सा.का. नि, 158, राष्ट्रपति , केन्द्रीय अन्वेषण ब्यूरो ( ज्येष्ठ पुलिस पद ) भर्ती नियम, 2000 का और संशोधन करने के लिए निम्नलिखित नियम बनाती हैं , अर्थात्
1. (1 ) इस नियमों का संक्षिप्त नाम केन्द्रीय अन्वेषण ब्यूरो (ज्येष्ठ पुलिस पद ) भर्ती ( संशोधन ) नियम , 2008 है । (2) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे ।
2. केन्द्रीय अन्वेषण ब्यूरो ( ज्येष्ठ पुलिस पद ) भर्ती नियम , 2000 की अनुसूची में , अपर पुलिस अधीक्षक के पद से संबंधित क्रम संख्या 8 और उससे संबंधित प्रविष्टियों के स्थान पर , निम्नलिखित रखा जाएगा , अर्थात्

1. नब्बे प्रतिशत प्रोन्नति द्वारा;
प्रोन्नति: 8,000-13,500 रु. के वेतनधान में केंद्रीय अन्वेषण ब्यूरो में ऐसा पुलिस उप अधीक्षक जिसने उस श्रेणी में छह वर्ष नियमित संत्रा की है ।
2. दस प्रतिशत प्रतिनियुक्ति/ आमेलन द्वारा ।
टिप्पण: जहां ऐसे कनिष्ठ व्यक्तियों के संबंध में , जिन्होंने अपनी अर्हक पात्रता सेत्रा पूरी कर ली हैं, प्रोन्नति के लिए विचार किया जा रहा हो यहां उनसे ज्येष्ठ व्यक्तियों के संबंध में भी विचार किया जाएगा परंतु यह तब जब कि उनके द्वारा की गई ऐसी अर्हक पात्रतासेवा, अपेक्षित अर्हक पात्रता सेवा के आधे से अधिक से या दो वर्ष से. इनमें से जो भी कम हो , कम न हो और उन्होंने अपने ऐसे कनिष्ठ व्यक्तियों सहित , जिन्होंने ऐसी अर्हक पात्रता सेवा पहले ही पूरी कर ली है . अगली उच्चतर श्रेणी में प्रोन्नति के लिए अपनी परिवीक्षा की अवधि सफलतापूर्वकः पूरी कर ली हो ।
प्रतिनियुक्ति/आमेलन :
कंन्द्रीय पुलिस संगठनों या राज्य पुलिस संगठनों के अधीन ऐसे अधिकारी :
( क) ( i ) जिन्होंने मूल काडर/विभाग में निमित आश्रार पर सदृश पद धारण किया हुआ है; या
( ii ) जिन्होंने मूल काडर/विभाग में 8,000-13,500 रु. या समतुल्य के वेतनमान में निर्यामत आधार पर उस पद पर नियुक्ति के पश्चात् उस श्रेणी में छह वर्ष सेवा की है। 779

(ख) जिनके पास निम्नलिखित शैक्षिक अर्हताएं और अनुभव हैं:
( i ) किसी मान्यताप्राप्त विश्वविद्यालय से स्नातक डिग्री या समतुल्य; और
(ii ) आपराधिक मामलों के अन्वेषण में पांच वर्ष का अनुभव ।
टिप्पण: आमेलन कुल प्रतिनियुक्ति पदों का 10 प्रतिशत से अधिक नहीं होगा । (पोषक प्रवर्ग के ऐसे विभागीय अधिकारी , जो प्रोन्नति की सीधी पंक्ति में हैं, प्रतिनियुक्ति पर नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे । इसी प्रकार , प्रतिनियुक्त व्यक्ति प्रोन्नति द्वारा नियुक्ति के लिए विचार किए जाने के पात्र नहीं होंगे । ( प्रतिनियुक्ति/संविदा की अवधि जिसके अंतर्गत केन्द्रीय सरकार के उसी या किसी अन्य संगठन/ विभाग में इस नियुक्ति से ठीक पहले धारित किसी अन्य काडर माह्य पद परं प्रतिनियुक्ति/ संविदा की अद्धि शामिल है, साधारणतया पांच वर्ष से अधिक नहीं होगी । प्रविनियुक्ति पर नियुक्ति जिसके अन्तर्गत अल्पकालिक संविदा भी है, के लिए अधिकतम आयु सीमा आवेदन प्राप्त करने की अंतिम तारीख को 56 वर्ष से अधिक नहीं होगी। )
यदि विभागीय प्रोन्नति समिति है तो उसकी संरचना

