आ. अ, 84,-यतः निर्वाचन आयोग का समाधान हो गया है कि नीचे की सारणी के स्तम्भ ( 2 ) में यथा विनिर्दिष्ट छत्तीसगढ़ राज्य से लोक सभा के लिए हुए उप निर्वाचन , 2007 के लिए ओ स्तम्भ ( 3 ) में विनिर्दिष्ट निर्वाचन क्षेत्र से हुआ है स्तम्भ ( 4 ) में उसके सामने विनिर्दिष्ट निर्वाचन लड़ने वाले अभ्यर्थी , लोक प्रतिनिधित्व अधिनियम , 1951 तथा तद्धीन बन्यए गए नियमों द्वारा अपेक्षित उक्त सारणी के स्तम्भ ( 5 ) में यथा दर्शित अपने निर्वाचन व्ययों का लेखा दाखिल करने में असफल रहे हैं; और
यतः उक्त अभ्यर्थियों ने सम्यक् सूचना दिए जाने पर भी उक्त असफलता के लिए कोई कारण अथवा स्पष्टीकरण नहीं दिया है और निर्वाचन आयोग का यह समाधान हो गया है कि उक्त असफलता के लिए उनके पास कोई पर्याप्त कारण या न्यायौचित्य नहीं है;
अतः अब, निर्वाचन आयोग उक्त अधिनियम की धारा 10 -क के अनुसरण में नीचे की सारणी के स्तम्भ ( 4 ) में विनिर्दिष्ट व्यक्तियों को संसद के किसी भी सदन के या किसी राज्य/ संघ राज्य क्षेत्र की विधान सभा अथवा विधान परिषद के सदस्य चुने जाने और होने के लिए इस आदेश की तारीख से तीन वर्ष की कालावधि के लिए निरर्हित घोषित करता है:-

आ. अ. 85.-यतः निर्वाचन आयोग का समाधान हो गया है कि नीचे की सारणी के स्तम्भ ( 2 ) में यथा विनिर्दिष्ट छत्तीसगढ़ राज्य से विधान सभा के लिए हुए उप निर्वाचन , 2007-08 के लिए जो स्तम्भ (3 ) में विनिर्दिष्ट निर्वाचन क्षेत्र से हुआ है स्तम्भ (4 ) में उसके सामने विनिर्दिष्ट निर्वाचन लड़ने वाले अभ्यर्थी , लोक प्रतिनिधित्व अधिनियम, 1951 तथा तद्धीन बनाए गए नियमों द्वारा अपेक्षित उक्त सारणी के स्तम्भ( 5 ) में यथा दर्शित अपने निर्वाचन व्ययों का लेखा दाखिल करने में असफल रहे हैं ; और

आ. अ. 86.-यतः आयोग ने 212 भभुआ विधान मभा निर्वाचन क्षेत्र से वर्ष 2005 जनवर्ग फरवरी ) में हुए बिहार विधान सभा का साधारण निर्वाचन के लिए निर्वाचन लड़ने वाले अभ्यर्थी श्री आनंद भुषण पाण्डेय , ग्राम डाकार भगवानपुर, थाना भगवानपुर, जिला कैमूर , भभुआ, बिहार द्वारा अपने निर्वाचन व्ययों का लेखा विधि द्वारा अपेश्चित रीति से दाखिल न करने के कारण लोक प्रतिनिधित्व अधिनियम , 1951 [ भाग II- खण्ड 3 ( iii) ]

की धारा 10क के अधीन अपने दिनांक 7 मार्च, 2008 के आदेश संख्या 76/ बिहार - वि.स. /2006 द्वारा संसद के किसी भी सदन के या किसी राज्य/ संघ राज्य क्षेत्र की विधान सभा अथवा विधान परिषद का सदस्यचुने जाने के लिए अथवा होने के लिए और आयोग के दिनांक 8 जून , 2007 के नोटिस संख्या बिहार- वि.स./212 /2005 प्राप्त होने के बाद भी लेखा दाखिल न करने के कारण निरर्हित कर दिया है;
और, यतः उक्त श्री आनंद भूषण पाण्डेय ने लोक प्रतिनिधित्व अधिनियम , 1951 की धारा 11 के अधीन उक्त आदेश के विरुद्ध एक अपील दायर की है और अपनी बिना तारीख की उस अपील में बताए गए कारणों के आधार पर निरर्हता हटाने के लिए अनुरोध किया है । यतः लोक प्रतिनिधित्व अधिनियम, 1951 के अधीन की गई अपील को सुनने और निर्णय करने के लिए सक्षम प्राधिकारी अर्थात् श्री आर. बालाकृष्णन ने निर्णय किया है कि दिनांक 7 मार्च 2008 के आदेश संख्या 76/बिहार- वि.स./ 2006 के द्वारा श्री आनंद भूषण पाण्डेय पर लगाई गई निरर्हता 27-08-2008 से हटा दी जाएगी ।
अतः , अब, आयोग के तारीख 7 मार्च, 2008 के आदेश सं.76/बिहार- वि.स. /2006 के साथ संलग्न सारणों की क्रम सं. 7 पर स्थित श्री आनंद भूषण पाण्डेय का नाम 27-08-2008 से हटा दिया जाएगा ।

