूर करने से संबंधित है , को लागू किया जाए ।
7. इसलिए , राष्ट्रीय प्रौद्योगिकी संस्थान अधिनियम , 2007 की धारा 36 (1 ) के अंतर्गत प्रदत्त शक्त्तियों का प्रयोग करते हुए केन्द्र सरकार संबंधित राष्ट्रीय प्रौद्योगिकी संस्थान के निदेशक के पद द्वारा कार्यभार ग्रहण करने की तारीख से अवधि आधार पर पांच वर्ष की अवधि तक या अगले आदेशों तक , जो भी पहले हों , निम्नलिखित नियुक्तियां करती हैं:-

जबकि विश्वविद्यालंय अनुदान आयोग अधिनियम , 1956 की धारा 3 के अंतर्गत केन्द्र सरकार को विश्वविद्यालय अनुदान आयोग की सलाह पर किसी उच्चत्तर अध्ययन संस्था को " समविश्वविद्यालय " घोषित करने का अधिकार प्राप्त है ।
2. और जबकि श्री बालाजी विद्यापीठ, पाण्डिचेरी जिसकी निम्नलिखित संस्थाएं हैं, से प्रस्ताव प्राप्त हुआ है जिसमें विश्वविद्यालय अनुदान आयोग अधिनियम , 1956 की धारा के अंतर्गत ' नए सिरे से संस्था के रूप में समविश्वविद्यालय के दर्जे की मांग की गईथीः-
(1) महात्मा गांधी चिकित्सा कालेज और अनुसंधान संस्थान, पाण्डिचेरी (ii) कस्तूरबा गांधी वर्सिंग कॉलेज , पाण्डिचेरी

(iii) इंन्दिश गांधी दन्त चिकित्सा संस्थान , पाण्डिचेरी
(iv) भरतियार इंजीनियरी और प्रौद्योगिकी कॉलेज , कराइकल , पाण्डचेरी 3 . और जबकि चिश्वविधालय अनुदान आयोग ने उक्का प्रस्ताव की जांच की है और दिनांक 2 जनवरी २०७४ अपने पत्र संख्या 6-50 :2005 (सी.पी.पी.- । ) के जरिए यह सिफारिश की कि महात्मा गांधी चिकित्सा कालेज और अनुसंधान संस्थान को उसके मूल विद्यालय से अनापत्ति प्रमाण प्राप्त करने की शर्त 1041 भाग ।-खण्ड १]

के अधीन समविश्वविद्यालय का दर्जा प्रदान किया जाए । इसके बाद विश्वविद्यालय अनुदान आयोग ने दिनांक 08.02.2008 के अपने पत्र संख्या 6-50/2005 (सी.पी.पी.-।) के जरिए इस आशय से अपनी सिफारिश को आंशिक रूप से संशोधित किया है कि यह दर्जा ' नए सिरे से' श्रेणी के तहत प्रदान किया जाए । 4. इसीलिए केन्द्र सरकार अब विश्वविद्यालय अनुदान आयोग अधिनियम , 1956 की धारा -3 द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए विश्वविद्यालय अनुदान आयोग की सलाह पर एतद्द्वारा वह घोषणा करती है कि श्री बालाजी विद्यापीठ , पुडुचेरी, जिसमें महात्मा गांधी चिकित्सा कालेज और अनुसंधान संस्थान , पुड्डुचेरी भी शामिल है , उक्त अधिनियम के प्रयोजनार्थ 'नए सिरे से' श्रेणी के तहत उस तारीख से जिससे महात्मा गांधी चिकित्सा कालेज और अनुसंधान संस्थान अपने संबंधन विश्वविद्यालय अर्थात पाण्डिचेरी विश्वविद्यालय से असम्बद्ध कर लेगा अनंतिम रूप से पांच वर्ष की अवधि के लिए प्रत्येक वर्ष के अन्त में विश्वविद्यालय अनुदान आयोग द्वारा समीक्षा की शर्त के अधीन " समविश्वविद्यालय" होगा । 5. श्री बालाजी विद्यापीठ को प्रदान किए गए दर्जे की उपर्युक्त पैरा -4 के अनुसार विश्वविद्यालय अनुदान आयोग की विशेषज्ञ समिति के माध्यम से की जाने वाली वार्षिक समीक्षाओं और उन पर आयोग की सिफारिशों के आधार पर ही पांच वर्ष की अवधि के बाद पुष्टि की जाएगी,
6 . उपर्युक्त पैरा-4 में की गई उद्घोषणा इस अधिसूचना के पृष्ठांकन की कमसंख्या-7 में उल्लिखित अतिरिक्त शर्तों को पूरा करने/इनका अनुपालन करने की शर्त के भी अधीन है ।
7 . न तो भारत सरकार और न ही विश्वविद्यालय अनुदान आयोग श्री बालाजी विद्यापीठ या इसकी संघटक इकाई को योजनागत अथवा योजनेत्तर सहायता अनुदान प्रदान करेंगे ।