1.(1)These rules may be called the Central Bureau of Investigation (Senior Police Posts ) Recruitment (Amendment) Rules,2008.
(2) They shall come into force on the date of their publication in the OfficialGazette.
2. In the Schedule to the Central Bureau of Investigation (Senior Police Posts) Recruitment Rules, 2000, for serial number 8 relating to the past of Additional Superintendent of Police and the entires relating thereto, the following shall be substituted, namely:-

सम.का.नि. 162.-राष्ट्रपत्ति, संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत शक्तियों का प्रयोग करते हुए, केन्द्रीय लोक निर्माण विभाग के निर्धारित कर्म स्थापन में मोटर लारी चालक के पद पर भर्ती की पद्धति का विनियमन करने के लिए निम्नलिखित नियम बनाती हैं, अर्थात् 1. संक्षिप्त नाम और प्रारंभ.( 1 ) इन नियमों का संक्षिप्त नाम केन्द्रीय लोक निर्माण विभाग निर्धारित कर्म कर्मचारिवृन्द ( मोटर लारी चालक) समूह ' ग ' पर्ती नियम, 2008 है ।
(2 ) ये राजपत्र में प्रकाशन की तारीख को प्रवृत्त होंगे । 2: पद-संख्या , वर्गीकरण और वेतनमान -उक्त पद की संख्या , उसका वर्गीकरण और उसका वेतनमान यह होगा , जो इन नियमों से उपाबद्ध अनुसूची के स्तंभ ( 2 ) से स्तंभ ( 4 ) में विनिर्दिष्ट हैं । 3. आरंभिक गठन ऐसे व्यक्ति जो इन नियमों के प्रारंभ से पूर्व भारत सरकार, संकर्म महानिदेशालय , केन्द्रीय लोक निर्माण विभाग द्वारा जारी किए गए शुद्धिपत्र सं. 10/2/97 ई सी- एक्स तारीख 28 जनवरी, 2000 के साथ पठित कार्यालय ज्ञापन सं. 10/2/97 ई सी - एक्स तारीख 5 अगस्त, 1999 के निबंधनों के अनुसार मोटर लारी चालक के रूप में पहले से ही कार्यरत है , इन नियमों के अधीन मोटर लारी चालक के रूप में नियुक्त किए हुए समझे जाएंगे तथा उनके द्वारा की गई सेवा उनके अपने पदों में प्रोन्नति, ज्येष्ठता और सेवा के अन्य निबंधनों तथा शर्तों के लिए गिनी जाएगी ।
4. विशेष उपबंध, प्रत्येक सर्किल में इसका अपना पृथक काडर तब तक नहीं होगा जब तक केन्द्रीय लोक निर्माण विभाग द्वारा अन्यथा विनिर्दिष्ट न किया जाए ।
5. भर्ती की पद्धति , आयु -सीमा , अर्हताएं आदि, उक्त पद पर भर्ती की पद्धति , आयु सीमा , अर्हताएं और उनसे संबंधित अन्य बातें वे होंगी जो पूर्वोक्त अनुसूची के स्तंभ (5 ) से स्तंम ( 14 ) में विनिर्दिष्ट है ।
6. निरर्हता. वह व्यक्ति ,
(क ) जिसने ऐसे व्यक्ति से जिसका पति या जिसकी पत्नी जीवित्त है, विवाह किया है , या
(ख ) जिसने अपने पति या अपनी पत्नी के जीवित रहते हुए किसी व्यक्ति से विवाह किया है,
उक्त पद पर नियुक्ति का पात्र नहीं होगा :
परन्तु यदि केन्द्रीय सरकार का यह समाधान हो जाता है, कि ऐसा विवाह ऐसे व्यक्ति और विवाह के अन्य पक्षकार को लागू स्वीय विधि के अधीन अनुज्ञेय है और ऐसा करने के लिए अन्य उधार हैं तो यह किसी व्यक्ति को इस नियम के प्रवर्तन से छूट दे सकेंगी ।
7. शिथिल करने की शक्ति, जहां केन्द्रीय सरकार की यह राय है कि ऐसा करना आवश्यक या समीचीन है, वहां वह उसके लिए जो कारण हैं उन्हें लेखबद्ध करके , इन नियमों के किसी उपबंध को किसी वर्ग या प्रवर्ग के व्यक्तियों की बाबत , आदेश द्वारा शिथिल कर सकेगी ।
8. व्यावृत्ति. इन नियमों की कोई बात , ऐसे आरक्षण , आयु- सीमा में छूट और अन्य रियायतों पर प्रभाव नहीं डालेगी , जिनका केन्द्रीय सरकार द्वारा इस संबंध में समय - समय पर निकाले गए आदेशों के अनुसार अनुसूचित जातियों, अनुसूचित जनजातियों और अन्य पिछड़े बंगों, और अन्य विशेष प्रवर्ग के व्यक्तियों के लिए उपबंध करना अपेक्षित है ।

