आ. अ. 89.-यतः, राष्ट्रीय राजधानी क्षेत्र दिल्ली विधान सभा के साधारण निर्वाचन , 2003 से निर्वाचन लड़ने वाले अभ्यर्थी श्री जनेश कुमार भदाना, निवासी डब्ल्यू. पी. 43. ग्राम वजीरपुर, अशोक विहार , दिल्ली लोक प्रतिनिधित्व अधिनियम, 1951 की धारा 10 क के अधर्थान तथा तद्वीन बनाए गए नियमों द्वारा अपेक्षित रीति से निर्वाचन व्ययों का लेखा दाखिल करने में असफल रहने के कारण भारत निर्वाचन आयोग के आदेश सं. 76/दिल्ली विधान सभा 2003 दिनांक 8-1-2007 द्वारा निरर्हित घोषित किया था ।
यतः श्री भदाना से दिनांक 19-3-2007 को निरहंता हटाने के लिए प्राप्त आवेदन , आयोग के दिनांक 4-6-2007 के आदेश द्वारा अस्वीकृत कर दिया गया है ।
यतः राष्ट्रीय राजधानी क्षेत्र दिल्ली विधान सभा के साधारण निर्वाचन 2003 के संबंध में श्री बदाना ने , माननीय उच्च न्यायालय के दिनांक 6-5-2008 के आदेश के निर्देशन के अनुसरण में बाउचर की फोटो कापी सहित अपने व्ययों की विस्तृत सूची एवं अपने दावे के समर्थन में निर्वाचन व्ययों का लेखा एस. डी. एम. ( निर्वाचन को पहले ही प्रस्तुत कर दिया था, आयोग की उपरोक्त आदेश की समीक्षा हेतु आवेदन दियाहै ।

यतः श्री भदाना को इस मामले में उनके निवेदन पर दिनांक 17-9 2008 को व्यक्तिगत रूप से सुने जाने का अवसर प्रदान किया गया था । श्री भदाना दिनांक -2008 को आयोग के समक्ष अपने अकील के साथ उपस्थित हुए जहां मौखिक निवेदन के अलावा मामले में सहानुभूतिपूर्वक पुनर्विचार किया जाए. और यदि वह दोषी पाया जाता है तो निग्र्हता आदेश में परिवर्तन किया जाए क्योंकि यह पहले ही डेढ़ वर्ष के लिए निरर्हत रह चुका है, जिससे वह अगले निर्वाचन में लड़ने में समर्थ हो सके, और
यतः मापले के दस्तावजों तथा तथ्यों एवं परिस्थितियों का अवलोकन करते हुए को ध्यान में रखते हुए तथ्य दिल्ली उच्च न्यायालय के आदेश के अनुपालन में . आयोग ने लांक प्रतिनिधित्व अधिनियम 1951 की धारा ।। के अर्थान प्रदत्त शांकायों का प्रयोग करते हुए उक्त अधिनियम की धारा 100 क अंतनंन श्री जनेश कुमार भदान पर अधिगणित निरर्हता की अधि कम करते हुए दृश्य आदेश की तारीख तक कर दी है ।
अतएव , अब अयोग के आदेश संख्या १. दिल्ली विधान सभा 2(H ) 3 ( 6 ) दिनांक 8-1-2007 में क्र संख्या में उपस्थित श्री जनश कुमार भदाना का नाम दिनांक 31-10-2008 में उक्त आर्दश से हरा दिया समझा जाएगा ।

Ashok Vihar, Delhi , a contesting candidate for the General llection to the Legislative Assembly of NCT af Delhi held in 2003 Commission ni lndis , vude its order No. 76-01-11:20 , dated 8-1-2007 , under Section People Act . 1951. for failure to lodge his account of election expenses as required by the said made thereunder and as disqualified by the Election ofthe Representation of the Act and the Rules and Orders Whereits am application dated 14-2-20 ? recented from Sh. Bhadana, for redusa dualification was rejected vide Commissier dated -4-6-2007, and
Where . St. Blakana , in pursuance of the directions of Jon'ble High Court titrier dated 6-5-2008 subunited an application tu teview the Comhinissigon's above-stid orders along with photo copies expenditure pertaining to the general election to the 1 egislative Assembly ofNCT of Del of the claim that he has already submitted the accoons of election expenditure to the SIPA aches and his detailed list of 2000 and documents in suppon 1.lection , and Whereas . Sh . Bhadana was aflrded an uprportmity to be hoard in person on is request . on 17-9-2008 , in the matter. Sh . Bindane appeared before the Commission on 17-9-2008 along with his lower whereat apart from his orat submissions, he inis also submined in writing that his case may be reconsidered sympathically and it at all he is found guilty, she disqualification order may be modified as he has already undergone one year and six months of disqualification so that be may be able to contest next elections . d
Wherens , having perused the papers and having regard to the facts and vircumstances of the case. and in deference to the order of the Delhi High Court, the Commission in exercise of the powers conferred under Section 1 ! [ R.P Act, 1951 , has reduced the period of disqualification imposed under Section 10 A of the sitid Act on the said Shri Janesh Kumar Bhadana upto the date of thus order,
Now, there lore , the name of Sh Janesh Kensar Bhadana appearing at Sl . No. S in the Commission's Order No 76/DL- LA: 2003 ( 6 ) , dated 8-1-2007 shall deemed to have been omitted from the said order withefteet tom 31-10-2008.