RESOLUTION
No. K- 12012/ 5/ 16/2006 - P & R/313- In partial modification to Resolutions of even number dated 21.12.2006 & 9.3.2007 Non - Official Members mentioned at S.No.1 Shri Karansinh Manubha Chavda , C- 25, Bhagat Nagar Society, Near Gulab Tower , Sola Road , Ahmedabad 380061 ( Gujarat ) and Shri Shisupal Singh , C- 51 , Kamala Nehru Nagar Extn . - 1 , Jodhpur ( Rajasthan ) respectively are removed from the All India Handicraft Board with immediate effect, while retaining all official and Non -Official members of existing All India Handicrafts Board constituted vide resolutions dated 08th September, 2006 ( except Sl.No.1,3 , 5 & 7 ) 23rd October , 2006 , 22nd November , 2006 and 27th November , 2006 , 5th , 21st December , 2006 ( except Si.No.1 & 2 ) and 22nd December , 2006 ( except Sl.5 ) 5th & 10th January 2007 , 1st February , 2007 ( except Sl . No.1 ) and 14th February, 2007 ( except Sl . No.2,3,4,5,7,8,9 & 10 ) , 2nd March , 2007 ( except Sl.No.2 ) , 7th & 9th March 2007 , 8th May, 2007 ( except Sl.No.2 ) , 16th , May, 2007 , 25th July, 2007, 3rd & 29th August , 2007 , 11th September , 2007 , 24th September , 15th October , 2007 , 2nd November 2007 , 11th , 12th & 25th March 2008 and 8th May 2008 .
The present strength of the Board shallbe 76 Members comprising of Chairman , 24 official Members including Member Secretary and 51 Non - official Miemibers , in the reconstituted All india Handicrafts Board.

ORDER
(In exercise of provisions of section 36 ( 1) of NIT Act 2007 ) .
No. 22-7/2006 TS III-
whereas the Ministry of Human Resource Development initiated the process of appointment to the post of Director in the National Institutes of Technology (NITS ) located at Agartala , Jamshedpur and Raipur in August 2006. The procedure adopted was as per rules applicable for these selections as applicable at that time . The selection process was completed with the approval accorded by the Appointment Committee of the Cabinet (ACC) as communicated to Ministry of HRD vide DOPT'S No. 4/17/2007 ΕΟ ( SM II ) dated 10th Sept. 2007. However , before the receipt of ACC approval , the NIT Act 2007 came in to force on the 15th August , 2007. Since Section 17 ( 1) of the NIT Act 2007 provides that the appointment of Director of an NIT shall be made by the Visitor , opinion of the Ministry of Law & Justice was sought whether after the approval of ACC , approval of Visitor is required for these appointments in view of NIT Act 2007 having came in to force. Ministry of Law & Justice opined that the approval of Visitor may be obtained as per The 3-201 G1 / 2008 PART 1-SEC . 1 ]