जाने वाले व्यक्तियों के लिए ।
(i ) पढ़ने और लिखने में समर्थ होना चाहिए तथा साधारण अंकगणित की जानकारी होनी चाहिए:
( ii ) उसके पास भारी मोटर यानों की विधिमान्य चालन अनुज्ञप्ति होनी चाहिए और
शारीरिक उपयुक्तता : अलेजां सीधे भर्ती किए जाने वाले व्यक्तियों
के लिए हैं ।
( iii ) गानों की लघु मरम्मतें करने का ज्ञान तथा कौशल हो ।
विभागीय परीक्षा वहीं जो सीधे
शारीरिक उपयुक्तता :
भर्ती किए जाने वाले व्यक्तिचों के लिए हैं ।
यदि आवेदक के पास चालन अनुज्ञप्ति 5 वर्ष से अधिक पुरानी है तो वह संबद्ध राज्य सरकार द्वारा रजिस्ट्रीकृत चिकित्सा व्यवसायी द्वारा जारी उपयुक्तता प्रमाणपत्र प्रस्तुत करेंगा जिसमें निम्नलिखित प्रमाणित किया
गया हो:-
( i ) वह चश्मे लगाकर या चश्मे लगाए बिना किसी दृष्टि दोष से ग्रस्त
न हो ।
( ii ) वह तुरंत रंजक रंगों , लाल और हरे रंग में भेद कर सकं ।
( iii ) वह दिन के प्रकाश में 25 मीटर की दूरी पर अगन्नी दृष्टि से मोटरकार पर प्लंट की संख्या में भंद करने में समर्थ होना चाहिए । (iv ) वह बधिरता की किसी ऐसी डिग्री से प्रस्त न हो जो उसे साधारणत
ध्वनि संकेतों के सुनाई पड़ने में रूकावट डाले ।
'(v ) रतौंधी से दोष ग्रस्त न हो , और
( vi ) उसमें ऐसा कोई दोष या विकलांगता या अंगविहीनता न हो जा एक चालक के रूप में उसके कर्तव्यों के दक्ष निष्पादन में हस्तक्षेप
करे ।
यदि आवेदक को मोटर लारी चालक के रूप में नियोजन में चयन करके रख लिया जाता है तो वह मोटर लारी चालक के रूप में बने रहने के 785

लिए अपनी उपयुक्तता के समर्थन में प्रत्येक पांच वर्ष पूरे होने पर उपरोक्त प्रमाणपत्र प्रस्तुत करेगा ।
विभागीयं परीक्षा: उसके चालन कौशल तथा उसके ज्ञान और थानों तथा समायोजनों की लघु मरम्मतें करने के कौशल के स्तर का निर्धारण करने के लिए मौखिक और व्यवहारिक परीक्षा ली जाएगी । चयन विभागीय परीक्षा में निष्पादन के आधार पर विभागीय प्रोन्नति समिति द्वारा तैयार की जाने वाली योग्यता सूची के अनुसार किया जाएगा ।
प्रोन्नति/ प्रतिनियुक्ति/आमेलन द्वारा भर्ती की दशा में वे श्रेणियां जिनसे प्रोन्नति/ प्रतिनियुक्ति/आमेलन किया जाएगा
भर्ती की पद्धत्ति : पर्ती सीधे होगी या प्रोन्नति द्वारा या प्रतिनियुक्ति/आमेलन द्वारा तथा विभिन्न पद्धतियों द्वारा भरे जाने वाली रिक्तियों की प्रतिशतता

स्तंभ 8 में विहित अर्हता तथा यथा उल्लिखित विभागीय परीक्षा के आधार पर 25 प्रतिशत सीधी भर्ती द्वारा और 75 प्रतिशत प्रोन्नति द्वारा ।
ऐसे सभी समूह ' घ' निर्धारित कर्मचारिवृन्द जिन्होंने कम से कम 10 वर्ष निरंतर सेवा की हो इस शर्त के अधीन रहते हुए विभागीय परीक्षा में बैठने के लिए पात्र होंगे कि वे स्तंभ 8 में उल्लिखित अर्हता तथा शारीरिक उपयुक्तता के मानदंड को पूरा करते हैं । 1 यदि विभागीय प्रोन्नति समिति है , तो उसकी संरचना
भर्ती करने में किन परिस्थितियों में संघ लोक सेवा आयोग से परामर्श किया जाएगा

