का.नि.. 93.-राष्ट्रपति , संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए, सेना समूह ' घ ' (अनौद्योगिक ) भर्ती नियम, 2001 का संशोधन करने के लिए निम्नलिखित नियम बनाती हैं, अर्थात्
1. ( 1 ) इन नियमों का संक्षिप्त नाम सेना समूह ' घ ' (अनौद्योगिक) संशोधन भर्ती नियम, 2008 है।
(2) ये राजपत्र में उनके प्रकाशन की तारीख को प्रवृत होंगे। 2. सेना समूह ' घ' ( अनौद्योगिक) भर्ती नियम , 2001 की अनुसूची में क्रम सं. 4 , 5 ,6 , 9 , 11 , 14 , 15 , 16, 17 , 18, 20 , 22, 25 के अधीन स्तंभ 4 में विद्यमान प्रविष्टि के स्थान पर , " 2610-60-2910-65-3300-70-4000 रुपये " प्रविष्टि रखी जाएगी। [फा. सं. 15203/5/ एम.पी. 4 ( सिव. ) ( ए. )/622/ आर. आर. / डी. MINISTRY OF DEFENCE New Delhi , the 12th November, 2008 S.R.O. 93. In exercise of powers conferred by theproviso to article 309 ofthe Constitution , the President hereby makes the following rules to amend the Army Group 'D' (Non-Industrial) Recruitment Rules, 2001 , namely:-
1.(1) These rules may be called the Army Group ' D ' (Non-Industrial)Amendment Recruitment Rules , 2008 .
(2)They shall come into force from the date oftheir publication in theOfficial Gazette.
2. In the Army Group 'D ' (Non - Industrial) Recruitment Rules , 2001 , in the Schedule , against serial numbers 4, 5, 6, 9, 11 , 14, 15, 16, 17, 18, 20, 22, 25, in column 4for the existing entry, the entry "Rs . 2610-60-2910-65- 3300-70-4000 " shall be substituted.

(iii ) स्तंभ 11 में प्रविष्टियों के स्थान पर, निम्नलिखित प्रविष्टियां प्रतिस्थापित की जाएंगी , अर्थात्:-
(वैमानिक गुणवत्ता आश्वासन महानिदेशालय )

" सीधी भर्ती द्वारा 60 प्रतिशत और प्रोन्नति द्वारा 40 प्रतिशत जिसके न हो सकने पर सीधी भर्ती द्वारा। 60 प्रतिशत सीधी भर्ती कर्मचारी चयन आयोग के माध्यम से की जानी है। "
3. अनुसूची में क्रम संख्या 1 से 3 तक पदों से संबंधित स्तंभ ( 11 ) में आने वाले शीर्षक के स्थान पर, निम्नलिखित शीर्षक क्रमशः रखा जाएगा , अर्थात्:-
का.नि.आ. 94.- राष्ट्रपति , संविधान के अनुच्छेद 309 के परन्तुक द्वारा प्रदत्त शक्तियों का प्रयोग करते हुए , वैमानिक गुणवत्ता आश्वासन महानिदेशालय , रक्षा उत्पादन विभाग , समूह ' ख ' और ' ग ' अराजपत्रित ( वैज्ञानिक ) पद भर्ती नियम, 2004 का और संशोधन करने के लिए निम्नलिखित नियम बनाती हैं, अर्थात्:-
भर्ती की पद्धति : सीधी भर्ती द्वारा या प्रोन्नति द्वारा या प्रतिनियुक्तिया आमेलनं द्वारा तथा विभिन्न पद्धतियों द्वारा भरी जाने वाली रिक्तियों की प्रतिशतता। "
1. ( 1 ) इन नियमों का संक्षिप्त नाम वैमानिक गुणवत्ता आश्वासन महानिदेशालय, रक्षा उत्पादन विभाग , रक्षा मंत्रालय , समूह ' ख ' और ' ग ' अराजपत्रित (वैज्ञानिक ) पद भर्ती ( संशोधन ) नियम , 2008 है। स्पष्टीकरण ज्ञापन
(2 ) ये राजपत्र में प्रकाशन की तारीख को प्रवृत होंगे ।
2. वैमानिक गुणवत्ता आश्वासन महानिदेशालय , रक्षा उत्पादन विभाग , समूह ' ख ' और समूह ' ग ' अराजपत्रित ( वैज्ञानिक ) पद भर्ती नियम, 2004 की अनुसूची में कनिष्ठ वैज्ञानिक सहायक श्रेणी -1 से संबंधित क्रम संख्या 2 के सामने :-
( i ) स्तंभ 8 के अधीन प्रविष्टियों के स्थान पर, निम्नलिखित प्रविष्टियां रखी जाएंगी , अर्थात्:-
" आवश्यक
विभिन्न पदों के भर्ती नियमों की अनुसूचि के स्तंभ ( 11 ) के शीर्षक को भारत सरकार , कार्मिक और प्रक्षिक्षण विभाग , का.ज्ञा. सं. ए.बी. 14017/2/1997- स्था. ( आर. आर. ) /पी.टी. तारीख 19 जनवरी, 2007 द्वारा संशोधित किया गया है । तदनुसार , वैमानिक गुणवत्ता आश्वासन महानिदेशालय , रक्षा उत्पादन विभाग , समूह ' ख ' (अराजपत्रित/ वैज्ञानिक ) पद भर्ती नियम , 2004 के स्तंभ ( 11 ) का शीर्षक इन नियमों के अधीन संशोधित किया गया है , स्तंभ ( 11 ) के शीर्षक में किया गया संशोधन सरकार द्वारा 19 जनवरी , 2007 से पुरःस्थापित किया गया है और यह उसी दिन से भूतलक्षी रूप से प्रभावी है। तथापि, कार्मिक और प्रक्षिक्षण विभाग के पूर्वोक्त का.ज्ञा. द्वारा पिछले मामलों पर पुनः विचार नहीं किया जाएगा। किसी मान्यताप्राप्त विश्वविद्यालय से विज्ञान में मास्टर डिग्री या इंजीनियरी में डिग्री
यह प्रमाणित किया जाता है कि इन नियमों को भूतलक्षी प्रभाव देने से किसी व्यक्ति के हितों पर प्रतिकूल प्रभाव नहीं पड़ेगा। या समतुल्य या