provision of the NIT Act and accordingly President's Secretariat was requested to place the proposal before the President for approval of these appointments in her capacity as Visitor to the NITS . The President's Secretariat sent back the proposal noting that the selection process employed in the appointments were not in conformity with the respective NIT Act 2007 and requested to resubmit the proposal afresh in terms of the relevant procedure laid down in the said Act .
2. whereas the procedure for appointment of the Director is given in Section 17 ( 1 ) of the NIT Act , which is as follows : -
" 17 (1) The Director and Deputy Director of an Institute shall be appointed by the Visitor , on such terms and conditions of service and on the recommendations of a Selection Committee constituted by him in such manner , as may be prescribed by the Statutes . " A
3 . is whereas , after the return of the proposal from the visitor's office , Ministry has been seized of the matter and has initiated the process for drafting the Statutes , in which the procedure being prescribed for selection process of the Director of an NIT . administration , in the absence of a regular Director .
4. -: whereas , these Institutes are of national importance, and cannot remain without regular Directors in place who are to act as the Chief Executive Officers of the Institutes . Also , delaying the appointments any further , may not be in academic interest of these 3 NITS .
5 . whereas , the ACC , which was competent to approve appointments of the Directors of NITS , before the Act having come in to force and already having cleared the appointment of the 3 Directors , the advice of Department of Legal Affairs was sought whether the appointment of three Directors of NITS at Agartala , Jamshedpur and Raipur may be given effect based on the approval of ACC .
6 . whereas , the Department of Legal Affairs have opined that the NIT Act 2007 , being prospective in nature , its provisions including that of appointment of Directors by visitor would come in to effect from the date of enforcement unless some retrospectively is attached to past or pending transactions which do not appear to be available in this Act . In view of this , selection process which was initiated much prior to enforcement of NIT Act 2007 and is almost complete can be carried out with rules / procedure as existed at the time of 4-20141/2008 [PART I--SEC. 1 1046

advertisement of vacancies and only future appointments are to be carried out in terms of the provisions of the NIT Act 2007. However , to harmonize the appointments with the provisions of the Act , provisions of section 36 of the NIT Act , which deals with Removal of Difficulties , may be invoked .
7. Now , therefore , in exercise of the powers conferred under section 36 ( 1 ) of the NTT Act 2007 , the Central Government makes the following appointments for a period of five years purely on tenure basis , w.e.f. the date of assumption of charge of the post of the Director of respective NITS or until further orders , whichever is earlier : -
( i ) Dr. Probir Kumar Bose , Professor , Department of Mechanical Engineering , Jadavpur University .
Appointed as Director , NIT, Agartala ( ii ) Prof. Rajnish Shrivastava , Adviser I , AICTE , New Delhi .
Appointed as Director, NIT, Jamshedpur
Appointed as Director , NIT , Raipur (iii ) Dr. (Mrs) Shashi Krishna Pandey , Director , Sant Longowal Institute of Engineering & Technology , Longowal .

Whereas the Central Government is empowered under Section 3 of the University Grants Commission ( UGC ) Act , 1956 to declare , on the advice of the UGC, an Institution of Higher Learning as a " Deemed -to-be - University" .
2. And whereas , a proposal was received from Sri Balaji Vidyapeeth , Pondicherry seeking status of'deemed-to-be-university' , as A ' De Novo' Institution , under Section 3 of the UGC Act , 1956 , comprising the following institutions:
(i) Mahatma Gandhi Medical College & Research Institute . Pondicherry, ( ii) Kasturba Gandhi Nursing College , Pondicherry
(iii ) Indira Gandhi Institute of Dental Science , Pondicherry; and
( iv) Bharathiyar College of Engineering & Technology , Karaikal , Pondicherry.
3. And whereas, the University Grants Commission ( UGC ) has examined the said proposal and vide its communications bearing No.6-50/2005 (CPP - I ) dated the 2nd January, 2008 has recommended that Mahatma Gandhi Medical College & Research Institute be awarded the status of ' Deemed - to-be - University' subject to receiving no objection certificate from its parent university . Later, the UGC vide its letter No.6- 50/2005 ( CPP - I ) Dated 08.02.2008 has partially modified its recommendations to the effect that the status recommended be awarded under De Novo category .
4. Now, therefore, in exercise of the powers conferred by Section 3 of the UGC Act, 1956. the Central Government , on the advice of the UGC , hereby declare that Sri Balaji Vidyapeeth , Pondicherry , comprising Mahatma Gandhi Medical College & Research Institute , Pondicherry , shall be a " Deemed -to-be - University" , under 'De Novo' category , for the purposes of the aforesaid Act , provisionally for a period of five years with effect from the date the Mahatma Gandhi Medical College & Research Institute is disaffiliated from its affiliating university , viz. , Pondicherry University, subject to a review at the end of each year by the UGC.;
5. The status conferred on Sri Balaji Vidyapeeth shall be confirmed after a period of five years only on the basis of the reviews to be conducted annually through an Expert Committee of the UGC as per para 4 above , and recommendations of the Commission thereof;
6. The declaration as made in para 4 above is also subject to fulfiliment / compliance of further conditions mentioned at Sr. No.7 of the endorsement to this Notification;

7. Neither the Government of India nor the UGC shall provide any Plan or Non- Plan grant-in - aid to Sri Balaji Vidyapeeth any of its constituent units.