Whereas , the Commission , vide it's Order No. 76/BR- LA/2006, dated 7th March 2008, had disqualifed under Section 10A of the Representation of the People Act, 1951 Shri Anand Bhushan Panday Village- Post Bhagwanpur , P.S. -Bhagwanpur, Distt . Kaimpur, Bhabhua , Bihar a contesting candidate for the General Election to Bihar Legislative Assembly from 212- Bhabhua Assembly Constituency, held in the year ( January- February) 2005, for being chosen as , and for being a member ofthe either House of the Parliament or Assembly or Legislative Council ofa State for a period of three years from 7thMarch, 2007 for not lodging the account ofhis election expenses in the manner required by law and even after receipt ofa notice No. BR-LA/212/2005, dated 8th June, 2007 by the Commission in this regard;
And , whereas , the said Shri Anand Bhushan Pandey has preferred an appeal under Section 11 of the Representation ofthe People Act , 1951 against the said order and has requested for the removal of the disqualification for the resons stated in the said appeal dated Nil .
Whereas, the competent authority to hear to decide the appeal under Section 11 of the R.P. Act, 1951 i.e. Shri R. Balakrishnan, Deputy Election Commissioner has vide its order dated 23rd September , 2008 has decided that the disqualification imposed on said Shri Anand Bhushan Pandey vide order No. 76/BR- LA/2006, dated 7th March, 2008 , shall be removed with effect from 27-08-2008 onwards.
Now, therefore, the name of Shri Anand Bhushan Pandey appearing at Serial No. 7 of the Table appended with Commission's order No. 76/BR- LA/2006 dated 7th March, 2008 shall be omitted w.e.f. 27th August 2008.

आ. अ. 87. लोक प्रतिनिधित्व अधिनियम , 1950( 1950 का 43 ) की धारा 13 - क की उप - धारा ( 1 ) द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , भारत निर्वाचन आयोग पंजाब सरकार के परामर्श से एतद्वारा श्री विजय कैन , आई.ए.एस. के स्थान पर सुश्री कुसुमजीत सिद्ध, आई.ए.एस. ( पीबी : 1979 ) को उनके कार्यभार ग्रहण करने की तारीख से आगामी आदेशों तक के लिए पंजाब राज्य के मुख्य निर्वाचन अधिकारी के रूप में नामित करता है ।
2. सुश्री कुसुमजीत सिद्ध पंजाब सरकार के अधीन सभी पदभार या किसी कार्य के पदभारों को तत्काल सौंप देंगी या धारण करना समाप्त कर देंगी, जो कि वे ऐसा पदभार ग्रहण करने से पहले धारण कर रही थीं ।
3. सुश्री कुसुमजीत सिद्ध निर्वाचन अधिकारी , पंजाब के रूप में कार्य करते हुए पंजाब सरकार के अधीन किसी भी प्रकार का कोई अतिरिक्त कार्यभार ग्रहण नहीं करेंगी सिवाय इसके कि उनको राज्य सचिवालय में निर्वाचन विभाग के प्रभारी , सरकार का सचिव पदाभिहित किया जायेगा ।

In exercise of the powers conterredby sub - section ( t ) of Section 13A of the Representation of the People Act , 1950 (43 of 1950 ) , the Election Commission of India in consultation with the Government of Punjab hereby nominates Ms. Kusumjit Sidhu , IAS (PB : 1979 ) as the Chief Electoral Officer for the State of Punjab with effect from the date she takes over charge and until further orders vice Shir Vijay Kain IAS .
2. Ms. Kusumjit Sidhu shall cease to hold and hand over forthwith the charge of all or any charges of work under the Government of Punjab , which she may be hokling before such assumption of office.
3. Ms. Kusumjit Sidhu while functioning as the Chief Electoral Officer, Punjab shall not hold any additional charge whatsoever under the Government of Punjab except that she should be designated Secretary to the Government incharge of Election Department in the State Secretariat.