New Delhi , the 7th November , 2008 वायुयान या वायव इंजीनियर या वायुयान उपसाधन या विमानन इलैक्ट्रानिकी या वैद्युत उपस्कर और यंत्र या वायु आयुध भंडार या भू- अवलंभ संबंधी उपस्कर या वायु कर्मीदल के लिए उडन वस्त्र उत्तरजीविता सहायता या विमानन इंधन तथा स्नेहक या वायुयान संयुक्त संरचना।
टिप्पण 1:- अर्हताएं, अन्यथा सुअर्हित अभ्यर्थियों की दशा में कर्मचारी चयन आयोग के विवेकानुसार शिथिल की जा सकती हैं ।

टिप्पण 2:- अनुभव संबंधी अर्हता ( अर्हताएं ) कर्मचारी चयन आयोग के विवेकानुसार अनुसूचित जातियों और अनुसूचित जनजातियों के अभ्यर्थियों की दशा में तब शिथिल की जा सकती हैं जब चयन के किसी प्रक्रम पर कर्मचारी चयन आयोग की यह राय है कि उनके लिए आरक्षित रिक्तियों को भरने के लिए अपेक्षित अनुभव रखने वाले उन समुदायों के अभ्यर्थियों के पर्याप्त संख्या में उपलब्ध होने की सम्भावना नहीं है" ।
1. ( 1 ) These rules may be called the Directorate General of Aeronautical Quality Assurance , Department ofDefence Production, Ministry of Defence , Group 'B ' and ' C' Non -Gazetted ( Scientific ) posts Recruitment (Amendment) Rules, 2008.

(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Schedule to the Directorate General of Aeronautical Quality Assurance , Department of Defence Production, Group ' B ' and ' C ' Non-Gazetted ( Scientific) posts Recruitment Rules, 2004, against serial number 2 relatingto Junior Scientific Assistant Grade- I :-- (i) for the entries under Column 8 , the following entries shall be substituted, namely :-
"Essential:
Master's Degree in science or degree in engineering from a recognized university or equivalent
OR
(1) Bachelor's Degree in Science or diploma in engineering from a recognized university or Institute or equivalent.
(ii) Two years experience in any of the following fields:-
Aircraft or Aero Engineer or Aircraft accessories orAviation electronics or Electrical equipment and instrument or Air armament stores or Ground Support equipment or Flying clothing survival aids for Air Crew or Aviation fuel and lubricants orAircraft composite structures .
Note-1: Qualifications are relaxable at the discretion of the Staff Selection Commission in case of the candidates otherwise well qualified.
Note- 2 : The qualification (s) regarding experience is/ are relaxable at the discretion of the Staff Selection Commission in case of the candidates belonging to Schedule Caste or Schedule Tribe if at any stage of the selection the Staff Selection Commission is ofthe opinion that sufficient number of candidates from these communities possessing the requisite experience are not likely to be available to fill up the posts reserved forthem".

395 (ii) for the entries in Column 11 , the following entries shall be substituted, namely :-
"60 per cent by direct recruitment and 40 per cent by promotion failing which by direct recruitment. 60 per cent direct recruitment is to be made through Staff Selection Commission. " 3. In the Schedule, for the heading occurring in column( 11) relating to the posts from serial 1 to 3 , the following heading shall respectively be substituted, namely:-
"Methodof recruitment whether by direct recruitment orby promotion or by deputation or absorption and percentage of the vacancies to be filled by various methods . "
Explanatory Memorandum
The heading of column ( 11 ) of the Schedule to the recruitment rules of various posts have been amended videGovernment of India, Department of Personnel and Training OM No. AB 14017/2/ 1997-Estt (RR)/Pt dated the 19th January, 2007. Accordingly, the heading of column (11) of the Directorate General of Aeronautical Quality Assurance, Department of Defence Production, Group 'B' Non-Gazetted(Scientific) Post Recruitment Rules, 2004 are amended under these rules. The amendment carried out in heading of column ( 11) has been introduced by the Government from the 19th day of January , 2007 and is effective retrospectively from the same date. However , the past caseswould not be reopened vide Para 9 ofDOP & T's ibid OM.
It is certified that interest of no one would be prejudicially affected by giving retrospective effect to these rules.