G.S.R. 162. In exercise of the powers conferred by the proviso to article 309 of the Constitution , the President hereby makes the following rules regulating the method of recruitment to the post of Motor Lorry Driver , Group ' C' in the Work-charged Establishment of the Central Public Works Department namely: -
1. Short title and commencement ( 1 ) These rules may be called the Central Public Works Department Work- charged Staff (Motor Lorry Driver) Group ' C ' Recruitment Rules,2008.
(2) They shall come into force on the date oftheir publication in the Official Gazette.
2. Number of posts, classification and scale of pay. The number ofsaid post , its classification and the scale of pay attached thereto shall be as specified in Columns (2) to (4) of the Schedule annexed to these rules.
3. Initial Constitution . The persons already working as Motor Lorry Driver in terms ofOffice Memorandum No. 10/2/97- EC.X, dated the 5th August 1999 read with Corrigendum No. 10/2/97 -EC.X, dated the 28th January, 2000 issued 3099 61/ 08-3 786

by the Government of India, Directorate General of Works . Central Public Works Department before the commеnсетени н these rules shall be deemed to have been appointed as Motor Lorry Driver under these rules and the services rendered by then shall be coumed for promotion , seniority and other terms and conditions of service in their respective posts .
4. Special Provision. Each Circle shall have its own separate cadre unless otherwise specified by the Central Public Works Department .
5. Method of recruitment , age limit and qualifications , ete . The method of recroil ment, age limit , qualification and other matters relating 10 the said post shall be as specified in Columns ( 5 ) 10 ( 1.1 of the said Schedule, 6. Disqualification . No person ,
(a) who has entered into or contracted a marriage with a person having spouse living:
(b ) who. having a spotuse living has entered into or contracted a marriage with any other person , shall be eligible for appointment to any of the said post :
Provided that the Central Govermanent may, if satisfied that such marriage is permissible under the personal litvi applicable to such person and the other party to the narriage and that there are other grounds for doing so, exempt any person from the operation ofthis rule .
7. Power to relax . Where the Central Government is of the opinion that it is necessary or expedient so to do , it may, by order, for reasons to be recorded in writing , relax any ofthe provisions of these rules with respect to any class on category of persons.
8. Saving.--Nothing in these rules shall attect reservations , relaxation of age humit and other concessions required tobe provided for the Scheduled Castes , the Scheduled Tribes , the Other Backward (Classes and other special categories ol persons in accordance with the orders issued by the Central Government from time to time in this regard.

Physical fitness : Same as for direct recruitment .
(ii ) He should possess a valid driving licence for heavy motor vehicles , and
Departmental test : Same as for direct recruitment.
(iii) He should have the knowledge and skill to do minor repairs ofvehicles.
Physical Fitness:
Ifthe driving licence possessed by applicant is more than 5 years old, he shall furnish a fitness certificate issued by the Registered Medical Practitioner of the concerned State Government certifying the following:
(i) He does not suffer from any defect ofvision with or without spectacles,
(ii ) He can readily distinguish the pigmentary colours , red and green ,
(iii) He is able to distinguish with his eyesight at a distance of 25 meters in good daylight , a motor car numberplate,
(iv) He does not suffer from any degree of deafness which would prevent his hearing the ordinary sound signals,
(v) He does not suffer from night blindness , and
(vi) He does not have any defect or deformity or loss oflimbs which would interfere with the efficient performance of his duties as a driver.
If the applicant is selected and taken into employment as a Motor Lorry Driver, he shall submit the above certificate on every 5 years in support of his fitness to continue as Motor Lorry Driver.
Departmental Test:
Oral and practical test to assess his level ofdriving skill as also his knowledge and skill to do minor repairs ofvehicles and adjustments . Selection shall be made according to the merit list to be prepared byDepartmental Promotion Committee on the basis ofperformance in the Departmental Test .
In case ofrecruitment by promotion or deputation/absorption , grades from which promotion /deputation or absorption to be made Method ofrecruitment , whether by direct re- cruitment or by promotion or by deputation or by absorption and percentage of vacancies to be filled by various methods

AllGroup 'D' work- charged staff who have put in atleast 10 years ofcontinuus service shall be eligible to appear in Departmental Test subject to the condition that they fulfill the criteria of qualification and physical fitness mentioned in column 8.
